The North American Aerospace Defense Command, or NORAD, will once again be tracking Santa Claus this year, as he travels around the world, bringing gifts to kids across the globe. What started 70 years ago as a mistaken phone call from a child to the former Continental Air Defense Command, is now a beloved holiday tradition for families everywhere. More than a thousand volunteers will be staffing NORAD's Santa Operations Center, to answer the hundreds of thousands of phone calls that come in from around the world. In Southern California, powerful winter storms are threatening holiday plans. Millions in California are expected to hit the road for Christmas, but are likely to meet hazardous travel conditions. Officials are warning residents about potentially deadly flash flooding and mudslides, and to reconsider their holiday travel plans. Local and state officials are gearing up to respond to emergencies through the week. The state has also deployed resources and first responders to a number of counties along the coast and in Southern California, with the California National Guard on standby to assist.A fire and explosion erupted in the Bristol Health and Rehab Center near Philadelphia on Tuesday afternoon. At least two are dead and 20 are inured. Pennsylvania Governor Josh Shapiro says firefighters, rescue crews and bystanders were helping to get the nursing home residents to safety. Authorities are investigating a possible gas leak as the cause.

CBS Justice Correspondent Scott MacFarlane joins Independent Americans for a hard-hitting breakdown of Trump's risky Venezuelan tanker seizure, the secret DOJ legal memos behind recent strikes, and the unprecedented blanket pardons that wiped out the largest criminal investigation in American history. Host Paul Rieckhoff also unpacks a near-trillion-dollar defense bill, Trump's blocked federalization of the California National Guard, and fresh pressure on Venezuela's Maduro, all converging in a volatile national security moment. Scott explains how DOJ's refusal to release its legal guidance on the Venezuela operations is fueling mistrust, why bipartisan ethics experts and the Senate Judiciary Committee are demanding transparency, and how the administration's strategy of funneling information to friendly outlets undermines accountability. The conversation dives into Trump's inauguration-day mass clemency for January 6 defendants, the still-murky arrest in the January 5 Capitol pipe bomb case, and the norm-shattering removal of traditional Pentagon reporters in favor of a new “propaganda press corps.” Amid the heavy news, Paul and Scott still make space for life and hope—from Jalen Hurts' rough season and Philip Rivers' surprise Colts comeback to Pete Alonso's move to the Orioles and the energy of Army–Navy week in Baltimore. They close with “something good”: NORAD's annual Santa Tracker volunteer effort and Scott's 15-year-old asking for a CD player and physical albums, a small reminder that the next generation still wants something real and tangible. Because every episode of Independent Americans with Paul Rieckhoff breaks down the most important news stories--and offers light to contrast the heat of other politics and news shows. SNAP Benefits Crisis: Alex Stone reports that food banks nationwide are bracing for a massive surge in demand as the government shutdown drags on. Federal SNAP (Supplemental Nutrition Assistance Program) benefits — serving 42 million Americans monthly — could end November 1 if no deal is reached. In Barstow, CA, the police chief warns shoplifting may spike as families struggle to afford groceries, planning to post more officers at stores. In Huntsville, AL, officials are preparing as if for a natural disaster. Meanwhile, the California National Guard is helping stock food pantries. For every 1 meal food banks currently provide, SNAP provides 9, highlighting how dire the loss would be. Day 30 of Government Shutdown: With no resolution in sight, SNAP benefits could run out by November 1, leaving millions without food assistance. Layoffs Hit L.A.: Paramount announces 1,000 job cuts, with Los Angeles among the hardest hit. Restaurants and local businesses are already seeing the ripple effects of layoffs across the entertainment and media sectors. Dodgers & Unclaimed Money: Dodgers vs. Blue Jays, Game #6 tonight. Plus, Orange County launches a new website where residents can search to see if they're owed unclaimed money or property, totaling hundreds of millions of dollars.

Trump is watching yet ANOTHER federal court win developing, this time in his ongoing legal battle with California Governor Gavin Newsom over Trump's deployment of National Guard to Los Angeles. Yesterday the 9th Circuit Court of Appeals heard oral argument in Newsom v. Trump on whether Newsom should be allowed to keep a temporary restraining order issued by a feckless, unelected, black-robed, tyrannical, inferior district trial court judge out of San Francisco, that prohibited Trump from deploying the California National Guard to LA. The same three-judge panel hearing these oral arguments has ALREADY voted UNANIMOUSLY to freeze that TRO pending its appeal by the Trump administration, including not just the two Trump appointed judges but also the Biden appointed judge. So, the odds are looking ever in Trump's favor. This reflects his recent victories in a similar National Guard case out of Oregon, Oregon v. Trump, in which Trump also won a stay of a district court TRO from a different three-judge panel of the 9th Circuit Court of Appeals.Today we'll watch and break down the video of yesterday's oral arguments. And, when Trump tried to violate the court's order by sending the California National Guard or the Texas National Guard to Portland, Judge Immergut issued a second restraining order, in the middle of the night, prohibiting those deployments as well. For nightly live Law Talks, please join Glenn on Substack: glennkirschner.substack.comIf you're interested in supporting our all-volunteer efforts, you can become a Team Justice patron at: / glennkirschner If you'd like to support Glenn and buy Team Justice and Justice Matters merchandise visit:https://shop.spreadshirt.com/glennkir...Check out Glenn's website at https://glennkirschner.com/Follow Glenn on:Threads: https://www.threads.net/glennkirschner2Facebook: https://www.facebook.com/glennkirschner2Instagram: https://www.instagram.com/glennkirsch...Bluesky: https://bsky.app/profile/glennkirschn...TikTok: https://www.tiktok.com/glennkirschner2See Privacy Policy at https://art19.com/privacy and California Privacy Notice at https://art19.com/privacy#do-not-sell-my-info.
Over the weekend, a federal judge blocked President Trump from deploying the National Guard in Portland. The judge blocked Trump from deploying the California National Guard to Oregon, too. Interestingly, the ruling cited Trump's own tweet, which described Portland as “war ravaged,” in determining that he does not have unlimited authority to wildly invent facts on the ground wholesale as a pretext to justify any use of the military he wants. “The President's determination was simply untethered to the facts,” this Trump-appointed judge declared. “This is a nation of Constitutional law, not martial law.” In short, Trump's gale-force bad faith worked against him. We talked to Oregon's Attorney General Dan Rayfield, who explains the ruling, details how Trump's lawless words and threats are undermining his own case, examines the larger stakes of this moment, and looks ahead to what's next. Today's Headlines: President Trump's creeping authoritarianism tour continues. The White House ordered 300 Illinois National Guard troops federalized to “protect federal assets” during ongoing ICE raids in Chicago — even though a federal judge (a Trump appointee, no less) just blocked a similar deployment in Portland for being, quote, “untethered to the facts.” Meanwhile, California Governor Gavin Newsom is suing over Trump sending his state's Guard to Portland, telling him to get his own troops. Those troops, by the way, are backing ICE's new “Operation Midway Blitz,” a dystopian raid that saw helicopters, grenades, and tear gas used on a Chicago apartment building at 1am, and the administration has since pressured Apple and Google to remove apps that warn users of ICE activity — both complied within hours. In other weird Trump administration things, the Treasury Department is reportedly considering minting a $1 coin featuring Trump's face and the slogan “Fight Fight Fight” for the U.S.'s 250th anniversary, while the longtime director of the Eisenhower Presidential Library was ousted after refusing to hand over a historic sword for Trump to gift to King Charles (yes, really). In South Carolina, a state judge and her husband barely escaped a massive house fire that's now under investigation. Abroad, Trump says a Gaza ceasefire deal is “days away,” despite Netanyahu reportedly responding to him with classic Bibi pessimism. Over 450 activists, including Greta Thunberg, were detained after the Israeli navy intercepted the “Global Sumud Flotilla,” with reports of abuse in detention. Also, Sean “Diddy” Combs was sentenced to just over four years in prison on prostitution-related charges — and apparently had speaking gigs lined up for the same week. And finally,, the government remains shut down while Speaker Mike Johnson continues to block the swearing-in of congresswoman-elect Adelita Grijalva. Here are 3 big things you need to know— One — Secretary of State Marco Rubio says speed is of the essence for a deal to end the war in Gaza. Appearing on ABC's "This Week", Rubio said this is not something that can continue to drag out. His comments come as President Trump is sending special envoys to the Middle East to try to seal his hostage release deal. Both Israel and Hamas have indicated support for the proposal, but with conditions that still need to be negotiated. Two --- A federal judge is stopping the Trump administration from sending members of the National Guard to the streets of Portland, Oregon. U.S. District Judge Karin Immergut granted the motion for a temporary restraining order filed by the state of California on Sunday night. The motion stopped the deployment of up to 300 members of the California National Guard to Portland. No word on how that might affect plans to send the National Guard to Chicago. And number three --- The new Michigan state budget cuts 18-hundred full-time jobs, but Governor Gretchen Whitmer says no layoffs will happen. Most of the job cuts are from Michigan State Police, the Michigan Department of Corrections, and Michigan Department of Health and Human Services. The openings likely will come from attrition and eliminating current unfilled roles.

As a result of a new ruling by a California appeals court, the people's First Amendment rights to free speech and assembly suffered a setback. The rule of law suffered a setback. Justice suffered a setback. The 9th Circuit Court of Appeals left a stay in place, blocking the trial court's order that Trump must turn control of the California National Guard back to Governor Gavin Newsom.Fortunately, the ruling is a temporary/interim ruling and the case is far from over.Glenn discusses some of the unfortunate aspects of this ruling, including how Trump gets to create chaos and confusion in California and then uses that chaos as a pretext to order the military into the streets of California. Political violence is never OK. So after the horrible news out of Minnesota, Mary and Andrew begin with a breakdown of the federal charges against the man accused of murdering a Minnesota state lawmaker and her husband and attempting to murder several others.Next, they move to an explainer of an appeals court ruling that temporarily blocked a lower court decision ordering the control of the California National Guard back to the state, while tying in the scuffle during Homeland Security Secretary Kristi Noem's press conference last week as Senator Alex Padilla was forcibly removed and handcuffed. And rounding out this episode, Andrew and Mary note Trump's failed attempt to appeal the $5 million judgement in the E Jean Carroll case, and the arguments heard last week on his attempt to remove his NY state hush money case to a federal court.Want to listen to this show without ads? Will a 9th Circuit appeals court put Governor Newsom back in charge of the California National Guard and refuse to accept the ruse of a Trump-declared “rebellion,” or will they rule for Trump and keep him in charge for many more months while they ponder the appeal. Michael Popok reports on today's oral argument and posits that they will likely find that they have jurisdiction to provide oversight over Trump's actions, but want the lower court to develop a more fulsome record before making an ultimate ruling, starting with a hearing in court on Friday before Judge Breyer. COUNTDOWN BULLETIN: SEASON 3 EPISODE 137 Attempting to question Homeland Security Secretary Kristi Noem at her Propaganda Conference in Los Angeles today about the Trump Junta's illegal usurpation of the California National Guard and its illegal deployment of active military into civilian police enforcement, California Senator Alex Padilla was jumped by a series of Trumpist thugs including uniformed members of the FBI who wrestled him to the ground, threatened him, and handcuffed him. This is simply the latest in a string of domestic terrorist events perpetrated by Trump's government since the beginning of the ICE raids rounding up migrants, naturalized citizens, and native-born Americans alike, last Friday. It precipitated minor protests and violence slightly below the level of that seen after the Los Angeles Lakers' basketball team won its last championship in 2020. The manhandling of Padilla may have not been the most ominous development Thursday in our march towards dictatorship. Pressed at a congressional hearing about the pending case asking a judge to restrain Trump from usurping control of the California National Guard from Governor Newsom, Secretary of Defense Pete Hegseth refused to confirm he would abide by any ruling from the court with which he would not agree. He is attempting to cloak the insertion of active military into civilian police enforcement, and the overriding of the courts, in some fantasy that he and Trump are enacting "foreign policy" by terrorizing Southern California. This week, Scott sat down with Lawfare Senior Editors Molly Reynolds and Quinta Jurecic, and Contributing Editor Chris Mirasola, to focus on the week's big domestic news, including:“Drama Majors, Meet Major Drama.” In the glittering city of Los Angeles, the Trump administration has taken the dramatic step of calling up the California National Guard and deploying them alongside active duty Marines to secure federal personnel and facilities, specifically against protestors demonstrating against the Trump administration's draconian immigration policies. Is this the beginning of a broader threat to the constitutional order, as some of Trump's critics say it is? And what should we make of President Trump's suggestion that he may yet invoke the controversial Insurrection Act?“Precision Rescission, What's Your Mission?” The Trump administration has asked Congress to formally rescind a slice of the federal spending it has been withholding since entering office, specifically relating to foreign assistance and the Corporation for Public Broadcasting—a request the House seems poised to move on this week. How likely is it that Congress will agree to the cut in funds? And what will the implications be for relevant legal challenges and Trump's broader agenda?“There and Back Again.” After an unexpected journey and epic delays on the part of the government, the Trump administration has finally repatriated Kilmar Abrego Garcia, the man who was mistakenly deported to El Salvador—only to charge him with human trafficking and other federal crimes in Tennessee. How serious are the charges against him? And is this likely to be a win or loss for the administration's broader immigration agenda? In object lessons, Molly shared a ranking of New York mayoral candidates by their bagel orders—and whose order is so bad, it's a schmear on their very New Yorker-ness. Quinta recommends Ava Kofman's profile of Curtis Yarvin in the New Yorker as a masterclass in the art of meticulous evisceration. Scott introduced his 4-year-old to his old Tintin books by Hergé—because it's never too early to get into the drawbacks of colonialism. And Chris fled real DC drama for fake DC drama with The Residence on Netflix. To receive ad-free podcasts, become a Lawfare Material Supporter at www.patreon.com/lawfare.
