Every year the Federal Communications Commission collects billions of dollars from telecommunications customers—anyone with a telephone—to fund “universal service.” The program subsidizes high-cost areas and certain educational and healthcare providers. However, Congress wrote an evolving and open-ended statute, leaving FCC to set and then rewrite its own policies for the Universal Service Fund and to fund the program without limit through fees that escape Congressional oversight. Congress never had the right to delegate such expansive power to EPA in the first place, and the agency has used it the detriment of NCLA's client, benefiting a Chinese-owned company that infringed on their patent. What that really means is pushing companies to hit net-zero carbon emissions by 2050,” Hild says. “S stands for social,” he adds. “What that really means is pushing companies to engage in LGBTQ propaganda, transgender ideology, pro-choice propaganda or policies at the corporate board level, or weighing into board makeup of companies in terms of setting racial and sexual quotas at the board level.”“And then, the G … stands for governance, and that's really just the enforcement mechanism,” he adds. Independent federal agencies sit awkwardly in our constitutional structure. When they engage in aggressive overreach, therefore, they should expect to see their actions challenged in court. This episode centers around two such challenges. In Axon v. FTC, a case the Supreme Court will hear this term, the plaintiff challenges the jurisdiction of the Federal Trade Commission's internal tribunal. And in Consumers' Research v. FCC, a set of cases currently in the federal courts of appeals, the petitioners challenge the Federal Communications Commission's power to raise money without congressional oversight. Just click that link.]You may have been doom-scrolling yesterday and caught the latest hysteria of anti-LGBTQ extremists in the conservative movement. State Farm—the insurance company whose commercials you've definitely seen everywhere in the past 15 years—had a really cool idea: partnering with The GenderCool Project to provide LGBTQ-themed books to schools and communities throughout the country, including Florida, where the infamous “Don't Say Gay, Don't Say Trans” bill recently signed by Ron DeSantis is set to take effect on July 1st.It's a private program in which schools and communities can proactively participate but, of course, doesn't require anyone else to participate or contribute their dollars toward that participation. In January, a State Farm employee sent an email announcement to Florida colleagues asking for volunteers to coordinate with interested schools and communities. It noted that the company would be enlisting the help of 550 volunteers nationwide—presumably State Farm agents—to gift a three-book bundle to participating recipients, noting:"The project's goal is to increase representation of LGBTQ+ books and support out communities in having challenging, important and empowering conversations with children Age 5+.”Recently, that email was forwarded to Consumers' Research, an anti-LGBTQ extremist organization (which will I not link to), who then sent it to far-right “news” outlets and anti-LGBTQ influencer Libs of TikTok, all of whom gleefully spent yesterday pushing content that claimed State Farm is indoctrinating five-year olds to become transgender.Because hateful online campaigns of this variety have become commonplace, lately, and I was working quite a bit all afternoon, I didn't take much notice when State Farm starting trending on Twitter from the relentless propaganda and s**t-posting by anti-LGBTQ extremists.Then came news early that evening of an emergency email sent by State Farm's Chief Diversity Officer to all employees announcing the company would no longer support the program. Here's a screenshot of that email:This wasn't in support of required curriculum. It was a program using State Farm's own money to buy 1,650 LGBTQ-themed books to be distributed to interested schools and communities across the country. In fact, given the total number of books being gifted, it would be damn near impossible to have anything approaching a large-scale awareness campaign. If anything, I see it as a very nice gesture and nod toward the importance of educating about LGBTQ families.But State Farm, being the cowards they are, instead of aggressively pushing back against the hateful censorship of anti-LGBTQ extremists, chose to humor the premise that anyone in this situation, any parent or child, was being required to do something they didn't want to do.No one was. It was intended to be all-privately-funded, all-volunteer, and all strictly based on recipients choosing to be part of the program.But State Farm pulled the plug because they got scared and decided it's more important to placate anti-LGBTQ extremists than stand beside the LGBTQ community in a moment of horrific uncertainty.Of course, given State Farm's political donations in the last cycle, this shouldn't come as a huge shock. According to Open Secrets, a majority of the company's political contributions for the 2020 elections went to Republican/conservative federal candidates, all of them opposing basic LGBTQ rights.Those of us who are active in LGBTQ politics have been bracing for what this year's Pride Month—starting in a week—will reveal about the strength of support so many companies have expressed for LGBTQ rights in recent years.Companies tossing up a rainbow logo on June 1st whilst contributing to anti-LGBTQ politicians has long been a problem—referred to as “rainbow washing”—but this year is different. This year, even the performative emptiness of a company's vague statement of support for LGBTQ people seems to be vulnerable to a massive and expensive effort by the Republican Party and conservative movement to erase LGBTQ people from the public square and deem anyone who fights back, including allies, as “groomers”.Pride Month this year will be less of a celebration and more of a grim acknowledgement that the GOP is clearly coming after us and have no empathy or nuance or basic sense of humanity in how they do it.When attempting to erase a minority group, it's essential to anesthetize public support for their humanity. The GOP has spent a long time attempting to do this in the broad public square. Recently, the bulk of that focus turned specifically to schools and fear-mongering over LGBTQ families, teachers, and students. Now, the GOP and anti-LGBTQ extremists are focusing their hateful rage on private companies who supposedly support LGBTQ people in the communities in which they do business. Podcast #23: Welcome back friends to In My Right Mind. I am Russ Andrews and as always, I am joined by the producer of In My Right Mind, Mr PJ Jaycox. How about them Av's PJ?? So PJ, critics…like me… are arguing that masking has become a form of virtue signaling. Uncle Joe Biden, the Delaware Destroyer, reinforced that claim with his appeals to patriotism, which began during last year's campaign as a rebuttal to the mask-resistant President Trump. But if wearing a mask conveys a political message, mandating it is constitutionally suspect. “No official, high or petty, can prescribe what shall be orthodox in politics, nationalism, religion, or other matters of opinion or force citizens to confess by word or act their faith therein,” Justice Robert Jackson wrote in West Virginia State Board of Education v. Barnette (1943), which held that forcing schoolchildren to salute the flag and recite the Pledge of Allegiance violated their freedom of speech. To wear a mask in public is to affirm a viewpoint no less powerful than the Pledge of Allegiance: that Covid poses a crisis so dire as to demand unprecedented government control of our lives and a transformation of the norms of interpersonal behavior. Ubiquitous mask mandates make assent impossible to avoid except by breaking the law or staying home. “The pandemic has receded rapidly, with the number of daily U.S. infections down 88% since its January peak and still declining. Since mid-April vaccines have been available free of charge to any adult in America. Almost 124 million Americans—including more than 47% of adults and nearly 73% of the vulnerable 65-and-over population—have been vaccinated fully. The CDC acknowledges implicitly with its latest guidance that vaccinated people are at trivial risk of contracting the virus or transmitting it to others.” The WSJ claims “All this would be relevant to a court considering a First Amendment challenge to a mask mandate. To defend content-based limits on speech, the government must satisfy a standard known as strict scrutiny. It has three elements, all of which must be met: The government has to demonstrate that the restriction furthers a “compelling interest,” that it is “narrowly tailored” to fulfill its objective, and that it is the “least restrictive means” of doing so. The government undoubtedly has a compelling interest in preventing infectious disease. But that doesn't necessarily imply a compelling need for mask mandates. If it did, they could be justified in perpetuity. Universal masking would reduce spread of the flu, the common cold and other infections, but that has never been thought to justify mandating it except during a pandemic. Widespread vaccination makes mask mandates far too broad to be a properly tailored remedy. Selective enforcement against the unvaccinated is impracticably cumbersome, so authorities have to rely on what CDC Director Rochelle Walensky calls “the honor system”—which presumably is why the CDC hasn't relaxed its own order requiring universal masking in transportation facilities. Many of the relaxed mandates arbitrarily apply to the 32 million Americans with natural immunity from prior infection unless they are also vaccinated. And if selective enforcement were possible, it would compound the First Amendment violation with an intrusion into medical privacy by effectively requiring the disclosure of vaccination status as a condition of going out in public. All of which is to say PHOCK the face mask! Consumers Reasearch ads, FIGHTING BACK! They are now learning the hard way that it isn't, as a national advertising campaign targets their brands and credibility. For so many, it will be to cover up personal anxieties or even issues which might need psychological counseling.
