The Foundations Series is a new web content venture from CLS aimed at helping Christian law students transition from 3Ls to first-year associates. It features Christian practitioners skilled in the integration of faith and practice, offering guidance in conversation with students at the early stages of their legal development. My guests today are James A. Boatman & Stephen Schahrer, collectively from the Florida law firm Boatman Ricci. James is a commercial litigator with extensive experience in both federal and state courts. He has handled a broad spectrum of matters including: contract enforcement; foreclosure prosecution/defense; internet wire fraud prosecution; special asset recovery; construction defect litigation; common law tort cases (fraud, defamation, etc.) and many others. Stephen handles legal matters for clients from “all walks of life” in the area of business and commercial litigation including business litigation, construction defect and lien litigation, real estate litigation, general contract litigation, and trust and estate litigation. Before law school Danney worked for 5 years as a paralegal. And before that she attended  Florida international University where she majored in political science.  While working she knew she didn’t like personal injury, but fell in love with criminal defense law.  After quitting her job, she took 6 months to study for the LSAT and applied to New York Law School! She tells the ladies how she made a lot of friends her 1st year, but sadly lost her scholarship at the end of it. So when it came to 2nd year, she knew she had to make some changes! After developing better time management skills she saw a huge improvement in her grades. Her story doesn’t stop there! After graduation, like many other students, she began to study for the bar. But she didn’t study the way she needed and ended up not passing the 1st time. As she studied for the 2nd time with a coaching company - Vinco Prep, she started to notice something wasn’t quite right. After going to the doctor she found out she had a stomach ulcer. She continued to study and even though she didn’t pass she was proud of a *HUGE* jump in her score. Then 3rd time studying and cue the pandemic. Her mom and brother got covid in the middle of her studying and it all hit Danney really hard! BUTTTT Danney passed the bar in a pandemic and is now an Attorney! She talks about how she was hesitant to work in immigration law because of her past and the emotions it brought back. She attended University of San Diego school of law because she got the best scholarship. Kelly applied to over 15 law schools and ended up with a full ride for 1st year! While she interned in law school she said she did lots of learning. Like at the PD & DA offices, she decided NO criminal law. Kelly finished in law school 2.5 years, and passed the bar the 1st time, at just 23 years old!   Kelly got into family law in law school with the domestic violence clinic. After passing the bar, she worked at multiple law firms in the San Fransisco area in insurance defense, for 5 years. However, she found herself always doing pro bono hours in family law, and needing independence in her schedule, so she decided it was time to start her own firm, at 30 years old! Tips Owning your firm: Have an online presence (make a good website and get the word out) ; also, Volunteer  / TV exposure / Get know in your community ; and get to know lawyers and judges on the bench. Phuong Nguyen is a CFA charterholder. He is a value-oriented and fundamentally driven investor. He has 8 years of experience in the investment industry with various buy-side firms and has lived through some, a few of the tough market times. In his view, the Asian investment landscape is uneven and investors should sharpen their investing acumen beyond the face value of data or information. He manages his family investment account, which has delivered an annualized return of more than 30%, which is more than 15% over the benchmark. Meanwhile, his portfolio since its inception 4 years ago has only sustained an average 14.1% downside volatility compared to 23.9 for the benchmark. He is currently exploring a global career opportunity to apply his rigorous research process and investment acumen. His core expertise is in Asia-Pacific markets and he is a member of the CFA Society Singapore.   “I make it worse by using leverage, Charlie Munger and Warren Buffett talk about the 3 Ls to avoid, which are ladies, liquor and leverage: leverage I used it. It turned out to be bad for the investment.” – Phuong Nguyen   Lessons learned Don’t forget the 3Ls. Phuong referred to Buffett talking about him and his partner Charlie Munger’s attitude to leverage when he said: “There are only three ways that a smart person can go broke: liquor, ladies, and leverage.” Leverage in Phuong’s case meant borrowing money from a broker in the hope of having the money multiply to the extent that the loan can be repaid with interest to leave enough of a gain to profit from. Look out for all potential headwinds. Avoid emotional bias after meeting a company’s smiling faces. No matter how charming a company’s management is, how convincing and humble they are, do not act to invest in a company right away after you meet the company because at that time you will be suffering from emotional bias. Stay away from them for about a week, do more research and only then can you look at the investment again. Despite a company meeting and your feelings about investment going well, emotions should be kept in check.   “Our aversion to leverage has dampened our returns over the years. But Charlie and I sleep well. Both of us believe it is insane to risk what you have and need in order to obtain what you don’t need.” – Warren Buffet   Andrew’s takeaways Be mindful of the effect of confirmation bias. It’s human behavior to look for information that confirms our original views or hypothesis on a matter, and everyone in all fields suffers from that bias. Therefore, investors especially have to work extra hard to find opposing views or arguments against our thesis on an investment idea. Be wary of cyclical. When investing in cyclical type of companies, it can be extremely dangerous. A lot of people like to invest in consumer-type products because generally demand is steady and supply is steady. But when you’re investing in cyclical, there is a much greater risk, which sometimes is what attracts investors because of the old magnet: “high risk, high return”. On company visits. As an analyst for more than 20 years, taking thousands of fund managers on visits to just as many companies, Andrew says that probably 95% of the meetings he attended added no value. In some cases, it made someone either overconfident in liking the company or overconfident in disliking it. Which either way biased their decisions. Andrew agreed with Phuong but said:   “Go out and visit the company. Fine. During law school, she participated in seven, overall, moot court and mock trial competitions, including the 2018 Pace Law Grand Moot Court Competition in which she argued in front of four federal judges and was awarded Best Oralist.Rob Veech went into law school knowing that litigation was something that he wanted to do after law school. During his 1L moot court competition, Rob advanced to the quarter finals (top 16 of his class). Because of this advancement, Rob was invited to participate in the Advanced Appellate Advocacy class. During his second year, Rob was placed on the American Association of Justice Trial Competition, in which the team placed first in the preliminary rounds. Rob was then placed on the advocacy board as the Director of Fundraising and Alumni Relations, where he is currently trying to organize the first inaugural Gavel Gala, in which the school recognizes alumni for their accomplishments in litigation. During his third year, Rob participated on 2 trial teams as well as the Dean Jerome Evidence Moot Court Competition held at Brooklyn law School. Greg thinks there is room for improvement with 3Ls professional development from the law schools, law firms, and vendors.  Marlene points out an MIT answer to "What is AI?" Sometimes a complicated concept can be explained on a napkin with a flowchart. This explanation is so simple, even Marlene's Mom can understand it.
