The case, brought by several individuals including Sheikh Yassir Fazaga, claims the FBI unlawfully monitored their community using an informant after 9/11. The justices did not rule on the merits but instead instructed the lower courts to revisit the case in light of new factual developments and the government's motion to dismiss.At the center of the dispute is the state secrets privilege, a legal doctrine that allows the government to block litigation if it risks exposing national security information. The FBI has argued that continuing the case could reveal sensitive intelligence methods and weaken this protection. Previously, the United States Court of Appeals for the Ninth Circuit allowed parts of the lawsuit to move forward, reasoning that courts should not dismiss claims too early without fully examining whether secret evidence is truly necessary. The appellate court suggested possible ways to proceed while protecting classified information, such as limited judicial review of sensitive materials.The Supreme Court's earlier 2022 decision confirmed that the state secrets privilege applies but left open how it should be used in this case. The outcome could shape how courts handle similar conflicts between civil rights claims and government secrecy.Justices Remand State Secrets Dispute In FBI Spying Case - Law360In my column for Bloomberg this week, I examine how a major IRS modernization effort fell short—not simply because of execution issues, but because of chronic underfunding. A recent report by the Treasury Inspector General for Tax Administration shows that funds from the Inflation Reduction Act that were intended for modernization were largely redirected to cover basic operations. Instead of transforming systems and rebuilding long-term capacity, the IRS used much of the money to sustain staffing and maintain existing IT infrastructure. In my view, this outcome was predictable given the agency's longstanding resource constraints.I explain how budget cuts and workforce reductions undermined the modernization initiative from the start. Even with new funding, the IRS still had to meet its core obligation of processing hundreds of millions of tax returns each year. Faced with those pressures, it prioritized immediate operational needs over long-term upgrades, including spending significant sums on routine IT maintenance. I also point out that contractor spending surged, reflecting a growing reliance on outside support rather than investment in internal expertise.The report highlights inefficiencies as well, including canceled or reworked contracts that consumed large amounts of funding without delivering meaningful results. At the same time, labor costs remained elevated due to the complexities of downsizing, creating a situation where the IRS was both shrinking its workforce and paying contractors to compensate for lost capacity. I argue that this pattern is better understood as institutional outsourcing rather than modernization.Ultimately, I contend that real modernization cannot occur without stable baseline funding for core operations. Without that foundation, any new investment will continue to be diverted toward keeping the agency running. My conclusion is that Congress attempted to modernize the IRS without first ensuring its institutional stability, making the outcome not just disappointing, but largely inevitable. In a joint statement, Health and Human Services Secretary Robert Kennedy, Jr. and Secretary of State Marco Rubio renounced American participation in a de facto treaty sneakily adopted last year by the World Health Assembly with the connivance of the Biden administration, Communist China and assorted other globalists. Turbocharged by the internet and mobile technology, legalized gambling has exploded across the globe, leaving behind ruined lives, broken families and financial hardships, and should now be classified as a major public health concern. A four-year study by a public health commission on gambling convened by The Lancet, the respected British journal of medicine, found that net global losses by gamblers could exceed $700 billion by the year 2028, and that 80% of countries now allow some form of legal gambling. But HKS Professor Malcolm Sparrow, a leading scholar on regulating societal harms, says that in reality the percentage of countries where gambling is practiced is closer to 100% because internet- and mobile-based gambling—often using cryptocurrencies—can easily circumvent borders. Among the commission's more concerning findings is that a significant portion of virtual gamblers are teenagers, and that more than 1 in 4 teens are at risk of becoming compulsive or problem gamblers. Sparrow tells PolicyCast host Ralph Ranalli that the harms are also widespread, since the suffering from each problem gambler also affects on average six to eight people around them—ranging from spouses to relatives to friends to employers and co-workers. Sparrow says the commission has identified a number of policy solutions to mitigate the growing fallout from gambling expansion, ranging from limiting the speed and intensity of virtual gambling products to prohibiting gambling with credit cards and banning gaming companies from offering loans. Policy Recommendations from The Lancet Public Health Commission on Gambling:Push governments to define gambling as primarily a public health issue, and prioritize health and wellbeing over economic gains when crafting gambling policies.Adopt effective regulation in all countries—regardless of whether or not they have legalized gambling—including limiting promotion and marketing, providing accessible support for betting-related harms, and denormalizing gambling through public awareness campaigns.Create independent regulators in jurisdictions where gambling is legal to enforce protections including safeguards for young people, consumer protections, and mandatory limits on gambling activities.Shield development of gambling policies, research, and treatment from industry influence through a shift to independent funding sources.At the international level, require UN entities and intergovernmental organizations to address gambling harms as part of broader health and wellbeing strategies.Create an international alliance of stakeholders to lead advocacy, research, and collaboration on gambling-related issues.Adopt a resolution recognizing the public health impacts of gambling at the World Health Assembly.Episode Notes:Malcolm K. The 77th World Health Assembly takes place from May 27th through June 1st in Geneva, Switzerland. The theme is, -All for health, health for all.- This assembly is the main decision making body of the World Health Organization, comprised of 194 member states.--What this assembly has in store for us is what brought Mat Staver back to Crosstalk. Mat is founder - chairman of Liberty Counsel. He's a constitutional attorney with three landmark cases before the U.S. Supreme Court. He is an author and the host of the radio broadcasts Faith - Freedom and Freedom's Call.--Mat noted that just a few years ago there were members of the U.S. Congress that believed the World Health Organization is merely an advisory organization and couldn't be legally binding. Smallpox is a deadly virus. At one point, it killed almost 1 in 3 people who had it. Almost 300 million of those deaths were in the 20th century alone. It was extremely painful, highly contagious and many people thought it would be impossible to wipe out—until it was. On May 8, 1980. the 33rd World Health Assembly declared the world free of smallpox. This marked the first—and only—time a human disease was eradicated globally. Epidemiologist and host of the podcast Epidemic: Eradicating Smallpox Céline Gounder has been looking into this history. Today, she shares the intense journey to eradicate smallpox in Bangladesh (spoiler alert: there are literal speedboats) and reflects on what this history tells us about the importance of healthcare that meets the needs of individuals and communities today.
