At a store, a female patron wanting to try on clothing secured the dressing area with a curtain. Another patron, the insured, engaged in allegedly assaultive conduct by rummaging, feeling, and grabbing the curtain in an attempt to make physical contact with the female patron. The insured also knelt down and used his phone to take videos or photos of the patron under the curtain. Notable Timestamps [ 00:19 ] - At a store, a female patron wanting to try on clothing secured the dressing area with a curtain. However, another patron, (who happens to be our insured) entered the store with various family members, selected a shirt and approached the occupied dressing area. Although the insured was made aware by the patron not to come in, he then engaged in allegedly assaultive conduct by rummaging, feeling, and grabbing the curtain in an attempt to make physical contact with the patron. [ 01:00 ] - At this point, a store associate provided the insured an alternate location to try on the shirt, which the insured did. But afterwards, the insured knelt down and used his phone to take videos or photos of the patron under the curtain. [ 01:24 ] - The patron sued the insured for allegedly assaultive conduct in a store. Prior to trial, in her discovery deposition, the patron explained that she tried to laugh it off and make a joke out of an uncomfortable situation by saying "you don't want to spoil your breakfast." According to the patron, the insured's family told the insured not to act that way, and "we kind of giggled and I just tried to shut it down very quickly and said, guys, enjoy your day." [ 02:00 ] - The insured sought coverage under his HO policy, and the insurer sought a declaratory judgment that it owed no duty to defend or indemnify the insured. [ 02:40 ] - Special guest Michele Hunter, coverage counsel at PLRB, joins us today to discuss this podcast's first Casualty topic. [ 03:37 ] - See AIG Property Casualty Co. v. Anenberg, 2020 WL 4607839 (D. Haw. 8/11/20). This behavior does not seem accidental, but this particular policy defines an occurrence not just as an accident, but as an offense as well. [ 05:50 ] - Among other charges, the patron claimed Negligent Infliction of Emotional Distress. If one claim triggers coverage, there is a duty to defend for the entire claim. [ 06:46 ] - The insurer relied on the Intentional Acts exclusion to deny coverage. Courts are split on whether to apply a subjective or objective test in applying this exclusion. For the objective test, the court asks if a reasonable person would consider it an intentional act. The subjective test asks what the insured believed, and Hawaii applies this test. [ 08:24 ] - However, the insured chose to argue that objectively speaking, his behavior was not intentional. The insured claimed that the patron's joking response proved he had no intent to harm. [ 09:20 ] - The court agreed that the insured objectively did not intend harm. [ 11:30 ] - The majority of relevant case law does not allow the “creative pleading” addition of Negligent Infliction of Emotional Distress to establish coverage, in intentional sexual assault cases. [ 12:40 ] - The court found that the Sexual Molestation exclusion did not apply because the complaint did not allege the pertinent actions. [ 13:50 ] - The laughter occurred after the behavior, but this court used it to interpret the insured's intent anyway. [ 15:30 ] - Under the typical ISO definition of an occurrence, this would likely not be considered an occurrence. [ 15:33 ] - Michele provides a recap of the scenario and the points above. This case demonstrates the impact that specific policy language, creative pleading, and individual judges can have on a seemingly clear-cut argument. Have you ever been on the giving or receiving end of kindness? When you really think about it, they were intentional, not random acts! Good is everywhere, and we can choose to be kind. We can practice intentional kindness until it's reflexive, knowing there is no measure or threshold for kindness, and can appear in different ways. The more we see it, and the more we're open to it, the more we want to participate in it, because kindness is contagious, addicting, and can be repaid abundantly!

Privacy laws in different countries. Privacy laws apply to both public and private sector actors. United States. The Constitution of the United States and United States Bill of Rights do not explicitly include a right to privacy. Currently no federal law takes a holistic approach to privacy regulation. In the US, privacy and associated rights have been determined via court cases and the protections have been established through laws. The Supreme Court in Griswold v Connecticut, (1965) found that the Constitution guarantees a right to privacy against governmental intrusion via penumbras located in the founding text. In 1890, Warren and Brandeis drafted an article published in the Harvard Law Review titled "The Right To Privacy" that is often cited as the first implicit finding of a U.S. stance on the right to privacy. Right to privacy has been the justification for decisions involving a wide range of civil liberties cases, including Pierce v Society of Sisters, which invalidated a successful 1922 Oregon initiative requiring compulsory public education; Roe v Wade, which struck down an abortion law from Texas, and thus restricted state powers to enforce laws against abortion; and Lawrence v Texas, which struck down a Texas sodomy law, and thus eliminated state powers to enforce laws against sodomy. Legally, the right of privacy is a basic law which includes: 1. The right of persons to be free from unwarranted publicity 2. Unwarranted appropriation of one's personality 3. Publicizing one's private affairs without a legitimate public concern 4. Wrongful intrusion into one's private activities In 2018, California set out to create a policy promoting data protection, the first state in the United States to pursue such protection. The resulting effort is the California Consumer Privacy Act (CCPA), reviewed as a critical juncture where the legal definition of what privacy entails from California lawmakers' perspective. The California Consumer Protection Act is a privacy law protecting the residents of California and their Personal identifying information. Exclusions to Coverage for Construction Defects https://zalma.com/blog Implicit in the concept of insurance is that the loss occur as a result of a fortuitous event not one planned, intended, or anticipated. Oddly, the fortuity principle never appears in insurance contracts. The principle is rooted in common law and in the statutes of at least six states. The fortuity principle has the effect of an exclusion. That is, an all-risk policy might provide coverage for all risks minus named exclusions, but never provides coverage for non-fortuitous events, even though non-fortuitous events are not named exclusions in the policy. For this reason, the fortuity principle is sometimes called the unnamed exclusion. A fortuitous event is an event which so far as the parties to the contract are aware, is dependent on chance. It may be beyond the power of any human being to bring the event to pass; it may be within the control of third persons; it may even be a past event, such as the loss of a vessel, provided that the fact is unknown to the parties. Travis, Court of Appeal of Texas, 68 S.W.3d 72 (2001)) Intentional Acts Exclusions Judge Cardozo, in 1923, stated a simple and obvious rule of law that “no one shall be permitted to take advantage of his own wrong. {Messersmith v. American Fidelity Co., 232 N.Y. 161, 133 N.E. 432 (1921).] California, by statute, covers has codified Cardozo's statement. Almost every insurance policy issued in the US excludes the intentional acts of the insured. Those that do not are covered by the public policy adopted by most states. To insure against wrongful acts would be to allow people to act wrongfully with no adverse effect since their victims would be compensated by insurance. Insurance involves the transfer of the risk of possible losses from the policyholder to the insurer. It is not available for losses that the policyholder knows of, plans, intends, or is aware are substantially certain to occur. Insurers faced with a construction defect claim may attempt to exclude coverage by claiming that the insured intended to build a defective structure. Intentional Acts https://zalma.com/blog In Automobile Insurance Co. of Hartford v. Cook, the court was faced with the legal question of whether an individual's homeowner's insurance policy affords coverage when that individual is sued for wrongful death after killing a person in self-defense. On February 20, 2002, defendant Alfred S. Cook shot and killed Richard A. Barber, the decedent, after a disagreement over a business arrangement spun out of control. The decedent had entered Cook's home without permission. During their discussions, Cook, armed with a handgun, retreated to his bedroom to retrieve a 12-gauge shotgun and then returned to the living room, where the fatal confrontation occurred. Cook was indicted for a number of crimes, including murder in the second degree, stood trial, and was acquitted on all counts of the indictment. The jury concluded in the criminal case that the prosecution failed to prove beyond a reasonable doubt that the 120-pound Cook did not have legal justification for shooting the 360‑pound decedent, who had previously attacked and injured Cook after he refused to leave Cook's home. Finding no coverage, the majority held there was no possible interpretation other than that the acts were intentional. In a case where “the policy language does not refer to an intentional act but, rather, contains an exclusion that applies to ‘assault and/or battery committed by any insured * * * or any other person.' Application of the exclusion does not depend upon the perpetrator's mental state or whether [injured person] was the intended victim.” When the perpetrator was convicted of battery on the claimant the exclusion applies regardless of the perpetrator's mental state. In 1978, the California Supreme Court in Clemmer v. Hartford Insurance Co.71 dealt with a shooting that resulted in the death of the victim. Regardless, it still led to a finding by the Supreme Court of California of a need for defense and indemnity. The court concluded that Hartford had no duties with regard to Dr. Lovelace's intentional acts in the killing of Dr. Clemmer but was obligated to defend him. On this episode of SCP, I am joined by my dad, Mikel Arnold to talk about kindness! My pops is a great handyman, hard worker, and loves to serve people. Both of my parents enjoy serving others, but my dad's willing & readiness is notable. One day when we were talking I noticed that his acts of kindness are not random at all. Rather, they were all intentional. Then I started to think that as followers of Jesus we should be intentional in our giving by seeking out ways to give daily, like my dad. Now, there will be moments of randomness, but for the Believer, we should be intentional in our acts of kindness towards others. I mean it is a part of the fruit of the spirit, so kindness should be what describes those who love Jesus. If it's not, ask the Lord to help you with being more intentional in acts of kindness. I believe that starts with preparedness in your mind and heart, as well as flexibility in your day for God to use you. This episodes sticky note quote is, "I can do all things through Christ which strengthens me. Philippians 4:13" SHIFT | CHANGE ANCRONYM: S - Soul Stirring. There needs to be a stirring of your soul to serve God before you start serving people. H - Habits. Being intentional in your acts of kindness has to start with your habits. If it's not one of your habits to give, you might not be as consistent. I - Internal trials. Turn your internal trials into opportunities to serve others. F - Faith. Build up your faith and trust in God. T - Time. Take time out of your life to help others. Start your intentional giving NOW even while in quarantine! Get creative as Hebrews 10:24-25 says in the Message Translation. Write a card, make a card, send food, make a care package, and have fun being intentional in your giving. Thank you for listening!
