This Day in Legal History: WTC Bombers ConvictedOn November 12, 1997, Ramzi Yousef and two of his accomplices were convicted for their roles in the 1993 bombing of the World Trade Center, marking a significant legal milestone in U.S. counterterrorism efforts. The bombing, which took place on February 26, 1993, involved a truck bomb detonated in the North Tower's underground parking garage, killing six people and injuring over a thousand. The attack was an early sign of the growing threat of international terrorism on American soil, with Yousef aiming to collapse one tower into the other to maximize casualties. Yousef, the principal architect of the attack, fled the country shortly afterward but was eventually captured in Pakistan in 1995. His trial underscored the challenges of prosecuting acts of terrorism under U.S. criminal law and introduced the public to federal strategies for dealing with international terrorists within the American justice system. Prosecutors successfully argued that Yousef's attack was part of a larger, ideologically driven campaign against the United States, setting a precedent for treating terrorism as a criminal offense rather than solely a military threat. The conviction of Yousef and his co-conspirators in a civilian court demonstrated the U.S. government's commitment to using its judicial system to address terrorism, despite criticisms from some who argued for military tribunals instead. Yousef was sentenced to life in prison without the possibility of parole and was placed in the federal "supermax" facility in Colorado, where he remains to this day. This case highlighted the importance of international cooperation in tracking down fugitives and the evolving strategies to counter terrorism through legal channels in the years before 9/11.The FTC's draft settlement with Marriott International over a series of data breaches highlights the agency's growing support for "right-to-delete" policies, mirroring a trend in state-level privacy laws. This agreement, targeting breaches from 2014 to 2020 affecting 344 million customers, would require Marriott to provide U.S. customers with a way to request deletion of their personal data. Unlike the FTC's traditional "notice-and-choice" model, this approach shifts responsibility to companies to manage and remove collected data when requested. Experts say the Marriott settlement may be a sign of future federal data privacy directions, especially since the FTC has recently applied similar requirements in cases with companies like Chegg Inc. As right-to-delete policies expand, companies face challenges navigating varying state privacy laws, with 20 states already enacting or soon implementing data privacy regulations. Ensuring compliance across different jurisdictions requires complex data mapping and collaboration between legal and technical teams to track, delete, and prevent reintroduction of sensitive data. Additionally, reducing retained data may impact marketing strategies that rely on long-term customer data. Marriott's settlement and the FTC's recent blog post signal the importance of limiting data collection to only what is operationally necessary, reinforcing the idea that uncollected data cannot be stolen.FTC's Marriott Data Breach Order Echoes States' Right to DeleteRyne Miller, formerly the U.S. general counsel for FTX, has joined New Jersey law firm Lowenstein Sandler as a partner to lead its new commodities and derivatives practice. Previously with Sullivan & Cromwell, Miller advised FTX through its bankruptcy proceedings following the crypto exchange's collapse and founder Sam Bankman-Fried's fraud conviction. Though Sullivan & Cromwell faced allegations related to FTX's misconduct, Miller was not named in any subsequent litigation. After leaving FTX, Miller founded Miller Strategic Partners, providing regulatory advice in traditional and digital finance. At Lowenstein, Miller will head the commodities and derivatives group and co-chair its crypto practice, aiming to capture the recent surge in U.S.-based crypto interest. His experience, including past work for SEC Chair Gary Gensler at the Commodity Futures Trading Commission, aligns with Lowenstein's strategic expansion in financial services, fintech, and investment management.Ex-FTX US Legal Chief Joins Lowenstein, Eying Crypto ResurgenceJack Teixeira, a 22-year-old Massachusetts Air National Guardsman, faces sentencing for leaking highly classified military documents online, with prosecutors seeking a 17-year prison term. Teixeira, who held a top-secret security clearance as a low-ranking airman, shared sensitive information with a group on the messaging app Discord, reportedly discussing topics like Russia's war in Ukraine, Israel, Syria, and Iran. He was warned by his superiors twice in 2022 about mishandling classified information, yet he continued to access and share sensitive intelligence. Prosecutors argue his actions represent one of the most significant breaches of the Espionage Act in U.S. history. Teixeira's defense team requested a shorter, 11-year sentence, arguing that his intent was to inform his online friends about global events rather than harm the U.S. and citing his struggles with autism and social isolation. In separate military proceedings, Teixeira also faces charges for obstructing justice and failing to follow orders.Pentagon leaker Teixeira faces sentencing, US seeks 17-year prison term | ReutersSteve Bannon, former adviser to President-elect Donald Trump, is due back in court ahead of his Dec. 9 trial in New York state on fraud charges linked to a 2019 fundraising campaign for Trump's border wall. Prosecutors allege Bannon deceived donors, raising over $15 million while secretly diverting funds to the campaign's CEO, Brian Kolfage, despite promises that all donations would go directly to construction. Bannon, who was previously pardoned by Trump on related federal charges, faces charges in New York state court where presidential pardons do not apply.Bannon has pleaded not guilty, with his lawyers arguing that he only reimbursed Kolfage for expenses. Kolfage, who pled guilty to federal fraud charges, is currently serving a 4¼-year sentence. On this edition of Parallax Views, Pulitzer Prize-winning investigative reporter David Cay Johnston returns to the program to discuss his new book The Big Cheat: How Donald Trump Fleeced America and Enriched Himself and His Family. According to David's reporting the Trump Organization made a between a whopping 1.6 to 1.7 billion dollars during the Trump Presidency. Although Trump ledged to receive only a salary of $1 for his time as President (and, in fact, did donate his salary to charity), it appears Trump himself along with his daughter Ivanka Trump, Ivanka's husband Jared Kushner, and other associates of the 45th President of the United States of America profited greatly from the Trump Presidency. In this way Trump is arguably the embodiment of a form of gangster capitalism. And "gangster" may well be apropos as David argues that the Trump family is actually a generational crime family. Despite all this, figures like Trump and Steve Bannon have promoted themselves as heroically trying to remember the "forgotten man" of the working class. Nothing could be further from the truth according to David Cay Johnston, who, it should be added, reports on the ways in which Trump bilked supporters in hospice and retirement out of their money in a very devious manner. In this conversation we cover all that as well as the story of Brian Kolfage and the "We Build the Wall" charity, how corruption under Trump differs from corruption of yesteryear like that associated with the Pendergast Machine and Tammany Hall, Donald Trump's effect on foreign policy, the story of the curious Trump associate Tom Barrack, why David refers to Trump as a carny huckster like P.T. Barnum (with one major difference) and his supporters as marks, Super PACs and the need for reforms, white collar crime, the Trump family history, Trump and Christianity, the death of conservatism in the United States, Trump and the Atlantic City casino business, Trump stealing from a dog charity, and much, much more!
Wayne discusses why Derrek Chauvin needs a retrial and interviews Brian Kolfage.
On this edition of Parallax Views, we revisit the subject of Steve Bannon, who was recently arrested along with his business partners Andrew Badolato, Brian Kolfage, and Timothy Shea were arrested on charges related to fraudulent skullduggery in relation to their "We Build the Wall" campaign. In this conversation we turn away from the legal controversies to discuss the ideas that undergird Bannon's thinking. Many journalists, including previous Parallax Views guest Jean Guerrero, believe that Bannon is a bit of an empty shell intellectually. Which is to say that he is less an ideologue than a conman or a grifter. Our guest on this edition of the program, however, Prof. Benjamin R. Teiltelbaum, author of War for Eternity: Inside Bannon's Far-Right Circle of Global Power Brokers, argues otherwise. Teitelbaum makes the case that Bannon, who he conducted 21 hours of interviews with for the book, is influenced by a radical right-wing spiritual/political ideology known as Traditionalism. This would put Bannon in line with such strange thinkers today as Brazil's Olavo de Carvalho and Russia's Alexander Dugin, as well as past thinkers like the Perennialism Rene Guenon and the self-described "Super-Fascist" Julius Evola (who, during the WWII era criticized the Nazis from the RIGHT; in other words, he didn't see them as going far enough in their aims). These thinkers, says Teitelbaum, believe in a cyclical vision of history and time. They believe, he argues, that the Progressive vision of history has led us to a Dark Age, or what the Hindu faith knows as the Kali Yuga, and that, eventually, this age will overturned... either naturally or by force. Put country simple, the radical Traditionalists in War for Eternity are seeking a rollback of modernity. In addition to covering how all these thinkers connect with Bannon we also cover, briefly, how War for Eternity led Teitelbaum down a strange path investigating a private intelligence firm known as Jellyfish. One of the company's leaders, Michael Bagley, was interested in a project of building micro-cities for refugees, but was busted by the FBI after allegedly seeking to work with Mexican drug cartels like the Sinaloa cartel. Bagley and Jellyfish, which it should be noted was co-founded by a number of figures involved with Blackwater, it turns out had tie into the story of the "Alt Right" and attempts to start something called "Alt Right Corporation" with far-right personalities Richard Spencer, Daniel Frieberg, Henrik Palmgren of Red Ice, and Jason Reza Jorjani. Jorjani, who was seeking to influence the Trump administration to form alliances with Iranian ultra-nationalists, came to believe that Jellyfish was part of an intelligence operation. One of Teitelbaum's anti-fascist sources, it turns out, was also spooked by some things he found out about Jellyfish. With that in mind is there more to this story than Jorjani potentially having sour grapes? Teitelbaum weighs in on this matter later on in the conversation. Steve Bannon & partners arrested for WE BUILD THE WALL charity. The Duran Quick Take: Episode 640. Via Zerohedge (https://www.zerohedge.com/political/steve-bannon-arrested-and-charged-fraud-federal-prosecutors-new-york)... Bannon pleaded not guilty this afternoon at a brief presentment before U.S. District Judge Analisa Torres in Manhattan, and was freed on $5 million bond which restricts his traveling. Bannon was arrested this morning on a Chinese billionaire's yacht, and charged with fraud over a $25 million campaign to crowdfund a wall on the US southern border. Three other executives of the We Build the Wall charity were also charged Thursday with plotting to defraud the donors and launder their money into their own pockets. Bannon; U.S. Air Force veteran Brian Kolfage; venture capitalist Andy Badolato; and Timothy Shea each face conspiracy counts that could carry a maximum 40-year sentence. “To induce donors to donate to the campaign, Kolfage and Bannon — each of whom, as detailed herein, exerted significant control over We Build the Wall — repeatedly and falsely assured the public that Kolfage would ‘not take a penny in salary or compensation' and that ‘100% of the funds raised … will be used in the execution of our mission and purpose' because, as Bannon publicly stated, ‘we're a volunteer organization,'” according to the indictment filed in the Southern District of New York. “Those representations were false,” it continues.

Former Trump advisor Steve Bannon was arrested Thursday—along with Brian Kolfage, Andrew Badolato, and Timothy Shea—after federal prosecutors discovered they defrauded donors involved with the “We Build the Wall” campaign, a GoFundMe that shored up $25 million in donations since its inception in 2018. The unsealed federal indictment is damning, and even shows evidence of the grifters’ amusement with scamming their donors and misappropriating the funds for personal use. President Donald Trump’s former chief strategist, Steve Bannon, was pulled from a luxury yacht and arrested Thursday on allegations that he and three associates ripped off donors trying to fund a southern border wall, making him the latest in a long list of Trump allies to be charged with a crime. The organisers of the “We Build The Wall” group portrayed themselves as eager to help the president build a “big beautiful” barrier along the U.S.-Mexico border, as he promised during the 2016 campaign. They raised more than $25 million from thousands of donors and pledged that 100% of the money would be used for the project. But according to the criminal charges unsealed Thursday, much of the money never made it to the wall. Instead, it was used to line the pockets of group members, including Bannon, who served in Trump's White House and worked for his campaign. He allegedly took over $1 million, using some to secretly pay co-defendant Brian Kolfage, the founder of the project, and to cover hundreds of thousands of dollars in personal expenses.Hours after his arrest, Bannon pleaded not guilty during an appearance in a Manhattan federal court. He is the latest addition to a startlingly long list of Trump associates who have been prosecuted, including his former campaign chair, Paul Manafort, whom Bannon replaced, his longtime lawyer, Michael Cohen, and his former national security adviser, Michael Flynn.Trump has also made clear that he is willing to use his near-limitless pardon power to help political allies escape legal jeopardy, most recently commuting the sentence of longtime political adviser Roger Stone.Bannon was taken into custody around 7 a.m. by the U.S. Postal Inspection Service on a 150-foot (45-meter) luxury yacht called Lady May, which was off the coast of Connecticut, authorities said. The boat is owned by exiled Chinese billionaire Guo Wengui and currently for sale for nearly $28 million. According to Marine Traffic, a commercial tracking service, the vessel's transponder signal went dark on June 17, shortly after it departed a port in Connecticut en route to Miami, potentially indicating its beacon was inoperable or had been turned off.At his hearing, Bannon appeared by video with his hands cuffed in front of him and a white mask covering most of his face. He rocked back and forth on a chair in a holding cell with his lawyers on the telephone. The magistrate judge approved Bannon’s release on $5 million bail, secured by $1.75 million in assets.Neither Bannon, nor his spokesperson or attorney responded to requests for comment Thursday. Kolfage did not respond either. Also charged were Andrew Badolato and Timothy Shea, the owner of an energy drink company called Winning Energy. The company's cans feature a cartoon superhero image of Trump and claim to contain “12 oz. of liberal tears.” Shea appeared at a brief virtual hearing in Denver.Other prominent members of the wall group included former Kansas Secretary of State Kris Kobach, its general counsel; Erik Prince, founder of the controversial security firm Blackwater; former Republican Rep. Tom Tancredo of Colorado; and former major league baseball pitcher Curtis Schilling. They were not named in the indictment. After the arrest, Trump quickly distanced himself from Bannon and the project.“When I read about it, I didn’t like it. I said this is for government, this isn’t for private people. And it sounded to me like showboating,” he told reporters at the White House, adding that he felt “very badly" about the situation. An immigration plan unveiled by Trump last year included a proposal to allow the public to donate toward his long-promised wall, as the Kolfage group had originally said was its mission before shifting its focus to private construction. But Trump later denounced the project publicly, tweeting last month that he “disagreed with doing this very small (tiny) section of wall, in a tricky area, by a private group which raised money by ads” and...
