This Day in Legal History: The Embargo Act On this day in legal history, December 22 marks the passage of the Embargo Act in 1807, a significant legislative maneuver influenced by President Thomas Jefferson. This act emerged against the backdrop of the Napoleonic Wars in Europe, a tumultuous period marked by widespread conflict and political upheaval. Jefferson, keen on maintaining American neutrality and avoiding the perils of war, saw the Embargo Act as a strategic tool to prevent American involvement. The Act prohibited trade with all foreign nations, a sweeping measure aimed at deterring any actions that could entangle the United States in European conflicts. It represented a bold assertion of American sovereignty, illustrating a preference for isolation over the potential risks of international engagement. The law was designed to leverage American trade as a means of peacekeeping, hoping that economic pressure would encourage European powers to respect American neutrality. However, the Embargo Act's broad scope led to significant challenges in enforcement. Its restrictions created substantial economic hardships, particularly for American merchants and sailors who relied heavily on international trade. The Act inadvertently harmed the very citizens it aimed to protect, leading to widespread criticism and opposition. The economic repercussions were immediate and severe, sparking significant distress in the maritime economy, especially in the New England states. The law not only disrupted commerce but also instigated a rise in smuggling and illicit trade, as merchants sought to circumvent the restrictions. This unintended consequence highlighted the difficulties in enforcing such an extensive trade ban.The political fallout from the Embargo Act was also notable. It fueled domestic tensions, exacerbating regional divides and contributing to a growing discourse on states' rights and federal power. The Act became a focal point of political debate, with Jefferson's opponents using it to question the wisdom and efficacy of his administration's policies.Recognizing the impracticality and unpopularity of the Embargo Act, the U.S. government moved to replace it with the Non-Intercourse Act in 1809. This new legislation was a more targeted approach, specifically barring trade only with France and Great Britain, the primary belligerents in the European conflicts. The Non-Intercourse Act sought to address the deficiencies of its predecessor, aiming for a more sustainable balance between diplomatic caution and economic necessity. In retrospect, the Embargo Act of 1807 stands as a testament to the complexities of foreign policy and the challenges of balancing national interests with global engagement. It reflects an era of American history where isolationism and neutrality were key themes in the nation's approach to international affairs. Despite its shortcomings, the Act is an important chapter in the legal and political history of the United States, illustrating the ongoing struggle to navigate the treacherous waters of international relations. Paul, Weiss, Rifkind, Wharton & Garrison has signed the largest commercial lease in the U.S. this year, committing to a 20-year agreement for 765,000 square feet across 18 floors at 1345 Avenue of the Americas in Midtown Manhattan. This move is part of a broader trend in New York City, where law firms, alongside the financial sector, have been notably active in expanding their office spaces, as evidenced by a significant increase in the proportion of leases being expansions compared to the previous year. The firm's move, leaving its nearly 30-year-old location at 1285 Avenue of the Americas, reflects the growing dynamism and spatial demands of law firms in the city.Paul Weiss NYC Move Is Largest Commercial Lease in US This YearSupreme Court Justice Clarence Thomas is facing increasing calls for recusal from cases involving former President Donald Trump's attempts to overturn the 2020 election results, particularly in light of his wife's active participation in challenging the election. These calls have intensified as pivotal Jan. 6-related cases approach the Supreme Court. The new Supreme Court code of ethics, which emphasizes a justice's need to recuse if their impartiality might reasonably be questioned, particularly when a justice's spouse is significantly involved in a case, adds weight to these requests.Justice Thomas, appointed by former President George H. W. Bush, is known for his reluctance to bow to criticism. However, the involvement of his wife, Virginia Thomas, in efforts to overturn the 2020 election, including her presence at the pro-Trump rally before the Jan. 6 Capitol attack and her correspondence with Trump's former Chief of Staff, raises serious concerns about his impartiality. Despite these concerns, Thomas has not publicly addressed his wife's involvement and has not responded to requests for comment.Democratic lawmakers, including Senator Richard Blumenthal and several House Democrats, have urged Thomas to recuse himself, citing the potential conflict of interest. The situation is unprecedented, with significant implications for Trump's eligibility for the 2024 presidential race and the broader question of presidential immunity from prosecution. While some Democratic senators have expressed concern, Thomas's supporters argue that his recusal is unnecessary. Notably, Thomas recused himself from one Jan. 6 case involving former Trump adviser John Eastman, but has otherwise shown resistance to recusal demands. The situation remains tense, with concerns about the impact on democracy and the integrity of judicial proceedings.Supreme Court's Thomas Faces Recusal Calls in Trump Jan. 6 CasesRudy Giuliani, the former Mayor of New York, has filed for bankruptcy following a $148 million judgment against him in a defamation case involving two former Georgia election workers. Giuliani, renowned for his leadership after the 9/11 attacks and later as former President Donald Trump's lawyer, claimed assets between $1 million and $10 million against liabilities of $100 million to $500 million. This bankruptcy filing comes amid his criminal charges in Georgia and is seen as a strategy to appeal the penalty and manage other debts.Giuliani's spokesperson argued that the punitive amount was beyond his capacity to pay. The bankruptcy process typically allows for debt reorganization or elimination, but in this case, it might not absolve Giuliani of the defamation penalty due to the nature of his conduct, which judges have deemed "willful and malicious." The defamation case arose from Giuliani's false accusations of election fraud against Wandrea "Shaye" Moss and her mother, Ruby Freeman, leading to severe threats against them.Despite admitting to defamation in court, Giuliani continued making these claims, resulting in a second lawsuit from Moss and Freeman. A federal judge has ordered immediate payment to the plaintiffs, citing risks of Giuliani concealing assets. The bankruptcy filing lists several creditors, including Hunter Biden and Noelle Dunphy, the latter suing Giuliani for sexual assault, harassment, and wage theft.Apart from personal liabilities, Giuliani faces lawsuits from Smartmatic and Dominion Voting Systems for claims about vote flipping in the 2020 election. His law license has been suspended in New York, and he faces disbarment in Washington. The bankruptcy filing is a significant turn in Giuliani's career, from being Time magazine's Person of the Year in 2001 and a Republican presidential candidate to facing multiple legal and financial challenges.Giuliani seeks bankruptcy after $148 million judgment in defamation case | ReutersDonald Trump's recent promise to reintroduce Schedule F, an executive order granting him the power to overhaul the federal workforce, has sparked significant opposition from unions, Democrats, and watchdog groups. They fear this move would enable Trump to replace tens of thousands of government civil servants with loyalists and implement his far-right policies, should he win the 2024 presidential election. This plan is seen as a step towards politicizing the federal bureaucracy and potentially steering it towards autocracy. In response, opponents are gearing up for legal challenges and strategic preparations. The Biden administration is considering a rule change that would make it harder for Trump to reintroduce Schedule F by allowing federal employees to retain their employment protections even if their job classifications change. This rule, expected by spring 2024, could delay but not entirely block Trump's efforts.Currently, presidents can appoint thousands of political appointees, but the career civil service, consisting of about two million workers, remains unaffected. Schedule F would change this, enabling the firing of up to 50,000 civil servants. Legal fights are anticipated, with unions and watchdogs ready to sue Trump if he follows through on his promise. The National Treasury Employees Union previously sued Trump over this issue, and groups like the American Federation of Government Employees are prepared to litigate again.Trump's supporters, including some conservative judges, argue for broad presidential powers to fire government workers. Trump has used his campaign rallies to promise an overhaul of the "deep state," a term used by conspiracy theorists to describe a supposed clandestine network within the government. He has vowed to pass reforms allowing the president to fire any executive branch employee.Other Republican presidential candidates, such as Florida Governor Ron DeSantis and entrepreneur Vivek Ramaswamy, support similar policies. Critics like U.S. Senator Chris Van Hollen are actively working to protect government workers from such potential actions, emphasizing the need to safeguard the government from being used to advance personal agendas or vendettas.Trump plan to gut civil service triggers pushback by unions, Democrats | Reuters Get full access to Minimum Competence - Daily Legal News Podcast at www.minimumcomp.com/subscribe

Special Counsel Jack Smith Forced to Withdraw Subpoena in Trump Jan 6th Trial

L ast week, reports emerged suggesting that Special Counsel Jack Smith's investigation into alleged election fraud subsequent to the 2020 Presidential election might be reaching its conclusion, taking the heat off of former President Donald Trump. People familiar with the proceedings revealed to The New York Times that Smith seems to gradually lessen his inquiry into the possibility that Trump's campaign may have financially deceived supporters by spreading unverified election outcomes. According to two anonymous sources, Smith's investigative team has discreetly revoked a subpoena that initially demanded record access from Trump's 2020 campaign. The move is part of their larger probe intended to find out if Trump's political and fundraising teams bent or broke any rules in an attempt to retain power after losing the Presidential race. Highlighting the development, The New York Times observed, 'The special counsel's office under Jack Smith made a decision at the start of the week to essentially nullify the subpoena served to the Trump campaign. This follows a similar subpoena withdrawal from Save America, Trump's political action committee established shortly after conceding the 2020 race.' The media outlet further added that this suggests an imminent wrap-up or termination of this segment of Smith's inquiry, which is focused on whether or not laws were breached by Trump's allegations of the 2020 election being rigged to fundraise. The investigations revolved around both the Donald J. Trump for President Inc. and the Save America PAC. Credit for the initial reporting about the subpoena withdrawal from Save America was given by The Times to The Washington Post. The claims by Trump's political operation, which brought in close to $250 million, were centered around controversial notions that the 2020 election results were manipulated, despite no credible evidence to support such allegations.See omnystudio.com/listener for privacy information.

Two of these indictments — Special Prosecutor Jack Smith's in D.C. and District Attorney Fani Willis's Fulton County, Georgia — take up Trump's and his co-conspirators efforts to steal the 2020 election, efforts that culminated with the insurrection on January 6. In this episode, Matt and Sam try to make sense of them and weigh the possible risks and rewards of "breaking the seal" and criminally charging a former president. In particular, they give closes readings to the two January 6-related indictments and discuss what they reveal about the deranged efforts Trump and his team made to overturn the election and a Republican Party that seemed to mostly go along with it, along with some of the problems with the RICO statute Trump and others are being charged under in Georgia. And of course, these indictments came down just as we're entering presidential election season — how will Trump's legal problems effect the 2024 race?Sources:Charlie Savage and Adam Goldman, "The Trump Jan. 6 Indictment, Annotated," NYT, Aug 1, 2023Alan Feuer, et al, "The Trump Georgia Indictment, Annotated," NYT, Aug 15, 2023Charlie Savage, "The Four Trump Criminal Cases: Strengths and Weaknesses," NYT, Aug 28, 2023James Risen, "In Trump's Georgia Indictment, a Tale of Two Election Workers," The Intercept, Aug 17, 2023Rick Rojas and Sean Keenan, "Dozens of ‘Cop City' Activists Are Indicted on Racketeering Charges," NYT, Sept 5, 2023Laurence Tribe, "Anatomy of a Fraud," Just Security, Aug 8, 2023Matthew Sitman, "Will Be Wild," Dissent, Spring 2023Damon Linker, "How Do You Solve a Problem Like Trump?" The biggest impact of the House Select Committee to Investigate the January 6 Attacks was on public understanding to realize that it wasn't just a single day, says Luke Broadwater, a Congressional reporter in the Washington bureau of The New York Times.  Broadwater has written hundreds of articles covering the causes and consequences of the January 6, 2021 attacks on the U.S. Capitol and the House Select Committee's investigation.  Prior to joining The Times, Luke worked for nearly a decade at The Baltimore Sun, where he covered the Maryland State House and Baltimore City Hall. He broke a story last year about a self-dealing scandal at the state's largest hospital system that resulted in the resignation of Baltimore's mayor and top hospital officials and the passage of sweeping reform legislation. That series of investigative articles won the 2020 Pulitzer Prize for local reporting and a George Polk Award for political reporting. The Todd Herman Show

THE THESIS: Facebook is an adjunct of government, in service of The Party.  THE SCRIPTURE & SCRIPTURAL RESOURCES:  We are living in a time of universal deceit. People have turned against God's Word in every conceivable fashion. In their rebellion, they are spiritually blind. In my opinion, being spiritually blind makes it harder to live in  truth--if not impossible.  21 Important Bible verses about spiritual blindness THE NEWS & COMMENT: Miranda Devine, writing in the NY Post, describes the decision Facebook employees apparently made to spy on the “private” message of its users. Without a warrant or subpoena, they sent messages they determined were too critical of the “authorities” or questioned the 2020 election to the FBI.  Facebook spied on private messages of Americans who questioned 2020 election Facebook has been spying on the private messages and data of American users and reporting them to the FBI if they express anti-government or anti-authority sentiments — or question the 2020 election — according to sources within the Department of Justice. Under the FBI collaboration operation, somebody at Facebook red-flagged these supposedly subversive private messages over the past 19 months and transmitted them in redacted form to the domestic terrorism operational unit at FBI headquarters in Washington, DC, without a subpoena. “It was done outside the legal process and without probable cause,” alleged one of the sources, who spoke on condition of anonymity. “Facebook provides the FBI with private conversations which are protected by the First Amendment without any subpoena.” . . . This is the same Facebook that colluded with the CDC and the DHS. To me, that indicates it is company policy to be the censorship arm of The Party.  It's not just censorship, it's paying citizens to create propaganda. When the Soros-funded group called “Good Information” launched, the Mockingbird Media members at Axios ran what was effectively a press release for them.  “A new public benefit corporation backed by billionaires Reid Hoffman, George Soros, and others is launching Tuesday to fund new media companies and efforts that tackle disinformation. Why it matters: Good Information Inc. aims to fund and scale businesses that cut through echo chambers with fact-based information. As part of its mission, it plans to invest in local news companies.” Shockingly, this group is apparently contacting social media influencers to pay them to create anti-Trump propaganda. Incidentally, as a 501-c-3, this is illegal conduct.  [AUDIO] - Influencer says he was offered money to spread anti-Trump Jan 6 lies on TikTok, brings receipts "I was just offered $400 to make an anti-Donald Trump propaganda post related to the January 6 investigation that is completely not true," Preston Moore, Esq. said in the video. Attorney and TikToker @TrialByPreston revealed in a video that the Good Information Foundation attempted to pay him $400 to spread unsubstantiated rumours and misinformation about January 6, President Trump, and his 2020 presidential campaign. "I was just offered $400 to make an anti-Donald Trump propaganda post related to the January 6 investigation that is completely not true," Preston Moore, Esq. said in the video. The Good Information Foundation, headed by Rick Stengel, Former Under Secretary of State in Obama administration, emphasizes that "America is in an information crisis," and that "disinformation is threatening public health, safety, social trust and democracy." Also of note, that group is run by a former Obama State Department official. You know, the same Obama who started using the FBI to launch a coup attempt against President Trump? The Mockingbird Media folks at MSNBC have been turning to disgraced former FBI agent Peter Strok to vouch for the credibility of the agency.  [AUDIO] -  MSNBC's Morning Joe brings on @PeterStrzok to argue on behalf of the FBI's integrity: “It's not that the FBI is targeting any one side or the other. What you see is the FBI going out on a day-in and day-out basis objectively investigating allegations of law.” Here's Strok celebrating the use of the FBI to attack political opponents.  Legal Insurrection explains why the timing of this is at the heart of the story.  Election Interference: DOJ/FBI Carpet-Bombed Subpoenas An Attempt To Freeze Political Opposition In Runup To Midterms; If Trumpworld and conservative world and Republican world legitimately were deserving of carpet bombed subpoenas regarding January 6, it would have been done a year ago, not now in the runup to the 2022 midterms. It's reminiscent of the 2013-2014 prosecutorial attempt to freeze the Wisconsin conservative movement. Getting the Special Master seems like the right step given the fact that the FBI's bosses who run things are without a doubt a politically opposed to Trump and advocating diktats hostile to families, God, children and the constitution.  Exclusive: Former top FBI official involved in Trump-Russia investigation under scrutiny by federal prosecutors for his own ties to Russia Durham shocker: Danchenko was a paid FBI informant:  “[The FBI] hid it from the FISA Court and from the public. Danchenko continued as a CHS throughout Mueller's service as Special Counsel. Danchenko couldn't be touched because of his status as CHS, thus protecting Mueller and the FBI.” Mar-a-Lago Raid: Judge Rejects DOJ Request For Partial Stay, Appoints Special Master; As to DOJ claims that documents are classified and not subject to executive privilege: “The Court does not find it appropriate to accept the Government's conclusions on these important and disputed issues without further review by a neutral third party in an expedited and orderly fashion….” Kyle Cheney, Senior Legal Affairs Reporter at The Politico has a detailed and refreshingly balanced thread on Judge Cannon order where she once again called out media leaks as a reason she is siding with Trump.  Judge CANNON has denied DOJ's motion for a partial stay and has appointed Raymond DEARIE as special master. Senator Ron Johnson--heroically going after Big Pharma and Fauci--invites his Senate colleague retract the charge that the Hunter Biden laptop story was a hoax . . . in defense of his colleague, the FBI treated it as Russian propaganda, as did Facebook. How weird . . .  [AUDIO] - Sen. Johnson to Dem Sen. Peters: ‘do you want to retract' your false allegations that my Hunter Biden report ‘was rooted in Russian disinformation?' These people are utterly lost to lies. God appears to have rendered them incapable of speaking truth. Praise God that He has allowed us to have His Word in which we ground ourselves, so we more easily see the lies of this fallen world.  [AUDIO] - Fact Check: False! MSNBC Analyst Paints Biden As A 'Retired War Hero' [AUDIO] - ABRAMS:  "I have never denied that I lost" the last Georgia gubernatorial election. "I'm not delusional, just so that's clear."
