Sheraz Mian, director of research at Zacks Investment Research, says that the cumulative effect of the Federal Reserve's rate cycle starts showing up, it will goose the economy and the stock market, and with the worst of the post-Covid struggles behind us, the "soft landing" most experts forecast is actually what we're experiencing now, and that better times — and continued strong corporate earnings — are ahead, without a big correction or downturn in the interim. Mian isn't the only one expressing bullish sentiment, as Charles Rotblut, editor of AAII Journal checks in with the details of the latest AAII investor sentiment survey, which has shown particularly high levels of bullish sentiment for about two months now, but who notes that the market typically delivers unimpressive gains when emotions are running high. David Trainer of New Constructs re-affirms the past selection of Affirm Holdings in The Danger Zone, noting that the stock's recent gains of about 70 percent have simply positioned it to take another big fall, as he believes investors have bought the hype and ignored the reality of the company's struggles to deliver real profits. Plus, Money Life introduces its latest sponsor, Monetary Metals; Saad Zein, chief portfolio officer for Monetary Metals, discusses how the company enables investors to earn interest on their gold and silver holdings — paid in precious metals — and how generatking that income changes what many people consider the biggest weakness and turn-off to putting money into silver and gold.

This week on Cyber Matters, hosts Tanner and Katherine cover a wide range of topics in cybersecurity, privacy, and technology law. They begin by discussing the ELVIS Act, a new Tennessee law effective July 1, 2024. Katherine explains how this act expands protections for individuals' voices and likenesses, particularly regarding AI-generated deepfakes. While both hosts praise the act's intentions, they also point out several ambiguities in its language that could lead to implementation challenges. Tanner then provides an update on the Department of Defense's Cybersecurity Maturity Model Certification (CMMC) program. He details the revised CMMC rules submitted to the Office of Information and Regulatory Affairs, incorporating changes based on public feedback. These revisions include a new 2.5-year rollout plan, allowances for self-attestation in some cases, and increased focus on third-party risk management. In SEC news, Tanner discusses a recent 8-K filing by Affirm Holdings, noting how it aligns with new SEC guidance on cybersecurity incident disclosures. The hosts also delve into the Supreme Court's decision in Moody v. NetChoice, which vacates lower court rulings on social media platform regulation laws in Florida and Texas. They explore the nuances of the majority opinion, concurrences, and the implications for future as-applied challenges to these laws. Katherine highlights international privacy enforcement actions, including the European Commission's preliminary findings that Meta's "pay or consent" model for Facebook and Instagram users in Europe may violate the Digital Markets Act. She also mentions an order for Meta to stop training its AI on Brazilian personal data. In the healthcare sector, Tanner covers a $950,000 settlement between the Office for Civil Rights and Heritage Valley Health System for potential HIPAA violations. He emphasizes the importance of basic security measures like risk assessments and access policies, noting that this case took nearly seven years to resolve. The hosts then turn their attention to emerging technologies and their privacy implications. They address concerns about OpenAI's ChatGPT application for Mac storing conversation history in plaintext, debating whether this constitutes a breach of trust. Tanner and Katherine also explore the potential risks and considerations surrounding Morgan Stanley's new AI-powered tool for recording and summarizing client calls.

As Christmas is less than a week away, Walmart shoppers have been greeted with a new BNPL payment at the checkout line. The increased use of BNPL is incredibly problematic for consumers with insurmountable credit card debt and depleted savings. Affirm Holdings announced Tuesday that its BNPL service has been expanded to self-checkout kiosks at 4,500 Walmart stores nationwide. Customers can purchase electronics, apparel, toys, and many more items (except groceries) by spreading payments out from three months to 24 months. "Recent Affirm research revealed that more than half of Americans (54%) are looking for retailers to offer a buy now, pay later option at checkout. Moreover, we've found that 76% of consumers would either delay or not make a purchase without Affirm," said Pat Suh, Affirm's SVP of Revenue. OCC warned about the overuse and poor understanding of the BNPL payment structure that could lead to disastrous outcomes for consumers if payments are missed. The ‘Bases for the Reconstruction of the Argentine Economy' decree, passed on Dec. 20, did not specifically mention crypto but included provisions that debtors had the choice to pay in currencies not recognized as legal tender in Argentina. “We ratify and confirm that in Argentina contracts can be settled in Bitcoin,” said Mondino. “And also any other crypto.” The Minister's assertion further underlines Argentina's efforts to leverage the potential of Bitcoin to stimulate economic growth and innovation.
