At trial, Shane Lazenby demonstrated that James Harper, the 76-year-old tractor-trailer driver who died before the case went to trial, lied on his Federal Motor Carrier Safety Administration medical exam, took prescription narcotics four times a day, performed breathing treatments for COPD in his trailer and was regularly admitted to the hospital for pneumonia. In 2020, a Gainesville, Georgia jury returned a verdict in favor of Kip Holland's grieving family and awarded $21,029,363 in damages, litigation expenses, and attorney's fees.   Guest Bio: Shane Lazenby Shane Lazenby is the founder and managing member of Lazenby Law Group. After more than a decade of defending those accused of negligence in personal injury cases, Shane decided to reverse course and help the victims of serious injuries. With unparalleled compassion and limitless commitment, Shane quickly learned how much more rewarding and uplifting service as a victim's advocate can be. Shane now focuses his practice on helping the victims of catastrophic personal injury and the families whose loved ones have passed as a result of another's negligence. Shane received his law degree in 1999 at the Walter F. George School of Law at Mercer University in Macon, Georgia. While at Mercer, Shane was a member of the Moot Court Board and the Mercer Law Review where he served as the Eleventh Circuit Survey Editor. Shane also received his Bachelor of Arts degree in Political Science, with a minor in Latin, from Mercer in 1994. Following law school, Shane returned to the United States Army, where he served as a Judge Advocate with the 82d Airborne Division. Shane's service included duties as the Regimental Judge Advocate for the 505th Parachute Infantry Regiment, where he obtained a 100% conviction rate in the most active military justice jurisdiction in the United States Army. Shane was also selected to be the first Judge Advocate from the 82d Airborne Division to deploy to the Global War on Terrorism as counsel to the Commander of the 3rd Battalion, 505th Parachute Infantry Regiment in Kandahar, Afghanistan. Shane was then selected to be the Operational Law Attorney for the 82d Airborne Division Commander in Bagram, Afghanistan, where he served until returning home. In December 2010, Shane retired from the Georgia Army National Guard after 21 years of total military service with the Georgia National Guard, United States Army, and Army Reserve. Shane joined the military in 1989, first serving as a combat medical specialist. In 1993 Shane graduated from Officer's Candidate School and was commissioned as an Infantry Officer. Shane served as an Infantry Platoon Leader, Signal Platoon Leader, and Operations Officer with a Ranger-led, Airborne Long Range Surveillance Unit. He then returned to the active Army for his tour of duty as a Judge Advocate before transitioning into the Army Reserve. In the Army Reserve, Shane continued service as a Judge Advocate, but was then selected for Command as the Headquarters and Headquarters Company Commander for the 335th Signal Command. Thereafter, Shane transitioned back into the Georgia Army National Guard where he returned to his Infantry roots and became the Executive Officer of the 3-108th Cavalry Squadron; his retirement assignment. Shane's service awards include the coveted Ranger tab, the Master Parachutist Badge, the Air Assault Badge, and the Bronze Star for service in the Republic of Afghanistan during Operation Enduring Freedom. Shane's service as an Army Ranger also included competition in the LTG David E. Grange Best Ranger Competition in 2002. After his return from Afghanistan, Shane transitioned into private practice with a prestigious trial defense firm in Atlanta, Georgia, where he gained invaluable experience and growth alongside some of Georgia's finest defense and plaintiff attorneys. After deciding to depart big city life, Shane settled with his family in Gainesville, Georgia. In Gainesville, Shane continued honing his skills as a partner with a Gainesville firm specializing in the defense of physicians accused of medical malpractice. In his career, Shane has tried more than fifty cases to verdict. His extensive experience was noted when he was selected as an Atlanta Magazine Georgia Super Lawyer Rising Star in 2009, 2010, 2011, and 2012. Booth Middle School, was named the overall winner in the Cherokee County Water and Sewerage Authority's annual essay contest. The theme for this year's contest was "Imagine A Day Without Water," and Mikaela's winning essay, developed as an enrichment activity in her English literature and composition class, used a fictional story to emphasize the value of water and the importance of conservation. She received a $100 prize and a gift bag from the authority. Mikaela will be recognized by Superintendent Brian Hightower and the Cherokee County school board at their next meeting. Call 770.874.3200 for more info.  Back in a moment  Break: DRAKE – ESOG – HELLER LAW STORY 4: Calhoun National Guard Unit Activated for Deployment Soldiers from the Calhoun-based 1st Squadron, 108th Cavalry Regiment, part of the Georgia Army National Guard, are gearing up for an overseas deployment to Kosovo. Around 200 soldiers from the 108th have been activated from the unit's armories in Calhoun, Dalton, Cedartown, and Canton. The soldiers will undergo pre-deployment training at Fort Stewart, Texas, and Germany before arriving in Kosovo as part of the NATO Kosovo Force (KFOR) for a peacekeeping mission. The deployment is expected to last around eight months. A sendoff ceremony will be held on January 2, 2024, at the Calhoun campus of Georgia Northwestern Technical College. STORY 5: Apartment Complex Under Construction in Canton Madison Communities has begun construction on Madison Canton, a 252-unit apartment complex located near downtown Canton, Georgia. Situated at the intersection of Marietta Road and Jackie Moore Lane, the complex will feature a variety of amenities, including a clubhouse, fitness center, cyber lounge, and workspaces. Outdoor amenities include a pool and deck with grilling stations, a dog park, a dog wash, and pickleball courts. The units will have modern interiors with granite countertops, walk-in closets, full-sized washers and dryers, and private outdoor patios and balconies. The first units are expected to be complete in the second quarter of 2025.   Commercial: CHEROKEE CHAMBER - INGLES 9   STORY 6: Republican-Drawn Legislative Maps Come Under Fire The Georgia General Assembly's special redistricting session commenced with Democrats and watchdog groups criticizing Republican-backed proposed maps for the state House and Senate, claiming they are unfair to Black voters. Both maps aim to comply with a federal court ruling that declared previous maps violated the Voting Rights Act. Democrats argue that the proposed maps make unnecessary changes beyond the court order, while they have released an alternative map focusing on the specific districts identified in the court ruling. Critics also highlight extensive redrawing and incumbent pairings in the Republican-backed maps for partisan reasons. STORY 7: State Senate study committee recommends repealing CON law A committee in Georgia, comprising lawmakers, healthcare executives, and an insurance industry representative, has recommended repealing the state law governing hospital construction and medical services. The Senate Study Committee on Certificate of Need (CON) Reform believes that the decades-old CON law is hindering advances in healthcare delivery, especially in rural Georgia. The CON law, enacted in 1979 to reduce healthcare costs by avoiding duplication, requires applicants to demonstrate the need for a new medical facility or service in a community. The committee's recommendation for repeal or reform will now be considered by the full Senate during the 2024 legislative session. He had a long and impactful career, serving as an editor and conservative columnist at the Atlanta Journal and later at the Journal-Constitution. Wooten was known as the "voice of conservatives" at AJC and was actively involved in the GOP, offering his time and mentorship to young leaders. In addition to his journalism career, he served in the Georgia Army National Guard, retiring as a colonel. Later in life, he and his wife, Ann, restored an historic home and received an award from the Georgia Trust for Historic Preservation. A memorial service is scheduled for November 11. STORY 2: Mableton Mayor: 'Highly Likely' Citizens Will See Higher Natural Gas Prices The Mableton City Council is considering a 30-year contract with Austell Gas System, which could raise natural gas prices for residents. The contract is one of several franchise fee agreements being considered by Mableton with utility companies. The city collects franchise fees from utilities for using government rights-of-ways, and they are a significant source of revenue for the city. In this contract, Mableton would collect 3% of Austell Gas System's sales receipts, and the company is likely to pass that fee on to customers. The fees, though they may lead to higher utility costs, are necessary for a city that doesn't levy property taxes and require revenue to operate. STORY 3: MUST Ministries Opens Thrift Store in East Cobb MUST Ministries CEO Ike Reighard inaugurated the new MUST Marketplace thrift store in East Cobb. The thrift store was previously located in Marietta and has now moved to a 7,000-square-foot space in the Sandy Plains Village shopping center. The store offers various items, including clothing, books, kitchenware, Christmas decor, sports gear, and furniture. The revenue generated from the thrift store will be reinvested in MUST's programs to support those in need. We'll be back in a moment  Break: DRAKE – INGLES 5 – THE MARKET STORY 6: Former Chief Scientist at GA Tech Research Institute Led Scheme to Defraud Tech, CIA James G. Maloney, the former chief scientist at the Georgia Tech Research Institute, has been sentenced to nearly six years in federal prison for conspiring to defraud Georgia Tech and the CIA. He, along with two other scientists, conspired to charge personal expenses to a Georgia Tech credit card, engaged in outside consulting activity, and covered up their actions. Maloney, James J. Acree, and James D. Fraley III worked on projects funded by the U.S. Department of Defense, intelligence agencies, and private companies. Between 2007 and 2013, they used their positions to charge hundreds of thousands of dollars in personal expenses. Maloney was sentenced to five years and 10 months in prison and ordered to pay over $1.9 million in restitution. STORY 7: Richardson Ally Files Paperwork to Run For Cobb Commission Kevin Redmon, an ally of Democratic Cobb Commissioner Jerica Richardson, has filed paperwork to run for Richardson's seat on the Board of Commissioners. Redmon, who serves as the east Cobb liaison on Richardson's community cabinet, plans to run as a Democrat in District 2 in 2024. On his campaign website, he lists priorities like increased engagement, intentional budget planning, infrastructure modernization, smart planning for residential growth, and supporting local businesses. Redmon has previously worked for the political group For Which It Stance, which supported Richardson's "home rule" bid. Several Republicans have also expressed interest in running for the seat. Shane Lazenby from Lazenby Law Group joins us this week on Sports ‘N Torts. Shane is the founder and managing member of Lazenby Law Group. After more than a decade of defending injury cases to include medical malpractice, Shane decided to reverse course and help the victims of serious injuries. In her role, she co-leads the day-to-day operations of the SMVF TA Center, providing guidance on technical assistance tasks, developing tools and resources, collaborating with Federal partners, and providing technical assistance to states, territories, and local communities working to strengthen their behavioral health systems for SMVF. In the last three years, she has played a significant role in designing and coordinating the Governor's and Mayor's Challenge to Prevent Suicide Among Service Members, Veterans, and their Families Policy and Implementation Academy's. To date, there has been a total of 35 states and 18 communities that have accepted the challenge!  Ms. Galloway-Salazar is an Army Veteran and spouse to a retired combat veteran serving in law enforcement. Her years of military and professional experience have provided her with the knowledge and abilities to support the needs of the SMVF population. Some of her previous roles included serving as a state project director, a Veteran and Family Advocate, a trainer, a research manager in academia, a state behavioral health program coordinator for the Georgia Army National Guard, and a behavioral health treatment court liaison. In 2009, she assisted the state of Georgia with the development of jail diversion programming for Veterans, which aided in the growth of Veteran Treatment Courts. She also has experience bridging the gaps between criminal justice and behavioral health systems. With this knowledge, Ms. Galloway-Salazar has trained law enforcement and other criminal justice professionals on encounters with the mentally ill to include Veterans. Like what you heard? Biographies:Jillian (Jilly) Woody is a wife, friend, Brazilian Jiu Jitsu athlete and Los Angeles resident. She is currently serving as a Medical Service Corps Officer in the California National Guard and has been a “Ground Medical Evacuation Platoon Leader” for 18 months. She holds a B.S. degree in Kinesiology with an emphasis in Health Professions, and also has a Minor in Leadership Studies. She has a passion for people, justice and the need for quality leadership in every organization. Kristina Toscano was born and raised in Rockland County, NY with her parents and two siblings. She comes from a close knit Italian family who for the most part are all still located in the greater New York area. She received her undergraduate education in Athletic Training from Northeastern University in Boston, MA and her graduate education in Physician Assistant Studies from South University in Savannah, GA. She's currently living in Savannah, GA. She direct commissioned into the Georgia Army National Guard in December of 2018 about 6 months after graduating PA school. She's been lucky to be in several leadership positions from my undergraduate career and extending into her professional career. She was a resident assistant while at Northeastern University for 2 years; she was co-president of South University’s interviewing and mentorship club; she's been PL and class leader during both her DCC course and BOLC course respectively; and presently she's PL for her medical section in her National Guard unit. At trial, Shane Lazenby demonstrated that James Harper, the 76-year-old tractor-trailer driver who died before the case went to trial, lied on his Federal Motor Carrier Safety Administration medical exam, took prescription narcotics four times a day, performed breathing treatments for COPD in his trailer and was regularly admitted to the hospital for pneumonia. In 2020, a Gainesville, Georgia jury returned a verdict in favor of Kip Holland's grieving family and awarded $21,029,363 in damages, litigation expenses and attorney's fees.    Click Here to Read/Download the Complete Trial Documents   Guest Bios: Shane Lazenby Shane Lazenby is the founder and managing member of Lazenby Law Group. After more than a decade of defending those accused of negligence in personal injury cases, Shane decided to reverse course and help the victims of serious injuries. With unparalleled compassion and limitless commitment, Shane quickly learned how much more rewarding and uplifting service as a victim's advocate can be. Shane now focuses his practice on helping the victims of catastrophic personal injury and the families whose loved one has passed as a result of the negligence of another.   Shane received his law degree in 1999 at the Walter F. George School of Law at Mercer University in Macon, Georgia. While at Mercer, Shane was a member of the Moot Court Board and the Mercer Law Review where he served as the Eleventh Circuit Survey Editor. Shane also received his Bachelor of Arts degree in Political Science, with a minor in Latin, from Mercer in 1994.   Following law school, Shane returned to the United States Army where he served as a Judge Advocate with the 82d Airborne Division. Shane's service included duties as the Regimental Judge Advocate for the 505th Parachute Infantry Regiment where he obtained a 100% conviction rate in the most active military justice jurisdiction in the United States Army. Shane was also selected to be the first Judge Advocate from the 82d Airborne Division to deploy to the Global War on Terrorism as counsel to the Commander of the 3d Battalion, 505th Parachute Infantry Regiment in Kandahar, Afghanistan. Shane was then selected to be the Operational Law Attorney for the 82d Airborne Division Commander in Bagram, Afghanistan where he served until returning home.   In December 2010, Shane retired from the Georgia Army National Guard after 21 years of total military service with the Georgia National Guard, United States Army, and Army Reserve. Shane joined the military in 1989, first serving as a combat medical specialist. In 1993, Shane graduated from Officer's Candidate School and was commissioned as an Infantry Officer. Shane served as an Infantry Platoon Leader, Signal Platoon Leader, and Operations Officer with a Ranger-led, Airborne Long Range Surveillance Unit. He then returned to the active Army for his tour of duty as a Judge Advocate before transitioning into the Army Reserve. In the Army Reserve, Shane continued service as a Judge Advocate, but was then selected for Command as the Headquarters and Headquarters Company Commander for the 335th Signal Command. Thereafter, Shane transitioned back into the Georgia Army National Guard where he returned to his Infantry roots and became the Executive Officer of the 3-108th Cavalry Squadron; his retirement assignment. Shane's service awards include the coveted Ranger tab, the Master Parachutist Badge, the Air Assault Badge, and the Bronze Star for service in the Republic of Afghanistan during Operation Enduring Freedom. Shane's service as an Army Ranger also included competition in the LTG David E. Grange Best Ranger Competition in 2002.   After his return from Afghanistan, Shane transitioned into private practice with a prestigious trial defense firm in Atlanta, Georgia gaining invaluable experience and growth alongside some of Georgia's finest defense and plaintiff attorneys. After deciding to depart big city life, Shane settled his family in Gainesville, Georgia. In Gainesville, Shane continued honing his skills as a partner with a Gainesville firm specializing in the defense of physicians accused of medical malpractice. In his career, Shane has tried more than fifty cases to verdict. The citizen soldiers of the Army's National Guard component often lead different lives from their active duty counterparts. Geographically tied to their state units, they often live out their entire career in their home states spared of the constant moves the rest of the military endures. Guard units in years past have been overlooked for equipment modernization and training. But the wars that the United States has been involved in since 2001 have changed a great deal of those historic missteps. What once was a strategic reserve has now found itself with a much larger operational role. A BETTER PEACE welcomes Mike Flaherty and Pete Helzer, two graduates of the AY20 Resident Class of the Army War College, and guardsmen form Ohio and Oregon respectively. They join podcast editor Ron Granieri to discuss their experiences throughout their careers and during their time in Carlisle. Mike and Pete share what they learned during their academic year and what they hope their active duty counterparts may have learned about the National Guard. This was our first podcast episode conducted remotely during the pandemic as you'll hear noted in the intro. Dick Jonas served four years as an infantryman in the Georgia Army National Guard while attending Valdosta State College. He graduated in 1965 with a BS degree in Physics and Math. He entered the Air Force and received his commission through Officer Training School. In 22 years service he flew 3,000 jet fighter hours in the F-4 and the F-16. During 125 missions in Vietnam he earned the Distinguished Flying Cross with two oak leaf clusters and the Air Medal with 12 clusters. He recorded his first albums of military ballads in 1969, after returning from Vietnam. He retired from the Air Force in 1986 as a Lieutenant Colonel, and became an Aerospace Science Instructor in the Air Force Junior ROTC program.

Kennesaw, Ga. (Nov. 11, 2009) — A fly-in by an Army Blackhawk helicopter and the blessing of the flags highlighted Veterans Day ceremonies at Kennesaw State University. The event was sponsored by the KSU ROTC Club, the KSU Students in Free Enterprise Team and the KSU Veterans Club. “We invited all area veterans to join us to celebrate the Army’s Year of the Non-Commissioned Officer (NCO) and honor them for their dedication to training and leading soldiers beneath their rank,” said faculty adviser Gary B. Roberts, professor of management and entrepreneurship in the Coles College of Business and an Army veteran of Vietnam and Operation Desert Storm. In keeping with the NCO theme, Sgt. Maj. Meinrad Kuettel of the 78th Aviation Troop Command of the Georgia Army National Guard gave the keynote speech, after which all veterans were invited to the stage for recognition of their service. Finally, Rev. Keith B. Whitmore, assistant bishop of the Episcopal Diocese of Atlanta and a former Army chaplain, performed the blessing of the flags ceremony for those who brought an American flag.
