Value based pricing is an alternative that takes into account the value of the service being provided rather than simply the time spent. It means that lawyers and firms are paid based on the results they achieve for their clients. The incentive becomes focused on getting better results. Value-based pricing can also help build trust and improve communication between lawyers and clients. However, that doesn't make pricing or pricing conversations any easier. In this episode, we go into the rabbit hole of pricing.  SUBSCRIBE AND REVIEW:  iTunes // Spotify // Pocket Casts // StitcherSpecial thanks to Paul Stroka of LexFusion for making the introduction to Keith.Episode content Introduction and summary ➡ 1.24 Power of buyer ➡ 4.30 Power of supplier ➡ 7.34 Elastic economic market ➡ 9.42 Price discrimination ➡ 13.14 Client sophistication ➡ 17.08 Inflation and pricing for specialized services ➡ 23.46 The next service delivery model ➡ 31.04 Here are some of our favorite takeaways from the episode (edited to be reading-friendly).Value of workOne of the things that get ignored in discussions with clients or in the clients' calculus and how they determine what they're getting for the bills they're paying is that there's never a very accurate way of measuring the value that was captured from the services, and what the outcome was. It's always what was that bill? That bill is high. Maybe you bought a company, in an M&A scenario, that had subsidiaries or locations in highly regulated, highly risky territories - where there's a ton more work to be done. It's not an apples-to-apples kind of company. So you don't look at what I got for the price I paid? You're just saying the bills are higher now.Price discriminationAb: How do you demonstrate that we're going to charge you X, and it's worth more than X to you as an outcome?Keith: Price discrimination is the short answer to that. Not everything is worth the same amount. By nature, and this is not any judgment or me trying to take a position on the actual value or the value of the practitioners doing this kind of work. But by nature, there's a spectrum of complexity, and the stuff that's really complex on the highly complex side tends to be more scarce. There is a more scarce supply of people who can do it.On the opposite side, on a more commoditized side or the more routine side - it's not as complex, and there are more options to avail yourself of to do that work.Client sophistication - apply the scalpel, not the hatchetMy particular role is to ensure that the firm is as profitable as possible and that we're making our clients as happy as possible in terms of service delivery models and getting the outcomes they want. The conversation with the client depends on the level of sophistication:I'd say architecting and implementing some of those solutions depends on the sophistication that the client or the person on the buy-side has. There are only so many levers in this business in terms of what I can do. It's all about service delivery models and the underlying economics. This isn't astrophysics. There are not huge, massively complex data jobs in most cases (there are some benefits to that in different scenarios). There are a couple of levers on who's going to do the work and how much they have to do, what's the cheapest way to do it, and what the outcome will be. How do those things correlate (the price to the product)? Having those conversations with people that understand that better is important.I've worked with several legal operations groups where they have the knowledge, the understanding, and the sophistication. Still, there's a gap in the level of influence they have over the in-house attorneys...Different sides of the table, same challenges:We have very similar challenges - in-house and the law firm side - as it relates to getting the lawyers to understand the economics, the process, and to engage attorneys with it - to really adopt it. As opposed to, 'Yeah, but I'm skeptical of that because I don't understand it. So let's just do it the old way.'Next service delivery modelWhere can I get efficiencies out of technology? Which is a hugely growing market, that's going to be the new paradigm shift. It's going to be a much more dynamic service delivery model...Given that we've got a shortage of supply of people with the requisite skills to do a lot of this work and that's why we have to charge more. They [the attorneys] also have been working ridiculous man hours, and that's why we have to pay more for that. On top of that, there are obviously the mental health and quality of life concerns which is why a lot of people leave the workforce.I've been trying to make the case, and we work with our innovation group a lot, too, with several different teams internally to say: 'if you don't want people burnt out, you want them to have a better level of work-life balance and job satisfaction. Don't force them to brute force their way through everything all the time.'If you can get 30% more productivity out of the same people and let them sign off at seven or eight at night and use some tool that scales their productivity and delivers efficiencies then do it. You still get the same outcome, you just don't have to have as much input to have the same output.Resources mentioned Off The Clock Podcast Porter's Five Forces and a deeper look at Buyer Power

Real Prison Real Freedom by Rosser McDonaldAward-Winning ReporterChronicling Transformation of Notorious Texas Inmate and Entire Texas Prison System'Real Prison Real Freedom' by Rosser McDonald Shares the Heartbreaking Life Story and Inspiring Change of Rickie Smith During Time of Major Upheaval with Department of Corrections Itself.Prisons, an integral part of society, generally are not familiar to most people. Length of sentence and treatment by others in the prisons vary widely. The immediate "Man-in-charge" of each prison unit is the warden, who has some flexibility within TDCJ guidelines. Warden Dr. Keith Price gained a reputation for turning around some chaotic prison units. He knows from experience that at best, prisons are very difficult places for people, whether they are behind the bars or in front of them."People that wind up in prison, inmates, generally are society's rejects," Price said. "They've been unable to do the things other people do to make life a success, whether it's because of an abusive parent, addiction to some substance, stupidity, being unable to read or write, they've been failures and have chosen alternate means, that is crime."Price also knows officers have a challenging life, "The correctional officer, has to deal with people so maladjusted that society says they can't live amongst them anymore. It's conflict day after day, hour after hour and it really takes a toll, from broken marriages to financial problems to substance abuse. It's continual."The Texas Prison System was named "one of the best" in the country by a leading penology expert. However, shortly after that, a Federal Judge took control of the entire Texas Department of Corrections for "unconstitutional treatment" of inmates. TDC denied and resisted many of the reforms the judge ordered. The result was chaos. Too few guards, rampant gangs, gang wars and overcrowding were the norm for several years. The court kept control 20 years and finally the prison system adapted to the new (and constitutional) ways of operating. At the same time Texas prison population doubled, and more than doubled, again.During that time, 19-year-old Rickie Smith began a 10-year sentence in TDC on a drug charge. He joined the gang wars, in the Aryan Brotherhood and then made his own personal war with prison officers. He could have been released in a few short years, but, in 3 separate trials juries added 3 ninety-nine-year sentences for him to serve. Trial transcripts have many references in testimonies to how dangerous Rickie Smith is--even calling him "the most violent inmate" in TDC.REAL PRISON / REAL FREEDOM is a biography of Rickie Smith and how his life intersects with the woes of the prison system and with Warden Keith Price.Naturally, he wanted out, knowing that realistically it will never happen. Officials told him he'll never get out. Then came the impossible that shocked everyone, especially Rickie. This is the first book, but Rosser McDonald is an experienced writer. Sixteen years reporting news on TV in Oklahoma and Texas. Then twenty-eight years as a producer at the Radio and Television Commission, SBC. Twelve of those, Rosser produced and scripted documentaries for use on NBC TV stations. Two brought Emmy Award nominations. We’re excited to welcome Michael McCrary, the CEO, and Founder of PureSpectrum, as our guest for the podcast. Michael helps to solve business, economic, and even social issues with the valuable data and insights that he provides for companies and organizations. He is joining us today to talk about his choice to take the risk of becoming an entrepreneur, rather than remaining a wantrepreneur. Michael’s bio PureSpectrum is a modern-day sample automation platform based in Los Angeles, California. In 2003, Michael joined Greenfield Online, where he became the company’s SVP of North America Sales. He played an instrumental role in Greenfield’s public offering and eventual sale to Microsoft. From 2008 to 2014, Michael helped pioneer Cint as Managing Director, and Lucid as President. In 2015 Michael went full time as an entrepreneur and founded PureSpectrum, which is one of the fastest-growing consumer insight tech firms. Michael’s background Michael started with market research and data collection about seventeen or eighteen years ago, and since then, he has had a wonderful journey within the market research industry. The last jump he took just before that was working for the Meredith Corporation in their Direct Response to Advertising group, where he had the pleasure of representing the Mid-West Living magazine. It was not an easy sell to the agencies, however, and Michael had to use a lot of data to support the magazine’s claims about its readers. Taking the leap In the early days of Greenfield Online, Keith Price was looking for salespeople, and he contacted Michael, who decided to take the leap. Ever since then, Michael has very much enjoyed working in the industry. A stimulating industry The umbrella of the insight industry, in general, is filled with great and intelligent people, and Michael finds it intellectually stimulating to know that the work he is participating in helps solve business, economic, or even social issues. An entrepreneur, versus a wantrepreneur Michael spent much of his life as a wantrepreneur, which is somebody who talks about wanting to be an entrepreneur. Later on, he had to decide whether he wanted to remain a wantrepreneur or become an entrepreneur, who is someone who attempts to do it. Making a tough decision Deciding to become an entrepreneur is risky. It was a big choice for Michael to make because he is married with three children and a mortgage, so he spent about six months thinking about it before deciding to become an entrepreneur. A supportive ecosystem Having a supportive ecosystem is vital for entrepreneurs. Michael’s wife encouraged him to go for it, and he also had the support of his investors, yet he still felt he needed some support from someone who was exclusively in his corner. A mentor Michael very much appreciated getting the support of his late mentor, who did not expect getting anything in return for his mentorship. The dark years Michael’s first years as an entrepreneur were so tough that he refers to that time as ‘the dark years’. Online sample and data collection Michael has spent his time in the industry on the online sample and data collection side of things. PureSpectrum PureSpectrum is a programmatic platform that provides a lot of value to several agencies. It is very nuanced and complicated because it involves many different and exacting technology connections to suppliers. The focus of the platform is on being simple and easy for anyone to use, and on improving the efficiency automation of the data collection process. An automated sampling platform PureSpectrum has an automated sampling platform that brings all the different pieces together to change the trajectory of the speed and time in which everything gets done. It saves business owners a lot of time and money. The future of survey data collection The survey research process provides data that doesn’t already exist,
