Garland v. Cargill concerned whether bump stocks are considered "machineguns" as defined by Title 26 of the United States Code. Impacting the realms of both Second Amendment and administrative law, the case raised questions concerning the role of lenity, the applicability of the (then standing) Chevron Doctrine, and the nature of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF)’s authority.The issue came to the Court following a significant circuit split on the validity of the ATF's 2019 reclassification of bump stocks as machineguns, with the Fifth and Sixth Circuits having held that bump stocks are not machineguns, while the D.C. and Tenth Circuits had held that they were. Today on Legalese, we add a new video to my series: “Today In Supreme Court History” This latest installment looks at the landmark case of Printz v. United States. We call it “Today” in Supreme Court history because it was on this day in 1996 that oral arguments for this case were heard by the Supreme Court; as two of our Nation's finest litigators squared off. Stephen Halbrook, representing Sherriff Printz and Sherriff Mack argues as the petitioner. Walter J Dellinger III represented the United States as the respondent. The Brady Handgun Violence Prevention Act (Brady Bill) required "local chief law enforcement officers" (CLEOs) to perform background-checks on prospective handgun purchasers, until such time as the Attorney General establishes a federal system for this purpose. County sheriffs Jay Printz and Richard Mack, separately challenged the constitutionality of this interim provision of the Brady Bill on behalf of CLEOs in Montana and Arizona respectively. This case became a landmark in defining the meaning and scope of the anti-commandeering doctrine. Legalese is a reader-supported publication. What’s been the result? 3) Gun shops have experienced a record number of first-time gun buyers. What do you make of that? 4) First-time buyers are often surprised that they cannot just go in a shop and buy a gun immediately. Do you think this will make a difference in the future, and perhaps people might not be as willing to want more restrictions on their gun rights? 5) Some officials have declared groceries, hardware stores, and even liquor and pot businesses to be essential and may remain open, while gun shops and gun ranges are not “essential” and must close. What actions have been taken? 6) Some officials have halted background checks on gun buyers, thereby preventing the sales. Please help people understand how that intersects with the idea of “Universal Gun Laws”. 7) What experiences have we seen, such as Hurricane Katrina, when law and order broke down? 8) What historical lessons are to be learned from government decrees that curtail civil liberties and last beyond the emergencies by which they were said to be justified?

This podcast is a little different than the normal fare as I discuss a dark time in the world’s history.  I was given a copy of the book, Gun control in the third reich several years ago and was moved after reading it.  The author, Stephen Halbrook, is a well regarded attorney who has argued cases in front of the Supreme Court and won.  Stephen is also somewhat of a historian and has written several books including this one. Nazi Germany brings up a slew of emotions from hatred to sorrow depending on your preceptive.  The book begins immediately after the first world war when Germany was in turmoil and violence was on the rise.  Gun laws were passed that were severe but also began the process of registration of ownership.  Something that would later haunt the populace especially the Jewish Germans.  The warnings were there that lists of gun owners could fall into the wrong hands of an extremist group…and that’s exactly what happened.  So I ask you to come with me as I go back to the 1920 and 30s in Germany were we discover one of the major aspects to why Hitler and his Nazi party were so successful..
