Sheriff Richard Mack is an Author, speaker and former Sheriff. He has served in a wide variety of roles over the course of his nearly twenty year career in law enforcement, which began in Provo, Utah.  He was elected as Graham county Sheriff in 1988. In 1994, Mack and six other sheriffs from across the country, challenged the constitutionality of the Brady Bill and ultimately, fought it all the way to the United States Supreme Court, where they won a monumental decision for freedom.    Eric J. Segall graduated from Emory University, Phi Beta Kappa 27  and summa cum laude, and from Vanderbilt Law School, where he was the research editor for the Law Review and member of Order of the Coif. He clerked for the Chief Judge Charles Moye Jr. for the Northern District of Georgia, and Albert J. Henderson of the 11th Circuit Court of Appeals. After his clerkships, Segall worked for Gibson, Dunn & Crutcher and the U.S. Department of Justice, before joining the Georgia State faculty in 1991. Segall teaches federal courts and constitutional law I and II. He is the author of the books Originalism as Faith and Supreme Myths: Why the Supreme Court is not a Court and its Justices are not Judges. His articles on constitutional law have appeared in, among others, the Harvard Law Review Forum, the Stanford Law Review On Line, the UCLA Law Review, the George Washington Law Review, the Washington University Law Review, the University of Pennsylvania Journal of Constitutional Law, the Northwestern University Law Review Colloquy, and Constitutional Commentary among many others. Segall's op-eds and essays have appeared in the New York Times, the LA Times, The Atlantic, SLATE, Vox, Salon, and the Daily Beast, among others. He has appeared on CNN, Fox News, MSNBC, and France 24 and all four of Atlanta's local television stations. He has also appeared on numerous local and national radio shows. Today on Legalese, we add a new video to my series: “Today In Supreme Court History” This latest installment looks at the landmark case of Printz v. United States. We call it “Today” in Supreme Court history because it was on this day in 1996 that oral arguments for this case were heard by the Supreme Court; as two of our Nation's finest litigators squared off. Stephen Halbrook, representing Sherriff Printz and Sherriff Mack argues as the petitioner. Walter J Dellinger III represented the United States as the respondent. The Brady Handgun Violence Prevention Act (Brady Bill) required "local chief law enforcement officers" (CLEOs) to perform background-checks on prospective handgun purchasers, until such time as the Attorney General establishes a federal system for this purpose. County sheriffs Jay Printz and Richard Mack, separately challenged the constitutionality of this interim provision of the Brady Bill on behalf of CLEOs in Montana and Arizona respectively. This case became a landmark in defining the meaning and scope of the anti-commandeering doctrine. Legalese is a reader-supported publication. Constitutional Sheriff Richard Mack reveals the sobering truth that nothing has been done to prevent another stolen election. Author, speaker and former Sheriff Richard Mack has served in a wide variety of roles over the course of his nearly twenty year career in law enforcement, which began in Provo, Utah. After 11 years at Provo PD, Mack decided to return to his childhood turf in Arizona and run for Graham County Sheriff. His campaign took off and he was elected in 1988. During his tenure, federal officers informed the sheriffs of the state that they would be required to enforce the so-called “Brady Bill” and run background checks at their expense under the law. In 1994, Mack and six other sheriffs from across the country, challenged the constitutionality of the Brady Bill and ultimately, fought it all the way to the United States Supreme Court, where they won a monumental decision for freedom. Three years later, in a landmark 5-4 split decision based on the Tenth Amendment to the United States Constitution, Mack won his case. He has also been named Elected Official of the Year by the Arizona-New Mexico Coalition of Counties in 1994, received the NRA Law Officer of the Year, inducted into the NRA Hall of Fame, 1995 Cicero Award, Samuel Adams Leadership Award from the Local Sovereignty Coalition, and Gun Owners of America Defender of the Second Amendment Award. He was sheriff for two terms until 1997. Sheriff Mack currently teaches, consults and empowers people around the country and around the world. In a 5-4 decision, the US Supreme Court determined that under the Tenth Amendment to the Constitution, the county sheriff was the ultimate arbiter of decisions concerning law enforcement within their jurisdiction. In other words, this locally elected official has the last word on how laws are enforced, allowing them to weigh state and federal mandates with their own interpretation of what constitutes legality. Mack began his career with the Provo Police Department as a parking enforcement cadet while attending BYU. A couple of years later he became a full-time officer and was soon promoted to Corporal, Sergeant, and Detective. His most traumatic experience there was a one-year assignment as an undercover narcotics agent. After nearly 11 years at Provo PD, Mack decided to return to his childhood turf in Arizona and run for Graham County Sheriff. His campaign took off and he was elected in 1988. He was sheriff for two terms until 1997. He was named Elected Official of the Year by the Arizona-New Mexico Coalition of Counties in 1994, received the NRA Law Officer of the Year, inducted into the NRA Hall of Fame, 1995 Cicero Award, Samuel Adams Leadership Award from the Local Sovereignty Coalition, and Gun Owners of America Defender of the Second Amendment Award. During his tenure, federal officers informed the sheriffs of the state that they would be required to enforce the so-called “Brady Bill” and run background checks at their expense under the law. In 1994, Mack and six other sheriffs from across the country, challenged the constitutionality of the Brady Bill and ultimately, fought it all the way to the United States Supreme Court, where they won a monumental decision for freedom. Three years later, in a landmark 5-4 split decision based on the Tenth Amendment to the United States Constitution, Mack won his case. A graduate of the FBI National Academy, some of Mack’s positions include: patrol officer, undercover narcotics officer, hostage negotiator, youth officer, school resource officer, communications supervisor, corporal, front desk sergeant, detective, sheriff, Search and Rescue supervisor, jail administrator, and DARE instructor. Mack has been a consultant on numerous cases regarding police abuse, brutality, and other misconduct by public officials. He has joined with other members of the law enforcement community to speak out in favor of drug policy reform. A graduate of Brigham Young University, Mack now lives with his wife near the Phoenix, AZ area. During the past two years Sheriff Mack has been a speaker at more than 70 different Tea Party rallies all across the country, ranging all the way from Honolulu to Bangor, Maine. It’s a true tax cut overall, but whether it helps or hurts an individual case depends on each specific tax situation. Because most energy companies are structured as partnerships, tax reform didn’t do a lot to benefit the industry, but it didn’t have too many negative impacts, either — and there are trickle-down benefits. “In The void of any role model, any role model will do” Jason The Brady Handgun Violence Prevention Act , enacted November 30, 1993, often referred to as the Brady Act or the Brady Bill, is an Act of the United States Congress that mandated federal background checks on firearm purchasers in the United States, and imposed a five-day waiting period on purchases, until the NICS system was implemented in 1998. The original legislation was introduced into the House of Representatives by Representative Charles E. Schumer in March 1991,[1] but was never brought to a vote. The bill was reintroduced by Rep. Schumer on February 22, 1993 and the final version was passed on November 11, 1993. It was signed into law by President Bill Clinton on November 30, 1993 and the law went into effect on February 28, 1994. The Act was named after James Brady, who was shot by John Hinckley Jr. during an attempted assassination of President Ronald Reagan on March 30, 1981. That being said, the frustration with situations in which a group, race, ANY, are singled out and treated with disregard of laws should be held accountable. Your silence is their victory, as the writer of this I think McVeigh was right in believing that the attacks at Ruby ridge and Waco went horribly wrong. His shock and outrage were a normal reaction, I do believe as an opinion that his actions were also horribly incorrect. Violence in anyway only provokes violence and justifies the divide. Application Process Background Check Psychological/Medical Background check How many guns can you purchase at once (or in a specific time frame) What types of guns are legal/illegal The myth about “Gun Registration” The Brady Bill What is the Brady Bill and why was it passed? Go over the prohibitions in section 922(g) Discuss the NRA trying to defeat the Brady Bill. The Brady Bill “Bypass” - (private sellers, in most states) Other Federal Gun Foolishness Federal law fails to require law enforcement officers to investigate the multiple sales or purchases of firearms that are reported. Federal law actually prohibits state and local law enforcement agencies from disclosing reports of multiple sales (other than those involving prohibited purchasers) and requires those agencies to destroy such reports and related records within 20 days of receipt. Federal Work Around - Some states require reporting Places that have or have had strict gun laws and correlating gun violence. Washington D.C. - All guns were illegal from 1976 - 2009 California Maryland Connecticut, NJ, NY NY - The City limits all firearm purchases (not just handguns) to one handgun and one rifle or shotgun every 90 days. Before a sale can occur, the seller must check with the governmental authority that licensed the purchaser to make sure the purchaser has not bought another firearm within the previous 90 days.
