But I wanted to find out what are the main categories of things that wind up in legal land when it comes to broker or EBC (employee benefit consultant) payment agreements. And let me just state for the record that, while there are a whole lot of brokers and EBCs who would or do engage in some of these practices, there are also many who do not; and/or it might not be the broker/EBC themselves but the company that they work for who is up to some of the things that we're gonna be talking about in the episode today. But I really, for sure, want to support the gang of honest actors, great fee-based, integrity-based brokers and EBCs; and I wanna support them all day long, many of whom listen to the show and are part of the Relentless Health Value Tribe. But let's talk about how the rent-seeking ones roll so that you can spot them. See what they did there. So, yeah … the first kind of ground zero that Doug and I talk about today is just up-front direct compensation agreements, which may be just ridiculously complicated and/or ridiculously expensive compared to what others are charging for a similar group. Where there's mystery, there is margin. That is so relevant in so many situations, and this is just another one of them. So then, after that, Doug and I move on; and we get into three categories of stuff that sits in that undisclosed or maybe even disclosed zone, where just the whole model of payments is problematic on its face. First up (and this is a biggie), brokers/EBCs recommending rent-seeking solutions to their clients. Like, a broker or EBC suggests a solution to their client where the solution itself makes money on a perverse incentive, and then the broker or EBC gets a piece of that action, which might be called shared savings. So, yeah … even if the dollars to the broker or EBC are disclosed, a naive plan administrator might not see that overcharge for what it really is—and Doug gives a bunch of examples in the show that follows. Chris Deacon (post) and Justin Leader (post) also wrote posts about this. Donovan Pyle wrote a whole book about it. Okay … the next big category of typical payment model methodologies that Doug Aldeen (again, a lawyer) has seen plans get themselves into trouble with their EBCs and brokers—the ones who are sharks, I mean, circling the plan like it's a gold mine—this big category is undisclosed payments from vendors who the plan doesn't realize have a business relationship with the EBC or broker. This can also be a whole basket of solutions that the EBC/broker wants to install, which is basically this problematic payment model at scale. And, right, this matters because then the plan doesn't know if this particular point solution, PBM, stop-loss carrier … Right? They think their broker EBC is recommending it because it's the best option for that particular plan, not understanding that it's the right option for the broker or EBC. And these dollars can be undisclosed because, to a certain extent, the Consolidated Appropriations Act, it's a little bit unclear on certain points. There's some loopholes if you go looking for them because you are so inclined. We get into more detail on this later on. After this, Doug offers a really great roadmap with six steps in it for any plan to really think about as they consider. First, the maybe integrity of their broker or EBC and what is being recommended to the plan. And that's important because, look—and we say this in the conversation that follows, but I'm gonna say it again here loudly—if a plan realizes that their broker or EBC is not really serving the best interest of the plan, there are great options out there. There are great EBCs and brokers who are honest, upstanding that really care about their clients, their plans, their members, and doing the right thing. But telling the difference between the not-so-good ones and the good ones takes some diligence, takes some validation on the part of the plan sponsor. It just does. But the amount of dollars that can be saved is millions, and this is actually, saving those millions is actually better for the plan because it's not like those dollars were going in somebody's pocket. It's not like they were being put toward better, safer, lower premiums. These are dollars that can be cut, and the plan is actually better. My guest today, as I have mentioned at least several times already, is Doug Aldeen, who is a well-known attorney who has spent many years in the self-insured space. From 1997 to 2006, he served both as associate general counsel and general counsel for provider-sponsored HMOs in Champaign-Urbana, Illinois, and San Antonio, Texas. During his tenure at Health Alliance Medical Plans in Urbana, Illinois, he had a front-row seat to the US Supreme Court ERISA case in Pegram v. Herdrich. Since 2007, Doug has owned and operated his own law firm that serves the US self-funded market. In 2016, he served as ERISA counsel for the Berkley Research Group, who served as an advisor to the private equity firm Hellman and Friedman that purchased a majority stake in MultiPlan for $7.5 billion. From 2019 to 2024, Doug served on the government relations committee for the Self-Insurance Institute of America during the period when the Consolidated Appropriations Act was being implemented. In 2022, Doug was featured by KXAN television in Austin in an investigative piece that examined the collection practices of a local hospital. This episode first aired on July 19.  Among cultures around the world, it's traditional to grow your own food. But with the rise of supermarkets and grocery stores, gardening in the United States has become more and more uncommon. But, what do you do when the food you like to eat isn't sold in grocery stores? Or when there are no supermarkets near you, and you can't afford to buy fresh produce? This isn't uncommon in Nashville. North Nashville, East Nashville, South Nashville and Edgehill all have neighborhoods with food deserts. Community members are taking matters into their own hands. If you look around, you'll find local farms, community gardens and organizations working to make gardening (and good food) more accessible to Nashville residents.  Growing your own food isn't easy, and in this episode, we'll hear about why support is so important for local farmers and gardeners. We'll also hear about how gardening can be fulfilling in ways that extend beyond just feeding us. By Davy Crockett You can read, listen, or watch Read the full story of Frank Hart in my new book: Frank Hart: The First Black Ultrarunning Star Frank Hart, at age 22, broke through racial barriers with his fourth-place finish in the 5th Astley Belt Race in Madison Square Garden, held in September 1879. Despite being black, Hart became a local hero in his hometown of Boston, Massachusetts. He had proven himself worthy of praise, competing on the grandest sporting stage in the world. The ultrarunning/pedestrian promoters, backers, and bookmakers had allowed for diversity in this most popular spectator sport in America of that time. But was an American public ready to accept a black champion, just 15 years since the end of the bloody Civil War, with racial bigotry still prevalent in nearly all aspects of society? Hart, an immigrant from Haiti (see Part 1), had not grown up in slavery, and had the determination to reach the highest level of the sport in 1880, if he would be allowed. After the good training he received from O'Leary, and with his recent success, fame, and fortune, he was ready to go out on his own. He hired his own trainer/handler, John D. Oliver (1860-1914), age 19, who became better known as “Happy Jack Smith.” Smith was originally from Richmond, Virginia, born to Irish parents. Within months he became recognized as the best pedestrian trainer in America. He developed a reputation for being able to keep his runners in the competition to the bitter end. J. J. Gottlob Hart also needed a manager/agent. He again turned to a very young, unproven, but dynamic talent.  He hired nineteen-year-old Jacob Julius “J.J.” Gottlob (1860-1933). Gottlob, a commercial traveler and theater man with west coast ties, took interest in pedestrianism. He would become known as the “Dean of Pacific Coast Theater managers.”  As he acquired money, he would be Hart's backer for several years. The Rose Belt With these two young men to look after him, in December 1879, Hart went to compete at the next big six-day tournament, the “Great International Six-Day Race” or “Rose Belt” held in Madison Square Garden in New York City. The manager of the race was Daniel Eugene Rose (1846-1927) of New York City, a pedestrian promoter and owner of the D. E. Rose cigarette manufacturing company. This was perhaps the largest six-day race in history with 65 starters. An expensive Rose Belt, valued at $400, was created for the winner, with seven rectangular sections. The center section included a globe with running figures and colored flags, and the words, “American International Champion of the World.” About 200 scorers were employed. Scores were displayed on dials for each runner. Each runner had a big number both on their chest and on their back. Hart was not the only black runner in the field, there were three others, Edward Williams of New York City, Paul Molyneaux Hewlett (1856-1891) of Boston, and William H. Jacob Pegram (1846-1913) of Boston, who would often run together with Hart on laps.  Pegram was a former slave from Sussex, Virginia. He won a small 60-hour race in Brighton, Massachusetts against whites, a month before Hart started competing. Pegram spoke in a thick southern black dialect that at times was mocked by the press. After the first day, December 22, 1879, Hart was in second place with 117 miles. On day two, after Peter J. Panchot (1841-1917), of Buffalo, New York, withdrew from the race, Hart took over first place. By evening, only 48 of the 65 starters remained in the race. Christian Faber On Christmas Eve, day three, the race continued, and Hart lost the lead in the evening to Christian Faber (1848-1908), of Newark, New Jersey, when he went to get some sleep. Grumbles were heard by those with wagers on Hart, worried that he would not return.  But Hart had not had very much sleep and needed it badly. He returned at midnight to kick off day four.

 What exactly is student voice? This question has become the hot topic in public, private and charter schools here in Hawaiʻi, for which I am glad. Sometimes the conversation revolves around giving students agency over their learning. At other times we talk about public exhibitions of learning and the ways students might articulate what they know and what they can do. Conversations around student activism, especially around ways to encourage kids to be politically active, seem fewer and farther between. I wonder sometimes if we are afraid to encourage this kind of deep community involvement for fear that parents might object or schools might feel liable.
