My guest today has been preaching about the potential power of tech in the legal sphere since the earliest days of social media. Nicole Black began her legal career as a Public Defender, conducting countless hearings, jury trials, bench trials, and depositions, in matters both civil and criminal.But in 2008 she began covering the intersection of technology and law as a journalist for publications like The American Bar Association, Above the Law, and The Daily Record.In 2012 she joined MyCase, a legal software case management system, where she serves as a Subject Matter Expert and Educator, and in that time has become a self-proclaimed Legal Technology Evangelist.I was able to hear Nicole speak earlier this year, and by the time she'd finished her talk she'd convinced even me to give a ChatGPT subscription a shot. Today's guest is Nicole Black, legal technology evangelist at MyCase. Nicole describes her role as a bridge between technology and the practice of law. The year managed to end, though, on a somewhat hopeful note when Apollo 8 broadcast incredible pictures of a peaceful earth rising above the moon's surface. And no one did a better job of embodying this America in extremis than actress Tuesday Weld in Pretty Poison. Pretty Poison is a film about the youth in the 1960s. It shows how they loved and how their passionate expression fueled them into promiscuity, pills, and a general disregard for life itself. As the country mourned the deaths of two significant political figures: Martin Luther King, Jr., and John F. Kennedy, Jr, The deaths gave the studio executives some pause; releasing this movie would be risqué and may be seen as offensive to some. Thankfully some incredible movie critics saw the film buried in Hell's Kitchen and knew that the film must have some merit. Joe Morgenstern, Pauline Kael, Judith Crist, and Arthur Knight for taking a chance and giving the film rave reviews. Time magazine even wrote, “The nicest, nastiest crime film to come out of Hollywood in years!” Pretty Poison was featured on the marquee in Quentin Tarantino's Once Upon a Time in Hollywood. Seeing this, Nicole Black, daughter of No-el Black saw this as a clear sign to get the film included in The National Film Registry. Think of online behavior as an extension of offline behavior. If activities run afoul of ethics rules offline, don’t do it online. Twenty-seven states have adopted some duty of technology competence requiring lawyers to understand and use technology to provide adequate representation to their clients. It can cause significant stress for solos and small firm attorneys, in particular. On top of representing their clients and maintaining competence in their practice areas, while trying to figure out how to run their businesses which law school doesn’t teach, they have to be up on technology. It can be overwhelming. But it’s important to be on top of changes in technology. If you’re a litigator and don’t understand social media and how it can be used to mine for evidence and research jurors, you may be committing malpractice. Question: How can attorneys make sure they’re complying with ethical obligations regarding social media and technology? Answer: The rule of thumb is to think of your online behavior as an extension of your offline behavior. Consider if you’d be able to do someone offline and apply that to your online activities. So, if you can’t post something in print with language that requires a “this is attorney advertising” disclaimer because it’s blatant advertising and not just educational, don’t do it online. Attorneys are responsible for complying. In other words, don’t outsource your ethics. Sure, legal marketers need to have an understanding of the rules but the ethical obligation lies with the lawyer. It’s the lawyer’s job to inform their legal marketing team of the ethics rules and review copy to make sure it’s compliant. Remember: The online is an extension of the offline and the medium doesn’t change the message. Mining social media data Lawyers are now using social media to represent clients and not just for marketing purposes. They are mining social media for evidence and to research jurors. Anything that is publicly viewable is fair game when mining social media for evidence. What about information behind the privacy wall on social media? Nicole provides some insight into the ethical considerations for disclosure when friending or connecting with someone online for the purpose of mining private data, including differences among jurisdictions. In this episode of The Legal Toolkit, Jared Correia interviews lawyer and legal technology expert Nicole Black about how and why lawyers adopt mobile and wearable technology, how they are using tablets, smartphones, and smart watches in their practice, the role of cloud computing, and what to watch for in the legal ethics of wearables. Black discusses how the spread of cloud computing has made mobile computing possible by reducing battery and storage constraints. From there, she says, smart watches are the lawyers' solution to impolite interruptions and the inconvenience of situations in which phones are not allowed. Also, most people are comfortable wearing a watch already (we used to wear them before smartphones). Black believes smart watches will be the gateway to Google Glass, or something similar, as we all become more comfortable with the constant presence of technology.
