Today, the Two Mikes spoke with Sheriff Richard Mack, who was a constitutional sheriff in GrahamCounty in southwestern Arizona. He also is the founder and the president of an association named theConstitutional Sheriffs and Peace Officers Association (CSPOA, https://cspoa.org) which is holding itsannual conference in Orlando, Florida on 7 September 2024. The CSPOA's membership includes about athousand of the republic's constitutional sheriffs – one-third of the country's total number -- many oftheir subordinates, and it is open for membership to all American citizens interested in its non-violenteffort to restore constitutional government to all of the United States, with a special emphasis on fullyrestoring the Bill of Rights. Sheriff Mack noted that the constitutional sheriffs swear an oath ofallegiance to the U.S. Constitution and so can act in protection of life, liberty, and the pursuit ofhappiness – the latter refers to the accumulation of personal property – and, for example, can block gunseizures, protect churches and businesses from mandated closings, as in the case of Covid, and preventthe outrageous denials of liberty we have seen against Amish farmers in Pennsylvania and other farmersaround the country. In essence, Sheriff Mack said, the maintenance of the peoples' liberty is theconstitutional sheriffs' sole responsibility. It also should be noted that Sheriff Mack managed to achievethe almost impossible when he launched a personal law suit that made its way to the Supreme Court –and he won! In the case of Mack-Vs-United States (1995), Mack challenged the legality of “The BradyHandgun Violence Prevention Act (Brady Bill) required ‘local chief law enforcement officers. (CLEOs) toperform background-checks on prospective handgun purchasers, until such time as the AttorneyGeneral establishes a federal system for this purpose.”(1)--the Supreme Court constructed its opinion on the old principle that state legislatures are notsubject to federal direction. The Court explained that while Congress may require the federalgovernment to regulate commerce directly, in this case by performing background-checks onapplicants for handgun ownership, the Necessary and Proper Clause does not empower it tocompel state CLEOs to fulfill its federal tasks for it - even temporarily. (2)Sheriff Mack's argument not only won the case, but, in its decision, the Supreme Court also stuck a blowin favor of state's rights by reasserting the constitutional fact that state legislatures are not vassals ofthe federal government. Indeed, the Founders intended the states to be a check and balance against thesteady expansion of federal power. El objetivo de "Y el tren arrolló la Arcadia...", es analizar, a partir de la novela de Palacio Valdés, La aldea perdida, el impacto de la construcción del ferrocarril sobre la población, el número de caseríos y el número de negocios a nivel parroquial en los concejos mineros de Laviana y Langreo. Utilizando el estimador de diferencias en diferencias (DID) se cuantifica el efecto del acceso al ferrocarril sobre las parroquias en el periodo 1879-1911. Las fuentes utilizadas son los nomenclátor de las entidades de población y el Anuario de las profesiones, comercios e industrias Bailly-Baillière. Los resultados confirman una influencia positiva y significativa del ferrocarril sobre la población y el número de negocios, mientras que se reduce el número de caseríos. Este hecho pone de manifiesto el proceso de urbanización de la población vinculado a la industrialización que se estaba produciendo y al que se oponía Palacio Valdés desde las primeras líneas de su novela María Gómez Martín, licenciada en Historia por la Universidad de Oviedo, es profesora ayudante doctora en el Departamento de Economía General de la Universidad de Cádiz en el área de Historia e Instituciones Económicas. Realizó sus estudios de posgrado en el máster «Género y diversidad» de esa Universidad. Después de recibir diversas becas de colaboración, disfrutó de una beca predoctoral Severo Ochoa (FICYT) a cargo del Gobierno del Principado de Asturias. Ha realizado diversas estancias de investigación en universidades del Reino Unido y Estados Unidos. Desde 2019 es Doctora en Género y diversidad con Mención Internacional por la Universidad de Oviedo, habiendo recibido el premio extraordinario de doctorado. Es autora de dos libros y más de 30 textos en revistas de reconocido prestigio. Su interés se centra en cuestiones de género, historia del trabajo femenino, economía doméstica, industria rural y literatura en el periodo que comprende el último tercio del siglo XIX y primero del XX. Verónica Cañal Fernández, licenciada en Economía por la Universidad de Oviedo y profesora en el Dpto. de Economía Cuantitativa de la misma universidad. Su trayectoria se extiende a lo largo de los últimos 17 años. Durante el periodo 2002-2003 consigue una beca de la Consejería de Economía del Principado de Asturias adscrita al Dpto. de Economía Aplicada. En 2004 es contratada en el proyecto “Análisis de las alternativas de transporte para personas con movilidad reducida” y en 2005 en la “Actualización de la Evaluación Intermedia del Programa Operativo Integrado del Principado de Asturias 2000-2006”. Today on Legalese, we add a new video to my series: “Today In Supreme Court History” This latest installment looks at the landmark case of Printz v. United States. We call it “Today” in Supreme Court history because it was on this day in 1996 that oral arguments for this case were heard by the Supreme Court; as two of our Nation's finest litigators squared off. Stephen Halbrook, representing Sherriff Printz and Sherriff Mack argues as the petitioner. Walter J Dellinger III represented the United States as the respondent. The Brady Handgun Violence Prevention Act (Brady Bill) required "local chief law enforcement officers" (CLEOs) to perform background-checks on prospective handgun purchasers, until such time as the Attorney General establishes a federal system for this purpose. County sheriffs Jay Printz and Richard Mack, separately challenged the constitutionality of this interim provision of the Brady Bill on behalf of CLEOs in Montana and Arizona respectively. Jamie, Brienne, and Cleos run into bands of outlaws. One of the three doesn't survive. The other two aren't in much better shape, now being in the hands of the Brave Companions. Jamie urges their leader Vargo Hoat to hand him over to his father. Hoat considers it but wants to hand-deliver a message to Tywin first. Simon and Mackelly clasp hands and hope for the best.Chapter Review:Jamie Lannister, Cleos Frey, and Brienne of Tarth have made it to Maidenpool. The town is in ruins, with dead bodies everywhere. The trio leaves and make their way down the Duskendale Road toward King's Landing. An unexpected hail of arrows claims the life of Cleos. Jamie picks up Cleos' sword and attacks Brienne. At the end of a long fight, the pair are surprised to find they're surrounded by members of the Brave Companions.Jamie mistakenly thinks they still support his father Tywin Lannister. He's quickly disabused of that notion. They now support Roose Bolton and the King in the North. Jamie fears Brienne will be raped by the men. He suggests she's worth a lot in ransom, hoping it will keep her save.When the group meets up with the main body of the Brave Companions, Vargo Hoat claims Jamie as his captive. Jamie tells Vargo it's not too late to come back to the Lannister fold. Return him to his father and Vargo will reap a massive reward. Vargo isn't opposed to the idea. However, he wants to send a message first. With that, he has Jamie's arms laid across a rock. A sword is swung down toward Jamie. Arya, Hot Pie, and Gendry run into another trio on the road to Riverrun, whose motives are hard to read. Ultimately, the starving kids decide to trust them and accompany the men for promised food and shelter. They get the food, but lose their horses. Right when Arya thinks all is lost, she sees a friendly face, but has her secret revealed to all. Mackelly gets goosebumps. Simon's not so sure it's all good news.Chapter Review:Arya Stark, Hot Pie, and Gendry dig up some vegetables in a garden of a burned-out cottage. The sound of singing puts them on high alert and they hide. They are quickly discovered by three men on foot. The men fancy the kids' horses but offer them a meal and shelter at an inn not far away. When the archer sends an arrow an inch from Arya's head, they realize they have no choice and comply.The inn is the same one Brienne, Jamie, and Cleos visited, the Inn of the Kneeling Man. This time the wife Sharna is home. She offers them food and ale. The men discuss how the kids' horses are better than the ones the innkeeper gave away. He insists he sent the three who bought the horses toward the men, to reclaim those horses. But the men say they never showed up.A man named Tom offers Arya an IOU for their horses. Arya's not interested. She'll give them the horses for the sailboat tied up at the dock. Everyone gets a good laugh at her boldness. But negotiations are broken off when a group of men arrive. The kids are scared and prepare to defend themselves. However, the newcomers include a familiar face. Harwin, from Winterfell, is among the group. He doesn't recognize Arya at first. But when he does, he takes a knee and announces her as the Hand's daughter Arya Stark of Winterfell.Characters/Places/Names/Events:Arya Stark - Younger daughter of Ned and Catelyn Stark. Tyrion tours the wildfire production lines in the Guildhall of the Alchemists. He welcomes Cleos Frey to King's Landing and reads Robb Stark's demands. He meets with Cersei who is furious that Tyrion plans to sell off Myrcella to Dorne in return for their cooperation in the war. Simon and Mackelly weigh the strategies. Chapter Review: Tyrion Lannister meets with the pyromancer Hallyne in the Guildhall of the Alchemists. They have 7,000 pots of wildfire ready to be used in the defense of King's Landing. Tyrion is very uneasy - this substance burns on water and does unspeakable damage to all that it touches. He asks for some empty pots to be used in training the defenders. Bronn informs Tyrion of two urgent summons. The Hand decides to visit Jacelyn Bywater first. Tyrion's cousin Cleos Frey has arrived from his captivity in Riverrun. Robb Stark's demands are unacceptable, but Tyrion is pleased that he can stretch out the negotiations. He forbids anyone from Cleos' crew from entering King's Landing. He doesn't want word of the starvation to reach the King in the North. En route to his second urgent visit (with Cersei) he hears a preacher decrying the royals and the church. He's a bit offended by being referred to as a “demon monkey.”His sister Cersei is furious to have been kept waiting and incandescent that Tyrion should try to ship Myrcella to Dorne without consulting her. He tries to placate and feels like he's made progress. Compelling amongst his arguments is that the princess may well be considerably safer in Sunspear than she is in the capital.
