The jury is like a giant fishbowl. Things appear larger and out of place. Clients are highly scrutinized by these 12 strangers in a box, and quite frankly, how they make their decisions is sometimes pretty foreign to us, as trial lawyers. Sometimes, they make it very clear by telling us after they reach their verdict when, for instance, we see them in the hallway; and sometimes, they don't. Either way, we always strive to have a client that connects with the jurors in a human way – and that can sometimes be difficult if we have an unlikable client. At a glance, it seems like a harsh label. But we're actually discussing this from the point of view of jurors. This is very important if you're going to go to trial because the perceptions of jurors can seriously impact a case. Therefore, we never intend to offend people by saying that they're unlikable. It's just how lawyers describe it. In this episode, Peter Levine joins today's conversation as we discuss how to deal with an unlikeable client and how you can help them connect with the jurors. Today we are talking with Ernie Svenson. I met Ernie at a conference and have always been intrigued by how he developed his new business. He used to practice law the “traditional way,” handling complex business litigation cases. This meant he juggled countless boxes of paper organized by many team members. He did this until he learned how to create a 100% paperless, highly automated law practice. This was a law practice that was financially rewarding and personally fulfilling. There was low overhead, low stress, and more freedom. Now, Ernie helps lawyers who want to do the same for their practices. He found getting new clients easy and inexpensive; his main marketing tool was a simple website that cost less than $100. Ernie Svenson grew up in New Orleans, Louisiana. His parents divorced when he was young, and he quickly found himself a pawn in his parents' custody battle. His dad was a psychoanalyst who manipulated Ernie to achieve selfish desires. Ernie knew he was being manipulated, but had little wiggle room to react due to his age. In this episode, Mark and Ernie talk about the challenges of being a litigation attorney, the importance of having a good relationship with your therapist, and how the thing that makes us as humans really happy is helping other people.

According to Ernie Svenson, either you already are paperless or you just haven't committed to it, yet. If you haven't committed, you are just wasting resources maintaining two systems: one for your paper files and and one for your digital clients files.
