Leah Litman: Disorder in the Court

Commonwealth Club of California Podcast

Something is deeply rotten at the Supreme Court, says Leah Litman, an attorney and law professor at the University of Michigan. How did we get here and what can we do about it? Litman shines a light on what she calls the unabashed lawlessness embraced by conservative Supreme Court justices and shows people how to fight back. With the gravitas of Joan Biskupic and the irreverence of Elie Mystal, Leah Litman brings her signature wit to the question of what's gone wrong at One First Street. Drawing on her new book Lawless, she argues that the Supreme Court is no longer practicing law; it's running on vibes. By “vibes,” Litman means legal-ish claims that repackage the politics of conservative grievance and dress them up in robes. Major decisions adopt the language and posture of the law, while in fact displaying a commitment to protecting a single minority: the religious conservatives and Republican officials whose views are no longer shared by a majority of the country. Litman employs pop culture references and the latest decisions to deliver a funny, zeitgeisty, pulls-no-punches cri de coeur undergirded by impeccable scholarship. Join us for a fascinating and engaging hour, as Litman explains the tools we need to understand the law, the dynamics of courts, and the stakes of this current moment. How We Got Here

This past year, what feels like a hundred in Trump years, Gaslit Nation listeners have asked the same question: How did we get here? The answer, though deeply unsettling, is vital to understand. It's the story of a 40-year campaign waged by far-right Christian nationalists, Big Oil, and corporate power to undermine our democracy. To help us all make sense of this crisis moment, as a firehose of corruption and racist disinformation blasts from the White House, we've created a special “Best of Gaslit Nation” episode. This powerful montage connects the dots with help from some of the most tenacious experts sounding the alarm. You'll hear from Ari Berman of Mother Jones and author of Minority Rule: The Right-Wing Attack on the Will of the People—and the Fight to Resist It; Anne Nelson, author of The Shadow Network: Media, Money, and the Secret Hub of the Radical Right;  Nancy MacLean, author of Democracy in Chains: The Deep History of the Radical Right's Stealth Plan for America, Elie Mystal of The Nation and author of Bad Law: Ten Popular Laws That Are Ruining America, and more. Each voice reveals a piece of the puzzle: how the Reagan revolution, Supreme Court corruption, and dark money led us to this breaking point, unleashing Trump as their Frankenstein monster.  But this isn't just about history: it's about action. The Gaslit Nation Action Guide is your toolkit for resisting, rebuilding, and reclaiming our democracy. The darkness we face cannot withstand our collective light. So stand up. Be defiant. Shine bright. This chapter isn't the end: it's our call to build something better, together. Want to enjoy Gaslit Nation ad-free? It was a busy news weekend so it's a pretty jam-packed show today. First Emma and Sam take in the latest Trump administration spin on the blowback from their self-imposed tariff disaster. After that, they're joined by The Nation's legal analyst and justice correspondent Elie Mystal who breaks down some of the overarching legal issues that have emerged in Trump's first 100 days. Elie also has a new book out, “Bad Law: Ten Popular Laws That Are Ruining America" which is available here: https://thenewpress.org/books/bad-law/  Also check out Elie's writing in The Nation: In a Normal World, Harvard's Lawsuit Against Trump Would Be a Slam Dunk: https://www.thenation.com/authors/elie-mystal/  Did the Supreme Court Just Grow a Spine? https://www.thenation.com/article/politics/did-the-supreme-court-just-grow-a-spine/ After that, Sam and Emma react to the news that Rep. Gerry Connolly is stepping down as ranking member of the House Oversight Committee due to his worsening health. Basically at this point there's no good reason that the party shouldn't back AOC to replace him. In the Fun Half, Sam, Emma and Matt react to "Mr. Wonderful" attacking AOC by saying she's against the American dream because she's rallying tens of thousands of people against oligarchs. Then, Republican congressman Mike Lawler gets shouted out by a room full of his constituents over his acquiescence to Donald Trump. Meanwhile, Illinois governor J.B. Pritzker is in New Hampshire (gee, I wonder why) where he gave a fiery speech where he calls for mass protests against the Trump administration, saying that Republicans "must not know peace." Bestselling author, popular commentator, and former litigator Elie Mystal has long been critical of the U.S. Constitution. Now he focuses his ire on 10 laws that he says are causing way too much misery to millions. In Bad Law, Mystal brings his trademark legal acumen and passionate snark to a takedown of 10 of what he considers the most egregiously awful laws on the books today. These are pieces of legislation that are making life worse rather than better for Americans and should be repealed completely. On topics ranging from abortion and immigration to voting rights and religious freedom, he says Americans have chosen rules to live by that do not reflect the will of most of the people. With respect to the decision to make a law that effectively grants immunity to gun manufacturers, for example, Mystal writes, “We live in the most violent, wealthy country on earth not in spite of the law; we live in a first-person-shooter video game because of the law.” But, as the man Samantha Bee calls “irrepressible and righteously indignant” and Matt Levine of Bloomberg Opinion calls “the funniest lawyer in America,” points out, these laws do not come to us from on high; we write them, and we can and should unwrite them. Don't miss Mystal at Commonwealth Club World Affairs as he visits all the hot-button topics in the country today. This program contains EXPLICIT language. Learn more about your ad choices. Is there a current law on the books that you disagree with? How about ten? In Bad Law: Ten Popular Laws That Are Ruining America, New York Times bestselling author and legal analyst Elie Mystal argues not only that ten pieces of legislation are making life worse for millions of Americans but that they should be repealed completely. On topics ranging from immigration to gun rights to abortion and religious freedom, Mystal asserts that these are the worst of our ordinances and that the laws by which our nation is governed do not always reflect the will of the people. Dissecting these laws through a critical lens, Mystal also addresses how these laws intersect with and impact race, class, gender, and other social identities. Even though people in power made these laws, Mystal reasons that these laws can — and should — be unmade. Bad Law aims to examine the status quo and serve as a clarion call for future reform. Elie Mystal is the New York Times bestselling author of Allow Me to Retort: A Black Guy's Guide to the Constitution (The New Press) as well as The Nation's legal analyst and justice correspondent, and the legal editor of the More Perfect podcast on the Supreme Court for Radiolab. He is an Alfred Knobler Fellow at Type Media Center, and a frequent guest on MSNBC and Sirius XM. Jay Willis is a writer who covers courts, politics, and democracy. He is the editor-in-chief at Balls & Strikes, and was previously a staff writer at GQ magazine and a senior contributor to The Appeal. When they do, what actions should they take?According to my former Above the Law (ATL) colleague Elie Mystal, the left needs to take a page from the right's playbook and “come in with the hammer.” Instead of focusing on repairing what Trump has broken, Democrats need to rally the people around destroying what deserves to be destroyed. And Elie has thoughts on where they should start. In his new book Bad Law: 10 Popular Laws That Are Ruining America, he identifies 10 laws that he believes need to be ended, not just amended. What federal and state laws are on Elie's chopping block? To hear more, visit zeteo.comThe United States Constitution was written nearly 240 years ago, laying the foundations for an independent, successful, democratic country. But, like most of the nation's laws, it was written by and for wealthy white men. To put it simply, the US legal system today feels, in some ways, both outdated and discriminatory – especially when it's either under attack or weaponized by Donald Trump. It's this exact issue that Elie Mystal, lawyer, author, and justice correspondent at The Nation magazine, tackles in his new book, Bad Law: Ten Popular Laws That Are Ruining America. There's a troubling sense of normalcy bias among some Democratic leaders who believe they'll regain their footing in the 2026 midterms, riding another anti-Trump wave. But here's the critical question: will the United States even have free and fair elections? To answer that, we need to look back and ask: was the 2024 U.S. election free and fair? Elon Musk and Donald Trump, and those around them, break the law so brazenly, how can we trust they came to power without breaking the law?    According to investigative journalist Greg Palast, this week's guest and director of the must-see film Vigilantes Inc., which you can watch for free, the answer is a resounding no. Palast's analysis reveals the shocking normalization of Republican voter suppression: over 3.5 million votes were effectively canceled in 2024. This means 3.5 million Americans were denied their fundamental right to vote. And according to Palast, a significant number of suppressed voters are nonwhite. This isn't just voter suppression; it's a modern-day resurrection of Jim Crow, fueled by the Republican Party's relentless assault on democracy. In this week's bonus episode, out Friday, Elie Mystal, the Justice Correspondent for The Nation, and author of the new book Bad Law: Ten Popular Laws That Are Ruining America, explains how the GOP's reaction to the first Black president was to gut the Voting Rights Act, paving the way for Trump.    In this week's bonus episode, we also continue our conversation with Palast, diving into the power of film as a powerful force for confronting America's darkest history. Plus, we'll also hear from Mystal on why European nations must take a stand by imposing a travel ban on Ivanka Trump and others complicit in the destruction of our democracy—a move that could help hold the Musk-Trump regime accountable for its action, along with divestment strategies that brought down Apartheid. The World Must Stand Up to Trump's America

One of the most striking aspects of living under a dictatorship is how eerily normal life can appear on the surface. The sun still rises, children still play in parks. Yet, beneath this façade of normalcy, the foundations of democracy are being purged. Drug-fueled Nazi oligarchs, emboldened by their unchecked power, withhold critical funding, endanger lives, and proudly defy the courts. They destroy the rule of law and unleash a culture of corruption, all while the world watches America turn into a failed state.   Joining us to unpack this dystopian nightmare, as well as what must be done to overcome this global threat, is Elie Mystal, Justice Correspondent for The Nation and author of the new book Bad Law: Ten Popular Laws That Are Ruining America. Mystal, a prophetic voice in the fight for democracy, breaks down what Biden and the Democrats should have done to curb Trump and MAGA extremism when they had the chance. (We'll be shouting we told you so all the way to the gulag!) He explains why Merrick Garland was, as we warned, a threat to democracy, what actions Democrats and the people must take now in the limited time we have left, and why New York State Attorney General Tish James serves as a vital reminder of the importance of local resistance. Most importantly, Mystal calls on world leaders to divest from America, an urgent strategy that helped bring down apartheid.    This week's bonus show is our live recording with Russian mafia expert Olga Lautman, who answers listener questions about combating the Russian-backed fascist threat of the Musk/Trump regime. We also discuss Trump and Russia's attempts to strongarm Ukraine into a deal that would buy Russia time to continue its genocidal invasion. Don't miss this special episode, coming to you on Friday.   A heartfelt thank you to all our Gaslit Nation supporters. This show wouldn't be possible without you. Together, we're shining a light on the truth and fighting for a better future.   Want to enjoy Gaslit Nation ad-free?
