OA1108 - A Coup in Search of a Legal Theory We commemorate the fourth anniversary of the January 6, 2021 insurrection by remembering the two elite lawyers who bear significant personal, moral, and legal responsibility for one of the single worst days in US political history. The bad-faith legal cover Kenneth Chesebro and John Eastman provided for the “Stop the Steal” movement in the months leading up to MAGA's violent insurrection would ultimately result in nine deaths, hundreds of injuries, and the initiation of more than 1500 federal criminal cases--but Eastman and his MAGA allies are already trying to rewrite that history in front of us. We push back in this special episode, with more to come. SS chief Reinhart Heydrich's official memo authorizing and regulating the  Kristallnacht “demonstrations” targeting the property of German Jews (11/10/1938) January 6th House Select Committee's final report (and supporting evidence) Fake elector records submitted to the National Archives (via FOIA by American Oversight) Cleta Mitchell email requesting that John Eastman write a memo for a “movement” which needs “Constitutional support” (11/5/20) John Eastman's first “draft” memo (12/24/20) John Eastman's second memo (early 2021) Kenneth Cheseboro's NY disbarment ruling (10/31/24) Record of John Eastman CA disbarment proceedings Kenneth Cheseboro December 9, 2020 memo John Eastman's speech at January 6, 2021 “Stop the Steal” rally Jack Smith's Motion for Immunity Determination (with complete supporting brief) in Trump v. David Waldman counts down the days until Thanksgiving and Christmas… both due in about 4 days if all goes well… Gops cut the money to monitor elections, making it much easier for MAGA to create problems. Trump's Supreme Court skips Congress, the Constitution, precedence, whatever, to disenfranchise voters. Donald Trump relentlessly lies, cynically grifts, maniacally rants, and viciously threatens... Every. Single. Day. Donald Trump wants you to accept this as normal. And we are… at least half of us, or maybe, maybe, a few less than half of us. 10 years ago, the only thing normalized about Trump was his raping… Okay, his racism, fraud, criminal connections, ineptitude, too. Maybe a few more things… maybe a lot more things. Family man Elon Musk was considered a bit weird back in the day as well. People who vote in person can be terrorized. People who use drop boxes can be terrorized as well. A so far pretty unsuccessful ballot box burner is being described as a balding 40-year-old white male against occupying Gaza, into metal crafts, and driving a Volvo on the streets of Portland… well, that cuts it down. Meta's weaknesses are many, as their defenses seem mostly reactive, and bots are designed to actively exploit them. A Russian court ordered Google to pay $20 decillion, making Trump wish he went bigger in his $10 billion lawsuit against CBS. Donald will probably go quattuordecillion in his upcoming lawsuit against Trump Media. Kenneth Chesebro won't be his lawyer, though. They say that the only thing that can stop a bad government database of gun owners is a good government database of gun owners. Tucker Carlson only wishes that the demons he sleeps with would have the common courtesy to trim their nails before they came to bed.

Special Counsel Jack Smith's recent court filing details not only the crimes committed by Donald Trump but the crimes committed by his alleged co-conspirators, folks like Rudy Giuliani, John Eastman, Sidney Powell, Kenneth Chesebro, and others. Smith included this information for a reason: the legal doctrine of co-conspirator liability provides that once someone joins a conspiracy, that person can be held criminally responsible for every crime committed by every other member of the conspiracy, provided the crime was a reasonably foreseeable consequence of the nature of the conspiracy. Conspiracy law further provides that every incriminating statement made by every member of the conspiracy is admissible against every other member of the conspiracy if the statements were made during the course of and in furtherance of the conspiracy. Marjorie Taylor Greene put her mental issues on display for the entire world this week as she went off crazier than usual about everything you could imagine. The Georgia lawmaker said that she wants an "exorcism" of the Republican Party to get "the demons out," and then she encouraged Republicans to abuse their power in order to protect Trump. That doesn't even include her insane attacks on Dr. Anthony Fauci or her love letter to Donald Trump. Also, former Trump lawyer Kenneth Chesebro, along with two other Trump allies, were hit with indictments in the state of Wisconsin this week for their role in the fake elector scheme in the state. Specifically, the three men were each charged with one felony count of forgery. These indictments are a bit of a surprise considering the fact that Chesebro had been cooperating with the investigators for quite some time - much like in Arizona. And Fox News host Jesse Watters thinks there could be a sexy silver lining in sending Donald Trump to prison. The host believes that Trump is going to come out of the slammer with a totally ripped "prison body," and then the liberals will all be sorry about putting him in jail. It isn't clear if Watters was just excited about seeing Trump with actual muscles, or if he thinks Trump is going to start beating each of us up, but either way it was beyond creepy. Finally, Donald Trump got even more bad news from polls this week, with the latest showing that one-third of Republicans believe that he is the wrong candidate for the Party this year. This is an absolutely devastating blow because these are his people, and now they appear to be turning against him in far larger numbers than previously thought. If Trump can't get 100% of his Republican base to support him, then he has no shot at winning in November.Subscribe to our YouTube channel to stay up to date on all of Farron's content: https://www.youtube.com/FarronBalancedFollow Farron on social media!Facebook: https://www.facebook.com/FarronBalanced/Twitter: https://twitter.com/farronbalancedInstagram: https://www.instagram.com/farronbalancedTikTok: https://www.tiktok.com/@farronbalanced?lang=en

Fani Willis Under Fire: Unjustified Political Persecution of Former President Trump

In a new development that could tip the scales, Fani Willis, the under-fire District Attorney for Fulton County, finds herself thrust into a new skirmish over her role in the RICO case filed against the former U.S. President Donald Trump and other key players revolving around events following the 2020 Georgia elections. Prominent personalities involved alongside Trump are his past chief of staff Mark Meadows, Rudy Giuliani, the former President's ex-personal attorney, and associates Cathy Latham and Michael Roman. These co-defendants are challenging a questionable verdict by Fulton County Superior Court judge Scott McAfee made over a month ago that enabled Willis to maintain control over the case, despite the departure of the former special prosecutor Nathan Wade. What's at the heart of the matter is Willis' relationship with Wade and additional measures taken regarding the case's prosecution, all of which, claim the defendants, undermine her position. These concerns have led ex-DeKalb County District Attorney Robert James to urge a thorough probe of the case by the appeals court, underlining a paucity of legal precedence in this scenario. Describing the situation as 'uncharted territory,' James further forecasts a lengthy review process in the offing, with a resolution not likely to emerge before November's elections. In the meantime, four involved parties – bail bondsman Scott Hall and attorneys Sidney Powell, Kenneth Chesebro, and Jenna Ellis – have admitted to charges, whereas the remaining defendants, including Trump himself, have refuted any misconduct and entered not-guilty pleas. Last month provided a significant move when the appeals court consented to examine Trump's case and granted him a ten-day window to file. Trump's legal representative, Steve Sadow, cast the issue as an opportunity for the former President to put forth compelling arguments for both the dismissal of the case and the disqualification of Willis due to her 'improper conduct in this unjustified, unwarranted political persecution.'See omnystudio.com/listener for privacy information.

It's Thursday! Maundy Thursday! Today David Waldman reintroduces the word “turpitude” to our colloquial lexicon, and it's about time, there's a lot of it going around. Titan of turpitude Trump received another very tardy gag order. When will judges learn? Trump officials are hired primarily to aid in Donald's turpitude, and thus knowingly endanger their own careers. Assistant attorney general Jeffrey Clark could face disbarment for supporting Trump's 2020 coup. A California judge has now recommended disbarring  John Eastman for being the chief architect of one of the January 6 plots, and of course, moral turpitude. Kenneth Chesebro and Jim Troupis turned over more than 1,400 pages of documents detailing their bad-faith arguments and turpitudinous cloud of confusion chaos. Lev Parnas can tell you all about that stuff. Joe Lieberman, who was ok as ALF's dad, I guess, but got pretty irritating following the 2000 election, is much less irritating today. Turpitude never entered his mind. CPAC's Matt Schlapp dropped $480K to get one sexual battery lawsuit dropped. Now, what will he do about all the rest? Schlapp and Mrs. Schlapp worked to discredit and defame their first accuser, so they seem pretty turpitudinous. You don't hear much about Jeffery Epstein's island now that the right wing has been implicated. Expect to hear much less about it soon.

After the settlement in Wisconsin over the fraudulent electors scheme, veteran prosecutors Andrew Weissmann and Mary McCord analyze the importance of what came to light as a result of the litigation against James Troupis, Kenneth Chesebro and 10 ‘alternate' electors. Mary was part of the team arguing the case and gives expansive context to the ongoing efforts to overturn the 2020 election. They then turn to the Supreme Court's decision on the Colorado ballot issue, and why, despite a unanimous vote, there may be dissension in the ranks. And they wrap up with a look at the timing of the Florida documents case and Trump's former CFO Allen Weisselberg's guilty plea on federal perjury charges.

SERIES 2 EPISODE 130: COUNTDOWN WITH KEITH OLBERMANN A-Block (1:44) SPECIAL COMMENT: Bob Costas has been my friend for 40 years. He has been one of my closest professional friends for a quarter century. And now, bluntly, Bob Costas needs to shut the EFF up about Joe Biden. He has launched this extraordinary campaign - first on HBO with Bill Maher, now on CNN with that toad Michael Smerconish - demanding that Biden and his "hubris" be "shown the door" off the presidential ticket. Bob not only has no idea that such a thing is impossible and even if it were justifiable or smart or legal, it would result in a different candidate who would lose to Trump by ten points. Bob will hear none of this. I tried, behind the scenes, for two weeks. I failed. And I failed to make it clear to Bob that Trump is ALSO trying to get Biden off the ticket and so that all Bob is accomplishing is - he's doing Trump's work for him. It's heartbreaking, I'll lose his friendship, but Bob Costas needs to shut the EFF up about Joe Biden (and that goes for Jon Stewart, Ezra Klein, and all the others who like Bob don't realize that we have lots of historical evidence of what happens when the Democrats try to do a Julius Caesar on a sitting president. There are two results: you LBJ him and you get Richard Nixon; or you DON'T completely LBJ him and you only wound him - and you get Ronald Reagan). Bob. Shut the eff up. B-Block (29:42) POSTSCRIPTS TO THE NEWS: Oh, nothing, just Joe Biden and his hubris about to get a Gaza Cease Fire while eating ice cream; James Comer's favorite Russian plant will stay in jail so it's "Smirnov on Ice." Kenny The Cheese didn't tell the truth about his plot to overthrow democracy in Michigan; Trump underperformed the polling by EIGHT POINTS in South Carolina (36:52) IN SPORTS: A new explanation for baseball's uniform fiasco; Peter King retires; one of the unheralded heroes of baseball - Jim Hannan - passes away. (42:07) THE WORST PERSONS IN THE WORLD: It took FIVE NBC reporters to claim Trump is about to "pivot?" Van Jones speaks at CPAC; There's a price on Tucker Carlson's head and bluntly it's humiliatingly low. Are single-sentence apology letters a sign of true remorse? The latest episode of The Atlanta Journal-Constitution's Breakdown podcast explores the meaning of apology letters written by three of the four defendants who have pleaded guilty in the Fulton County election interference case against former President Donald Trump and others. The apology letters were a condition imposed by District Attorney Fani Willis for the plea deals. Two of the letters, written by attorneys Kenneth Chesebro and Sidney Powell, are just a single sentence. “Sorry, Not Sorry” – Episode 22 of Breakdown's Season 10, “The Trump Indictment” – also reports on oral arguments before the federal appeals court in Atlanta, which considered a request from former White House Chief of Staff Mark Meadows to transfer his case from Fulton Superior Court to federal court a few blocks away. And the 11th U.S. Circuit Court of Appeals, to the surprise of many, handed down its decision just three days after a three-judge panel heard the arguments. SERIES 2 EPISODE 83: COUNTDOWN WITH KEITH OLBERMANN A-Block (1:44) SPECIAL COMMENT:  I'd like to apologize for what MSNBC has become. Again. I'd like to apologize AGAIN for what MSNBC has become. They fired Mehdi Hasan yesterday. He hosted one hour a week on Sunday nights and it might have been the best hour on the network because while I don't know that I agreed with even MOST of what he said, he wasn't doctrinaire and he didn't simply repeat what Maddow says and he didn't pretend to be a moderate because being a Trump propagandist didn't work out for him like Scarborough does and he didn't struggle to read a prompter full of Democratic Party talking points like Joy Reid does and to my knowledge he never fell asleep on the air like Andrea Mitchell does nor cause the viewer to fall asleep like Hayes and O'Donnell do. I do NOT know for certain why they fired him, I do NOT know if he said something about the Middle East they did not like, I do not know if the timing was coincidental. Let's put it this way: they either fired him for his Middle East opinions DURING conflict in the Middle East OR they fired him for something else DURING conflict in the Middle East and thus made themselves look guilty of firing him for his Middle East opinions anyway. Just as important as the continuing asinine and ignorant conduct of the management of MSNBC and NBC and NBC News is the issue of personal integrity of the people at what is god help us the closest thing to a liberal news network in this country. MORE important than the FIRING of Mehdi Hasan, is the response from MSNBC's stars about the firing of Mehdi Hasan. Want to read what Maddow and O'Donnell and Hayes and Wagner and Reid and everybody else said about this:   Wanna read it again? The POINT of HAVING the money IS that you SHOULD say "F YOU" to somebody at least once in your life. Not like Musk did; saying it to people who for some reason don't want their ads next to antisemitic and Pizzagate posts. But in DEFENSE of something. FOR something. If there are three people at NBC – hell, three people in NEWS – three people in TELEVISION – who can at least get away with a loud pointed protest – hell, can get away with saying “If Mehdi Hasan goes or if Tiffany Cross goes or if we keep diluting our product down to badly rewritten Democratic Party press releases, we're on strike” – if there are THREE people in media – besides like Taylor Swift - who can say “We are standing on our principles” and will LIVE TO TELL ABOUT IT, it's Chris Hayes and Lawrence O'Donnell. Of course – you've gotta HAVE principles. ALSO the Judge Engoron Trump gag order is back in place and Trump is still endangering the judge, his wife, and now his son. And Politico says the editorial that provoked Trump to revive the self-own "I will kill ObamaCare" not only revivified the ISSUE; it revivified Biden's campaign. Emails went out within hours. Nancy Pelosi got on a press call Tuesday. Biden hit Trump on video Wednesday. Commercials are already running on the state level. And then the Wall Street Journal ran another editorial on ObamaCare… attacking… TRUMP. For his failure to repeal AND his failed response to their first editorial. Whereupon Trump replied by attacking… the Wall Street Journal by calling the paper quote “Globalist” and the Editorial Page a “mess.” The Editorial Page whose editorial about ObamaCare got him so excited that he again vowed to replace ObamaCare and thus revitalized the Biden campaign and I haven't fully diagrammed this bizarre confluence of events but I think the gist of it is: if Biden is re-elected we can thank… The Wall Street Journal Editorial Board? B-Block (31:46) POSTSCRIPTS TO THE NEWS: House Judiciary subpoenas Harlan Crow and Leonard Leo and enrages GOP. Good. Wanna guess how many copies Marjorie Greene's book sold in its first week? Joyce Vance hosts #SistersInLaw to analyze the guilty pleas of Kenneth Chesebro and Sidney Powell in Georgia, why they got off relatively easy, and what their convictions mean for the other defendants.  Then, they discuss the DOJ's class action settlement on behalf of immigrant families separated at the border, with a look at how they're being compensated and the steps the government must take to make sure it never happens again.  From there, they debate the merits of forum shopping that has enabled people to take advantage of the system for better outcomes and empower a single judge to set national policy.  But given that it was a lone judge who dismantled Trump's muslim ban, can it sometimes be a good thing?
