Riding Shotgun With Charlie #254 Alisha Curtin San Diego Concealed Carry & Gun Owners Radio   In 2022, I went to the San Diego County Gun Owners' Gun Prom with a friend. I got to meet lots of people at the event, many whom I've had on the show at some point. I'm sure I met Alisha Curtin then. She's been part of Gun Owners Radio for a few years now. I did a PitStop interview with her, which is already posted, and I got to film this interview where we get into things a little more with her. This was her first SHOT Show and she had a great time!    Alisha was raised in the San Diego area and met her husband in high school. At 17, she enlisted in the delayed entry program in the Army. The week before she was supposed to ship off for bootcamp, she re-evaluated the situation with her boyfriend and thought it was leading places just 4 months into dating. Just before SHOT Show, they celebrated their 29th wedding anniversary!   Her husband is in law enforcement and with a firearm in the home, he wanted her to be familiar with it. She really enjoyed it but, for him, shooting was just work. Eventually, she found that she was going to shoot and take training with her lady friends. Around 2012, she bought her own gun, a S&W .40 cal! Fortunately, it was a gun she rented, knew what she was getting into, and liked shooting.    During her pre-firearms career, Alisha was a high school teacher, covering biology, chemistry, forensic science, and criminal justice. The path to becoming an instructor was interesting. She was taking courses and another instructor took her in, said she would be good at this and mentored her. Then a range approached her and asked about having her teach courses at their facility. Instructing was a part time gig until the virus that shall not be named happened. The gun laws were changing and it seems like a good time to make a change.    As an instructor, she mostly works with women. Many times a woman takes a lesson and brings her husband's gun or buys a gun the store suggests she buys. But that often isn't a great choice for the ladies, something like a J frame snubby. The thought is if a woman isn't strong enough to rack a slide, then she's going to have issues shooting a revolver in double action.    Her business is called San Diego Concealed Carry. There are a couple of ranges where she teaches. In California to become a CCW instructor, there are three different paths one can take: the NRA path,  the BSIS (Bureau of Security Investigative Services) path, and the POST Police Officer Standard of Training). She's got all three of them. She also has all of the USCCA certifications, as well.    Certified with NRA, USCCA, and others, she offers several courses. Of course, there's CCW courses, the California DOJ initial course and renewal course, introduction to firearm courses, youth courses, self defense training, and the court mandidated courses, too. She keeps very busy and is very well versed in the Calif. gun laws and statues.    Besides everything else she does, Alisha was going to events hosted by San Diego County Gun Owners. I will say that having been to one of their events, they draw in huge numbers of attendees! In 2021, the capacity at Gun Prom was 999. If there were 1,000 people they would need "special requirements', if you remember. At one event, Michael Schwartz, head of SDCGO, and Alisha got to talking. He had some changes with Gun Owners Radio and asked her to be a co-host of the show. I've got to say, it's been a weekly listen for me for a number of years now, and I highly recommend it to everyone. She has her own segment called Curtin Call, where she talks about training.    Females are the largest growing demographic of firearm owners. It's fantastic that the ladies can take courses with someone like Alisha. It's also good that she can more than hold her own with the fellas, too. It was about 7 degrees outside when we met. And it was very windy!   Lizzie is a volunteer with Firearm Owners Against Crime (FOAC). FOAC is led by Jim Stoker (RSWC #187) and Klint Macro (RSWC #069 & #201). They're fighting all the time, like everyone else, with the anti-gun politicians. Lizzie is in it to make things better for her children and to make sure they don't lose the Right to Keep & Bear under her watch. They've got two groups, the ILLEA, Institute for Legal, Legislation, and Educational Action  and their Political Action Committee. The "crime" part of FOAC isn't "regular" crime; it's the crime of the politicians they're fighting.    For those who may be interested, the Pennsylvania carry permit is pretty easy to get. You need to fill out an application and give them a $20 bill. I went to central PA a few years ago to the Tommy Gun Warehouse and I drove a bit further to get my PA permit while I waited. It took an hour.    Lizzie has a history of gun owners and shooters in her family. Her grandfather was a chief of police. Her dad became a police officer, too, but he had several careers. As a young man, her dad was a Marine sniper and very much into shooting and fishing. As a young girl, Lizzie was into archery, joined the boys teams, and embarrassed them.    When she was older, she had some things happen in her life. When the police were called, they would often tell her "you're safe now" or "it's over, you're ok". But she didn't feel that way. That made her decision. She knew about firearms, but not enough to know what she was doing. She knew to keep her finger off and in a safe direction. Her first shots were with a Desert Eagle and that was a turn off, but then she went to a .22 and things were better. Finally, she settled on a 9mm.    Once she was comfortable shooting, she started thinking about carrying and that was something new to learn. She took some courses with Klint, started to draw from the holster and progressed through the program.  With her new skill and interest, she wasn't sure about instructing, but she was taking friends and family to the range. But she knew she needed something so she became an RSO through the USCCA. In the future, there could be some instructing for her. She could be a great advocate for female shooters. The hunger for learning and passing on is something Lizzie would enjoy.    We talk about some current events (from January 2026). It was hard to explain to folks that carrying two spare magazines isn't excessive or out of the norm for some folks. I have come around to believe that you need at least one spare mag for malfunctions.    With the FOAC events, Lizzie started running the gun bash. It's an event that raffles and auctions off firearms. It's a day to spend with others who are like minded and enjoy the shooting sports. They've also got the famous Wall of Guns! They hold these twice a year and it's all up to her!   There's lots of amazing volunteers working with groups all around the country. Lizzie was giving up a lot of time, in the cold weather, to spend at the Great American Outdoor Show. She was there all weekend. So, you know, my whole life I’ve really loved air guns. I had BB guns and air rifles as a kid. I had my, of course, the classic Red Ryder, and I had a Crosman 760 XL. Now, that was the Crossman 177 pellet and BB rifle, and the XL had the beautiful golden receiver on it. I don’t know if any of you had an XL version of the 760, but that was a really fun, great air gun. And I had a Benjamin. Man, that was a powerhouse, and it was .22 caliber pellet. You can pump that baby up, and that was my number one squirrel killer. And all as a kid. I shot squirrels in my yard, where my father had a giant garden. He needed to keep the squirrel population down, and I shot those squirrels. Then I cut off their tails, and then I sold the tails to Mepps Lure company, which would buy squirrel tails. I think they still might do that. And that got me some money as a kid. And it was used, of course, to buy more pellets and fun things. And I progressed, as maybe some of you did, to a love of adult air guns. Evan Nappen 01:59 And then, of course, Robert Beeman and air rifle headquarters. They were bringing in those premier, phenomenal air rifles that today are the standard of an entire sector of what I’ll call the gun world. Some of you may have had great RWS guns. My favorite were the Feinwerkbaus. I’ll never forget, my dad got a Feinwerkbau 124 from Beeman that he ordered. He had it custom ordered, and they worked out, worked up the innards on it. So, that thing was sweet. And ever since then, I’ve acquired many adult air guns. I have, you know, the finest Feinwerkbau ever made, the 300 series, the Olympic Feinwerkbau. It just shoots through the same hole. Evan Nappen 03:01 There are so many phenomenal air guns. And today, of course, the revolution in air guns is the pre-charge air gun. They have air guns that have tremendous ability for hunting, and air guns are just a blast. They’re fun. They’re a great way of learning firearm safety and shooting skills. A great way of Page – 2 – of 10 introducing young folks into firearms and the fun and joy of shooting. So, air guns are great. I have a deep love of air guns. Always have. I’m a collector of air guns. I love the history of air guns. And you may know that an air gun was taken on the Lewis and Clark expedition, which made a lot of sense, because the ability to get gunpowder in the wilderness is not an easy task. And with an air gun, there’s always air around. They would pump up that air gun and could use it to take big game. It was that air rifle. It is actually still known and around, that was used on the St. Louis, you know. When they left St. Louis, they had it with them on that great exploratory mission under President Jefferson. And air guns, even at one point, they were used militarily by the Austrians. Napoleon had the death penalty for anybody caught with an air rifle, and those were able to fire repeatedly with enough power to be used militarily. There’s an amazing history and air guns. But the modern sporting air gun today, all the way down to the BB gun, has a tremendous role. Evan Nappen 05:02 Yet, despite the tradition and the history of air guns in America, New York is now proposing a law to ban BB guns and air guns. The law that New York Democrats, of course, are proposing is to ban air guns by making air guns all being placed in a category of “imitation weapons”. (https://bearingarms.com/camedwards/2026/04/13/new-york-lawmakers-take-aim-at-bb-guns-n1232199) And by doing that, it would require that every air gun has a plug and specific coloration, and by putting them in that category, they will no longer shoot. Okay? So, you know, what’s the point there? The idea here being, if you make them an imitation firearm, and then they want to raise the age from 16 to 18. They’re selling this nonsense under a typical gun oppressionists lie of claiming police-involved shootings involving individuals who possessed an air gun, which was designed to look like a firearm. You know, the same way they sold the nonsense of cop-killer bullets, of which no cop has ever been killed by one. But why should that stop them from banning so-called cop-killer bullets. Anytime they get any angle that they can sell to the public and fool the public, who doesn’t have an understanding of guns as such, they do it. Evan Nappen 07:11 And here, New York now may become subject to what would essentially be a ban on air guns and BB guns. But let me say right now on the Gun Lawyer podcast that if New York succeeds in passing this law, there is a magic bullet, shall we say, that can kill this law. New Yorkers can shoot the eye out of New York’s air gun ban. The way to do it, I’m going to give you right now how to kill an air gun ban. It is under the United States Code, Title 15 (Commerce and Trade, Chapter 76), Section 5001. (https://law.justia.com/codes/us/title-15/chapter-76/) Evan Nappen 08:12 And this, my friends, is a federal law. It is a federal law that deals with imitation firearms. The reason this federal law is such an incredibly powerful weapon is that this federal law is an area of firearm pre-emption law. What it means is that federal law preempts state law. Federal law supersedes and is superior to, overrides. Overrides it, my friends. Overrides it. And because of that, we are able to take out state laws that attempt to interfere with air guns, and, for that matter, imitation firearms. The very thing that New York is attempting to use as the vehicle to create an air gun ban. Page – 3 – of 10 Evan Nappen 09:27 Let me tell you about Section 5001. Section 5001 first defines and lays out what is required to be on imitation firearms. It lays out what we have seen in the last few decades of having the distinctive markings, the blaze orange plug on look-alike or toy air guns and other imitation firearms and such. The look-alike firearm, which is what the law refers to, is defined as any imitation of an original firearm which was manufactured, designed or produced since 1898 including and Evan Nappen 10:21 limited to toy guns, water guns, replica non guns, airsoft guns firing nonmetallic projectiles, you know, such as airsoft and such. The term does not include any look alike, non firing collector replica of an antique firearm developed prior to 1898 or traditional BB, paintball, or pellet firing air guns that expel a projectile through the use of force or air pressure. And lo and behold, this section has a statement that says, preemption of state or local laws or ordinances. Preemption. The provisions of this section shall supersede any provision of state or local laws or ordinances which provide for markings or identification inconsistent with provisions of this section. Okay. Then it goes on and it says, ready? No State shall and then number one, prohibit the sale or manufacture of any look-alike, nonfiring, collector replica of an antique firearm. So, replica collector firearms are protected. And two, very important here for New York and any other state that wants to try to ban air guns, prohibit the sale parentheses, other than prohibiting the sale to minors end parentheses, of traditional BB, paint ball or pellet-firing air guns that expel a projectile through the force of air pressure. So, should New York be as repressive and stupid as to attempt to ban air guns, federal law preempts and nullifies, supersedes, that state law. Evan Nappen 12:54 Let me tell you another little factor, very interesting. I used this law successfully to attack New Jersey’s assault firearm law. In the case of Coalition of New Jersey Sportsmen versus Florio, which you can find at 744 F. Sup. 602, back in 1990, I challenged the then Attorney General, Robert Del Tufo. I brought an action, a civil action, challenging New Jersey’s assault firearm ban on a number, and magazine ban, by the way, on a number of things. One of the specific challenges was utilizing 15 U.S.C. 5001, which is the air gun preemption. New Jersey’s assault firearm ban, as written, included air guns, because air guns are firearms in New Jersey, and the ban on assault firearms and magazines by definition included air guns. And this case with Judge Garrett Brown, federal judge, had an injunction, which, by the way, this is why today you can still buy air guns, BB guns, pellet guns in New Jersey that may seem at first to fall under the definition of New Jersey’s assault firearm law because of this case and its outcome. The court found that the prohibition as it affects air guns was unconstitutional in that it was preempted under this federal law. Evan Nappen 15:06 So, there’s even case law enforcing this federal preemption as it comes to air guns, even in an assault firearm ban, no less a ban that specifically attempts to ban air guns and BB guns. So, I am giving this to New York as information, folks, and anywhere else that there is an air gun ban that we have a weapon. Believe it or not, air guns, BB guns, etc, are more protected than firearms in America. More protected because federal law preempts state laws from banning them. If we had federal preemption for firearms, then the only firearm law would be the federal law, and no state law banning guns would stand. But we don’t have federal preemption. Our federal gun laws, except with very limited narrow, a few laws like Page – 4 – of 10 Title 18, 926a for interstate transportation and for LEOSA, for law enforcement carry, and retired law enforcement carry, and for armored car carry. Except for a few areas like that, we don’t have federal preemptive laws on firearms, but we do have a federal preemptive law that protects air guns, BB guns and replica firearms. Evan Nappen 16:55 If we ever wanted to wipe out all the state bans, we’d simply have to make the federal law preemptive, but instead, the federal law specifically says it’s not preemptive. So what it does is it creates a situation, when it comes to firearms, that the federal law is the minimum gun law for the United States. Then the states are given carte blanche to go crazy, to do whatever the hell they want, to maximize the gun laws. Then the only thing that possibly limits states is the Second Amendment and its impact that we’re gaining ground every day in the courts. But if we simply said that the Gun Control Act of 1968, for example, and any of its other amendments are preemptive, it would wipe out all state bans instantly. Well, we haven’t done that, but we did do it for air guns, folks, and BB guns and replica firearms. It needs to be known out there so that when these attempts at bans are made by states or towns, this weapon, this hammer in our law, can be used to defeat them. Teddy Nappen 18:19 Out of curiosity, just thinking on New York and their other attempts, you know, they, I give them credit, they’re always very creative on finding ways to take away people’s rights. Could they make any laws that either try to make weird compliance requirements for air guns or air pellet guns? Where they would be effectively banned, basically, without saying, oh, you can’t have it. You just have to have all these different bells and whistles. Or is it just full preemption? And there’s nothing they can do. Evan Nappen 18:52 Well, it might, you might be able to create a license or permit system, maybe, if there’s no ban. Because currently in New Jersey, you still need a Firearms ID Card to purchase an air gun, or, you know, long arm. Air guns are technically defined as shotguns, even if they have a rifle barrel, and therefore a firearm, because they don’t fire fixed ammunition. So, it puts them into the shotgun long arm category, which is why you would need a Firearms ID Card. And if it’s a handgun, then you would need a Pistol Purchase Permit, if you’ve acquire those air guns in New Jersey. Now, if you acquire air guns outside New Jersey, federal law doesn’t view them as firearms. If the state you’re in doesn’t view them as firearms, like Pennsylvania doesn’t, you can acquire air guns outside the jurisdiction of New Jersey, and you can bring them back to New Jersey and possess them in New Jersey. Without even having a Firearm ID Card, if you possess them, by way of the exemptions. But New Jersey regulates air guns by way of firearm licensing, but it doesn’t, it cannot ban them. Judge Brown declared New Jersey’s assault firearm law a de facto ban, and because it’s a de facto ban, you can’t ban air guns with a ban, and the de facto band did just that. So, maybe New York, in theory, could create, you know, licensing, maybe. Depending on how they structure it. But an outright ban that forces guns that are air guns into an imitation firearm category, that requires a plug, is completely and utterly contradiction to the federal preemption law regarding those type of guns. Teddy Nappen 20:59 Watch as Hakeem. Watch as Hakeem Jeffries introduces a bill to repeal the air gun preemption. Page – 5 – of 10 Evan Nappen 21:06 You never know, right? I mean, he might. He might decide that. But this was fought for back in the day, and it was great that, I know, Daisy played a major role, by the way, in getting that legislation through. And it is why we have actually stronger protections for air guns, BB guns and traditional pellet firing guns of that nature, and for that matter, paintball as well. Even though we also have the In Re Gong case in New Jersey that protects paintball markers and why you can have paintball. Essentially soft air falls under this protection as well. So, it’s interesting how our laws have evolved. But this preemptive federal law needs to be better known and out there, to be used to stop these repression Second Amendment states from doing their thing. Teddy Nappen 22:11 Just to play with the idea. Let’s say, if things get very, very bad and the states start legislating. In terms of technology, do you think they’ll ever get to a point for air guns to be essentially like carry guns, almost where there’s a way around it? Evan Nappen 22:27 Well, you know, we have Byrnas, right? They fire projectiles that are essentially pepper balls. It was, given how much, you know, we might be able to do that. But federal law doesn’t preempt carry. They would preempt sale. And according to Judge Brown as well, sale extends to possession. It’s not just limited to sale. And really Judge Brown in the logic in that case could actually be used, I think, as an argument against what recently has been determined in the weird trick, as they call it, the weird trick, where they’re claiming that a sale isn’t protected under the Second Amendment, just possession. And that they can ban the sale of various semi-automatics that they feel shouldn’t be possessed, even though they’re not banning possession, and that somehow you can distinguish that. Evan Nappen 23:38 But Judge Brown cut through that garbage in terms of the air gun preemption by saying no, it is a de facto ban. When you ban the sale, you ban the possession. You could follow the logic of Judge Brown in that case and maybe apply it even in these other challenges and fights that we have. But, yeah, I mean, to make an air pistol that has the power of a weapon probably could be done. Look, even I don’t want to get shot with anything, even a BB pistol. Who wants to get shot with anything? But whether it would be effective enough for general, truly effective self-defense, remains to be seen. I don’t know of any actual lethal handgun development in air guns out there that is truly designed to be a self-defense gun. I don’t know of that. Now, less than lethal, of course, you’re dealing with Byrnas, when it comes to less than lethal. Evan Nappen 24:43 Hey, let’s mention our good friends at WeShoot. You know, Trump with the Pope. And I want to start things off. To every, you know, all the Catholic listeners, do not think on this as a theological lens. Think of this as a political. They were not, you know, I’m not arguing spiritual, the spiritual aspect of it. I am talking the politics, the hard core politics. And what do I see here? I see an individual arguing. If you were to listen to someone who made an argument for climate change, open borders, against capitalism and economic inequalities, and also pushing for gun rights oppression, you would assume it’s a woke Democrat, progressive. Yet, those are the views espoused by the Pope. The sources are here for that. (https://www.newsweek.com/what-pope-leo-said-abortion-gun-control-2070019) You can look it up. You can see it all across the internet. Teddy Nappen 28:51 Crowder did a great job breaking it all down. (https://rumble.com/v78i7r0-trump-vs.-the-vatican-why-the-pope-should-stay-out-of-politics.html) But I wanted to dive a little deeper on the thing that matters to us the most, which is the Second Amendment. Evan Nappen 28:59 Wait. Who’s Crowder? Teddy Nappen 29:00 Steven Crowder. He is Louder with Crowder. He does a great show. He breaks down the whole deal and shows what this individual, prior to becoming Pope, would go to bat on. Bashing Trump, bashing J.D. Vance, pushing for open borders. Oh, my God, what’s that thing surrounding the Vatican? Page – 7 – of 10 Evan Nappen 29:19 Oh, you mean the wall. It’s pretty crazy. I’ve been there. Vatican is cool. It really is. Teddy Nappen 29:24 Yeah, and that’s what I mean. You have to. And then, of course, he goes on and says, I don’t want to talk about politics, but then voices his opinion on every political stance. It’s incredibly disingenuous. And almost I want to call, to call, like, cognitive dissonance, where he’s understanding, like, how much that comes off. So, just to point out a few things here. This comes right from the NCR online, right here. From the Pope, when it was two bishops, we hold prayer. This is after one of the big shootings. We hold prayer for the countless to the countless children killed and injured every day around the world. Let us plead to G-d to stop the pandemic of arms, large and small. I have heard that term many times, the pandemic of arms. Where does that come from? Oh, the gun rights oppressors. And the same Cardinals. Evan Nappen 30:24 Well, wait and the reason is, by making it, putting it in a health context, they want to use it. So, they can use it to go after the political issue regarding health insurance. They want to make it a health issue. This was their actual plan, and I personally heard it espoused early on by Josh Sugarman, when Hillary Clinton was pushing for national health care. How they want to make guns a health issue, and they sure as hell have done a good job of that, actually. And they’ve gotten the CDC involved. They got the pediatricians and the doctors. You’re asked questions about, are you a gun owner? By your doctor. This didn’t happen by magic. This is all part of the plan. So, by calling it pandemic, by looking at it in that way, it’s pushing the gun rights oppression via the political issue of health care. Teddy Nappen 31:32 Yeah, and also the fact that his fellow Cardinals at that time were also taking it a step further, saying the facts are clear. Guns are plentiful and common sense attempts to limit their availability have largely been rejected in the name of freedom not found in our Constitution. Huh? I don’t think they read the Constitution, or they skipped some pages. You know, they only went to the things that mattered to them. But I didn’t hear him call out and say, no, no, we’re not about that. We’re not about disarming our people. By the way, it doesn’t really work out too well when a group of individuals are disarmed. You know, those of religion, of religious faith. Just looking at history, mind you. Going back, by the way, this goes back even prior to, when he was just the Cardinal. In 2017 after the mass shooting in Las Vegas, he reposts Senator Chris Murphy, Democrat, to my colleagues, your cowardice to act cannot be whitewashed by thoughts and prayers. None of this ends unless we do something to stop it. Increase access to mental health care and stronger, quote, unquote, sensible gun control laws. Hmm, I wonder what that sounds like. Evan Nappen 32:48 Yeah, it’s true. Well, you know, there’s the politics of it, then there’s the economics of it. You know, there’s donations and such. There’s all these kind of things that have unfortunately skewed, skewed what’s going on. As a matter of fact, I want to mention, and I don’t know if I ever told you, Teddy. About the time that Frank Perdue, okay, remember Frank Perdue with Purdue chicken there? Well, he wanted to better promote chicken, which was always his mission. You know, it’s true, true story about him. Page – 8 – of 10 Remember his slogan? It takes a tough man to make a tender chicken. Right? That was his slogan for many, many years. You’d see Frank Perdue’s face on billboards. It takes a tough man to make a tender chicken. And this is a true story now. I know this is a little bit off the topic, but I’m going to get back to how this applies to what you’re talking about. Evan Nappen 33:49 But they did try to market in Spain, true story. And when the translators translated, it takes a tough man to make a tender chicken in Spain, they put up the billboards with Frank’s face, you know, with his slogan. And the translators for the word “tough” used the word “macho”. We all you know, in America, macho means tough. However, in Spain, in Spanish, “macho” means “sexually excited”. So, everyone was driving by billboards with Frank Perdue’s face, saying, it takes a sexually excited man to make a tender chicken. But I digress. Evan Nappen 34:27 Let me tell you about what happened when Frank Perdue really wanted to market chicken. And, you know, he went to the Pope and he said, I would like you to change, Give us this day our daily bread, to Give us this day, our daily chicken. And the Pope said, No way. I’m not going to do that. He goes, look, we’ll donate $10 million to the church. What do you say? Pope said, No, not doing it. Frank Perdue upped his offer, 100 million. The Pope wouldn’t do it. This one is just everywhere, because New Jersey has made anyone who gets a mental health commitment, involuntary or voluntary, it becomes a disqualifier to get a gun. Folks, let that sink in. If you voluntarily check in to get mental health help, as soon as you voluntarily commit to getting the help, guess what? You now have cost yourself your gun rights. Under New Jersey law, within five days of that, you’re supposed to turn in your Firearms ID Card. You become disqualified under New Jersey gun law. If you simply have seen any doctor or psychiatrist for a mental health reason, New Jersey will question you about it. And now you will have the added burden, just on seeing a doctor, no less a voluntary commitment, okay? Just seeing the doctor. Now you’re going to have to find a doctor willing to say that you’re safe for firearms. And the problem is, doctors are cowards. Even if they know you’re good for guns, they don’t want to say it. Because if there’s ever a problem, they’re afraid they’re going to get sued. And if you ever have a voluntary commitment, well, that’s just a per se bar. If it’s an involuntary commitment, well, you’re not only banned under state law, but you’re banned under federal law, my friends. Beware of the mental health trap that exists which will disenfranchise you of your gun rights. And look, I get it. If you need mental help, then I don’t want to say, don’t get it. But make sure you have, in your calculation, what will the ramifications be? It’s not something to do lightly, that is for sure. You know, our show does have a lot to do with what’s going on with New Jersey, because New Jersey is, as you know, the worst state in the country when it comes to oppression of our Second Amendment rights. And by bringing more and more attention to it, we shine that disinfectant of truth out there. So, this is important, and we want to keep up the keep the pressure. Teddy Nappen 01:44 Do you know what we should do for when we for the awards, we don’t go to accept it. We instead send a couple people who are recently released from the Gun Owner Gulag to accept the award. Yeah, like Marlon Brando sent Evan Nappen 02:00 Yeah, right. We’ll send someone from the Gulag to accept the award. I spent three months just to get out, even though I was innocent of all charges. You know, it’s just insane what New Jersey is doing. We’ll be reporting on the new laws that the Governor has yet to sign, but it appears that he will sign further oppression of our Second Amendment rights in New Jersey. And what you have to be aware of so you can protect yourself, because it is really just the extreme government action focused on attacking the Constitution. I mean, that’s what New Jersey is doing. It’s a fact. They try to contrive every conceivable angle to further deteriorate a Constitutional right. Instead of doing everything they can to Page – 1 – of 10 try to protect it, they do everything they can to try to diminish it. That’s the evil of what the New Jersey government is all about, and that’s really what it is. Evan Nappen 03:18 It is anti-rights, anti-Constitution. They are oppressors, and good people suffer. Good, law-abiding citizens suffer. This isn’t an academic exercise. Real people go to jail. Real people have their lives destroyed. Real people have their careers destroyed, their freedom taken and their families destroyed, over this garbage that New Jersey does in turning law-abiding citizens into criminals. I see it every day in the practice of New Jersey gun law. And the purpose of gun law, Gun Lawyer, of this radio show, is to bring attention to this. To help you, the listener, protect yourself from the evil oppression that is New Jersey. And they will, without any care, destroy you if they can, to promote their agenda, their agenda of destroying guns and gun owners. And this is what I see. Okay? This isn’t just hyperbole. It isn’t some made up fantasy. It is literally what I see happening to individuals as I practice in the, in this very area of New Jersey gun law. And it shows you when you have states that are following this agenda, how they destroy good people. So, you’ve got to be careful, especially in New Jersey. But do not give up. Maintain the fight. Stay vigilant. It’s critical. In the big picture, we are winning. New Jersey is going to get its head handed to it. I’m confident in the court decisions that we’ll be seeing. We will succeed. But in the meantime, it’s a battle. I want to see the least amount of casualties on our side in this battle, but it’s a battle nonetheless. Evan Nappen 05:24 And on that point recently, there was an article by one of my favorite writers, Dean Weingarten, who posted this in AmmoLand. He makes a very interesting point about what happened to the homicide rate after the Supreme Court’s Bruen decision. (https://www.ammoland.com/2025/12/what-happened-to-the- homicide-rate-after-the-supreme-courts-bruen-decision/) So, you know, we have this great Second Amendment decision in Bruen that establishes our right to self-defense outside the home and that actually finally enables the carry permits to have to be issued by the anti-gun oppression states like New Jersey that were using the trick of “justifiable need” to stop law-abiding citizens from being able to have a gun to defend themselves, and the legal barrier that the courts created knowingly to oppress rights was working. Evan Nappen 06:25 You know, we had less than 600 carry licenses. And the Bruen decision handily eliminated that, so that licenses had to be issued. Now we’re in the, you know, 60, 70, 80,000 licenses. The number is hard to pinpoint, but it’s constantly growing. And this is great that so many citizens now can be defenders instead of victims. But New Jersey, of course, embarked on trying to limit where you can use your carry. Hence, the “sensitive places”. This crazy matrix of where you can and can’t carry which is also the subject of a court challenge, and we should be seeing some great outcome there, as the, as the Appellate Court has taken on that issue again. Seeing New Jersey’s gun laws go up in flames and go to the garbage can, the garbage heap of history where they belong. Evan Nappen 07:29 But this article from Dean Weingarten about what happened to the homicide rate after the Bruen decision is really very interesting, because it’s a very interesting question. I mean, what this goes to is, Page – 2 – of 10 every time there is anything that is pro-gun rights, pro-enforcing our Constitutional rights, anything that expands our ability to exercise our rights, the anti-rights crowd, the oppressors, will shout what I call BITS, bits. Which is Blood In The Streets. There’ll be blood in the streets. You know, this is going to be the Wild West. This is going to be, you know, just the sky is falling, right? Every time, every time. And so, of course, the prediction was, if we have carry, we’re going to have blood in the streets. And it’s going to be terrible and all this mayhem. And guess what? The opposite, of course, the opposite. The opposite happened. Evan Nappen 08:31 Because as Dean points out in his article, it says. “As of the latest numbers of October 2025, the 12- month running average of violent crime has dropped 14% since June of 2022. The drop in murders is even more pronounced at 39%. The numbers are from the tools provided by the Real Time Crime Index.” How about that, folks? Murder down 39%. Violent crime down 14%. This is tracking, as you and I always knew it would, when law-abiding citizens can defend themselves. Now, of course, it’s not the only reason that violent crime and murders have gone down, but it is absolutely a contributing factor. And the antis are always quick to say. Well, if it just saves one life, we need to. Well, guess what? How many lives have now been saved by the expansion of our rights to carry and defend ourselves since the Bruen decision? Way more than one life, that’s for sure. Lots of lives, lots of lives are being saved because of Constitutional freedom being expanded and protected and preserved. So, this is important to recognize and to force our adversaries to face the fact that guns save lives. That trained law-abiding citizens are lifesavers, and that firearms are protection that is effective. Not just to that individual defending themselves or their families, but in the big picture, the statistics themselves speak to the benefit of it. Evan Nappen 10:54 Hey, I would also like to mention our good friend, John Petrolino, who does amazing journalistic work. And it’s not just me saying that. I’m happy to mention that John recently was given an award, and actually more than one from the New Jersey Society of Professional Journalists. (https://bearingarms.com/camedwards/2025/12/30/petrolinos-coverage-of-new-jersey-2a-issues-earns- accolades-from-surprising-source-n1231070) They announced winners of the 2025 Excellence in Journalism Awards. And we’re talking about winners that include the New York Times, the Asbury Park Press and Politico. Evan Nappen 11:39 Well, lo and behold, there’s John Petrolino, one of the contributors for Bearing Arms and a great writer. He really has done tremendous work in New Jersey, and he won first place for “Best Coverage of State Government” for his series of articles highlighting abuses of the “shall issue” carry permit system. These very abuses of which demonstrate institutionalized racism. He documented excessive wait times and how the number of black applicants are discriminated against. And this research was, in fact, corroborated by the group Rise Against Hate, which, you know, they’re normally not a 2A group. And he won first place also for “Best Coverage of Municipal Government for his Bearing Arms story “Permit to Carry Denial Over a Driving Record?” And he’s really gotten praise here from his fellow journalists, and I think it’s great. Because not only does he deserve it, but imagine, you know, we’re talking about real journalism here, not the propaganda that the lamestream media throws at us. I mean, we’re talking Page – 3 – of 10 about real journalism that puts out a product that is otherwise not being seen, and in doing so, aids our Second Amendment rights and helps fight the oppression with the disinfectant of truth. John, congratulations on your awards. That is just really great, because when you win, we win, and it gets the message out. So, that’s a great job, and we’re proud of you. Teddy Nappen 20:11 Well, as you know, Press Checks are always free, and I always want to see what is the Left, what is the argument they are making now? What is the push that they are trying to go for? Well, it seems they’ve gone and changed their tactics. They are now focusing in on high capacity magazines, or as what you know and everyone else knows them to be, standard capacity magazines. Because it’s just another made up term that they use. But going to The Trace to see their newest argument, I love this, by the way. “How Gun Manufacturers Swamped the Market With Large-Capacity Magazines” (https://www.thetrace.org/2025/12/large-capacity-magazine-nssf-gun-study/) Yes, that’s who is to blame for why there is such a high demand of a quote, unquote high capacity magazines. It’s the gun manufacturers. That’s who’s to blame. So, this article is by Mike Spies in The Trace. They start off with “At least 717 million devices like the one used in the Brown University mass shooting . . . ” Oh, well, there you go. Immediately. The first line. Evan Nappen 21:23 All they do is sell emotion. They’re just selling it as emotion. What about, you know. Do you know what a small, virtually, statistically irrelevant, it’s so small, the number of magazines, of a magazine that holds whatever they’re calling high capacity of that day, whatever that may be, was the reason, was the effect for that crime. Because the magazine held a certain amount of rounds. That is somehow the reason for the crime. It is a statistical irrelevancy. It is pure emotion. Teddy Nappen 22:07 I wonder how they, I wonder how they feel about in Australia, where it took, you know, two guys with a couple of bolt actions. And, you know, I think the body count was what? Double from Brown. But no, sorry, don’t talk about that. Page – 5 – of 10 Evan Nappen 22:20 Right. Teddy Nappen 22:21 Mind you they try to highlight this. Oh, man, Dad, did you know that between 1990 to 2021, the gun industry flooded the market with 717 detachable firearm magazines that held 11 rounds or more. You see, Dad, prior to 1990, there were no magazines that held over 11 rounds. Evan Nappen 22:46 That’s what it was? None. There was suddenly a flood. Teddy Nappen 22:52 A flooding, as a flooding. Then describe what the term a magazine, you know, for anyone doesn’t understand. And then tried to make the argument that not all manufacturers of gun magazines provided data to the study to stipulate the figures representing conservative estimates that military and law enforcement sales were not counted, and roughly 46% of magazines were accounted for from some 443 million, including rifle magazines that held 30 rounds or more. Evan Nappen 23:26 Okay. So, if we have millions and millions and millions of magazines that hold over 10 rounds, do you know how few isolated events, just think of how many few events? They get a ton of media coverage, but how few those events are. And even in those events, what statistical difference did it make that they had a magazine that held more than 10 rounds in commission of that crime? It is so rare and to have to this be of anything, of any real impact, of any true impact, yet it’s pure emotion there. So, oh my God, all these magazines are out there. Yeah, well, so what? So, what? They don’t make a difference. The only time it makes a difference is to the individual who needs to defend themselves. Then the issue of firepower is important in one’s own self-defense. So, when magazines are limited, the question you have to ask is, well, how many bullets is your life worth? In other words, how many bullets can you have to defend your life? Your Government has arbitrarily determined that your life is only worth 10 bullets. No more than 10, just 10. That’s all it’s worth. You’re not worth 11 bullets or 12 or anything more. That’s really what they are saying. Teddy Nappen 25:00 They also seem to stress this whole idea that magazines were only at 10 rounds until 1990, and they’re trying to make that argument. Well, thanks to again, always, when the left make their argument, use context and history, and that is how it is debunked. Right here from, I believe, you said this was a very well known writer, Dave Kopel. Evan Nappen 25:29 Absolutely. David Kopel. Page – 6 – of 10 Teddy Nappen 25:30 He wrote a brilliant article, which I highly recommend people read, “The History of Firearm Magazines and Magazine Prohibition”. (https://davekopel.org/2A/LawRev/2015/History-of-firearms-magazines-and- magazine-prohibition.pdf) Evan Nappen 25:33 Well, it must be a short history, since it only began in 1990. Teddy Nappen 25:44 No, no, let’s start with. Evan Nappen 25:46 Oh, really. Teddy Nappen 25:47 Yeah, you know, let’s go all the way back to 1580. Evan Nappen 25:51 Oh, 1580. Wow, how did they miss that? Teddy Nappen 25:55 I know. With the multi-shot guns. And then cut to the patent pending, 1718, of the Puckle Gun, shooting, you know, 23. Evan Nappen 26:05 I love the Puckle gun. Teddy Nappen 26:06 You know, it used 11 pre-loaded cylinders. And then cut over to everyone’s favorite, the Lewis and Clark air rifle, the Girandoni, that had a detachable magazine. Evan Nappen 26:20 And air guns are firearms in New Jersey. So, it would still considered a firearm. Yeah. Teddy Nappen 26:27 Yeah. So, and cut over to the Alexander Hall and Colonel Parry Porter rifles that were 15-shot rotating cylinder. But they may say, oh, it’s not detachable, though. Even though it’s well beyond the capacity, and you know this is only 1850. Cut over now to the 1866 chain pistol fed , 20 round, belt fed chain pistol. Imagine carrying that? Evan Nappen 27:00 I like that. Page – 7 – of 10 Teddy Nappen 27:01 Yeah. And then cut now to 1899 with the, or 1900 when they were commercially available, the Luger semi- automatic pistols that, you know, could use a seven or eight round magazine or a, you know, their version of a high capacity 32 drum mag. Evan Nappen 27:21 Oooh, the old snail drum mag for the Luger. Teddy Nappen 27:25 And then cut to 1927 where you could go to Auto Ordinance for a 30 round mag. Evan Nappen 27:32 Or a 50 or 100. That’s right. Teddy Nappen 27:35 In 1927, you know? Well, we’re getting, we’re getting closer. You’re getting around that time. But now to 1963, with the AR-15 rifle, with the 20 rounds, a little higher than that, to 30 round magazine capacity. Which to the point, where there was a famous (Supreme Court) case, Staples versus United States, where they were trying, where it differentiated from the AR-15 to the M 16. They tried to blend machine gun to semi auto. Evan Nappen 28:06 Well, they did that on purpose — to fool the public. It was even admitted in Josh Sugarmann’s book. He said that was the intention — to fool the public, who won’t be able to tell the difference between full auto and semi- auto. Machine guns and semi autos. It’ll fool them, because that’s what they’re about. They just want to fool the public to get their agenda through. Teddy Nappen 28:27 Because they, because the Left have this whole ideology, which is the people are stupid and we can manipulate them. Unfortunately, yeah, there’s a lot of people that aren’t read up on it and get easily tricked. They play off of emotions and that’s how they play their game. Luckily, now, thanks to the internet and people being able to do their own research. Even though they’ve, you know, censored, but we’ve fought back hard on that, people can actually see and look up and find out. Oh, yeah, wait. They just lied to me. Here’s the proof. It’s very easy now to debunk their lies, and it’s quite hilarious. Teddy Nappen 29:08 And then I love the ending to it all. I love his ending to the whole article, which is we end this story now in 1979. Jimmy Carter is president, and Gaston Glock is making curtain rods in his garage. Now, look right now. Evan Nappen 29:28 Oh, no, the Glock pistol is coming. Page – 8 – of 10 Teddy Nappen 29:30 Yeah, the Glock pistol is coming. And then all magazine which, and then all polymers. It just comes down to this. The magazines, high capacity magazines, have existed throughout history, and they will continue to exist. Because when they try to sell their argument about high capacity magazines, you know, they will forever be out there. Evan Nappen 29:59 What’s going to happen when it is just laser, and it can be endless? Just how much power. There won’t even be a capacity limit. It’ll just be limitless, essentially. Evan Nappen 30:13 I’m so. Sorry, my wife is always about the teleporter, where you won’t even need to load the mag. You’ll just point the gun and it’ll teleport the bullet into you, like. Evan Nappen 30:24 Oh, that sounds like a real accuracy improvement. Teddy Nappen 30:27 I know. So, again, technology will always progress more and more, and they will never be able to keep it. I can’t wait for the National Ray Gun Association. I think it was a Futurama joke. Evan Nappen 30:39 A National Ray Gun Association. That’s good. Evan Nappen 30:46 So, you know, one of the key things we like to do is have our listeners stay protected and not end up a GOFU. And unfortunately, GOFUs are Gun Owner Fuck Ups. They’re expensive lessons that you get to learn on the cheap. You get to learn for free, so you don’t commit the same error, the same fuck up. And so this week’s GOFU, something that, you know these come from actual cases, actual experience, actual folks that I’m representing. And it’s really a principle here today, and that is, don’t escalate the situation. Don’t be the person that initiates a problem that can be avoided. If you can avoid a conflict, you need to avoid the conflict. You cannot engage in a manner the way you used to, let’s say, before you were armed. Evan Nappen 31:56 Because you are armed, you’re essentially having to walk away. If something is just verbal, whatever, don’t escalate it. Don’t engage further. Because then what happens is you, as a gun owner, become the target of the law enforcement action, even though you weren’t the one who may have even initiated it. But if you escalated and went along with whatever this problem was that even got created or started by another person, you end up having to pay the price. I see this often where a law-abiding gun owner has an argument with somebody, and the law-abiding gun owner is in the right. The law-abiding gun owner doesn’t do anything wrong, but the other party somehow sees, notices, believes, thinks, that the gun owner has a gun, and then claims to the police that they saw the gun. You threatened them with the gun. They felt intimidated by the gun, whatever. Page – 9 – of 10 Evan Nappen 33:19 And it’s now escalated to where the gun owner gets charged with threatening, brandishing, whatever, and you just see it take off as an escalation. You need to learn to ignore all the jackasses that are out there that cause trouble, that act stupid. You have to take a different kind of attitude to ignore these people. Ignore them. Unless you are being threatened with serious bodily injury or death, where you have no other option, then ignore these people. Get away from these folks that are just trouble. Because if it comes around that you’re a gun owner, and there’s an issue, I see it. The tables turn on the gun owner all the time. Stay low key. Stay discreet. Don’t escalate. Stay away from these people that get law-abiding citizens into trouble because of the built in bias in the system against gun owners. Lee Strobel is an American Christian author, apologist, speaker, and former investigative journalist who transitioned from an atheist investigative journalist into a leading Christian apologist and author, blending rigorous investigative methods with his faith journey to influence millions worldwide. He later assessed into the 160th Special Operations Aviation Regiment (Airborne), flying the MH-47G on heavy-assault missions in direct support of special mission units. Across twelve combat deployments flying both the Apache and Chinook, he gained extensive experience in complex, high-risk environments.   After the Army, Gavin served as a police officer in Southeastern Wisconsin, completing advanced LE training, including ALERRT and SWAT school. He now leverages his combined military, law-enforcement, and instructional expertise to strengthen USCCA training programs and enhance the readiness and capability of responsibly armed Americans. Riding Shotgun With Charlie #243 Tonya Franklin   Back in 2020, Tonya reached out to me. She was very involved with her local politics and wanted to talk about how the news on the "pandemic" was nonsense. She's been in the medical field and may have been helping folks get a medical exemption to the vaccine. She's also a gun instructor who offers NRA and USCCA courses as well as medical courses, which is her background. Growing up in Illinois, I was taking several trips to visit family and friends. On a recent trip, I was able to make plans with Tonya and catch up with her.    Firearms weren't really her thing for some time. Her family moved from Florida to Illinois for her husband's career as a pilot. Learning about the FOID (Firearm Owners Identification Card), she thought it was ridiculous.But since there were firearms in the home and it was required by the state, she got it. When you make her do something, she says she's going to do it all the way. So, her new thing was the Second Amendment. She took several courses as a newbie, and noticed she was surrounded by males.    Over the years, Tonya took a number of courses to learn all the fundamentals. The first female instructor she had was none other than Jan Morgan. Morgan owns a range in Little Rock, AR. That's when Tonya decided that she was going to be an instructor.    In the fall of 2020, Tonya got heavily involved in A Girl & A Gun, the nation's top female firearm group. Her chapter has over 100 women in it. AGAG hosts a conference every year and has chapters all around the United States. Tonya started one in McHenry County, Illinois. The first meeting was at her house and it was packed to the rafters! They also host courses and events at some local ranges and at her home classroom.    When concealed carry became a thing in Illinois in 2013, she jumped all in with both feet. She became an instructor through both the NRA and USCCA, as well as a Training Counselor so she could teach the instructors. The permitting course requirements in Land of Lincoln is a whopping 16 hours of class time! Her business, Act Fast Academy, offers several firearms courses, but also medical courses, which is also important for gun folks to take. With a career teaching in the medical field, getting into firearm instruction was a no brainer.    During 2020, things were tough in the training business. With the state mandated live fire as part of the training, Tonya started going into her own stash of ammunition to keep the instructing business going. She has noticed a pattern that every four years, there's gun and ammo issues, which just happens to coincide with the presidential election years. Buying ammo can be tricking in states like Massachusetts where they keep track of what you're buying. On the flip side, they're also going to require that people do live fire to get permits.    All the training she's taken for herself and her students, getting certified with NRA and USCCA, and going out to competitions has earned her respect. Through her AGAG connections, she's been going to Outdoor Texas Camps to work with young females aged 9-17. She gets to instruct young women in all types of firearms and shooting. The camp has pistol, rifle, shotgun, fishing, archery, mock blood trails, fly fishing, and a whole host of events. With her experience and expertise, she keeps getting invited back.    Tonya is very energetic! She's offering courses all the time. Victor L. Vescovo is a private investor with over thirty years of experience in a variety of complex business situations. He co-founded private equity firm Insight Equity in 2002 with his business partner, Ted Beneski and raised over $1.5 billion in equity capital across four funds. In 2023, he departed Insight in order to focus on his own investments with new capabilities to support industrial startups, life sciences, and other areas of venture capital and special situations. Victor received his bachelor's degree from Stanford University, a Master's Degree from the Massachusetts Institute of Technology, and received an MBA from Harvard Business School where he graduated as a Baker Scholar. Additionally, Victor served 20 years in the U.S. Navy Reserve as an intelligence and targeting officer, retiring in 2013 as a Commander. In 2017, Victor completed the “Explorer's Grand Slam” which requires climbing the highest peak on all seven of the world's continents including Mt. Everest and skiing at least 100 kilometers to the North and South Poles. He piloted the first repeated dives to the ocean's deepest point, Challenger Deep, in the Pacific's Mariana Trench - now fifteen times, and in August 2019 became the first person to visit “The Five Deeps,” the deepest point in all five of the world's oceans. Victor has now personally explored the bottom of seventeen deep ocean trenches and has made three dives to the Titanic including the only solo dive ever made there. He and his team also discovered and surveyed the two deepest shipwrecks in the world: the USS Johnston in 2021 and the deepest, the USS Samuel B. Roberts at 22,600 feet, in 2022. In 2025, the US Navy announced that T-AGOS 26, a new ocean surveillance vessel of the Explorer class, would be named after him. He is also a commercially rated, multi-engine jet, glider, seaplane, and helicopter pilot, a certified submersible test pilot, and recently flew into space on Blue Origin's New Shepard rocket, becoming the first person in history to climb Mount Everest, dive to the bottom of the ocean, and visit space. I was doing a show, someone slipped his card into my pocket, and said reach out to this man. We started following each other on the socials. At NRA AM, we had a chance to film a show.    Evered didn't get into firearms until he was a father and going through a divorce. He realized that the layout of his place wasn't necessarily the safest. There was potential for some he said/she said going on. So it was time to pursue getting a carry permit in Georgia.    His first purchase was a Mossberg 88 shotgun. Maybe not the best choice, but we all start somewhere. We've all been “tactically frugal.” He said he went all “Amazon tactical” buying things like a scope and a light to put on the gun. He admits “this is why you got to research and study.” His first trip to the range with the Mossy was a bit embarrassing. He wasn't sure how to hold it so he ended up putting it under his armpit.    This is how he started down the rabbit hole to see that rights are being taken away from us. His taste in gear has also matured since then, too. He moved to a Canick and a Ruger handguns.   One of the goals that Evered has is to become an instructor. After his divorce, things were tough. His daughter was only 6 months old when that happened. He wasn't getting enough time with her.  But  he's looking into getting certified by either the NRA, the USCCA, or by NAAGA. He has been helping some friends get into firearms and helping them along their journey.  Taking other courses as a student has helped him get through the hard times that affect divorced people.    Georgia is a permitless carry state, but they still issue permits. Back when Evered was getting started on his firearm journey, he still needed to get a permit and there was a learning curve for that, too.    The Black Powder Podcast is mainly focused on black society and firearms. He takes the name from a cartridge. The fans are the powder. The bullet is the message he's putting out. He ignites the fans to get the message out. He dropped his first episode on Sept 11, 2020 as a reminder of how we all came together as a country.  It was a good year for new beginnings with all that was going on. And thus, a good time to get the new gun owners from 2020 into the fold and learn about firearms, safety, and how and when to use them. Since SHOT Show, he's gone from just an audio podcast to adding video, which he drops on Mondays.    Before Black Powder Podcast, he was doing Warbound Radio. It was more towards video gaming. But he plans on rebranding that and bringing it back as a men's positivity podcast. Going through his divorce, he became much more aware how the family court system leans toward the mothers and not the fathers.    This past year was Evered's first year at SHOT. A friend helped him get in. He's working on a lot of things and I think he's really getting his message out. He's got the Black Powder Podcast and YouTube channel. He's working to become an instructor.
