It was the referendum Anthony Albanese promised to hold at the last election, but pretty much all the opinion polls suggest that when Australians cast their votes, it will be a resounding “No” to an Indigenous Voice to Parliament.  The Voice would act as an independent advisory body to the government for First Nations people, but the proposed change to the Constitution has led to a divisive and heated debate.  Today, ABC reporter Isabella Higgins on why Yes campaigners still see a glimmer of hope and what to expect when you wake up the morning after the vote.   Featured:  Isabella Higgins, ABC reporter

Inflation is coming down.  The spokesperson from the bosses pamphlet on Insiders continued to recite the neo-liberal mantras of higher rates, more unemployment and lower wages but Ben outlines how Jim Chalmers and Labor are implementing a neo-Keynesian approach that is bringing down prices, keeping people in work and supporting those most in need. Workplace reforms are coming to parliament to stop the multi-billion dollar loopholes that see labour hire workers paid less, forced casualisation of millions of people and profiteering at working people's expense.  There's a union for every worker, casual, labour hire, teacher, miner, nurse, graphic designer and you can join at australianunions.org.au/wow The Housing Affordability Future Fund is coming back.  With $1,300,000 a day NOT going into housing because of the Greens back Dutton's Noalition Labor is ready to set up a double dissolution trigger. The Voice.  Greg Sheridan can go on Insiders to say that Dutton isn't racists if the referendum fails but if all the racists are voting NO does it matter if he considers himself to be racist?  Ben argues you pick a side.  No has Pauline Hanson and Andrew Bolt.  Yes has Marcia Langton and Noel Pearson.  Which side are you on? She has been a fighter for rights and progress for Indigenous Australians for decades, and she's one of those at the centre of the yes campaign for the Voice. Her own voice is always forthright and formidable. Langton admits she isn't “entirely confident” where the referendum stands at the moment but is more positive as the debate continues. “I've been gauging the response of the general public by reading a lot and having a look at the social media, and I think most people can see that this is a very simple and modest proposition and that it will make a difference. And what I'm seeing more and more is most people realising, yes, well, why don't Indigenous people have a say about policies and the laws that affect them? "They realise when they think about it that this has gone on for too long, where all of these laws and policies that seem to be universally ineffective in closing the gap, and causing more suffering, have been imposed on us by non-Indigenous people. […] I think most people are still very embarrassed about the Northern Territory intervention initiated by John Howard.”

The Albanese government has released the draft wording for enshrining an Indigenous Voice to parliament in the constitution. Anthony Albanese is making a referendum a priority but history tells us how hard these are to pass. Tom Calma, Chancellor of the University of Canberra, has been a leading participant in Indigenous affairs for many years. He and professor Marcia Langton prepared a report for the Morrison government on the Voice. They recommended a Voice structure involving local and regional levels as well as the national level. The Albanese government has not spelled out a detailed model for the Voice it proposes, but the extensive consultations Calma and Langton undertook produced insights that will help shape the conversations ahead. “We've got to understand that when we talk about the Voice through referendum changes to the Australian constitution, [it] is only about Commonwealth legislation and not about state and territory legislation,” Calma tells the podcast.   He says during the consultation process, people said “we support a national voice, but don't forget us at the local and regional level, because that's where all the action takes place”. “When we look at education, employment, health service delivery, all of that takes place under a state or territory jurisdictional level, supplemented by funding from the Commonwealth. It's administered through the states and territories by and large.” Calma says regional groups could “do the canvassing of the membership and push that up to the national-level voice”. “There needs to be these other regional level arrangements and all the [federal] government needs to do is to agree to that – and then the dialogue can start with the states and territory governments to build up what form it might take. "But none of this is coming out cold because in every state and territory, they've already got some form of arrangement. And this is really about saying, how do we maximise the impact of the current arrangements, give them a secretariat, give them some guidance and support and make it an inclusive body?”. The proposed Voice, Calma stresses, “is about giving an Aboriginal and Torres Strait Islander person's perspective on that new legislation. But it has no other authority to veto or to direct politicians on how to think. This is only an advisory body and to make comment, so we have formal input by Aboriginal Torres Strait Islander people into legislation that most affects us.” Calma says Aboriginal and Torres Strait Islander people “don't always speak with the same voice and we all have different experiences, we represent different demographics and so forth.” He rejects the argument that a Voice isn't needed because there are 11 Indigenous members of the federal parliament. “We can't expect that the elected politicians […] are going to be able to give a view for all Aboriginal or Torres Strait Islander people.” “What we envisage is that the Voice […] will be able to work with the bureaucrats in providing Aboriginal and Torres Strait Islander perspective to bills, so that by the time [legislation] reaches parliament a lot of the issues might already be sorted out […] Once that relationship with Commonwealth agencies and departments starts to mature, hopefully those departments and agencies will work with the Voice group to look at their existing policies and programmes.” “The Voice would not be usurping the role of any existing organisation. It would be about partnership, it's about capacity development, it's about inclusion.” “I'm very confident that we could work cooperatively with the parliaments of the day - and that's both the federal and the state and territory parliaments - for the betterment of Aboriginal and Torres Strait Islander people”.

When historian Mark McKenna set out to write a history of Uluru, he had no idea where the story would take him. Researching the shooting death of an Aboriginal man by policeman Bill McKinnon, Mark uncovered shocking evidence that was typical of Australian frontier justice, and astonishing in its contemporary resonance. With support from the families of key individuals, and the assistance of South Australian Museum, Mark uncovered critical new evidence, and Return to Uluru became a true crime story of the most explosive kind, and an important exploration of what truth telling and reconciliation means in practice. No one has a monopoly on truth when it comes to the past and present lives of Australia’s Indigenous peoples. Conservatives tend to deny that Indigenous peoples should have special status in the Constitution. Progressives tend to turn a blind eye to the profound dysfunction that plagues so many Indigenous communities – and refuse to accept that Indigenous people want and deserve all of the benefits of the modern world. Marcia Langton is a fearless truth-teller who challenges the dangerous orthodoxies of a society that seems incapable of making peace with the truth of its own past.

The Thea Astley Address, named in honour of one of Australia's most influential and distinctive novelists, has been presented annually at the Byron Writers Festival since 2005 - by some of Australia's best writers and most interesting minds. This year, we add to the prestigious list Professor Marcia Langton, one of our country's most important voices for Indigenous Australia. The 2020 Thea Astley Address, entitled Black Lives Matter, is supported by The Conversation and the Copyright Agency's Cultural Fund. In this powerful address, Marcia Langton explores how Black Lives Matter in Australia, through history, in the present and for our future. She takes us back to the death of Mulrunji, or Cameron Doomadgee, in custody on Palm Island in 2004, and the subsequent failure of the police and the criminal justice system to deliver justice for the deceased and his family. Langton tracks many similar cases, shining a light on the crisis in which we find ourselves as a nation, and demands the implementation of long-overdue recommendations from the 1987 - 1991 Royal Commission into Aboriginal Deaths in Custody.

It was Melbourne Cup day in Tim's hometown while Diewue had Guy Fawkes night crackers going on in Auckland. But the government business of day continued which we also get into on the weekly episode of Trans Tasman Talk. The Nup to the Cup animal welfare campaign gained growing support this year after ABC’s 7.30 program showed evidence of retired race horses being abused before being slaughtered. The cup has also become known for the drunken and slothful behaviour of the attendees, all while they attempt to act as members of high society. NZ’s Justice Minister, Andrew Little, has been accused of establishing a Ministry of Truth over the euthanasia referendum that he says will combat “misinformation”. Both sides of the debate have criticised it harshly. NZers will likewise get to vote on legalising weed at the next general election. For a change, both will be binding. Australia is still deciding on the wording for its next referendum to amend the Constitution to recognise aboriginal peoples, and the appointment of Aboriginal academic and twitter rager Marcia Langton to an advisory position has raised plenty of eyebrows. In New South Wales “pregnant people” can get abortions, but that debate is also raging in New Zealand with feminists clashing with trans-activists on the need for “inclusive” wording around who should be allowed to kill their babies. The current bill still refers to pregnant women. The usual Marxist groups have continued protesting coal mining in Australia, with Scott Morrison responding by proposing a ban on secondary boycotts. The ABC interviewed a woman who wants to kill a million men to destroy the patriarchy. The Hong Kong protests in Auckland saw a group of foreign students in PLA uniforms goose-step down the road with the Chinese flag. “Antifa” was nowhere to be seen when faced by the presence of actual fascists. The PLA Navy has a warship docked in Wellington to training exercises in the Cook Strait. In Australia, there have been talks of removing welfare from those prosecuted in violent protests, and the New Zealand National Party has adopted a “no jab, no pay” stance for parents and wants to remove welfare from gang members who can’t prove they have no other income. National has selected a former Air NZ CEO, Christopher Luxon, to run in Botany — a safe National seat currently held by a defector. NZ First MP Shane Jones features weekly on the show due to his controversial comments and actions. This week he told immigrants to “get on the next plane home” if they didn’t like NZ’s immigration policies. The government has recently tightened the requirements for Partner Visas and the Indian community has complained it’s racist against arranged marriages. A 2-minute video of Jacinda’s Ardern’s accomplishments, in 2 years of her government has been produced, most of which involved spending more money or claims that were not entirely true. In Australia, the inquiry into historic abuse in aged care has wrapped up with solution deemed more taxpayer funds being spent. Scott Morrison was also at a summit in Asia and claimed that Australia and China would not attempt to interfere in each other’s domestic policies — a promise that may not be kept by either side.
