Sen. Rand Paul (R-Ky.) is known for being a firebrand when it comes to his conservative, small-government principles. But that doesn't mean I'm going to sit back and just say, ‘Oh, I'm leaving all my beliefs on the doorstep. I'm no longer going to be for free trade. I'm no longer going to be for balanced budgets. I'm no longer going to be opposed to killing people without trials, without naming them, without evidence.' 1. DOJ Subpoenas and Alleged Political Surveillance Senator Cruz reveals that Jack Smith, Special Counsel under the Biden DOJ, subpoenaed his phone records as part of an investigation into events surrounding January 6th. Cruz was not initially listed among the nine Republican senators whose records were obtained because his phone provider, AT&T, refused to comply with the subpoena, citing constitutional protections under the Speech and Debate Clause. The DOJ reportedly obtained records from Verizon for other senators, including Marsha Blackburn, Ron Johnson, Josh Hawley, and Lindsey Graham. Cruz and Ferguson characterize the subpoenas as a politically motivated fishing expedition, lacking criminal justification. 2. Concerns Over Abuse of Power Cruz argues this represents a dangerous precedent of the executive branch spying on legislative members. He calls for hearings and investigations to uncover who authorized the subpoenas and to prevent future abuses. The operation is referred to as “Arctic Frost”, which Cruz likens to a modern-day Watergate. 3. Meeting with Donald Trump at the White House Cruz recounts a lunch with Trump and other Republican senators, where Trump showcased renovations to the Rose Garden and plans for a new ballroom. The upgrades are privately funded, not taxpayer-funded, yet have drawn criticism from Democrats. What was supposed to be a sign of unity by a fractious DOJ and FBI leadership called together by Trump in the Oval Office turned into a dressing down of Bondi, Blanche, and Patel by Trump, who demanded that his former Special Counsel, Jack Smith, be indicted along with others in the former DOJ leadership. In a controversial post, AG Pam Bondi says “Hate speech that crosses the line into threats of violence is NOT protected by the First Amendment. Send us a textI may not agree with his every conclusion about the history of the Special Prosecutor and Special Counsel office  and the people who have held it. But I can say that I could find no fault with how this one man handled the job. The Special Counsel and Special Prosecutors Office, begun in 1974, as a way to investigate the sitting President and his staff for alleged wrongdoing, has a history so awful, with so much wrongdoing itself, that it is literally almost impossible to defend as an institution. I don't think the abuse of power has any equal in our governmental history. The shameful conduct of Archibald Cox, Leon Jaworski, Richard Ben-Veniste, Henry Ruth, Lawrence Walsh, Ken Starr, and even the behaviour of our modern day investigators in the Trump-Biden-Trump era is enough to make even the worst tyrants blush. In my opinion, there are possibly two exceptions to this appalling record of power hungry maleficence, Robert Hurr, who investigated the records found in Joe Biden's garage, and Robert Fiske, the original Whitewater Scandal Special Prosecutor. Both men laid out what they saw in detail, and then either walked away, or were in the process of doing so when they were replaced. You cannot ask for anything more than that. In this episode, we get a real treat, as Robert Fiske traveled to Vermont to speak on the history of the Special Prosecutor and Special Counsel Offices and put the Robert Mueller Investigation into historical context. That investigation was ongoing when this lecture occured. The lecture was hosted by the Vermont Law and Graduate School and it runs nearly an hour. Send us a textThe Whitewater investigation takes a giant leap as Attorney General Janet Reno appoints a Special Prosecutor to look into the case coming out of Arkansas. Former Watergate House Judiciary Committee staffer Bernard Nussbaum is now the assistant legal counsel to the President and his advice is not "No but Hell No!1 Mr. President, don't do that!" But it fell on deaf ears as Democratic Senators put pressure on the White House to take the step and allow a Special Prosecutor to be appointed. At first Clinton got lucky. Janet Reno appointed Robert Fiske to oversee the job. He may actually be the one and only Special Prosecutor in the history of its existence who was willing to look at a case and render a nonpartisan fair judgement, which he did, that nothing had happened in Arkansas involving President and Mrs. Clinton, and that Vince Foster had, in fact, committed suicide. He got fired for saying it. Not in so many words, but the Special Counsel statue had run out and Republicans worked to get it renewed. When it was renewed Janet Reno recommended that Fiske remain the Special Prosecutor and be allowed to finish his report. They removed him, and replaced him with Kenneth Starr instead. The Jeffrey Epstein scandal stands as one of the most glaring failures of the American justice system, a case where victims were silenced, a secret non-prosecution agreement shielded powerful enablers, and federal custody ended in Epstein's death under suspicious negligence. Despite civil settlements, oversight reports, and the conviction of Ghislaine Maxwell, the story remains fragmented, unresolved, and tainted by mistrust. The Department of Justice is compromised by its own history in the case, and every unanswered question deepens public suspicion. A federally appointed special counsel is the only mechanism capable of cutting through that distrust—armed with subpoena power, independence from political pressure, and the mandate to follow the evidence wherever it leads.That need is only magnified by the President's shocking dismissal of the scandal as a “hoax.” Such rhetoric retraumatizes survivors, emboldens enablers, and corrodes faith in the rule of law. When the highest office mocks the reality of child exploitation, independence becomes not just preferable but mandatory. A special counsel would separate truth from politics, provide finality where there has only been denial, and ensure that victims receive recognition instead of erasure. Without such independence, every decision will remain suspect, every survivor's voice overshadowed, and the system itself further discredited. It's been another wild week, after the D.C. Attorney General sued the government for attempting to install the head of the D.E.A. as D.C.'s emergency police commissioner. Following an emergency hearing, US Attorney General Pam Bondi backed down and re-wrote the directive. But Andrew and Mary highlight why that's just the start: it's no longer just the D.C. National Guard being deployed in the nation's capital, National Guard units from five other red states are being sent to the city, making a complicated stew of who's in charge and who has jurisdiction. Next, they weave this thread into last week's trial over whether California's National Guard performed law enforcement operations in Los Angeles, a potential violation of The Posse Comitatus Act. And with Russia and Ukraine so much in the news, Andrew offers some reflections from the 2019 Special Counsel's report that exposes Russia's long-held goal of taking over the Donbas region. Accountability or weaponization?
