On this day in legal history, November 1, 1943, the federal Office of Price Administration implemented rent control in New York City.This day in legal history marks a crucial transition in the regulatory landscape of New York City's housing market. In 1943, amidst the economic upheavals of World War II, the Federal Office of Price Administration took a decisive step to mitigate the inflationary pressures of a wartime economy by issuing regulations that froze rents in New York City at the levels of March 1, 1943. This action, borne out of the Emergency Price Control Act (EPCA) signed by President Franklin D. Roosevelt in 1942, sought to create a balance in a market where resources were overwhelmingly directed towards the war effort, including housing which was now a scarce yet essential commodity.The federal initiative on rent control was a precursor to a more localized approach that would follow in the ensuing years. As the war concluded and the Emergency Price Control Act was allowed to expire on June 30, 1947, it paved the way for the Federal Housing and Rent Act of 1947, which commenced on July 1 of the same year. This new legislation maintained controls on pre-1947 buildings while exempting new constructions post February 1, 1947, a demarcation that still plays a significant role in determining the control status of housing accommodations in both New York State and City.As the federal reins loosened, the State of New York foresaw the need to institute its own set of rent regulations to address the ongoing housing shortage. This foresight led to the establishment of the Temporary State Housing Rent Commission in 1950, tasked with the responsibility of regulating rental housing. The transition from federal to state control was marked by a legislative effort to freeze rents at the level effective on March 1, 1950, giving the commission ample time to devise a comprehensive rent control plan for New York. The legislation of 1951, which closely mirrored the federal regulatory framework, signified the State's commitment to preserving a semblance of stability and fairness in the rental housing market amidst the changing economic tides.The enactment and evolution of rent control laws were not merely a response to economic conditions but an exemplification of governance adapting to the exigencies of the times. Approximately 2,500,000 rental units came under state control, with about 85% of these units located in New York City, underlining the magnitude of the initiative. The establishment of local rent offices across the State further institutionalized the mechanism of rent regulation, ensuring that the delicate balance between the interests of owners and tenants was judiciously maintained. The saga of rent control from federal to state jurisdiction illuminates the intricacies of legal and economic interplay in shaping the lived experiences of New Yorkers.The U.S. Supreme Court is set to examine the legality of a trademark application for the phrase "Trump Too Small" made by California attorney Steve Elster, amidst objections from the U.S. Patent and Trademark Office. This case emerges as a notable dispute exploring the boundaries between trademarks and constitutional free-speech rights. The trademark, intended for use on T-shirts, is seen by Elster as a means to critique former President Donald Trump's governing style, with its roots in a 2016 debate exchange concerning Trump's hand size. The Patent and Trademark Office initially denied the application, referencing a 1946 law that restricts the use of an individual's name in a trademark without consent. However, a federal appeals court later supported Elster, positing that constitutional free-speech protections outweighed the cited privacy and publicity rights of public figures in this scenario.Now, as the matter escalates to the Supreme Court, the justices are to consider the appeals court's reversal and the larger interplay of free-speech rights within trademark law. The Court's decision, anticipated by June's end, follows its recent trend of overturning trademark laws on free-speech grounds, as seen in cases concerning the rock band The Slants and artist Erik Brunetti. The Biden administration argues that the current law differs as it aims to prevent exploitation of names for commercial gain, rather than restricting viewpoint-based speech. On the flip side, Elster contends that such a law could be misused by public figures to suppress criticism, pointing out inconsistencies in trademark approvals for political phrases. This follows a year after FTX's bankruptcy which led to a significant financial market shock and wiped out Bankman-Fried's estimated $26 billion fortune. U.S. prosecutors have charged him with committing a monumental financial fraud, allegedly stealing $8 billion from customers, marking one of the largest financial frauds in U.S. history. Bankman-Fried pleaded not guilty to the charges and even took to the stand in his own defense, facing rigorous cross-examination from prosecutors.Over the course of the trial, which included 15 days of testimony, key accusations came from three of Bankman-Fried's former close associates who, after pleading guilty, testified against him. They claimed he directed them to carry out financial crimes, including misappropriating FTX customer deposits and misleading lenders and investors regarding the financial health of FTX and his other venture, Alameda Research. Prosecutors argue that the misappropriated funds were used to settle debts, make speculative investments, and contribute to U.S. political campaigns. They also accuse Bankman-Fried of false advertising to attract customers to FTX, by misrepresenting the safety of their funds and the financial health of the exchange.In his defense, Bankman-Fried portrayed himself as a busy CEO who delegated operational details to subordinates, admitting to mistakes but denying any fraudulent intent or theft. However, the prosecution sought to challenge this narrative by highlighting discrepancies in his statements regarding the safety of customer funds and the independence of Alameda from FTX. The trial, reflecting high stakes for Bankman-Fried who could face a long prison term if convicted, underscores the ongoing scrutiny and regulatory challenges surrounding the cryptocurrency sector. During the past 30 years there's been a growing list of pop and rock musicians trying their hand at musical theater. And they range in style and scope from artists like Cindy Lauper, Dolly Parton, and Elton John to rock bands like The Who, Green Day, and The Go-Go's. Well, today's guest has been venturing into musical theater and is from a band you may not have heard of, but their name is certainly one you're not likely to forget: The Slants. Simon Tam, founder and bassist of the all-Asian rock band, has recently begun a transition from rock star to musical writer, and he shares why this new artistic endeavor is so important to him. But his path up till now has taken some surprising turns... We talk about the bullying he faced as a child just because he's Chinese. He gives the reasons why he and the band turned down not one but two million-dollar contracts. And then there's the famous eight-year trademark battle that ultimately landed him and the band's name at the Supreme Court. Sometimes it involves physical attacks and intimidation or verbal attacks like what Simon had to deal with when he was young (name calling, teasing, and taunting). But it can also be indirect, such as spreading rumors or trying to make others reject someone. More recently, though, technology and social media have created a new venue for bullying that has expanded its reach. Cyberbullying happens online like YouTube, Instagram, and Snapchat, where bullies can send hurtful, ongoing messages 24 hours a day. Adult bullying is a thing, too.  Preventing and stopping bullying involves a commitment to creating a safe environment where children can thrive, socially and academically, without being afraid. The same can be said of theaters, rehearsal rooms, on-set, and backstage as well and the importance of providing dependable, non-toxic conditions to do the best work possible. On the other, a group of BDSM-leather-loving women who called themselves the Lesbian Sex Mafia. They squared off in 1982 at the Barnard College Conference on Sexuality... I know, to be a fly on the wall, right 00:38:04 - CHAPTER THREE: Dykes on Bikes.After some 'cunt-a-linquistics' of the origin of the word 'dyke' Dawn tells the story of how the famous motorcycle club, Dykes on Bikes came to be. It, like leather and motorcycle culture among men, grew out of World War 2 and the individuals who found themselves on the forefront of the mechanics and technology of these relatively new machines.  In 2006 the motorcycle club known as Dykes on Bikes won their suit against the US Patent Office which refused the registration of their trademark due to a "slur" in the title. They successfully argued that 'Dyke' is not a slur - and if it is regarded so, it is not held as such within the community. "Can we long exist as a society if we lose our tradition in the roots of faith?" My guest on this episode of Law and Legitimacy is Ron Coleman. Ron Coleman is a partner at The Dhillon Law Group and has a robust practice including business law, commercial litigation, trademarks, intellectual property, antitrust, appellate issues and the occasional appearance in front of SCOTUS, anchored out of New York City.  Ron is also the host of his own new podcast, The Coleman-Nation Podcast, and is the brilliant mind behind the massive catalogue of blog material you can find at Likelihood of Confusion.  Ron is a lawyer's lawyer, without a doubt. Ron is a commercial litigator with extensive first-seat trial and appellate experience who focuses on torts of competition such as trademark infringement, unfair competition and consumer law. He is known for his First Amendment advocacy, regarding both religious and free speech rights, including his representation of Simon Tam and “The Slants” in the watershed free speech case, Matal v. Tam, in which the U.S. Supreme Court ruled that the prohibition against registration of “disparaging” trademarks was unconstitutional. An alumnus of a number of major commercial firms in New York and New Jersey, the states in which he is admitted, Ron maintains a leading-edge media practice representing political and new media figures in defamation and intellectual property claims, challenges to social media “cancel culture” or “deplatforming” cases as well as traditional intellectual property litigation on behalf of both plaintiffs and defendants in federal and state courts throughout the country. Ron has been perennially listed in the World Trademark Review's “WTR 1000 Top Practitioners” guide for his trademark litigation work in New York and the World Intellectual Property's Review's “WIPR Leaders” directory, as well as Super Lawyers; he is AV rated in Martindale Hubbell. Ron has successfully represented clients of every size in state and federal courts, arbitrations and mediations in a variety of litigation matters, including contract disputes, distributorship litigation, trademark and unfair competition cases, business tort claims, toxic tort and insurance coverage litigation, discrimination and wrongful discharge cases, copyright infringement claims, and cases involving trade secrets, restrictive covenants and real estate. His litigation experience runs from pretrial investigation and early dispute resolution through every aspect of bench and jury trials as well as appeals. Suprema Corte americana libera palavrões em marcas e patentes Agência de marcas e patentes havia se recusado a registrar marca com um nome que lembra uma flexão verbal de uma palavra de baixo calão em inglês. A Suprema Corte dos Estados Unidos derrubou, nesta segunda (24), uma antiga regra que proibia que marcas que tivessem palavras e símbolos imorais ou escandalosos. Os juízes tiveram que tomar uma decisão relativa a uma empresa de roupas que tinha um nome controverso. O dono da marca alegou que a proibição violava o direito ao discurso, que é uma garantia constitucional nos EUA. O governo de Donald Trump, favorável à proibição da marca, argumentou que a lei que restringia palavrões em marcas existia desde 1905. O caso em questão é da marca FUCT, da cidade de Los Angeles. O designer Erik Brunetti protocolou o registro do nome comercial, mas a agência de marcas e patentes recusou. A palavra FUCT não existe em inglês, mas tem uma sonoridade próxima de um termo inapropriado. A Suprema Corte manteve uma decisão de uma instância inferior de Justiça, de 2017, que considerava que a proibição era uma violação à garantia constitucional de liberdade de expressão nos Estados Unidos. Na prática, a agência de marcas e patentes não vai mais impedir registros de marcas por profanidade ou imagens gráficas de cunho sexual. A administração de Trump havia avisado que invalidar a lei abriria as portas para um fluxo de palavras extremas e imagens sexualmente gráficas no mercado. Em 2011, quando o protocolo da FUCT foi rejeitado, a agência concluiu que, além da sonoridade da palavra, os produtos tinham imagens explícitas, misóginas e violentas. Brunetti tentou registrar a marca porque seria mais fácil protegê-la de falsificações. O nome é uma saída inteligente, ele afirma, por causa da sua associação a um palavrão, mas também é uma sigla para “amigos em quem não se pode confiar”. Uma instância de Justiça deu razão a ele em 2017. Banda de rock ganhou processo semelhante A decisão desta segunda (24), a Suprema Corte seguiu a mesma lógica de uma decisão de 2017 quando derrubou uma lei que proibia marcas ofensivas. Naquela ocasião, era uma banda de rock dançante que se chama The Slants. Esse é um termo que, originalmente, se refere a algo inclinado, mas que é empregado de maneira pejorativa para descrever pessoas de origem asiática. O conjunto The Slants é formado por músicos de ascendência asiática. A agência de marcas e registros considerou que eles não poderiam ter esse nome, eles entraram com um processo na Justiça e venceram. Cuidados com a pronúncia Na argumentação, no dia 15 de abril, os juízes e advogados tiveram o cuidado de não pronunciarem o palavrão do qual deriva o nome da marca de roupa. Um advogado descreveu a palavra como “o equivalente à flexão verbal no particípio passado de uma profanidade paradigmática de uma palavra profana na nossa cultura”. O juiz Stephen Breyer a chamou de “a palavra em questão”. Os produtos da marca de Brunetti incluem um pulôver com a inscrição “The World is fuct” (o mundo está fuct), calças com os dizeres “We are fuct” (nós estamos fuct) e uma camiseta com a frase “Fuct is free speech, free speech is fuct” (Fuct é a liberdade de expressão, a liberdade de expressão está fuct). Ainda que algumas pessoas fiquem ofendidas por certas palavras, limitar o direito de se expressar é uma medida perigosa, afirmou Brunetti, em uma entrevista em abril. O governo dos EUA argumentou que banir termos vulgares e imagens indecentes não é uma discriminação contra um ponto de vista, e que o governo não deveria ser forçado, pelo sistema de proteção de marcas, a promover palavras e imagens que podem chocar o público.
