SEASON 3 EPISODE 101: COUNTDOWN WITH KEITH OLBERMANN A-Block (1:45) SPECIAL COMMENT: Trump fired the Chairman of the Joint Chiefs of Staff and replaced him with a junior officer he brought back from retirement whom HE claims once wore a MAGA cap in his presence. Then he fired the Judge Advocate of the army, the Judge Advocate of the Navy, and the Judge Advocate of the Air Force. What you have been told by news organizations – even ones that still have good reporters – that this is part of the Trump Racism Orgy. The fired Joint Chiefs Chairman Charles Q. Brown is black. The Chief of Naval Operations was a woman. Their identities are cover stories and red meat for the Trump cult. Trump looked at the top lawyers at the Army, Navy and Air Force, the ones who would tell him, no, you can’t have the Army shoot civilians, and you can’t have the Navy blockade Vancouver and Greenland and the Panama Canal, and you can’t bomb the next Democratic convention… and he fired them. At least six different reporters and commentators on the military beat said the same thing. Firing the Chairman of the Joint Chiefs is bad and a red flag. Firing the T-JAGS, the Judge Advocates, the lawyers who tell you when something you are going to do with the military is illegal… can mean only one thing… you are planning to do something with the military that is illegal. You fire the people who would SAY it’s illegal and replace them with people who would say it ISN’T illegal. There are degrees of nightmare ahead. They all amount to different versions of Trump's plot to permanently take over the government by using the military. B-Block (26:20) THE FIRING OF JOY REID: Yes, firing her is racist and maybe worse yes it is designed to keep out people who might think differently and it is designed to reward professional political salespeople like party chairmen and press secretaries. But most of all, since they also fired Alex Wagner, it means that four women of color have solo hosted prominent shows ON MSNBC and all four of them have now been fired. C-Block (58:00) SPORTSBALL CENTRAL: I could not have been more wrong about hockey's Four Nations Faceoff. But at least I wasn't as wrong as Wayne Gretzky, now under deserved attack in Canada as a remorseless Trumpist, and rapidly becoming The Man Without A Country. Today we were thrilled to welcome back Erik Milito, President of the National Ocean Industries Association (NOIA). Erik has served as President of NOIA since 2019 following 17 years in several leadership roles at the American Petroleum Institute and prior experience as an attorney in the Solicitor's Office of the US Department of the Interior. Erik served on active duty in the US Army as a Judge Advocate from 1995 to 2000 and continued his service in the US Army Reserve from 2000 to 2004. NOIA's mission is to advance and promote the interests of the offshore oil, gas, wind and ocean minerals industries. We last hosted Erik on COBT in April 2021 (episode linked here) and were excited to reconnect for an update on offshore activity. In the discussion, Erik provides an overview of the NOIA's role to promote favorable policies related to offshore leasing, permitting, and regulation covering all flavors of energy including oil and gas, wind, carbon capture and storage and minerals. We start the conversation with Erik reminding us of the importance of the Gulf of Mexico as a booming region for the country and then dig into the challenges of offshore wind as an emerging sector. We cover the fascinating contrast of lease sales in the current administration compared to historical numbers. As the episode title mentions, this will be the first year since 1958 without a single federal offshore lease sale. We touch on advances in technology as current operations explore deeper depths / higher pressures in recent years, and we dig into how Erik sees the offshore wind industry developing from the services standpoint over the next couple of years. We also cover the complex issues around insurance and decommissioning platforms. We move on to discuss the positive relationship with the fishing industry and the significant role that the coastal state governments play in the world of the NOIA. Erik shares his perspective on Washington DC, the current climate given the election, and his sense of the public's mood and attitude towards the various sources of energy that the NOIA is involved in. We wrap up the discussion by getting Erik's thoughts on the progress of carbon capture over the last few years and the slower pace of offshore versus onshore CO2 projects and he urges that more progress would be possible with the cooperation of the government around permitting and regulatory support. We end the discussion with the areas that Erik is most optimistic about for the NOIA's membership which includes opportunities in the Gulf of Mexico. It was a fantastic conversation. Thanks to Erik for joining us! Mike Bradley opened the conversation by highlighting that trading in markets last week could be summed up briefly in two words: “volatility & reversal”. On the bond market, he highlighted that the 10-year bond yield was trading modestly lower due to a cooler-than-expected PPI. He also noted that this was a heavy economic reporting week with July CPI set to report on Wednesday and Initial Jobless Claims & Retail Sales on Thursday. On crude oil, he highlighted that WTI price was down ~$2/bbl. on Tuesday due to monthly reports from the IEA & OPEC showing minor 2024 demand reductions. He noted that despite these two demand datapoints that WTI still rebounded by ~$6/bbl. over the 5+ trading days due to improving technicals (WTI price back above its 50/100 day moving averages) and growing supply concerns (potential Iranian retaliation against Israel & Ukrainian incursion into Russia). He rounded out the conversation by highlighting that 3mo rolling forward copper prices have declined over the last 4-5 weeks (~$10.5k/MT down to ~$9k/MT) due to continued global demand concerns and elevated LME Copper inventories. At trial, Shane Lazenby demonstrated that James Harper, the 76-year-old tractor-trailer driver who died before the case went to trial, lied on his Federal Motor Carrier Safety Administration medical exam, took prescription narcotics four times a day, performed breathing treatments for COPD in his trailer and was regularly admitted to the hospital for pneumonia. In 2020, a Gainesville, Georgia jury returned a verdict in favor of Kip Holland's grieving family and awarded $21,029,363 in damages, litigation expenses, and attorney's fees. Guest Bio: Shane Lazenby Shane Lazenby is the founder and managing member of Lazenby Law Group. After more than a decade of defending those accused of negligence in personal injury cases, Shane decided to reverse course and help the victims of serious injuries. With unparalleled compassion and limitless commitment, Shane quickly learned how much more rewarding and uplifting service as a victim's advocate can be. Shane was also selected to be the first Judge Advocate from the 82d Airborne Division to deploy to the Global War on Terrorism as counsel to the Commander of the 3rd Battalion, 505th Parachute Infantry Regiment in Kandahar, Afghanistan. Shane was then selected to be the Operational Law Attorney for the 82d Airborne Division Commander in Bagram, Afghanistan, where he served until returning home. In December 2010, Shane retired from the Georgia Army National Guard after 21 years of total military service with the Georgia National Guard, United States Army, and Army Reserve. Shane joined the military in 1989, first serving as a combat medical specialist. In 1993 Shane graduated from Officer's Candidate School and was commissioned as an Infantry Officer. Shane served as an Infantry Platoon Leader, Signal Platoon Leader, and Operations Officer with a Ranger-led, Airborne Long Range Surveillance Unit. He then returned to the active Army for his tour of duty as a Judge Advocate before transitioning into the Army Reserve. In the Army Reserve, Shane continued service as a Judge Advocate, but was then selected for Command as the Headquarters and Headquarters Company Commander for the 335th Signal Command. Thereafter, Shane transitioned back into the Georgia Army National Guard where he returned to his Infantry roots and became the Executive Officer of the 3-108th Cavalry Squadron; his retirement assignment. Shane's service awards include the coveted Ranger tab, the Master Parachutist Badge, the Air Assault Badge, and the Bronze Star for service in the Republic of Afghanistan during Operation Enduring Freedom. Shane's service as an Army Ranger also included competition in the LTG David E. Grange Best Ranger Competition in 2002. After his return from Afghanistan, Shane transitioned into private practice with a prestigious trial defense firm in Atlanta, Georgia, where he gained invaluable experience and growth alongside some of Georgia's finest defense and plaintiff attorneys. After deciding to depart big city life, Shane settled with his family in Gainesville, Georgia. “Thinking Inside the Box” brings you interviews with the United States Army's experts in combined arms maneuver, the Observer Coach Trainers (OC/Ts) of Operations Group, at the National Training Center (NTC), Fort Irwin, California. While the Army focused on counterinsurgency, we had the luxury of taking time to make decisions, but large-scale combat operations will not afford this indulgence. Appropriately delegating decision-making authority allows leaders closer to a problem to make decentralized, rapid decisions rooted in the principles of mission command. Codifying who can make decisions prevents staff and subordinates waiting on a time sensitive action, because they are not sure if they are empowered to take action. Thinking through delegating decisions before arriving at the National Training Center will produce payoffs for commanders who understand when and where they must be present to make the essential decisions they can make. By defining who can make decisions, units will understand the systems needed to support making those decisions in various command posts, allowing effective dispersion of command posts to increase survivability. To discuss how to delegate decision making, we interviewed two members of our Bronco Team, our senior brigade trainer, LTC Adam Latham, and our senior Judge Advocate trainer, MAJ Timothy Davis. Shane Lazenby from Lazenby Law Group joins us this week on Sports ‘N Torts. Shane is the founder and managing member of Lazenby Law Group. After more than a decade of defending injury cases to include medical malpractice, Shane decided to reverse course and help the victims of serious injuries. Shane'sfirm is in Gainesville, GA and he considers himself a small town lawyer – but who gets the results of big city lawyer. By way of an example, Shane is a record holder for largest jury verdict in Georgia history against a tractor trailer company in a wrongful death case in his region. We talk about the facts of his $21M verdict, why it was such an important case to him and the lessons learned in “dirt work” that led to that result. Following law school, Shane returned to the United StatesArmy where he served as a Judge Advocate with the 82d Airborne Division. Shane's service included duties as the Regimental Judge Advocate for the 505th Parachute Infantry Regiment where he obtained a 100% conviction rate in themost active military justice jurisdiction in the United States Army. Shane was also selected to be the first Judge Advocate from the 82d Airborne Division to deploy to the Global War on Terrorism as counsel to the Commander of the 3d Battalion, 505th Parachute Infantry Regiment in Kandahar, Afghanistan. Shane was then selected to be the Operational Law Attorney for the 82d Airborne Division Commander in Bagram, Afghanistan where he served until returning home. In December 2010, Shane retired from the Georgia ArmyNational Guard after 21 years of total military service with the Georgia National Guard, United States Army, and Army Reserve. Shane joined the military in 1989, first serving as a combat medical specialist. In 1993, Shane graduated from Officer's Candidate School and was commissioned as an Infantry Officer.Shane served as an Infantry Platoon Leader, Signal Platoon Leader, and Operations Officer with a Ranger-led, Airborne Long Range Surveillance Unit. He then returned to the active Army for his tour of duty as a Judge Advocate before transitioning into the Army Reserve. Shane's service as an Army Ranger also included competition in the LTG David E. Grange Best Ranger Competition in 2002. The Army Directive was so impactful, she received a coin of excellence from the Secretary of the Army for her contributions. During her career, Dominique has served in a variety of leadership positions including HHC Company Commander, executive officer, BN S3 OIC, and BN S1 OIC. Dominique also graduated as the Honor Graduate of her AG Captain Career Course in April 2017. Dominique is supported by her amazing husband, Aaron, and her toddler Ariana.Terace Garnier “The first Pentagon Correspondent for “Newsy,” Terace also worked for Fox New's DC bureau. Garnier enlisted in the Air Force in 2010, as a Broadcast Journalist. As such, she produced, shot and anchored news stories. Terace earned a Masters degree in Broadcast and Digital Journalism, from Syracuse University. She makes time for community service: fund-raising pageant-scholarship money, mentoring women, and raising money for vaccines for underprivileged children.
