Depuis mardi matin, des policiers fouillent les alentours d'un lac artificiel et du barrage d'Arade au Portugal, et sondent les eaux. La zone se trouve à une cinquantaine de kilomètres de la station balnéaire de Praia da Luz, l'endroit où Madeleine McCann, une fillette britannique de quatre ans, passait des vacances avec sa famille avant de disparaître le 3 mai 2007. L'affaire est hors norme : seize ans d'enquête, d'hypothèses, de rebondissements et de fausses pistes. Quand la police portugaise classe le dossier en 2008, après quatorze mois d'investigations controversées, marquées notamment par la mise en examen puis la mise hors de cause des parents, les enquêteurs britanniques puis allemands prennent le relai. Ces nouvelles recherches sont d'ailleurs organisées à la demande de la justice allemande, qui soupçonne Christian Brueckner. L'homme de nationalité allemande est un pédophile multirécidiviste ayant vécu plusieurs années en Algarve et se rendait régulièrement au barrage d'Arade. Le jour de la disparition de l'enfant, il se trouvait dans la région. Il purge une peine de prison en Allemagne pour le viol d'une Américaine de 72 ans en 2005 au Portugal. Identifié en 2020 par les enquêteurs allemands, qui ont dit alors avoir la certitude que la fillette est morte, il a été mis en examen en 2022 à la demande de la justice portugaise. La vérité sur le mystère de la disparition de Maddie se trouve-t-elle dans les eaux du barrage d'Arade ? Pourquoi de nouvelles fouilles ont-elles été lancées ? Comment les enquêteurs travaillent-ils sur ces dossiers anciens et complexes ? En France, pour améliorer le traitement de ce que les Américains nomment "cold cases", un pôle national consacré à ces affaires a été lancé le 1er mars 2022. Installée au tribunal judiciaire de Nanterre (Hauts-de-Seine), cette division judiciaire est dédiée aux affaires non élucidées, parfois vieilles d'un demi-siècle. Un an après sa création, le pôle "cold cases" qui atteindra sous peu la centaine de dossiers a ravivé l'espoir de nombreuses familles de victimes soulagées "d'être enfin entendues" par la justice. Reprendre ces affaires, repartir à zéro, réinterroger proches et témoins, réexaminer chaque hypothèse… Raphaël Nedilko l'a fait à deux reprises alors qu'il était officier de police judiciaire à Dijon, en Côte-d'Or. Sa ténacité pendant huit ans, entre 2008 et 2016, a permis de résoudre les meurtres de Christelle Maillery et Christelle Blétry, deux des "disparues de l'A6". Il a vu d'un bon œil le lancement d'un pôle dédié aux cold cases à Nanterre mais estime cette création insuffisante si l'on veut éviter un nouvel embouteillage. "Avec le nombre récurrent de dossiers qui vont émerger, il va falloir certainement en arriver à la multiplication de ces pôles sur le territoire, partout en France" explique-t-il. En France, environ 50 à 70 000 personnes sont ajoutées chaque année au fichier des personnes recherchées (FPR) du ministère de l'Intérieur. Parmi ces signalements, environ 10 000 sont considérés par les enquêteurs comme particulièrement préoccupants. En 2021, 43 870 de ces disparitions concernaient des mineurs dont 42 151 jeunes déclarés "en fugue", 545 signalés "enlevés" (avec violence) ou "détournés" (sans violence) le plus souvent par un parent lors d'un conflit familial. Pour 922 mineurs, la disparition a été jugée particulièrement préoccupante. Her parents left the 3-year-old and her two brothers sleeping, as they had dinner at a nearby restaurant. The main suspect in her disappearance is 44-year-old Christian Brueckner . He's currently in a prison for the rape of tourist. Brueckner has also beden arrested for pornography and abuse of a minor. Investigators found thousands of images of child porn at a property owned by him. They also found that Brueckner had been in the area at the time of McCann's disappearance. Madeleine was on holiday from the UK with her parents, Kate and Gerry McCann; her two-year-old twin siblings; and a group of family friends and their children. In June 2020, Police reveal that a 43-year-old German prisoner has been identified as a suspect in Madeleine's disappearance, Christian Brueckner. Christian Brueckner, 43, is currently in prison in his native Germany for raping a 72-year-old woman, and he had previously been jailed for sexually assaulting a six-year-old girl in a playground.
