Plausibly Live! - The Official Podcast of The Dave Bowman Show

In November of 2013, the nation was "more divided than we have ever been before!" The issue at hand was healthcare, and specifically the lawsuit that was headed to the District Court over Obamacare. Odd as it seems today, at the time it was NOT at all clear what any Court would rule on the matter. And on the DC Circuit, where the case was headed, there were three seats open. The Senate had been unable to confirm President Obama's three nominees as the democrats could not overcome the cloture rule to end debate. This left the DC Circuit court in an odd position of being almost equally split between GOP appointed Judges and Democrat appointed Judges which really put the matter up in the air. At just this moment, onto the stage of history walked Harry Reid, the senate Majority Leader, who announced that there would be a change tot he rules, and the cloture rule was being "nuked" - at least as far as these three nominees went. Oh... there was great wailing and gnashing of teeth on the right, while the left rejoiced and proclaimed eternal victories yet to come because of this brave and bold move by the Majority Leader. Less than half a decade later, there was another round of weeping and gnashing of teeth. This time, things were reversed and there was much condemnation of those who decided to nuke the rules. What happens if Harry Reid doesn't invoke the nuclear option? What happens if Edmund G Ross decided to listen to threats made against him and not vote his conscience on May 16, 1868? Who? You know... Edmund G Ross, Major, USV, 11th Kansas Volunteer Cavalry... and Senator from the great State of Kansas... That Edmund G. Ross...

Joel Payne is a Democratic strategist who worked on Hillary Clinton's 2016 campaign as well as a member of the late Senator Harry Reid's staff. He joins Jessica to discuss the Biden administration's first term. President Joseph Robinette Biden Jr. was sworn in last January 20th in the midst of a maelstrom of foreign and domestic challenges - a raging Covid-19 pandemic, a monumental vaccine rollout, a strong conservative majority on the Supreme Court, and a country divided by years of misinformation and disinformation fomented by the chaotic prior administration - and he moved into the Oval Office two weeks to the day after an unprecedented and violent insurrection at the Capitol that left five Americans dead. But Biden also found himself with narrow majorities in both the Senate and the House and managed to pass a groundbreaking infrastructure bill within months. How did Biden navigate his first year in office? And how is he positioned to guide the United States through the ongoing pandemic, the upcoming midterm elections, and a likely run for reelection in 2024?

RUSH: Paula in Hartland, Wisconsin, I'm glad you waited. Welcome to the Rush Limbaugh program. CALLER: Rush, so cool to talk to you. Anyway, I'm gonna get right to my point like I was instructed. Rush, I had a thought doing some reading this morning. I understand that Harry Reid and some Democratic senators are gonna try to push through some changes in the filibuster rules. And as I got thinking about it, I said, ‘Man, I hope I can get Rush today because I need his input on this,' and I'm thinking, ‘Well, the House is now Republican so it's really not gonna matter as far as legislation goes,' but I'm thinking, ‘The Senate does all the judicial and federal nominations, approves them,' and I'm thinking that since Obama's agenda is really going nowhere legislatively, that the Democrats are looking at this as a way to load the courts with as radical judges as they can to try to keep their agenda moving forward. RUSH: Well, now — CALLER: What do you think? RUSH: — you know, you are incredibly shrewd, and I mean this. You are incredibly shrewd. I just want to bring one small correction. Their desire to get rid of the filibuster in the Senate goes beyond judicial nominations. They really want to get rid of it. They've lost and the filibuster is now an obstacle. So of course, ‘It's outdated, it's outmoded, it's a fetish, and we have to get rid of it. We've gotta get rid of this requirement that says we have to have 60 votes to get anything done. That's just antiquated.' It held them back. So they're serious about it in terms of legislation. But the way this breaks down legally is quite fascinating, and a lot of people are calling Republicans hypocrites for opposing the change in filibuster rule, and the reason… https://www.rushlimbaugh.com/daily/2011/01/05/senate_dems_target_filibuster_rule/ Learn more about your ad-choices at https://www.iheartpodcastnetwork.com
