John is joined by Michael Gottlieb, partner in the Washington D.C. office of Wilkie Farr & Gallagher, and Nicholas Reddick, partner in the San Francisco office of Wilkie Farr & Gallagher. They discuss the landmark $1.1 billion judgment Michael and Nicholas obtained against the Islamic Republic of Iran, on behalf of U.S. service members and civilians harmed by Iran-backed terrorist groups and the legal framework for suing state sponsors of terrorism and private organizations that support them. Claims against sovereign states are based upon the Foreign Sovereign Immunities Act (FSIA). FSIA claims require plaintiffs to prove that the foreign sovereign materially supported acts of terrorism, often through militia groups operating in conflict zones. The process is complex and time-consuming. Although Iran never appears to defend these cases, plaintiffs must still prove liability and damages with admissible evidence, often obtained through Freedom of Information Act requests, military reports, and expert testimony. Because such judgments are rarely enforceable against Iran's frozen or inaccessible assets, successful plaintiffs must seek compensation through the U.S. Victims of State Sponsored Terrorism Fund, which draws from congressional appropriations and settlements from unrelated sanctions violations. Payments from the fund are made annually and prorated based on judgment size, but disbursements have been inconsistent. Recent developments, including circuit court rulings and a pending Supreme Court case, may reshape key legal standards for FSIA claims, such as the requirement of an actual death for certain terrorism-related claims. Several new legislative efforts seek to expand the cases that may be brought under the FSIA and increase the funds allocated for compensating victims. Claims against private entities such as banks, contractors or companies that evaded sanctions rely upon the Anti-Terrorism Act (ATA). Many such cases are currently being litigated. ATA claims require proof of the defendant's material support and knowledge of terrorist outcomes. The defendants in ATA cases are likely to appear to defend against the claims, but only after the plaintiffs navigate complex issues of jurisdiction and service of process.Podcast Link: Law-disrupted.fmHost: John B. If you could have a conversation with yourself back when you started your career in healthcare, what would you say? Or how to approach one's naivete as it comes up in their career? Consider where you're at today in your career. Would you be willing to talk to yourself about owning your naivete? After 12 years of working in a large hospital setting, in outpatient mental health and substance use disorders clinics, I can admit that I naively behaved and spoke as though I was exempt from the stressors of life, and the stressors on the job. I was naïve to how things would eventually start to breakdown in my personal life. Which they eventually did. Some of the breakdowns were preventable, but my naivete interfered with seeing clearly. Their discussion covers how AIDs was found to be a new clinical entity, what factors may have lead to the discovery of COVID-19 as a new clinical entity, how the delay and/or lack of information from politicians affects public health, as well as what we as a medical community and society can learn about the HIV and AIDS epidemic that might be applicable to the current pandemic. Dr. Michael Gottlieb, a physician and immunologist, who is credited with identifying AIDS as a new disease in 1981. Dr. Gottlieb is a graduate of Rutgers University and the University of Rochester School of Medicine and was a post-doctoral fellow in Immunology at Stanford University. The COVID-19 pandemic requires a substantial change to the traditional approach to conference didactics. Switching to a virtual medium for conference sessions presents several challenges, particularly with regard to aspects that rely heavily upon in-person components (e.g., simulation, ultrasound). Over the past year there has been a small bit of controversy regarding the best way to make sure that we aren’t causing iatrogenic infections when placing ultrasound-guided IV’s. To be honest, I took it for granted that tegaderms should be used when we do this potentially life-saving procedure. Recent posts from ALiEM and EMRAP made me question the utility of these adhesive barriers. After much research, it turns out that tegaderms are probably perfectly fine to use. Climate change is a massive issue on the national agenda but also particularly topical with its connection to natural disasters and in turn it’s affect on insurance claims. Insurance companies and all business alike have an obligation to make changes, whether big or small to counteract climate change and reduce greenhouse gas emissions but also to prepare communities for the worst. And how will digital disruption and AI impact big business and small businesses alike? Artificial intelligence and digital transformation are predicted to have an impact on insurance and it’s related technologies, from distribution to underwriting and pricing to claims. While small businesses may not think that AI is relevant to them, they should think again. A study by Pegasystems showed that only one third of people have used AI, while in actuality 77% have already implemented it – most commonly though an AI powered device.
