By Adam Turteltaub Traditionally, explains, Tanya Ganguli (LinkedIn), Principal Associate, Law Offices of Panag & Babu, India's criminal law framework revolved around the Indian Penal Code, The Code of Criminal Procedure and the Indian Evidence Act, two of which dated back to the 19th century. That changed with the passage of three new laws: the Bharatiya Nyaya (Second) Sanhita, 2023, the Bharatiya Nagarik Suraksha (Second) Sanhita, 2023 and the Bharatiya Sakshya (Second) Bill, 2023. Together they seek to bring criminal law into the 21st century and build off of long-established precedents. They are designed, she reports, to address loopholes, enhance efficiency and ensure justice. The laws are now more victim centric, but may not be too transformative, according to Tanya, for most compliance and ethics programs. Nonetheless, there are changes. New rules for searches and seizures will likely require updated training on dawn raids. Summons can now be delivered electronically. There is much greater need to digitize and consolidate records. Having the right tone at the top will be more important than ever. However, the change is likely to come relatively slowly with many aspects of the law expected to be implemented in stages. Every year, the announcement of the Union Budget is eagerly awaited as one of the key tax policy events in India. "There's a gap currently between the way the small startup companies would think about how to get investment dollars and grant dollars to keep their company alive, and what the big operators need to have a deployable project." In this episode, I'm in conversation with Bradley Wamboldt, who is the principal associate of Hawk and Squirrel Innovation. Bradley specialises in helping industrial companies innovate with hard technologies such as new industrial equipment and processes. Innovations in hard technology have strong parallels with soft technology (digital), and hard technology these days is usually accompanied by some kind of digital overlay. "If you look to move to a more distributed energy generation and consumption model, there's going to be a tremendous amount of infrastructure required. We're talking about 20 terawatts of energy used by the planet. Currently, about 85% of that is fossil fuel. So the scale of this energy transition, we're really just starting to scratch the surface." Bradley Wamboldt is the Principal Associate at Hawk & Squirrel Innovation, a boutique consultancy and technology development practice in Calgary. Bradley has over 30 years of experience in oil and gas operations, project development, commissioning, operations, and technology development with both Shell Canada and Suncor Energy. "Every day you go to work you think about three things, and none of them have to do with change. Number one is safety. Safety is always making sure everybody comes home. Number two is how many barrels did you produce today. Number three is keeping the costs in line." He is currently focusing his efforts on assisting large and small companies in advancing new energy transition and decarbonization technologies from research through to commercial deployment. Bradley has a Bachelor of Chemical Engineering from McGill University and an MBA (with distinction) from Ivey School of Business at Western University. The appeal was filed by Avery Dennison Corporation (‘Appellant') seeking to set aside an order passed by the Controller of Patents and Designs (‘Respondent') refusing the grant of the Appellant's patent application for lacking inventive step. The High Court, after considering the facts of the case, decided that the assessment of the claimed invention by the Respondent was erroneous and directed that the patent application may proceed for a grant. An applicant, to whom divisional applications have been invaluable for securing multiple patents arising out of a single inventive platform, the recent decisions may appear more restrictive. To bring uniformity in practice and in the best interest of justice certain principles have been laid down by the courts that are to be adhered to while dealing with divisional applications. The main pillars of this are the EU single rulebook and a new supervisory authority at EU level. Additionally, the package includes legislative proposals for a new AML/CFT Directive repealing the currently applicable 5th Anti-Money Laundering Directive.
