Thursday January 26, 2023 - The United Supreme Court declined certiorari on the case Toth vs. United States. Certiorari is the process by which an appellate court has the discretion to review decisions made by trial courts. Becase the Supreme Court refused to hear this case the appellate court's decision stands. And that decision stinks! I think a clear violation of the Eighth Amendment to the Constituion. The Eight Amendment simply says "Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted." Justice Gorsuch dissented from the denial of certiorari. Monica Toth, an American citizen who failed to report a foreign bank account as required by law. The Internal Revenue Service assessed a civil penalty against Ms. Toth for her failure to report, which she argued violated her rights under the Excessive Fines Clause of the Eighth Amendment. Justice Gorsuch noted that protection against excessive punitive economic sanctions is “fundamental” and “deeply rooted in this Nation's history and tradition". He further argued that it would be wrong for governments to evade constitutional scrutiny by labeling fines as "civil" rather than "criminal". In addition, he pointed out other reasons why taking up this case was worth consideration such as incentivizing governments to impose exorbitant civil penalties and clashing with original understanding of Eighth Amendment. Some Judges write for other Judges to help them understand the legal basis for a certain ruling, or even provide their own interpretation of an existing law. This can help inform future decisions on similar cases, since the opinion can serve as precedent. Some judges write with lawyers in mind, crafting legal opinions that are complex and highly technical, so that attorneys can use them as powerful tools when advocating for their clients. Some judges write for the public, with the intention of making legal opinions easier to understand and more accessible to a wider audience. Justice Gorsuch writes for the public. Attorney Steven A. Today we start off discussing an email released just yesterday. Remember the border patrol agent flap for supposedly whipping migrants? Remember Joe Biden saying they were going to get to the bottom of it and DHS Alejandro Mayorkas calling it horrifying and choosing to liken it to slavery and racism? We knew at the time, the photographer whose picture we saw splashed on every magazine, social media post and talking head program said there was no whipping, but it didn't stop the narrative from the White House. We know the investigation came out a few months ago showing nothing. Now, we learn DHS Secretary Mayorkas received an email 2 1/2 hours prior to that first press briefing that the agents had done nothing wrong. Thanks to a Freedom of Information request, we know they chose to throw those agents under the bus. And, not just them, but their families and the entirety of the Border Patrol. They knowingly lied to the American people all for political expediency. Dovetailing on that discussion is the ongoing bombshell dropped by a Pfizer Director in front of an investigatory panel of the European Parliament. After all of the edicts, bluster, mandates and smear campaigns, we finally learn Pfizer never tested if their vaccine prevented the spread of Covid-19. Just like with the Border Patrol story, they knowingly lied in order to gain conformity. Those who chose to not comply were part of the biggest discrimination scandals in modern history. MEP Rob Roos was on the Tucker Carlson show to discuss the shocking testimony further. In a press conference held this morning, another MEP, Cristian Terhes expressed similar shock and is now concerned about what else is being hidden from their questions? Last night, President Joe Biden was interviewed, one-on-one, by CNN's Jake Tapper. At one point, the President said he did not believe we are headed for a recession and if it were to happen, it would be just a little bit and would end. Now, where have we heard that sort of prediction before? Oh, yeah, they all said the same thing over a year ago regarding rising inflation. The patterns are repeating themselves right before our very eyes. But, we should just blindly trust them this time, right? Why would they lie about this? The midterms are now less than a month away and it is critical the Republicans gain control of Congress so, at the very least, they can begin to remove these criminal liars from their positions of power. We have to get back to following our Constituion as a Republc. We must abandon the current direction the Left is taking us toward their Authoritarian utopia, for the sake of our freedoms and for the future of our nation. Liberty is a cornerstone of the US Constitution, which seeks to protect individuals from arbitrary and unreasonable restraint. The Constituion codifying what freedom means for the individual and the state, yet debate on the surface level extents of freedom in modern America mean deeper reasoning is lost. Polarised discourse misses that freedom expects from the individual as much as it provides. An individual must hold and display certain values within a working pro-freedom society. This ideal comes from the ancient Greeks philosophy of stoicism: citizens should apply the virtues of wisdom, courage, justice, and temperance. As Aurelius would put it “be a good person”. If the citizens and the state can both respect each other and act with values that are in concert with each other, then a pro-freedom civilisation is possible with all the benefits that this brings. But if the state is oppressive, the rationale actions of the affect individuals, and the long term consequences for their civilisation, are obviously going to be antithetical to progress. In our fast-paced ‘fiat' system where debate is dominated by short form communication, we are too quick to prejudge and pigeonhole people. Pro-freedom advocates are associated with far right politics. Yet, any long-form conversation with pro-freedom advocates indicates this ideology appeals to a wide political spectrum as it is predicated on sound and sustainable principles. In short, slowing down and spending time with people we find our commonality exceeds our differences. That is the Bitcoin way. In this interview, I talk to Ragnar Lifthrasir from Guns N' Bitcoin. We discuss what it means to be pro-freedom, the role of the state, the importance of values to build good civilisations, Bitcoin groupthink, printed guns and the safe gun culture.

There are also talks of Trump issuing a pardon for himself to stave off possible federal investigations. Trump’s probable use of the pardon power is likely to push the boundaries of Constitutional norms and may wind up empowering future presidents to go even further.In Non-Compliant Podcast Episode 23, Host Jay Edelson, nationally recognized class action plaintiff’s attorney and Founder of Edelson PC, and Guest Kimberly Wehle, professor of law at the University of Baltimore School of Law and legal expert and commentator for CBS News, dive into Trump’s use of the pardon power and what it means for our Democratic Republic. Introduction There those who believe that our admittedly deeply flawed nation is the best, most prosperous and freest and nation on earth. Capable, as it often has, of rescuing other nations--other continents--from war and financial ruin. Martin Luther King was one of those believers. As am I. And there are those who believe that America has been flawed to the point of being evil ever since 1619, the beginning of slavery in the US. Not 1607 with the founding of the first settlement. Not 1775 with the beginning of the Rebellion. 1619. And they believe that America is irredeemable, and must be ripped down, and rebuilt from the ground up. That’s the subject of today’s 10 minute episode.  Continuing One of our responsibilities as citizens it to understand enough of American and world history to make sense of the many political statements and claims being that are tossed at us every day. To start, let’s go back to the Constitutional Convention of 1787.  Wait, Will, didn’t the Revolution end with Lord Cornwallis' defeat in 1781? Why wait six years before having a constitution? We did have an original constitution, The Articles of Confederation, enacted in 1781. These Articles provided only the loosest form of confederation, with little or no central power. It was often correctly called a “league of friendship. No central military, no central taxing authority. Simply the 13 states calling themselves friends. It soon became apparent that this loose confederation would not work; a tighter bond was needed. Rocked by the resulting economic difficulties and radical political movements under the powerless Articles, a Constitutional Convention was held in 1787, with the new Constitution being signed in September of that year. This is the same constitution that governs us today, along with its 27 amendments. Yes, the very same constitution that allowed for the continuation of slavery and the disenfranchisment of women and uppropertied men. The purpose of the new Constitution is found in the preamble: "We the people of the United States, in order to form a more perfect union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity, do ordain and establish this Constitution for the United States of America."  Today’s key point. There would have been no union if the abolitionists of the day and those supporting women’s suffrage had insisted on abolishing slavery and enfranchising women. Any number of the 11 slaveholding states, and likely all of them, would have simply blocked it on the slavery issue alone. And with no union, there would have been no centralized political, financial or military entity. What force, what political, financial and military force would have squared off against the slaveholding states? The 11 Southern states would not have needed to secede from the Union; there would have been no Union from which to secede in the first place. They could have just kept right on owning slaves. What entity would have opposed them? The ignorant irony of those who believe that America was--and is--evil because our Constituion origially allowed slavery, is that it was the creation of the Union in the Constitution they detest that was key to ending the horror of some humans owning others. The only way to end slavery was to have an opposing force so powerful that it could utterly destroy the financial and military might of the 11 states which were willing to fight to the death to preserve the terrible fiction that blacks were sub-human, and therefore subject to being bought and sold. Of the 620 thousand deaths in the Civil War, 360 thousand deaths were North soldiers. Only a very tight union would have been willing to suffer staggering loss of blood and treasure like that for any purpose. And that very union could not have been formed without initially allowing slavery.  In January of 1865,

***  Judicial Review, the power to "interpret" the Constituion and overrule laws, regulations, and policies of the Federal Governent, rests with the States, through State Nullification; passing laws refusing to honor unconstitutional federal laws; and with the People, through Jury Nullification; the ability ot the People through Juries to nullify unjust and unconstitutional laws which are tested at trial, and where the jury can acquit, not because the person didn't violate the law, but that the law itself is a violation of the Constitution, or is simply unjust, unfair, or otherwise flawed.  The 10th Amendment also reserves ALL power not given the Federal Government to the States, and to the People.  That especially includes Judicial Review.  Kevin Derby of FloridaDaily.com joined us 30 minutes in, and we continuted our discussion, Brian a caller joined in about 60 minutes in, and Michael Volpe our investigative reporter came in sometime in the second hour.  We covered a ton of ground starting with Kevin.  For a historical, constitutional, practical, and legal perspective, this is the show to listen to.
