Neste episódio, conversamos com Vicente Ataíde Júnior, juiz federal do TRF4 e professor de Direito da UFPR, sobre a tutela jurídica dos animais e o direito à manifestação cultural. A relação entre a proteção dos animais e o respeito às práticas culturais historicamente enraizadas traz ao debate a necessidade de refletirmos até que ponto é possível conciliarmos as tradições culturais com o bem estar animal. De um lado, há um avanço significativo no reconhecimento da senciência animal e na consolidação de princípios como o da dignidade dos seres vivos e o da vedação à crueldade. No Brasil, a Constituição Federal, em seu artigo 225, §1º, inciso VII, veda expressamente práticas que submetam os animais à crueldade, estabelecendo a proteção da fauna como um imperativo constitucional. Por outro lado, a Constituição também assegura a proteção das manifestações culturais dos povos e comunidades tradicionais, reconhecendo práticas religiosas e culturais como patrimônio imaterial da nação. Como, então, o ordenamento jurídico pode conciliar esses interesses aparentemente conflitantes? Até que ponto a proteção dos animais pode justificar restrições a práticas culturais? Quais são os limites e as possibilidades do Direito na construção de um modelo jurídico que harmonize a tutela dos direitos dos animais com o respeito à diversidade cultural?
