Our guest today is Paloma A. Capanna. Paloma has been speaking and writing about the Second Amendment as the modern civil rights movement for nearly fifteen years. In more than 25-years in state and federal courtrooms, Paloma has represented plaintiffs in ground-breaking civil rights litigation. An award-winning activist and writer, Paloma chases truth until it's treed. And her latest work is a book titled “The Events of January 6, 2021: What Impact the Second Amendment Movement?”. 1) When we had you on back in August we broke down a lot of the details that seem to lead to a reasonable conclusion that people who have been arrested in the January 6th events were targeted simply because of specific clothing they were wearing that day and that there were FBI Agents among the crowd who were actually ramping up the people and egging people on to enter the building. Do I have that correct? 2) This many months later, the top three bullets are: 2a) Order of DC District Court Judge Royce Lamberth on 10/13/2021 in the case of Christopher Worrell, which found DC Warden and Director of Prisons in contempt for failing to turn over prisoner medical records to the court on time AND which directed the US AG to launch an investigation into the conditions of all defendants incarcerated pending trial relative to the events of January 6. The call to action here is to call the Assistant AG in charge of civil rights, Kristen Clarke [(202) 514-3847], to ask for a "thorough and unbiased investigation" into the prison conditions in accordance with Judge Lamberth's Order. 2b) Arrest of defendant Jeremy Michael Brown on 9/26. DOJ is calling him a "self-identified Oath Keeper" (no evidence he was a member, including his position that he was not). He says that the FBI tried to recruit him in December 2020 to be a "confidential informant." He got interested in the Oath Keepers after the November election and was at the December MAGA rally in WDC. He drove up from FL to the January 6 events with one of the four defendants who are alleged to be "Oath Keepers" who already took a plea, including a term to be "confidential informants" of the government. That person in his car reported Brown to the FBI. On January 6, while Brown was on the Capitol lawn, Brown's FBI handler called him wanting to know exactly where he was. It's another "Fast & Furious." Where are the assets? What's going on? Brown isn't the only one saying his FBI handler was calling him on January 6. Second-in-command of the Proud Boys has already been complaining of the same thing. 2c) Records of Ashli Babbitt starting to come through to Judicial Watch and to me basis Freedom of Information requests. I now have a time line of the shooting, and the procession of her body for that week. What DC Metro also released was their interview notes with US Capitol Police officers the night of January 6. If you read my blog "15:15," you learned what I learned: there were 15 armed USCP officers in that hallway + 3 unidentified uniformed officers in front of and then next to the group of 10 citizens + 3 riot USCP officers closing in immediately behind them up the stairwell, just steps away. It is fair to say we are lucky that the entire group wasn't gunned down where they stood, unarmed, and making absolutely zero retaliation against any LEO in their vicinity. Talk about chilling information for anyone who is an activist at the Capitol.

In this program, I will be reading, and commenting on, the Doctrine of the Lesser Magistrate and relate that principle in the performance of the duties of government officials. The Doctrine of the Lesser Magistrate is especially relevant in the United States with our federalist form of government. Federalism is a system of government in which the same territory is controlled by two levels of government. Both the national government and the smaller political subdivisions (state, county, and city) have the power to make laws and both have a certain level of autonomy from each other. Enumerated or delegated powers: Article I, Section 8 of the Constitution describes specific powers which belong to the federal government. Reserved powers: The Tenth Amendment reserves powers to the states, as long as those powers are not delegated to the federal government. Among other powers, this includes creating school systems, overseeing state courts, creating public safety systems, managing business and trade within the state, and managing local government. Concurrent powers: Powers that are shared by both the federal government and state governments. This includes the power to tax, build roads, and create lower courts. Per Article VI, all government officials at all levels take an oath to protect and defend the US Constitution. As such, all government officials at all levels have as their primary duty the protection of the Constitutional Rights of their constituents. When someone in authority makes laws or decrees contrary to the Constitution, they have violated their oath of office and their law or decree is invalid. Those under their authority, including those in positions of authority themselves, are NOT to obey them when they do this. They may even have to actively resist them and take actions to protect their constituents from these unconstitutional decrees and laws. Five people died during the January 6, 2021 demonstration at the US Capitol, but the only death by violence was that of Ashli Babbitt, callously shot by a Capitol Police Officer. Internal Police Docs Reveal No Good Reason For Shooting Ashli BabbittMore than 500 pages of internal D.C. Metropolitan Police documents about the fatal shooting of Ashli Babbit at the Capitol on January 6th reveal never-before-heard witness accounts that she was not holding a weapon and that she wasn't given any verbal commands before being shot.Where the documents came from: Back in May Judicial Watch sued the DC Police for the documents through a Freedom of Information Act request. Back up: Babbit, an Air Force veteran, was tragically killed during the Capitol riot on January 6th as she attempted to climb through a window [pictured above, right] into the House chamber. That's when Capitol Police officer ​​Lt. Michael Byrd [pictured above, left] shot and killed her. Here are some of the transcripts of interviews with Capitol police:"Sergeant [redacted] observed a white, female protester was climbing through an opened area where the glass pane had been knocked out... He did not see anything in the female protester's hands prior to the gunshot."A summary report of an officer directly behind Byrd, said: "He did not see Ms. McEntee [Babbitt] in possession of any potential weapons... He reiterated that he did not observe that she was armed."Another summary said: "Sergeant [redacted] did not see anything in Ms. Babbitt's hands prior to hearing the gunshot."This summary is key: "He did not hear any verbal commands" before Babbitt was shot.There was a conflicting report summary from another officer that says Byrd did give verbal commands. But that same interviewee also stated that Byrd shot twice when he really shot once. In this program, I will be reading, and commenting on, several articles that discuss the aftermath of the January 6 demonstration while inserting my comments. Among the articles, portions of which I will read, include: “FBI confirms there was no insurrection on Jan. 6” by Conn Carroll, Commentary Editor, which appeared in the Washington Examiner on August 20, 2021. “Exclusive: FBI finds scant evidence U.S. Capitol attack was coordinated – sources” By Mark Hosenball and Sarah N. Lynch, which appeared in Reuters.com on August 20, 2021. “'Horror story': Navy vet, never set foot in Capitol on Jan. 6, but held in solitary” Accused of leading 'military-style attack' despite no evidence by Art Moore, which was published on October 5, 2021, by World Net Daily.com. The disparity in viewpoints in these articles illustrates the difference in assessment they portray of the people who exercised their First Amendment rights of Freedom of Speech, Freedom of Assembly, and Freedom to Petition for a Redress of Grievances based on whether the article's author accepts the bogus narrative that the mostly peaceful demonstration at the US Capitol on January 6 was an insurrection. This emphasizes the importance of adhering to the Biblical admonition of Psalm 1:1 “Blessed is the man who walks not in the counsel of the ungodly This program continues to discuss the response to the events surrounding the mostly peaceful demonstration that occurred at the US Capitol on January 6, 2021 in which citizens protested the fraudulent 2020 election because the treatment of these demonstrators vividly illustrates the destruction of our Constitutional Republic. Numerous citizens who exercised their First Amendment rights of freedom of speech, freedom to peaceably assemble, and freedom to petition for a redress of grievances because of the blatant fraud that occurred during the 2020 election have been vilified by the treasonous Bible-mocking media and by deceitful, self-serving politicians. Many of those who peacefully demonstrated on January 6 have been incarcerated and tortured without a trial, thus violating the Fifth Amendment (deprived of liberty without due process), Sixth Amendment (deprived of a right to a speedy trial), and Eighth Amendment (deprived of reasonable bail and subject to cruel and unusual punishment). As stated in Article VI of the US Constitution, the US Constitution is the Supreme Law of the Land, so the fact that various levels of government are blatantly violating the clearly stated rights codified in the Bill of Rights makes this exceptionally execrable. This outrageous criminal action by our government against law-abiding citizens is indicative of what the ruling class wants to do to any who question them or obstruct them in any way and is a message from our Deep State rulers to us to cower us into submission by giving us vivid examples of how cruel, sadistic, and criminal their behavior can be towards those who oppose them. As I said in a previous program, you are guaranteed to have friendly relations with liberals if you hand over your possessions, hand over your children, hand over your liberty, and keep your mouth shut. I intend to do none of these. The program title, Liberty and Posterity, comes from the US Constitution, the preamble of which states that one of the reasons for writing and ratifying the Constitution was to “secure the blessings of liberty to ourselves and our posterity,” our posterity being our children and descendants not yet born. As a reminder, on the Liberty and Posterity program, we view all events and activities in relation to reality, truth, and Biblical morality. If you have a problem with that, the problem is on your end, not ours. James Madison, Fourth President of the United States and one of the authors of the US Constitution wrote: “The future and success of America is not in this Constitution, but in the laws of God upon which this Constitution is founded.” Proverbs 14:34 Righteousness exalteth a nation: but sin is a reproach to any people. Psalm 9:17 The wicked shall be turned into hell, and all the nations that forget God. John Dickinson, one of the founding fathers of the United States and the author of the first draft of the Articles of Confederation, the agreement under which the thirteen colonies coordinated their actions after the Declaration of Independence in 1776, wrote: “Honor, justice, and humanity, call upon us to hold, and to transmit to our posterity, that liberty which we received from our ancestors. A girl shut down her school, was arrested, fined and owned plenty of libs, but until she climbs through a Capitol window, she shouldn't expect any lasting attention. We missed out on minting a trillion dollar coin again. What we now could use, what the world could use, is a global minimum tax, a phrase soon to be made terrifying through Republican framing. Joan McCarter describes how Joe Manchin ran to Republican's defense, flipping the narrative into how mean Democrats are. Manchin, and former Green Party rep Kyrsten Sinema aren't saying what they would pay for, but it won't be the environment. Mitch McConnell took credit for not destroying the global economy so far, while promising to destroy the global economy in December.

Numerous citizens who exercised their First Amendment rights of freedom of speech, freedom to peaceably assemble, and freedom to petition for a redress of grievances because of the blatant fraud that occurred during the 2020 election have been vilified by the treasonous Bible-mocking media and by deceitful, self-serving politicians. Many of those who peacefully demonstrated on January 6 have been incarcerated and tortured without a trial, thus violating the Fifth Amendment (deprived of liberty without due process), Sixth Amendment (deprived of a right to a speedy trial), and Eighth Amendment (deprived of reasonable bail and subject to cruel and unusual punishment). As stated in Article VI of the US Constitution, the US Constitution is the Supreme Law of the Land, so the fact that various levels of government are blatantly violating the clearly stated rights codified in the Bill of Rights makes this exceptionally execrable. This outrageous criminal action by our government against law-abiding citizens is indicative of what the ruling class wants to do to any who question them or obstruct them in any way and is a message from our Deep State rulers to us to cower us into submission by giving us vivid examples of how cruel, sadistic, and criminal their behavior can be towards those who oppose them. As I said in a previous program, you are guaranteed to have friendly relations with liberals if you hand over your possessions, hand over your children, hand over your liberty, and keep your mouth shut. I intend to do none of these. Specifically, in this program, I will be reading, and commenting on, the death of Steven Anderson of St Augustine, Florida, who was identified as one of eight people from North Florida involved in the January 6, 2021, protests at the US Capitol. He had been indicted in March on charges that included civil disorder and assaulting or resisting officers. Mr. Anderson claimed that he never assaulted anyone; that he collapsed after being sprayed and was assisted by Capitol Police officers. Prosecuting attorneys had suppressed the video that would have corroborated Mr. Anderson's account; by failing to provide exculpatory evidence to Mr. Anderson and his attorney, the prosecutors in Mr. Anderson's case appear to have violated the Brady Rule, named after Brady v. Maryland, 373 U.S. 83 (1963), which requires prosecutors to disclose materially exculpatory evidence in the government's possession to the defense. It seems obvious to me that the incarceration of those involved in the mostly peaceful demonstration at the US Capitol on January 6, 2021 is meant to provide the rationale for the demonization and persecution of those who oppose the current regime in Washington, DC. Five people died during the January 6, 2021 demonstration at the US Capitol, but the only death by violence was that of Ashli Babbitt, callously shot by a Capitol Police Officer. On January 6, a mob of pro-Trump supporters stormed the U.S. Capitol during the certification of the Electoral College vote. As lawmakers were being evacuated by Capitol police, Ashli Babbitt, a 35-year-old Air Force veteran, tried to climb through a shattered window in a barricaded door. Capitol Police Lt. Michael Byrd shot Babbitt as she was climbing through the window and Babbitt died later that day. In the polarized debate over January 6, the death of Ashli Babbitt has become a focal point and one of unusual political valence. Many on the right view her as a martyred hero and the police officer that shot her as an example of excessive force. Those on the left, who have traditionally been outspoken about police killings, have largely stayed quiet. To the extent they've commented, it's been to emphasize the unique circumstances of the Capitol insurrection as justification for the use of lethal force. The Department of Justice, having reviewed the incident, determined that there was insufficient evidence to charge Officer Byrd with violating Babbitt's civil rights, although DOJ did not conclude one way or the other, whether the shooting was justified under the Fourth Amendment.To work through the legal issues around the shooting of Ashli Babbitt, Alan Rozenshtein spoke with Seth Stoughton, associate professor of law at the University of South Carolina and the coauthor of a recent Lawfare post on the shooting. Stoughton is a nationally recognized expert on police use of force. A former police officer himself, he was a key witness for the murder prosecution of Derek Chauvin, the police officer who killed George Floyd.
