In this update on the Suboxone Tooth Decay Lawsuit, Stan Gipe describes a “big step” – a step that may not seem big to plaintiffs, but is significant to the team that's driving a mass tort against Suboxone's manufacturer. That step is a census so that the team – operating as a firm called Dolman Russo – vets each person it represents. The census asks claimants for information such as proof that they used Suboxone's sublingual film, now linked to tooth decay. The team will also start asking claimants to sign release forms so the defense can secure their medical information.A member of the Dolman Russo steering committee, Stan explains to colleague and host Matt Dolman: “I think we've been more aggressive and more proactive about getting records for our clients than just about any other firm out there. It's going to force everyone to be proactive. It's going to force everyone to go out there and get those records.”The team is also reviewing electronically stored information for evidence of what the manufacturer, Indivior, knew or should have known about Suboxone's dangers.Want to learn more about the Suboxone Tooth Decay Lawsuit? A study published in March links the birth control Depo-Provera to a form of brain tumor. But whether the study means that women who took Depo-Provera could successfully sue is unclear. Hosts Matt Dolman and Stan Gipe lay out both sides of the issue, including the opportunities and challenges of potential multi-district litigation.“We're gathering information, and I think at least from what we looked at, it looks pretty good from a claim perspective and kind of bad from a claimant perspective,” Stan says.“I just think it's early, and I want temper expectations,” Matt says.Stan agrees that litigation is no “slam-dunk,” but women who think they may have a claim are invited to visit Dolman Law Group, call the firm's toll free number, or call the Clearwater, Florida, number.Learn More and Connect☑️ Matt Dolman | LinkedIn☑️ Stan Gipe☑️ Dolman Law Group☑️ Dolman Law Group on LinkedIn, Facebook, Instagram, YouTube☑️ Subscribe: Apple Podcasts | Spotify | YouTubeThe insights and views presented in this podcast are for general information purposes only and should not be taken as legal advice for any individual case or situation. Back in the pre-digital days, you'd bring film into a drugstore to be developed. If the film contained nude photos, the only person you had to worry about was “that creepy guy behind the counter.”“That was when we were talking about paper photos. They can actually get that photo back. It's done, right? Different day now,” Stan Gipe explains in this episode, where he and co-host Matt Dolman examine two recent cases that reveal modern dangers when it comes to intimate images. In one case, a female judge has been threatened with the release of her nude photos in a messy divorce. In another, a healthcare system settled with 135,000 patients whose data, including nude photos in the healthcare context, was leaked in a breach.Tune in to hear Stan and Matt offer tips for handling nude photos in the digital era and invite listeners who may be the victim of exploitation to contact them.Learn More and Connect☑️ Matt Dolman | LinkedIn☑️ Stan Gipe☑️ Dolman Law Group☑️ Dolman Law Group on LinkedIn, Facebook, Instagram, YouTube☑️ Subscribe: Apple Podcasts | Spotify | YouTubeThe insights and views presented in this podcast are for general information purposes only and should not be taken as legal advice for any individual case or situation. Social media can be a dangerous place for kids, but the Dolman Law Group is employing a novel strategy to make tech giants accountable for the harm they cause. Matt Dolman and Stan Gipe explain that the Supreme Court's recent refusal to revive a case against SnapChat shows why the fight against social media needs a new tactic. In that case, the court said laws protect Snapchat from being responsible for content that's posted by users. Someone who is recovering from drug addiction is trying to get back on their feet. But what if the medication that is supposed to help is causing problems? In this episode of David v. Goliath, hosts Matt Dolman and Stan Gipe discuss the newest emerging mass tort relating to the use of Suboxone, a medication commonly prescribed to individuals with opioid addiction to help them get off of opiates. Recent findings show that the sublingual film version of Suboxone is acidic and causes the degradation of the protective outer layer of teeth and tooth enamel. This can have a cataclysmic effect on people's lives, and even impact their ability to find employment. There's currently a group of about 40 lawsuits in different districts throughout the United States that are likely to be consolidated over the next few weeks into multidistrict litigation (MDL). The Judicial Panel on Multidistrict Litigation (JPML) meets on January 25th and a steering committee will be selected by late February. In the meantime, anyone who has experienced dental problems while taking Suboxone before 2022, may be able to recover compensation and should contact a reputable attorney. How can an attorney fund a case? When a personal injury attorney files suit against an insurance company giant, they often don't have the same resources as the companies they are going up against. However, private equity gives these attorneys the power to level the playing field. There are ethical considerations though. Who controls the case? Does the lawyer listen to their client or the lender? Although the lender is giving the money, “any lawyer worth his weight in salt is going to take control of the case”. And the lender, in turn, wants the attorney to act in the best interests of their case in order to succeed. In this week's episode, hosts Matt Dolman and Stan Gipe discuss that changes to Florida's insurance laws primarily benefit insurance companies at the expense of consumers. The legislation was criticized for allowing companies to escape corporate negligence and shifting the burden to consumers and businesses. The bill was sold as a benefit to consumers despite lacking language that would lead to reduced insurance premiums. Rather, the new legislation shifts money from consumers to insurance companies without providing any benefit to consumers, while insurance companies continue to welcome record-setting profits. In this episode: [01:01] Escaping corporate negligence: The new law allows insurance companies to avoid being held liable for mistakes, shifting the burden onto consumers and businesses. [07:12] Pressure to settle claims: The legislation makes it more difficult for consumers and businesses to pressure insurance companies to settle claims quickly and fairly.[09:22] Nuclear verdicts: Framed as excessively high jury awards, nuclear verdicts are not driven by the costs of future medical bills, they're driven by pain and suffering, and the bill did nothing to curb recovery for pain and suffering.[10:16] Political motivation: Was the legislation pushed through as a political move to reward the insurance industry and attack the plaintiff bar? [12:24] Impact on injured individuals: How the new legislation leaves injured individuals at a disadvantage in settling claims with insurance companies.[15:42] No reduced premiums: The legislation lacks language that would lead to reduced insurance premiums for consumers.
In this week's episode, hosts Matt Dolman and Stan Gipe share valuable insights into navigating the complexities of tort law and insurance coverage. We discuss the distinctions between intentional torts and negligence, focusing on the insurance coverage implications for each. Intentional torts occur when someone purposely causes harm. Negligence arises from unintentional harm due to careless actions.Florida law doesn't provide insurance coverage for intentional acts, making it vital for attorneys to identify and correctly present cases involving underlying negligence. We delve into specific case types, such as negligent transmission of sexual disease and security cases.Matt and Stan share examples of how framing cases strategically can result in insurance coverage even when harm may initially seem intentional. It's essential to have a skilled attorney who can present a case in a way that triggers insurance coverage. Most people don't have sufficient liquid assets to cover large claims. It's also essential to seek a second opinion if you've been told you don't have a case. Different attorneys may have varying perspectives on case approaches and the ability to identify negligence in seemingly intentional acts.In this episode: [00.36] The differences between intentional torts and negligence[01.43] Florida's insurance coverage policy on intentional acts[04.39] Insurance coverage in specific cases, such as negligent security cases[05.58] How testimony from criminal cases can sometimes benefit civil claims[09.53] The importance of framing cases correctly for insurance coverage[11.14] Pursuing insurance coverage over individual assets[15.41] Why you should consider seeking a second opinion if you've been told you don't have a case

Furthermore, the bill favors insurance companies by forcing citizens to cover attorney fees, enabling these companies to manipulate the law and profit from countless claims. Join hosts Matt Dolman and Stan Gipe in this episode as they delve into the detrimental implications of the new tort reform bill and what it means for you. They examine each amendment in detail, explain how they directly impact Florida residents, and highlight the overarching issues associated with Florida's tort reform bill.In this episode: [00:27] An overview of the changes included in Florida's tort reform bill, HB 837[02:25] How the bill will negatively impact the healthcare treatment personal injury victims receive[04:35] Exploring the implications of a letter of protection[06:55] The problems arising from introducing Medicare rates in personal injury cases[08:46] The misguided effort to eliminate nuclear verdicts – how the HB 837 falls short[12:59] Why uninsured and underinsured drivers are far more expensive for Florida citizens than lawsuit verdicts[16:01] How HB 837 really hurts the people of Florida[23:47] Understanding the 51% standard and the challenges it presents for accident injury victims[27:55] The major problem with the HB 837 tort reform bill: the people drafting and voting on these laws often lack industry-specific expertise and, as a result, may not fully grasp the implications of their decisions.

After avoiding a potential death blow, the Tylenol-acetaminophen autism lawsuit has continued to build momentum. With over 20 reputable studies displaying clear correlation between a high dosage of acetaminophen use in pregnant women and children born with neurological conditions, the claim has continued to gain steam, but also criticism. The pushback from wanting something as simple as a label warning pregnant women before Tylenol use has become concerning, but is further validating the claim.Stan Gipe explains the recent losing argument filed by Walmart to derail the claim as preemption. “...The federal government already has a rule out there that addresses the warnings that need to be put on drugs before they're given to pregnant women,” a blanket warning that could cover any effects on pregnant women or their children. Matt Dolman breaks down the studies and desire of this claim, for women to have the full idea of risks when taking Tylenol, pregnant. When a doctor is entrusted with the task of preparing, monitoring, and delivering a baby, it's a special responsibility. Every parent deserves to be excited and happy for their new baby, rather than worried about their child's health and future.Unfortunately not all delivery rooms have the same story. Mistakes during delivery that lead to injuries and birth defects happen, and odds are that a doctor isn't going to inform parents when they do. It may not be malpractice, but when parents don't have all of the correct information about their child's birth, they can be left confused and ill prepared to properly cultivate their child's care and happiness. When mistakes are made that affect you and your child's future, that future deserves to be compensated. Stan Gipe explains that birth defects and disabilities ranging from mild to severe such as cerebral palsy and erb's palsy can be traced back to moments where a child was injured or wasn't breathing in delivery. Cases of brain damage or head trauma can be connected to uses of extractors such as forceps and vacuums. Guest host Becky Dolman looks even before delivery, highlighting that mistakes or poor preparation in prenatal care can cause birth defects with your unborn child including poor ultrasound use and failure to disclose poor test results. If your child was born with a birth defect or disability, discuss your circumstances with an attorney who has experience with this type of sensitive subject matter. When a woman is pregnant they are incredibly limited on what medication they can safely take for pain relief, mainly only being able to take acetaminophen. This may be something that pregnant women should think twice about. According to a study in 2021 from Johns Hopkins University, there may be a correlation between Tylenol use during pregnancy leading to autism in children when they're born. Matt Dolman explains that causes of autism spectrum disorder, a neurological disorder that affects learning, emotional regulation, and social awareness, aren't very clear apart from genetics. However, this new study shows a strong change of possible causation. Stan Gipe also elaborates that pharmaceutical companies should be testing and have warning labels to give pregnant individuals the chance to make informed decisions if acetaminophen does have these types of side effects. That a higher dose of Tylenol raises the chances that your child may be born with autism.Whether these studies continue to show furthered causation or proof, these studies have been replicated multiple times with similar results. There may not be concrete evidence yet, but there is cause for mothers to be concerned. If you've been injured in an accident when you weren't at fault, what should you do first? Matt Dolman and Stan Gipe are breaking down the process and sharing their do's and don'ts when hiring a personal injury lawyer. Time is of the essence. As soon as you realize you've been injured in an accident that wasn't your fault, seek the assistance of an attorney. The attorneys will know exactly what to do from healthcare to trial. When injured in an accident, your health insurance isn't the primary insurance. It's a coverage called PIP — however, you have to get your first treatment within 14 days of your injury. Stan explains that your primary care physician won't be able to treat you because they don't know how to bill your care. And, if you're like most people, this isn't common knowledge. Luckily, an attorney can help you navigate these waters quickly. What if you don't have health insurance and are scraping for funds following your accident? An attorney will work with you under a letter of protection, which states that your attorney will protect the settlement money and earmark the funds for medical treatment in their trust account, pending negotiation on the medical bills at the end of the case. When searching for an attorney, Matt and Stan have a few quick tips: hire an experienced, board-certified, and local attorney. If you've just been in a car accident, you're likely thinking about your health and safety first. Finding a great lawyer might not cross your mind until weeks (or in some cases, months) down the line. However, Matt Dolman and Stan Gipe remind us that time is of the essence when retaining an auto accident attorney. You should hire an attorney within one to two days of the accident. Why? There's an incredible amount of evidence available at the time of the accident that may not be there if you wait. Attorneys immediately begin to gather facts about the accident — like who was at fault or what sort of insurance coverage is available — to maximize a client's financial recovery and create a roadmap for the best possible plan of action. What if you want to represent yourself? Matt and Stan warn that the appeal of self-representation is deceiving. Studies show that the individual who is represented by counsel has three times the net recovery than the individual who's unrepresented, while Insurance companies will take advantage of individuals who choose to represent themselves. As Stan explains, insurance companies are bullies. There's going to be a certain number of fights, but they won't settle every claim. So which fights are they going to pick? They're going to pick the person who's least prepared, the person without documentation, and the person without an attorney. So how do you find the best accident lawyer for your case? Matt and Stan suggest searching locally. An auto accident attorney near you knows the doctors, the documentation, and the key figures who will likely be involved in the case. A local attorney will quickly form a plan of defense and shape a path to help you receive the compensation you deserve. In this episode: [0:34] Why you shouldn't wait to hire an auto accident attorney [1:51] Why is it dangerous to represent yourself in a car accident claim? [4:57] How insurance companies will prey on the victim without an attorney [6:07] Why it's important to hire a local car accident lawyer
People affected by the Camp Lejeune water contamination are already dealing with harsh effects, from cancers to infertility to neurobehavioral issues. Now, Camp Lejeune water contamination lawsuits are being pushed forward. But how much can you expect in settlement amounts for these cases? Although it's too early in the claims process to determine the exact settlement ranges, Stan Gipe is using his previous experience to craft ballpark estimates of settlements. According to Stan, the amount you get paid is going to be directly related to the condition you suffer from. Of course, each individual case may vary, but generally, the more serious the condition, the higher the amount of payment. Specifically, Stan is sharing his projected settlement ranges for those with cancer, Parkinson's disease, and birth defects. Stan also mentions that although these are loose estimates at the moment, settlement ranges will become more definitive later on as more cases arise. It's vital that you seek out knowledgeable, experienced lawyers to help you get the settlement you deserve. You can visit Dolman Law Group's website or give them a call to get in touch with Camp Lejeune lawyers who will review your case and help you get your entitled settlement. Many veterans and their families were exposed to an excess of chemicals at Camp Lejeune and the MCAS New River Marine Corps Air Station. After decades of fighting for compensation, the Camp Lejeune Justice Act was recently passed, allowing veterans and their families to receive meaningful compensation for their injuries. Now, there's a fund for Camp Lejeune victims and a Camp Lejeune water contamination lawsuit that's being pushed forward. But why file a lawsuit instead of going through a settlement fund? Matt Dolman says that it's based on the level of damages associated with different medical conditions. People with harsh diseases such as esophageal, kidney, or colon cancer are pushing for the lawsuit to receive the appropriate compensation for their conditions. To further explain, Stan Gipe breaks it down into three compensation layers: the first two layers, which are medical care and veteran disability benefits, are previously established forms of compensation. The third and newest layer puts real, meaningful compensation into veterans' pockets that pays reparations for how their lives have been changed. So it's now possible to file Camp Lejeune water contamination lawsuits and receive compensation…but what should you look for in a lawyer? Despite all of the commercials and advertisements, it's important to go with a firm that understands the nuances of these cases and puts you at the front of the line to receive compensation. Additionally, the firm should have the necessary resources and be affiliated with either the local counsel in North Carolina or on a national level, like Dolman Law Group. Between 1953 and 1987, countless military personnel and their families were exposed to toxic chemicals at the MCAS New River Marine Corps Air Station and Camp Lejeune. These chemicals, which contaminated the water, exceeded 4,000 times the amount allowed by EPA standards. But what are the effects on people today? Common symptoms and diseases from the Camp Lejeune water contamination include breast cancer, bladder cancer, female infertility, leukemia, neurobehavioral effects, and Parkinson's disease, among a plethora of other maladies. So, if you were on the base and now experience long-lasting symptoms and diseases such as these, what can you do about it? In the past, veterans seeking justice through Camp Lejeune water contamination claims were often shut down by North Carolina's statute of repose. But recently, the Camp Lejeune Justice Act was passed, allowing veterans and their families to file claims and seek compensation for the effects. Everything has changed with the passage of this act. The government is now working to provide real, meaningful compensation to people who were injured — even if their claim was previously turned down or if they've never explored the claim process before. To confirm if your case qualifies for compensation or to gain assistance in filing your claim, it's important that you reach out to knowledgeable Camp Lejeune lawyers. If you're new to digital marketing, you may be wondering who to hire, how much money to invest in marketing, and how to avoid common mistakes. Fortunately, https://www.linkedin.com/in/chrisdreyerco/ (Chris Dreyer), CEO of https://rankings.io/ (Rankings,) is here to help your firm make sense of all things marketing, digital, and SEO. Chris says that the first big mistake is failing to allot the right marketing budget. At a minimum, your firm should be funneling 20% to 30% of top-line revenue into your marketing efforts. Even if you're a boots-on-the-ground company, there are ways for you to compete in your market without spending all of your savings. To start out, your company needs a website and basic social media channels (at the very least). And if you aren't sure which channels to pursue further, Chris advises you to invest in the channels that are already delivering leads. You may have to experiment to figure out what works and what doesn't work, but when you find what's bringing in money, go all-in on it. Outsourcing your digital marketing to another company can be a great benefit, especially if your firm doesn't have any in-house experts. However, there are some major mistakes you want to steer clear of. If you're hiring an inexpensive agency that's charging you between $2,000 and $5,000 per retainer period, it may end up costing you more in the long run. Content and labor cost a lot of money, and if an agency is doing it for such a low price, they're likely buying cheap links to blast sites. Here's another big mistake to avoid: if an agency promises to get you on the first page of Google, they're likely employing black-hat tactics that could get you blacklisted or banned from Google. It's impossible to guarantee that you'll land on the first page of Google, especially for the key terms you want to rank. So, if an agency makes those promises, you should stay far away. Personal injury law is a saturated field — there are thousands of firms battling for top spots on Google search results. So, how do you stand out from your competitors? According to SEO expert and https://rankings.io/ (Rankings) CEO https://www.linkedin.com/in/chrisdreyerco/ (Chris Dreyer), there are two top digital assets that law firms should focus on: their website and their content. When crafting content and updating your website, you have to keep the consumer in mind. Is your website accessible? Is your content readable? Are you showcasing your authority and expertise? When it comes to your website, you want to create a flat architecture, which makes it easy to access each page of your website quickly. Most people are just focused on website aesthetics, but a great website makes it easy for consumers to find information. A flat website is one that doesn't have sub-folders for every different category — all pages are one or two clicks away from your home page. This means that you have to be intentional with every single piece of content and where you're placing it. In regards to the content itself, your goal is to have the best content on the internet. Not only should you be outputting more content to differentiate yourself, but it should be high-quality content to prove that you're an expert in the field. But here's one thing many lawyers get wrong: you shouldn't make your content too complex. It needs to be legally accurate, but it also needs to be conversational and easy for consumers to understand.
