Bio: Ambassador Elan Carr Elan Carr is the CEO of the Israeli American Council (IAC) and brings to this role his extensive experience as a senior U.S. diplomat, criminal prosecutor, military officer, and community leader. He is a passionate advocate for uniting the Israeli-American and Jewish-American community around our shared heritage and love for Israel. Elan has dedicated his career to service of country and community. In 2019, he was appointed the United States Special Envoy to Monitor and Combat Anti-Semitism, directing U.S. policy and programs aimed at combating Jew-hatred throughout the world. Before his federal appointment, Elan devoted over a decade to public safety as a Deputy District Attorney for Los Angeles County, prosecuting violent felonies and some of the region's most dangerous criminal street gangs. He also served for more than 20 years as an officer in the United States Army Reserve, and he led an anti-terrorism team in Iraq during his wartime deployment. While in Iraq, he was also able to connect to his Iraqi-Jewish heritage, when he helped preserve Jewish communal property and led Shabbat and holiday services in Saddam Hussein's former palace in Baghdad. Elan held senior leadership positions in the Jewish world, including serving as the 71st international president of Alpha Epsilon Pi, a voting member of the Conference of Presidents of Major American Jewish Organizations, and a national councilmember of AIPAC. Elan's relationship with the IAC has been deep and personal since its inception, when his parents were co-founders of the organization. As a second-generation Israeli-American and native Hebrew speaker, Elan prioritizes his family's indivisible connection to the Jewish people, culture, and faith. He and and his wife Dahlia, a rheumatologist in private practice, are the proud parents of Hannah, Rachelle, and Samuel, whom they raise bilingually, educate in Jewish schools, and bring to Israel every summer. Born and raised in New York City, Elan holds degrees in philosophy and political science from the University of California, Berkeley, and a law degree from Northwestern University School of Law. Over the past decade, the tension between First Amendment rights and public accommodations laws has grown, as wedding vendors have refused to serve same-sex weddings pursuant to their consciences. On June 30, 2023, the U.S. Supreme Court issued its decision in 303 Creative LLC v. Elenis, which held that the free speech clause prohibits a state from forcing a website designer to create messages with which the designer disagrees. That said, the Court has yet to issue a clear decision that resolves these issues under the free exercise clause, even though wedding vendors almost invariably object to providing services on religious grounds. Indeed, when the free exercise question was addressed in Masterpiece Cakeshop Ltd. V. Colorado Civil Rights Commission, the Court largely punted on the issue and resolved the case on very narrow procedural grounds.Wedding-vendor litigation continues to percolate throughout the country and raises important questions for First Amendment jurisprudence, including whether the Supreme Court should reconsider Employment Division v. Smith, whether the free exercise clause extends protection to wedding vendors in a similar way to the free speech clause, and whether the so-called “hybrid rights doctrine” is a viable theory for analyzing religious claims to exemptions. Click serves as the Director of First Responder Wellness for the Ohio Department of Public Safety, Office of Criminal Justice Services. Prior to his current position, he served as the First Responder Liaison for Ohio Mental Health & Addiction Services. Steve is a retired lieutenant from the Ohio State Highway Patrol where he served for 36 years, completing his career assigned to the Ohio State Highway Patrol, Office of Personnel / Ohio ASSIST program. Steve has been involved in peer support with the Ohio State Highway Patrol's Member's Assistance Team (MAT) since its inception in 2002 and previously served as the Operational Commander. Prior to retirement, he oversaw all aspects of the team including policies, activations and training. He has been active in peer support since being CISM trained in 1993. He was deployed to New York City twice after the 9/11 attacks and worked with the NYPD peer support program, POPPA. He helped bring the Post Critical Incident Seminars to Ohio. He has been utilized as a peer in South Carolina, Kentucky, Texas and Georgia, for their PCIS / STLS programs. He serves as the lead trainer for several training programs offered by OCJS, having provided training to a number of public safety and civilian agencies across Ohio. Steve graduated from Franklin University, with honors, with a Bachelor of Science degree in Public Safety Management with minors in leadership and public relations. Steve is also a graduate of the Northwestern University School of Staff & Command. Steve is trained in both group and individual peer support by the International Critical Incident Stress Foundation. He is also a certified QPR; Question, Pursued & Refer and Mental Health First Aid instructor. Steve retired with 36 years of service with the Ohio State Highway Patrol and served in a number of assignments including; Commander of Cadet Training, the Patrol's Motorcycle Unit, the Ohio Statehouse Detail as well as several field supervisory positions. In 1992, he received the Ohio Distinguished Law Enforcement Valor Award, the highest award for valor in Ohio. There was quite a reaction to our last session with Dr Gregory Smith, the guy who faced extraordinary trauma, turned his back on society, walked into a forest and stayed there for 10 years. Over the four seasons of The Mojo Sessions, there have been some definite themes appear. The guys at Doublestar, the production team behind The Mojo Sessions, suggested we do a Megamix of five trauma-related conversations back to back as a holiday superset. It's a long-form episode containing five conversations in all. We start with Iris Gardner, the wife of former Navy Seal Commander-in-Chief, Jason Gardner. Iris had a brutal upbringing, living in a house with a sexual predator who was a friend of the family. Iris is brave, humble, and out to share her story so that we can benefit from her learnings. Starts: 00:07:50 Then we meet Preethaji, who runs the O & O Academy in India. Preethaji has such a simplistic way of demonstrating how many of us, through our thoughts and actions, live in a world of suffering. This conversation shows how we go from a suffering state into a beautiful state. I've interviewed Preethaji a few times, and I find her approach to life and her philosophy a huge advantage. Starts 01:49:15 Sarah Woodhouse is a research psychologist who specialises in trauma. We talk about trauma and traumatic experiences. What Dr Sarah wrote about in her book "You're Not Broken" is that many people who are suffering from trauma or a traumatic experience say that they feel broken. Sarah is fantastic. This conversation sets up how we can reframe trauma and traumatic experiences. Starts 03:01:00 I first heard Dr Bruce Perry in a conversation with Oprah on 'Oprah Soul Sessions'. At that time, Oprah said that her conversation with Bruce Perry was one of the most important she had ever had. Oprah realised that rather than exploring what was 'wrong with her', the better question was 'what happened to her?'. Anyone who knows me or has heard me speak in the last number of years will know that I think Dr Bruce Perry's book (written with Oprah) entitled "What Happened To You", is a most valuable resource, as what happened to you quite often is anchored down in a backstory. By embracing and acknowledging your past and rewriting that narrative, we can change it to how it can benefit today. Yemi is the author of the book "Did You Get The Memo", which is about changing that backstory. How common is trauma? ACE study.Does trauma at a young age have longer lasting impacts? We have a child who is chronologically 3yrs, who had a non-accidental TBI at 3 months of age. He is a sweet boy but prone to rages and is very loud. Could this be from the trauma or is it his age and frustration? How can parents help their child manage trauma if they don't know what the trauma was?The times of healing are often very short but very powerful. And that the more times our kids experience healing, even in short bursts, the more their brain "re-develops" in healthier ways.Is there is an association between trauma and sensory processing and if so, do we know why?How do you become “unstuck” on being a victim? My daughter is 18 and is struggling to become an adult, but constantly feels and acts as though she is still a victim from her past. This is normal and natural.Students should have a wider and deeper set of college options as they build their college list if misconduct has been an issue.On new campus visits, encourage students to look at their likely list and to be more open-minded when they may be harder for the college to admit. The most important thing when writing admissions essays or applications is telling the truth. There is no such thing as the whole truth, but don't try and hide the information. Expulsion does not need to be the end of anybody's education. There are many alternate paths forward. The last two years produced an explosion of novel cases involving academic dishonesty during remote learning, misuse of social media, and violation of Covid protocols. About Mara Smith Mara Smith is a former attorney, corporate strategist and stay-at-home mom who is the founder of Inspiro Tequila. After studying accounting in undergrad and then attending Northwestern University School of Law, Mara began her legal career at a large law firm in Chicago. She then decided to switch gears and apply her business degree as part of the corporate strategy and business development team at a Fortune 100 Company. Mara was put on emergency bedrest while pregnant with her twins and when they were born prematurely, Mara decided to leave the corporate world to focus on her family and charitable work. She never stopped thinking about what was next. Mara always envisioned running her own company and in February of 2020 she set out on her journey to create a new tequila brand. Mara started drinking tequila when she was looking for a clean, gluten-free spirit that fit into her active lifestyle. She searched for a tequila brand that was additive-free with a look, taste and aroma that appealed to her as the consumer. That perfect tequila did not exist, so she decided to create one. On December 5,2022, the U.S. Supreme Court will hear oral argument in 303 Creative LLC v. Elenis. Petitioner Lorie Smith, an artist in Colorado and owner/founder of the graphic design firm 303 Creative LLC. is challenging Colorado’s Anti-Discrimination Act (CADA) on the grounds it is unconstitutional, arguing, among other things, it violates her right to free speech.Ms. Smith was looking to expand her business to include designing websites for weddings but would only design for weddings that were in line with her religious convictions, which meant she would not design websites for same-sex weddings. Further, in expanding her business, she wanted to post a message to her own professional website to communicate what wedding websites she would do, and explain her religious objections to same-sex weddings.Because 303 Creative LLC. is a business open to the public, however, it falls under CADA, which prohibits any business from discriminating against possible patrons based on a list of characteristics, one of which is sexual identity. Further, CADA defines discrimination not only as the refusal to provide goods or services but also as the promulgation of messaging that says or implies that a potential patron’s business would be unwelcome based on them possessing a protected trait. Under CADA, both the refusal to create webpages for same sex weddings and the promulgation of a message that Ms. Smith would not create such webpages, even if she is never asked so to do, would be illegal.Before any action was taken against her under CADA, Ms. Smith and 303 Creative LLC. challenged CADA in federal court, alleging its unconstitutionality. The district court granted summary judgement in favor of Colorado, and upon appeal, the Tenth Circuit affirmed that decision.Our panel of experts will break down and analyze how the Supreme Court oral argument went the same day. In the summer of 2020, when the murder of George Floyd was igniting protests in Minneapolis and around the country, it occurred to Margaret A. Burnham that “George Floyd” was a common-sounding name. Burnham is the founder and director of the Civil Rights and Restorative Justice Project at the Northwestern University School of Law, where she is also a professor. She went into the CRRJ's archive of Jim Crow racial homicides, and a search revealed another George Floyd. The account of the jailhouse death of this first George Floyd appeared in a 1945 letter to Thurgood Marshall from a Floridian chapter of the NAACP. Floyd, a 46-year-old turpentine worker, was arrested in St. Augustine, Florida, accused of public intoxication. When Floyd protested a second search of his person at the local jail, he was beaten to death by the arresting officer. Aside from a coroner's report, Burnham and her colleagues could find no evidence that the officer who killed Floyd in 1945 faced any investigation. “It was not entirely unforeseeable that we would find this name-fellow in our archive, pleading to be exhumed and put in conversation with the iconic inspiration for what would come to be known as the 2020 ‘reckoning' with Black death at the hands of the state,” writes Burnham in her new book,By Hands Now Known: Jim Crow's Legal Executioners. “We count, and contest, because George Floyd counted. Number 1. And Number 2.” InBy Hands Now Known, Burnham looks at three interrelated themes: The way the federal government enabled the subjugation of Black Americans through both action and inaction; the relationship between racial violence and political power; and community resistance to Jim Crow that predates the “official” Civil Rights Era from 1954 to 1967. Burnham's first chapter examines one such area that shows elements of all three themes: Rendition cases gave attorneys the opportunity to try to prevent the extradition of Black men and women to jurisdictions where they faced lynching or other violence. William Henry Huff, a Black lawyer in Illinois, successfully handled 77 such cases, Burnham found in her research. In this episode of the Modern Law Library, Burnham discusses her book with the ABA Journal's Lee Rawles. She describes talking to family members of victims who never thought the full story of their loved ones' deaths would ever be told; the way shopkeepers or bus drivers were essentially deputized to violently enforce rules against Black people in the South; and how her work in 1990s South Africa with truth and reconciliation efforts impacts her view of the potential for reparations efforts in the United States. She also contends that the lack of enforcement made the kidnapping of Black people by white people not a criminal offense, regardless of what laws were on the books. Burnham, along with her partner Melissa Nobles of the Massachusetts Institute of Technology, has also made her research available through the CRRJ's Burnham-Nobles Digital Archive. Primary source documents such as FBI interviews, news articles and jury inquests into anti-Black killings in the American South during the early to mid-20th century are available, as well as more than 900 case pages for individual incidents.
