Uma decisão do Supremo Tribunal Federal (STF) trouxe mudanças importantes para milhares de trabalhadores que atuam em atividades insalubres ou perigosas. Por seis votos a cinco, a Corte derrubou a exigência de idade mínima para a concessão da aposentadoria especial, regra que havia sido criada pela Reforma da Previdência de 2019. Com o entendimento firmado pelos ministros, volta a valer o critério baseado exclusivamente no tempo de exposição a agentes nocivos à saúde. Na prática, o trabalhador poderá solicitar a aposentadoria especial assim que completar o período mínimo exigido em atividade de risco, sem precisar atingir uma idade mínima. O tema foi abordado nesta sexta-feira (5) durante entrevista do advogado Odirlei de Oliveira ao programa Cruz de Malta Notícias. Segundo ele, a decisão representa uma mudança significativa para profissionais que passam anos expostos a condições prejudiciais à saúde e que, até então, precisavam aguardar o cumprimento da idade mínima estabelecida pela reforma. Pelas regras que voltam a ser aplicadas, o direito ao benefício é garantido conforme o tempo de exposição ao risco. Trabalhadores de atividades consideradas de alto risco, como mineração em subsolo, podem se aposentar após 15 anos de atividade. Para atividades de risco moderado, como mineração afastada da frente de serviço, o período exigido é de 20 anos. Já para profissionais da área da saúde, metalurgia, indústria, vigilância e outras atividades insalubres, o requisito continua sendo de 25 anos de exposição. Apesar da mudança nos critérios para concessão do benefício, o cálculo do valor da aposentadoria permanece o mesmo. O benefício continua sendo calculado com base em 60% da média salarial, acrescidos de 2% para cada ano de contribuição que ultrapassar o tempo mínimo exigido pela legislação. Os efeitos práticos da decisão ainda dependem da publicação oficial do acórdão e da definição dos detalhes de aplicação pelo Instituto Nacional do Seguro Social (INSS). Por isso, a orientação é que trabalhadores que atuam ou atuaram em condições insalubres mantenham organizada toda a documentação que comprove a exposição aos agentes nocivos, garantindo o reconhecimento do direito e a obtenção do melhor benefício possível. A decisão do STF é considerada uma vitória para categorias que desempenham atividades sob condições especiais e reforça o entendimento de que o desgaste causado pela exposição contínua a riscos deve ser levado em conta na concessão da aposentadoria.

En pleno periodo de la primera declaración, se ponen de manifiesto los retos de su aplicación práctica. Tal y como comentan los expertos, el Pilar Dos surge del Plan BEPS 2.0 de la OCDE y se implementó mediante las GloBE Rules, adoptadas a través de la Directiva europea de 2022 y el Impuesto Complementario en España. La normativa prevé tres modalidades de gravamen en cascada: el Impuesto Complementario Nacional, el Primario y el Secundario, aplicables según el nivel de tributación alcanzado en cada jurisdicción. Asimismo, subrayan que la normativa presenta desafíos prácticos derivados de su complejidad y coexistencia de normas españolas, europeas y trabajos interpretativos de la OCDE que se actualizan continuamente. Los expertos destacan que los grupos deben analizar primero la situación en cada jurisdicción para determinar qué modalidades pueden ser aplicables en cada ejercicio y orientar así las declaraciones y el cumplimiento de las obligaciones formales y materiales. Explican también en detalle las fases del análisis que se debe realizar en cada caso y detallan las implicaciones en función del tipo de grupo (multinacionales españolas, multinacionales extranjeras o grupos españoles), así como las simplificaciones o ‘puertos seguros' que incorpora la normativa. (Antevíspera del Día Internacional de la Mujer) Tenía veintitrés años cuando quedó huérfana de padre. Por eso ella y doña Paula, su progenitora, se trasladaron a su hacienda de Tonchalá. Llegó a poseer fincas y dinero, pero no tuvo esposo ni tuvo hijos. Se dedicó más bien a hacer obras de caridad. Según cuentan, fue promotora de la libertad de los esclavos, y en Tonchalá siempre había comida para los hambrientos y posada para los caminantes. Los trabajadores de la comarca le pedían de continuo que fuera la madrina de sus hijos. Cuando quedó huérfana de madre tuvo que encargarse de la administración de la hacienda, y bajo su cuidado aumentaron los ganados y fructificaron los cultivos. Debido a su magnanimidad, a los vecinos del valle de Guasimales, a la izquierda del río, se les ocurrió que tal vez ella estuviera dispuesta a donarles unos terrenos con el fin de construir capilla y casas a su alrededor, es decir, para fundar un nuevo pueblo. No es que quisieran aprovecharse de ella. «Es que a ella el corazón se le salía por las manos, y los colonos quisieron recoger un poco de ese corazón», comenta el historiador santandereano Gustavo Gómez Ardila en su obra titulada Cúcuta para reírla (Escenas de su historia).1 Así que fueron a su hacienda para pedirle que les donara los terrenos necesarios. —¿Está doña Juana? —preguntaron los vecinos a la criada que salió a recibir a la comitiva. La doña los hizo pasar, escuchó su petición y a los tres días les informó que había decidido donarles media estancia de ganado mayor. Fue así como el 17 de junio de 1733 se firmó la escritura de donación, y a ese acto la historia lo considera como la fundación de Cúcuta, Colombia. «El alcalde de Pamplona... se trasladó a Tonchalá para protocolizar la escritura... [y] comprobar [entre otras cosas] que doña Juana Rangel de Cuéllar, a pesar de sus ochenta y cuatro años, estaba en sus cabales [y] que no se le corría la teja ni sufría de pérdida de la memoria, no fuera a suceder que después se arrepintiera de lo donado, alegando que no se acordaba de la firma aquella», concluye Gómez Ardila.2 Así como aquellos vecinos de doña Juana percibían que «a ella el corazón se le salía por las manos», y por eso «quisieron recoger un poco de ese corazón», también a nosotros nos conviene reconocer que nuestro Dios es un Padre amoroso que quiere darnos lo que necesitamos, y que sólo hace falta que se lo pidamos. Jesucristo su Hijo lo afirmó en el Sermón del Monte al decir: «Si ustedes, que son malos, saben dar cosas buenas a sus hijos, ¡cuánto más su Padre que está en el cielo dará cosas buenas a quienes se las pidan! [Así que] pidan, y Dios les dará.»3 Sin embargo, nos animó no sólo a que le pidamos a Dios, sino también a que demos a los demás con generosidad, como lo hizo doña Juana, siguiendo así el ejemplo del Padre celestial. «Den a otros, y Dios les dará a ustedes —enseñó Jesús—....
