In this episode, we sit down with Mr. Adam Caudle and Miss Dana Chase to dissect the 39-year litigation in Secretary of Defense v. Pratt & Whitney. We analyze the Federal Circuit's 2025 decision, which reaffirmed that a contracting officer's authority is not unlimited and that agreements violating mandatory FAR provisions are considered illegal and unenforceable. The discussion highlights the critical takeaway that while the revolutionary FAR overhaul encourages broader professional judgment, practitioners must still remain within the four corners of the FAR to ensure their agreements remain valid. Cases discussed: United Technologies Corp., Pratt & Whitney, ASBCA Nos. 47416, 50453, 50888, 01-2 BCA ¶ 31,592; Rumsfeld v. United Technologies Corp., 315 F.3d 1361 (Fed. The biggest news for Division III football coming out of the NFL draft was, as usual, not about a player getting drafted. We are accustomed to that by now, sadly, and no amount of tweeting is going to convince the NFL to draft D-III players. But for Tyren Montgomery, the contract offer came. And for four additional players so far, the rookie minicamp invite arrived. And on this podcast, we talk to Montgomery, the former John Carroll wide receiver, now a member of the Tennessee Titans, about his route to the NFL. If you read our feature on Montgomery last September, you already know the back story. He talks about what he’s been working on since the season ended, how many calls his agent got on his behalf, what he likes about the Titans and why he chose them out of the number of offers he received. We also chat with Bethany coach David Blake, who joins the Bison this year and brings a number of new ideas to the sideline after a wide variety of past experiences, including flying jets in the Navy and then working for the Judge Advocate General’s office. How that experience plays out as a first-time head coach is really fascinating, and is worth a listen. This includes some interesting uses of music during practice and workouts, and a really unique title for one of his assistant coaches. Other topics of discussion include, of course, the demise of Anna Maria College and the Anna Maria football program, the future arrival of St. Anselm from NCAA Division II, the St. Francis schedule, the new WIAC commissioner and the intriguing Week 1 matchup between UW-River Falls and Southern Virginia. In addition, we take your questions on the following topics: What is our opinion on D-III schools scheduling teams? Who has set themselves up for a playoff bid? And how many games and teams are we able to watch per week? In this conclusion to our deep dive into Other Transactions (OTs), we sit down with Mr. Adam Caudle and Ms. Kristine Kassekert to debunk the myth that OT awards are immune to protests. We examine the current jurisdictional landscape at the GAO and Court of Federal Claims, highlighting why thorough documentation is essential not just for formal litigation, but also for answering potential inquiries from Congress or senior leadership. We also discuss the "fail fast" mentality and the unique flexibility of OTs, which allow us to manage projects through iterative payment milestones and open-ended collaboration rather than the rigid deadlines found in traditional acquisitions. In this first part, we sit down with experts Mr. Adam Caudle and Ms. Kristine Kassekert to discuss the history of Other Transaction Authorities (OTAs) and the broad statutory definitions for prototype projects under 10 USC 4022. We explore the "team sport" nature of these agreements, highlighting how the iterative process and the ability for vendors to collaborate can lead to better mission outcomes than traditional FAR-based acquisitions. We also address the common myth that OTs have "no rules," clarifying that while they offer flexibility, practitioners must still navigate legal boundaries such as the Procurement Integrity Act and the Anti-Deficiency Act while maintaining a robust written record. In this episode of The Winston Marshall Show, I sit down with former Judge Advocate General and Royal Navy veteran Jeff Blackett for a wide-ranging conversation on the Iran war, international law, and the growing weakness of Britain's armed forces. We examine the case that the United States and Israel have militarily defeated Iran, from the destruction of its military capabilities to the ongoing threat of its nuclear programme. Blackett explains the legal justification for the war under Article 51, the limits of regime change, and why ideology, not just military power, determines long-term outcomes. The conversation explores the global consequences of the conflict, from rising energy prices and instability in the Strait of Hormuz to the future of NATO and American hegemony. We discuss the fragility of the Western alliance, the role of the United Nations, and whether the rules-based international order can survive in an increasingly multipolar world. We also turn to Britain, where Blackett warns that the armed forces have been hollowed out after decades of cuts. From declining naval capacity to overstretched personnel and reduced readiness, he argues the UK is no longer capable of defending its interests against serious threats.A sobering conversation about war, law, power, and whether Britain and the West are prepared for the conflicts of the future.-----------------------------------------------------------------------------------------------------------------------WATCH THE EXTENDED CONVERSATION HERE: https://open.substack.com/pub/winstonmarshall/p/the-truth-about-the-iran-war-nobodys?r=18lfab&utm_campaign=post&utm_medium=web&showWelcomeOnShare=true-----------------------------------------------------------------------------------------------------------------------Chapters 00:00 Introduction 02:56 Has Iran's Military Actually Been Degraded?03:53 US War Objectives: Military, Nuclear, and Regime Change04:53 Can You Ever Truly Defeat an Ideology?08:50 Iran's Nuclear Enrichment: What Still Remains?12:02 The $1 Billion-a-Day Cost of War13:10 UN Resolution 2817 & Legality of the War16:18 UK vs US: Starmer, NATO & Strategic Tensions18:21 Britain's Military Weakness & NATO Dependence19:15 The State of the Royal Navy & Defence Cuts22:33 Global Economic Fallout: Oil, Fertiliser & Food Prices26:37 American Hegemony & the Future of NATO30:00 Decline of Western Military Power Since the Cold War33:12 Could Britain Defend the Falklands Today?37:10 What Does “Winning a War” Actually Mean?38:49 The Role (and Failure) of the United Nations40:23 Could This Become Another Endless War?44:07 NATO Fragility & UK-US Relations45:31 Veteran Immunity Controversy Explained47:17 The Overseas Operations Act & Legal Debate49:56 Endless Investigations Into Soldiers — The Real Issue51:11 The Blackman Case & Battlefield Ethics53:57 Rules of War & the Geneva Conventions55:55 Do Rules-Based Systems Still Work?57:12 “Might Is Right” vs International Law Debate59:31 Is Global Order Just Backed by Power?1:00:44 Final Thoughts: UN Failure & UK Military Decline Hosted on Acast. In this episode we analyze the Supreme Court's ruling in Cox Communications, Inc. v. Sony Music Entertainment, which explores the limits of secondary liability for internet service providers when users engage in copyright infringement. We discuss how the court determined that mere knowledge is insufficient for contributory liability, requiring plaintiffs to instead prove intent through "inducement" or "tailoring" frameworks derived from Sony Corp. of America v. Universal City Studios, Inc. and MGM Studios, Inc. v. Grokster, Ltd. We also highlight that the Digital Millennium Copyright Act (DMCA) safe harbor acts as a shield rather than a sword, underscoring the necessity for organizations to maintain active policies against service misuse. Thus far, Donald Trump has sent six military members - six of America's sons and daughters - to their death, in what is, by all rational accounts, an unlawful and unconstitutional war. And just so there's no mistake about the fact that we ARE in a war, Pete Hegseth just said at a press conference, "The terms of this war will be set by us." I just sat down with military law expert Dan Maurer. Dan is a law professor and retired Army LTC JAG officer. Dan taught constitutional law and criminal law at West Point, and was an instructor at the Army's Judge Advocate General's School in Charlottesville, Virginia. Dan explains why we are - indisputably - in an unlawful and unconstitutional war.Find Dan on Substack: danmaurer1.substack.com Find Glen on Substack: glennkirschner.substack.comSee Privacy Policy at https://art19.com/privacy and California Privacy Notice at https://art19.com/privacy#do-not-sell-my-info.

As the U.S. military remains mostly opaque on the details of ongoing aggression against Venezuelan targets, Donald Trump lack of filter and braggadocious inclinations mean there is little holding him back from blurting about a recent U.S. attack. Margaret Donovan, former federal prosecutor and former Judge Advocate General officer, and MS NOW senior national security reporter David Rohde discuss what is known about what the U.S. is doing in Venezuela and whether the Trump administration is reverse engineering legal justifications for its actions. With the arrest of Pastor Joe Campbell earlier this month on child sex abuse charges, the women who have spent decades seek justice for abuse they accuse Campbell of committing may be closer to that goal. Abuse survivor Phaedra Creed talks with Antonia Hylton about her feelings about Campbell's arrest, the effort it took, and insights her experience offers for women who were abused at the hands of Jeffrey Epstein and his associates. The ongoing release of Jeffrey Epstein-related files continues to raise more questions than answers. Rep. Suhas Subramanyam joins to discuss.Cesar Vazquez discusses progress in protecting his neighbors in California from the abuses of ICE. The Washington Roundtable discusses the President's use of the military for political ends, and the “almost unlimited” powers he would unlock by invoking the Insurrection Act, with Kori Schake, the director of foreign-and-defense-policy studies at the American Enterprise Institute. Donald Trump's decisions—sending the National Guard into American cities over the objections of local leaders and firing Judge Advocate General's Corps lawyers who help determine if an order is legal—send a message to the historically apolitical armed forces. “What he's trying to do is circumvent the disciplined senior leadership and appeal for personal loyalty to the younger, noncommissioned and enlisted soldiers,” Schake says. “The pressure from this Administration—there's been nothing like it since at least the constitutional crisis of 1866-68.” Schake is the author of the forthcoming book “The State and the Soldier: A History of Civil-Military Relations in the United States.” This week's reading: “Trump, the Self-Styled ‘President of PEACE' Abroad, Makes War at Home,” by Susan B. Glasser “Donald Trump, Pete Hegseth, and the ‘War from Within,' ” by Benjamin Wallace-Wells “Nixon Now Looks Restrained,” by Ruth Marcus “Hope and Grief in Israel After the Gaza Ceasefire Deal,” by Ruth Margalit “The Volunteers Tracking ICE in Los Angeles,” by Oren Peleg Tune in wherever you get your podcasts.
