On today's LawNext: we hand over the podcast to NotebookLM to discuss the state of law practice management technology.  If you haven't heard of NotebookLM, it is a generative AI tool from Google that turns your documents into engaging audio discussions. Its output sounds a whole lot like, well, a podcast, with two hosts chatting it up about your documents.  To quote Google's own description, “With one click, two AI hosts start up a lively “deep dive” discussion based on your sources. They summarize your material, make connections between topics, and banter back and forth.” So we decided to give it a try. Back in September, LawNext host Bob Ambrogi wrote a four-part series on his LawSites blog called, “The Shrinking Ownership of Law Practice Management Technology.” It was a deep dive into how ownership of law practice management software for solo and small law firms has been consolidated under just six major ownership groups.  We loaded the four parts of that series into NotebookLM and asked it to generate its audio overview. What you'll hear today is the discussion it generated, followed by Bob's thoughts on what it produced. The NotebookLM audio is about 15 minutes long, and Bob's comments will come after that plays.  It is important to keep in mind that the audio generated by NotebookLM is not simply a summary. The legal operations community was barely nascent a decade ago. Now there is a booming LegalOps profession and a number of professional associations have sprouted up to help the community learn and collaborate. Legal Operators is one of those communities. We asked the founder of Legal Operators, Colin McCarthy, to come on the show and talk about why he took a small legal ops community that started with a few people doing TED-Talk style presentations over drinks, to a community of thousands. Legal Operators produces online learning programs, a list of legal operations software and services, job board, and an innovation hub in order to support the growing legal operations profession. Recently, Legal Operators created a magazine with the planned distribution in the tens of thousands. While this may seem outside of what you would think a technology-forward operations would do, McCarthy says he believes in doing the unexpected, and providing the best platform for the distribution of knowledge and information. Managing a successful solo or small law practice means overcoming many challenges. These days, running a small practice requires many skills in addition to being a good lawyer: one often also needs to be a project manager, technologist, marketer and small business expert. The State of the US Small Law Firms Study surveyed more than 300 solo and small law firm leaders to find out how they define success, their challenges and what the most successful firms are doing to develop and execute winning strategies. All lawyers have an ethical obligation to employ security measures when sharing information and data with their clients. Whether that means encrypting all important emails or properly researching cloud based file-sharing services like Dropbox, it is incumbent on lawyers to understand the levels of security available. LexisNexis recently did a survey on what tools lawyers and legal professionals are using to protect their clients' privileged information. 77% of the lawyers surveyed did not have adequate security for their confidential client data. How important is encryption and what can lawyers do to change the way they share data? On this episode of Digital Detectives, Sharon Nelson and John Simek interview Bob Ambrogi, a lawyer and journalist who recently wrote about the LexisNexis survey. They ask him about the implications of the survey, what security measures lawyers should be taking, how frequently clients are hurt by lack of security, and why lawyers are generally resistant to learning about data encryption. Ambrogi explains that an overall lack of information, ignored ethics rulings, lack of time, and assumed difficulty are the reasons lawyers often refuse to learn how to safely share data. He encourages lawyers, especially the ones in small or solo firms, to seek out a consultant to learn about the relatively easy encryption tools and techniques. After all, no lawyer wants to be a part of the 77%. Bob Ambrogi is a Massachusetts lawyer and journalist and has covered legal technology and the Internet for two decades.
