This Day in Legal History: Chief Justice Taft ResignsOn February 3, 1930, Chief Justice William Howard Taft resigned from the U.S. Supreme Court due to declining health. Taft remains the only person in American history to have served both as President (1909–1913) and as Chief Justice (1921–1930). After his presidency, he achieved what he considered his true ambition—leading the nation's highest court. As Chief Justice, he was instrumental in modernizing the federal judiciary, including advocating for the construction of the Supreme Court's own building, which was completed after his death. His tenure also saw decisions that reinforced executive power and judicial efficiency. By late 1929, however, his health had deteriorated significantly due to heart disease and progressive neurological issues. Struggling to fulfill his duties, he reluctantly stepped down, fearing he could no longer serve effectively. Just five weeks later, on March 8, 1930, he passed away. His successor, Charles Evans Hughes, was nominated by President Herbert Hoover. The Rich Zeoli Show- Full Episode (04/30/2024): 3:05pm- On Monday, Columbia University President Minouche Shafik informed student protesters on campus that the school would not divest from Israel and demanded demonstrators remove their encampments from campus by 2pm. However, they refused to leave and later that night a group of students broke into Hamilton Hall, barricading themselves in the building. 3:10pm- Speaking with the press from outside of a New York City court on Tuesday, Republican presidential candidate Donald Trump referred to the ongoing anti-Israel protests on college campuses as “the Biden protests.” He condemned the protests as “horrible” and “all caused” by President Joe Biden. 3:20pm- Harris Poll Chairman Mark Penn said that according to data he has gathered, the more President Joe Biden caters to anti-Israel protesters the further his approval ratings fall—which is especially problematic with the election around the corner. 3:40pm- Listeners call-in and express their concerns over the anti-Israel protests on college campuses. 4:05pm- Harmeet Dhillon—Founder of The Dhillon Law Group & The Center for American Liberty—joins The Rich Zeoli Show to discuss news that Judge Juan M. It certainly didn't seem like it. 6:40pm- Earlier this month, a 7th grader in the North Penn School District was viciously attacked by a fellow student with a steel Stanley cup. According to reports, the student responsible for the attack may have been undergoing hormone therapy.

On November 28, 2022, the U.S. Supreme Court is set to hear oral argument in Percoco v. United States.Justice Scalia once commented “[t]hough it consists of only 28 words, the [honest services] statute has been invoked to impose criminal penalties upon a staggeringly broad swath of behavior.” In this case, which has potentially broad implications for the continued criminalization of politics and lobbying, the Court is asked to decide if a private citizen who holds no elective office or government employment owes a fiduciary duty to the general public sufficient to be convicted of honest-services fraud if they have informal “influence” over government decisions.Joseph Percoco was a longtime friend of New York Governor Andrew Cuomo and served as Governor Cuomo's Executive Deputy Secretary until he decided to leave government service to manager Governor Cuomo's reelection campaign. While he was working on Governor Cuomo's campaign, he was paid by a New York businessman to reach out to a state agency to resolve a labor issue. According to the trial court and the Court of Appeals for the Second Circuit, this effort deprived the citizens of New York of Mr. Percoco's honest services. According to both courts, the fact that Mr. Percoco was not a state employee was not dispositive -- what mattered was that Mr. Percoco “dominated and controlled” government business and that government officials “actually relied on” Percoco based on some “special relationship” between Mr. Percoco and the government.If upheld, the Second Circuit's test has the potential to greatly expand the application of federal honest services charges to people engaged in politics and lobbying.This talk, featuring Mr. Gary Lawkowski, who is counsel of record for an amicus brief submitted on behalf of Citizens United, Citizens United Foundation, and the Presidential Coalition in Percoco v. The 9th Circuit agreed with Meuser that federal law permitted disabled Americans to sue airlines if those airlines failed to care for passengers as  the law provided.In 2017, Meuser joined the Dhillon Law Group where he has focused on Election, Political, and Constitutional Law. However, the event was canceled at the last minute due to the local forest fires.As Meuser rode his bike back to his car, he was in a devastating bicycle accident. Not to be deterred from his vision of completing an Ironman, Meuser registered for the same event a year later, only to run into unplanned difficulties. The third time is the charm, as three months later, he tried again, finishing the Ironman Cozumel in 12 hours and 45 minutes. In 2021, Meuser finished his second full Ironman at Ironman Coeur d'Alene. In 2020, Meuser was ranked by Ironman as the third best male in his age group (45-49) in the United States for the half-Ironman distance (1.2 mile swim, 56 mile bike, 13.1 mile run).Meuser is a prolific reader, on average reading one book a week. Most of the books he has read are on the topics of American history and biography. Meuser also has a large collection of American political biographies, United States and California State Histories that were published over 100 years ago.

On Nov. 4, 2021, the Biden administration issued a sweeping and blatantly unlawful mandate that confronted tens of millions of Americans with a grim choice — get vaccinated or get tested and wear a mask to work, or risk losing your job. How did the Biden administration plan to pull this off? By commandeering every company in America with over 100 employees to comply. Under the administration's mandate, companies would be fined around $13,600 per “violation.” A violation would entail refusing to discriminate against your unvaccinated employees. An “egregious violation” could result in a fine higher than $136,000 — for “bad actor employers who willfully disregard” the administration's unconstitutional demands. This would not only crush businesses and risk putting millions of Americans out of work, but it is an outright attack on our freedom. Immediately after the administration officially released its mandate, The Daily Wire — with the help of Harmeet K. Dhillon of the Dhillon Law Group and Alliance Defending Freedom — filed a lawsuit to challenge it. That case and others eventually worked their way up to the U.S. Supreme Court on an emergency challenge. On January 13th, the Supreme Court ruled 6-3 to halt implementation of the Biden administration's COVID-19 vaccine mandate for large, private employers. Ron Coleman is a lawyer and writer best know for representing Simon Tam and his Asian-American band The Slants in the historic case of Matal v. Tam, in which the U.S. Supreme Court ruled that the US Patent and Trademark Office could not, under the First Amendment to the U.S. Constitution, refuse to register THE SLANTS as a trademark on the ground that it was "disparaging." He has written a popular blog about trademark and copyright law, LIKELIHOOD OF CONFUSION, since 2005. Born in Queens, New York, Coleman spent his childhood half in the Brighton Beach section of Brooklyn and half in suburban central New Jersey. He attended Princeton University, where he concentrated in economics and politics, and obtained a law degree at Northwestern University in Chicago. He later attended Aish HaTorah College of Jewish Studies in Jerusalem and eventually was a Kollel Fellow at Mesivta Yeshiva Rabbeinu Chaim Berlin in Brooklyn, New York. Ron is a popular speaker, has a large following on Twitter under the handle @roncoleman and is the author of numerous professional articles and publications. The name? “The Slants.” Officially, the case is called “United States Patent and Trademark Office versus Tam.” The issue was the Trademark Office's decision to prohibit the registration of a trademark “which may disparage…persons, living or dead, institutions, beliefs, or national symbols or bring them into contempt, or disrepute.” We're going to talk to our guest Ron Coleman today about precisely what that means in everyday language. But the key thing to remember here, as in so many cases where the Supreme Court has come down on matters of free speech – it has come down on the side of protecting freedom of expression even if that expression is offensive to some.
