Tina Fontaine was a young Indigenous girl from the Sagkeeng First Nation in Manitoba, Canada. Her body was discovered in the Red River in Winnipeg, wrapped in a duvet cover. Her death sparked widespread outrage and renewed calls for justice and action to address the systemic issues and violence faced by Indigenous women and girls across the country. The circumstances surrounding Tina's death highlighted the vulnerability and marginalization faced by Indigenous youth in Canada. She had experienced a difficult life, including the loss of her father and other significant family members, and had become involved with the child welfare system. Her death became a symbol of the larger issue of violence against Indigenous women and girls, leading to increased awareness, activism, and demands for justice. The case also prompted discussions about the need for systemic changes to address the root causes of violence and improve the safety and well-being of Indigenous communities in Canada. This week, to honor Native American Heritage Month, we are turning to the difficult and heavy - but important - topic of MMIW, Missing and Murdered Indigenous Women, Girls, and 2 Spirits. These cases are super hard to talk about, but we want to continue to shine a light on these way-too-prevalent atrocities. Featuring a beautiful two-spirit person's resilience in the face of bullying, a woman who disappeared at the height of COVID, and a controversial murder at the heart of the American Indian Movement. Colonial violence continues, so join us in bringing attention to these cases, and raging against the white supremacist patriarchal injustice that so many - especially indigenous women, girls, and two spirits - face. The story of Tina Fontaine is a heartbreaking one. Her family is a look into the sad history of the treatment of indigenous peoples in Canada through the residential school system and a damning case that shows how the mistreatment continues still. Tina was a very young lady, still trying to figure out where she fit in this world. Her murder is still a topic of conversation. Was Mr. Cormier the murderer who got away with it? Is there another killer or killers out there who think they got off scott free? Either way, this is a sad story that still doesn't have a proper conclusion. Indigenous women make up only 4% of Canada's population but are four times more likely to be murdered or go missing. This means that even by the most conservative estimates, half of all women murdered are indigenous. It is a tragedy striking Canada and the United States at an alarming rate. In 2014, a 15-year-old Indigenous girl named Tina Fontaine was found murdered and dumped in the Red River in Winnipeg, Canada. Her murder sparked a call for justice and lengthy investigation, ultimately resulting in an arrest and charges against the person that most are certain committed the heinous crime. Was the trial a success for the prosecution, ending in the conviction of the accused? We're gonna creep it real...let's talk about it. The story of Tina Fontaine’s life belongs to her and her family, but it parallels many others in Indigenous communities. Her struggle for stability, the promises not kept, and the sexual exploitation she endured meant that Tina experienced more trauma and pain than most people could imagine. Because of situations beyond her control, Tina needed housing, health, and educational services that were not easily accessed. In the last years of her life, poverty, homelessness, and drug use led her into life threatening situations on an almost daily basis. All of this by the time she was 15-years-old. Today, at the quiet end, we’re telling Tina’s story. After all, Tina was just a girl. She was a girl with hopes and dreams, just like our daughters. But Tina was left vulnerable to dangerous predators. Why was no one able or willing to protect or defend her?

Tina Michelle Fontaine was an Indigenous girl who had  a tough go right from the beginning. As she had run away before when 15-year-old Tina disappeared on August 9, 2014 the authorities did not treat it with much urgency at all. Tina’s family was worried sick and wanted more activity. It was not until it was too late that  the investigation began in earnest. Tina’s body was found wrapped in a duvet and floating in Winnipeg's Red River more than a week later. Her death and the subsequent acquittal of the only suspect in Tina’s slaying are cited by some as catalysts for the national inquiry that was called to look into the massive amount of missing and murdered indigenous women and girls in Canada. Welcome to the last episode of 2019!!! Thanks so much for sticking around for this very special episode with an indescribable human! (Let me attempt this anyway..) Meet jaye simpson, an Oji-Cree Saulteaux Non-Binary Two Spirit Queer Trans Woman (Sapotaweyak Cree Nation) poet, artist, performer and activist. They came over to the couch to tell me all the things. We go back to their 16 years in foster care, their art, advocacy and social justice work. In this episode, they tell me about their trials and tribulations, but also about stepping into their power and what the keys to their successes are. Topics: spotted owls, small town cruelty, queerness, slam poetry, erasure, violence, baby queers, call out vs cancel culture, privilege, indigeneity, social capital, colonialism, the tragic story of Tina Fontaine, the problem with the [white and capitalist] justice system, politics, land acknowledgments, the limitations of "awareness", gender identity, social work failures, coming out, bullying, sex, writing about sex, dating standards, power, and SO MUCH MORE, LIKE A FUCKING LOT. Bottom line: be unapologetic and consensual. Mentions: Maggie from @graceclubyvr, Billy-Ray Belcourt @nakinisowin, Kai Cheng Thom kaichengthom.com, Gwen Benaway @gwenbenaway, Arielle Twist @ArielleTwist, Sonya Renee Taylor thebodyisnotanapology.com, and probably a few more. Thank you for being part of this journey, for broadening your conversations, for laughing, crying and raging with us. I wish you rest, constructive energy and purpose in these reflective days. See you in the roaring twenties for more unabashed, unfiltered, uncomfortable topics with new and familiar souls. All my love belongs to you. A jury found Raymond Cormier “not guilty” in the murder of fifteen year old Tina Fontaine on February 22, 2018. She weighed 72 pounds at the time of her murder - so tiny.  It made the brutal death seem even more gruesome because her stature was that of a young child.  Her murder would inspire the Federal Government of Canada to order an inquiry into Missing and Murdered Indigenous Women and Girls.  In the meantime, the hurt and disappointment over Tina Fontaines murder would have a long reach in devastating a chain of family and friends that leave you wondering where does the pain ever end.  In fact will it ever end? Tina Fontaine did call in to tell police that “Sebastian” or Raymond Cormier, did in fact steal a truck.  It set in stone the fact of where she was, and what time and date she was there. Her displeasure with Raymond was enough to motivate her to make that call, and it gives us just that little nagging certainty that there was in fact a reason for Cormier to hurt her.   Recommended Podcasts: M.A.U.L.  MYSTERIES AND URBAN LEGENDS Creepy urban legends and perplexing unsolved mysteries..I have listened to these wonderful Australians since the beginning, and for being such a lovely couple, they sure can creep you out.  I have mentioned this podcast in the past, but they are now a feature podcast on Himalaya so it’s really helpful if you head over to that app and give them a like and subscribe. Tina Michelle Fontaine, was born on the first of January in 1999. Raised by her great aunt Thelma Favel,  and uncle Joseph Favel for over ten years ……… Tina’s  early life started out tough. She lived on the Sagkeeng First Nation Reserve and later in Powerview-Pine Falls, Man.  Her father, Eugene, when 41 was diagnosed with terminal cancer. He was told he would not survive longer than four months. Tina’s great aunt Thelma helped take care of her and her father.  At one point he went on a three day bender in 2011 with his friends Nicholas Abraham and Jonathan Starr. They argued about money and Eugene was beaten many times over several hours. Eugene  was then dragged out to a shed - and in that cold fall night he was left there … tied up and without a shirt on. Her father's violent death deeply affected Tina. "She was very hurt, very lost.  That's when she drifted away." So episode 73 - a new record. But you know that right? Because you subscribe to the show on iTunes and have already rated and reviewed the podcast - right? You should.Hey look we have a sponsor! Let the podcast money start rolling in! But seriously a huge thanks to Emond Publishing! So, after some technical difficulties we have a new episode - sorry about that. Maybe it is time to start one of those Patreon deals so we can buy some fancy equipment! We start off with another hard topic - another verdict in a case involving a young indigenous victim. We look at the tragic case of Tina Fontaine. The system failed her at every step of her life and last month a jury acquitted the man accused of murdering her. But did the criminal justice process fail her? We take a look at the trial and the jury's verdict. Then we move on to the bizarre case of a Radio Canada journalist arrested for criminal harassment for doing his job. The charges were dropped but WTF.And finally we take on the federal government's cherry picking of crime stats. Fear is a very good motivator and this is what our police and politicians depend on. Fear of guns. Fear of gangs. Fear of drugs. Fear of violence. Fear to justify seemingly ever-increasing police budgets. The reality is that fear of increasing violent crime is completely irrational. Canadians have never been safer. The most recent crime statistics continue a two-decade trend of decreasing violent crime. Violent crime rates were 24 per cent lower in 2016 than they were a decade earlier and are lower today than they has ever been in the last half-century.But the federal government chose to manipulate statistics about gun violence to sell the budget and new firearm restrictions.

Canada's justice system is working poorly for Indigenous peoples. Not-guilty verdicts arrived at recently in two separate murder cases involving First Nations victims, Tina Fontaine and Colten Boushie, have arguably yet again exposed Canada's justice system as failing Indigenous peoples. Indigenous people have been murdered or gone missing for a long time without due diligence from law enforcement and only now are we starting to expose these patterns of neglect in a meaningful way. Still, if you are an Indigenous person in Canada today, chances are, you will have difficulty receiving justice. The speaker will explain Canada's jury selection system and argue that it needs a serious overhaul. She will also contend that unless we come to terms with the staggering amount of racism that still exists in our institutions, and in our society as a whole towards Indigenous peoples in Canada, not much will change. Speaker: Ingrid Hess Ingrid Hess is a lawyer from Lethbridge who has been practicing for over 21 years.  For the majority of her career she has focussed on criminal defence work, representing clients on all kinds of criminal and quasi-criminal charges in the Provincial Court, Court of Queen's Bench and Court of Appeal of Alberta, including a number of serious jury trials.  She has worked extensively with clients of Indigenous background.  Some of her important court cases have been cited in academic work pertaining to the treatment of individuals with FASD in the legal system.   In 2010 she was drawn into working on the Residential Schools Independent Assessment Process for compensation for serious physical and sexual abuse.  In that capacity she has worked on over 300 individual claims from BC through to Ontario and across the North, acquiring a very personal but also broad understanding of the historical and cultural circumstances of First Nations, Métis and Inuit peoples.   Ms. Hess lives in Lethbridge and is mother to three young men.  Her eldest son is a member of the Big Stone Cree Nation and her younger two are both Blood Tribe members.   Moderator: Kristin Krein Date: Tuesday, March 13, 2018 Time: 11:30 am – 12:15 pm buffet lunch, 12:15 – 12:45 pm presentation, 1 – 1:30 pm Q & A Location: Royal Canadian Legion (north door) 324 Mayor Magrath Dr. S Cost:$14 buffet lunch with desert & coffee/tea/juice or $2 coffee/tea/juice. This week: A tale of two trials. Late last week, a jury found the man accused of murdering 15-year old Tina Fontaine to be "not guilty." The decision dealt another blow to those still processing the acquittal of the man once charged with the murder of 22-year-old Colten Boushie. Our roundtable is among those still working to process these court decisions, trying to make sense of how the Canadian justice system was seemingly incapable of producing anything remotely resembling resolution for the families of two young Indigenous people taken far too soon. We’ll discuss how we got here, the response and where justice for Tina and Colten might be found if not the courts. Joining host Rick Harp at the roundtable are Brock Pitawanakwat, assistant professor of Indigenous studies at the University of Sudbury, and Ken Williams, assistant professor with the University of Alberta's department of drama.
