As the owner of a copywriting business, you have a lot to think about—your products, your clients, your research process, writing great copy, finding new clients and more. So it's no wonder we tend to push legal questions to the bottom of the to-do list until there's a problem. Don't do that. Andrea Sager is my guest for this episode of The Copywriter Club Podcast. And she's got a lot of great legal advice on using A.I., contracts, business entities, and protecting your business and assets. Click the play button below, or scroll down for a full transcript.   Stuff to check out: AndreaSager.com Legalprenuer.com The Copywriter Club Facebook Group The Copywriter Underground Research Mastery Course Full Transcript: Rob Marsh: Do you have questions about contracts, trademarks, business entities, and your legal risk and liabilities? Today, I have answers. This is The Copywriter Club Podcast. About a year before I took on my first freelance writing project—I'm going back a long time here—I took the LSAT, that's the test for admittance into law school. I had thought I would become a lawyer from about the time I was in eighth grade. And I did well enough on the test to get into most of the schools I was planning on applying to.  My plan at the time was to practice law in the non-profit sector. And to help with that goal, I decided to enroll into a Masters program in public administration. But once I started that program, I was so bored by the curriculum, I couldn't envision myself finishing.  At the same time I met someone who asked me to write an article promoting a product for a company she was working for. When I realized I could make money as a writer, I turned my back on my dream of being an attorney and started writing copy. So when it comes to legal advice, I can't really help, but my friend Andrea Sager can. Andrea has helped hundreds of small businesses with legal advice and services. I tried to ask her all of the legal questions copywriters tend to have about things like using A.I., contracts and agreements, trademarks, and how we limit our exposure to legal liability that could cost you your business, your home and more. This stuff matters. And I hope you enjoy this interview. Before we get to the interview, the last couple of weeks I've mentioned that I put everything I know about conducting research and using A.I. as part of my research process into a short course called Research Mastery. It includes a lot, but it's not an overly long, impossible to watch course. Instead it's the kind of course you can watch in an afternoon or weekend and walk away with a research process that helps you uncover the insights you need to write great sales copy. ..more than twenty different techniques for capturing ideas, … all of the questions I use to get find big ideas about my client, their product, their customers and their competitors as well as the documents you need to capture your research and several tutorials on how to use A.I. to speed up your processes and even help with your research itself. But unlike other research courses that take hours to watch and implement, this one will teach you everything you need to know in a single afternoon. You can learn more about this unique resource at thecopywriterclub.com/researchmastery… research mastery is all one word. I'll link to that in the show notes so you can easily find the link if you can't type the URL into your browser right now… thecopywriterclub.com/researchmastery And now, my interview with Andrea Sager. Hey, Andrea, welcome to The Copywriter Club Podcast. I am thrilled to have you here. It's been quite a while since we talked to an attorney about all of the stuff that we need to be thinking about in our businesses. So I'm excited to have you here, but before we get started, maybe you could tell us your story. Just how did you become an attorney, an author, founder of the legal preneur.com and if I'm reading your website correctly,

President Trump ordered the Pentagon to send around 2,000 National Guard troops to Los Angeles in response to protests against immigration raids in the city. Gavin Newsom's objections to deploying the National Guard. The last time a president called in the National Guard without the governor's approval was in 1965 during the Selma march. Historian Julian Zelizer explains more. Then, John Ruskey calls the Mississippi River "a creative force" that sculpts the landscape and rejuvenates the people who experience it up close. Why is federal jurisdiction over street crimes like murder less common, and what conditions allow the federal court to take over a case from the state? We are talking about the complexities and nuances of legal cases that law schools often overlook. I'm your host, Steve Palmer, and today we're joined by our resident law school students, Bella and Troy, to dissect the high-profile Luigi Mangione murder case.We cover how Mangione's case has made waves in both state and federal courts, exploring the intricate legal tactics and lesser-known procedures involved. From the FBI's criminal complaint to the challenges of arraignment, and potential issues of double jeopardy, we'll unpack it all. Plus, we touch on why the federal government has taken a keen interest in this seemingly state-level crime and what it could mean for the future of the case.Key TakeawaysUnderstanding Jurisdictional Nuances: The episode sheds light on the dual involvement of federal and state courts in the Mangione case, emphasizing the significance of probable cause and the process of indictment in both jurisdictions. The Role of Preliminary Hearings: We talk about the importance of preliminary hearings in federal court, highlighting how they provide defense attorneys with early discovery and the ability to cross-examine witnesses, which can be pivotal in building a defense strategy.Challenges in High-Profile Cases: The discussion covers the inherent challenges in securing a fair trial in highly publicized cases, exploring arguments related to prejudicial pre-trial publicity and the strategic considerations for change of venue.Key Moments00:00 Legal Questions and Double Jeopardy Dilemma05:21 Establishing Probable Cause in Court06:43 Call for Independent Prosecution Review11:50 Preliminary Hearing and Indictment Process15:45 Federal-State Cooperation in Legal Cases18:23 Interstate Crime Prosecution Dynamics21:45 State Murder Case Becomes Federal Drug Case25:52 Trial Fairness and Venue Dispute26:58 Mangione's Legal Proceedings OverviewSubmit your questions to www.lawyertalkpodcast.com.Recorded at Channel 511.Stephen E. What's Next for TikTok? Supreme Court to Rule on Nationwide Ban

Passing Judgment

In this episode of Passing Judgment, we analyze the high-stakes TikTok ban case as it heads to the Supreme Court on an accelerated timeline. Host Jessica Levinson explains the key arguments: ByteDance claims the ban violates First Amendment rights, while the government cites national security concerns over TikTok's Chinese ownership. With oral arguments set for January 10th, Jessica discusses potential outcomes and actions President Trump might take once in office. Here are three key takeaways you don't want to miss:1️⃣ Overview of the Legislation: The law in question mandates that TikTok's parent company, ByteDance, divest its U.S. operations by January 19th, 2024, or face a nationwide ban. The ban would affect app stores and Internet providers, eventually causing TikTok to stop working as updates and downloads would be prohibited.2️⃣ Lower Court Rulings: The DC Circuit upheld the law as constitutional. A three-judge panel determined that the national security concerns cited by Congress justify the legislation. Judges generally defer to the political branches on national security issues.3️⃣ Arguments by ByteDance and TikTok: ByteDance argues that the law violates the First Amendment by eliminating a mode of communication without a compelling government interest. They contend that the national security concerns are baseless and accuse the U.S. government of targeting TikTok based on its content, which is potentially a content-based restriction—a key concern in First Amendment law.Follow Our Host: @LevinsonJessica

My guest for this week's episode is Clay Brewer who is an MLM attorney at Thompson Burton.  I was so excited to dive in and ask him questions so I dove right in and asked the questions I get from my team/clients as well as about certain things we hear all the time as MLMers/Network and affiliate marketers.Clay has a vast knowledge and answered all my questions thoroughly. Here are some of the questions I ask him:Does every network marketing company HAVE to have 3 customers per affiliate? Is it true that affiliate marketing companies can only pay 2 levels deep and if they pay 3 or more levels deep, they have to be a network marketing company? Are matrix compensation plans legal? How about membership compensation plans? Is it illegal to pay commissions from ONLY membership fees? Can network marketing companies mandate that you don't sign up with other companies?Join us for this interesting conversation about what's legal and not legal in the MLM industry.  And listen to the end to find out what Clay recommends you do to keep yourself safe from legal action.Get in touch with Clay HERE.DISCLAIMER: I make no income claims, and I can not guarantee any income with any program or opportunity I share.
