Dr. Robert Glatter is Editor at Large for Medscape Emergency Medicine and Assistant Professor of Emergency Medicine at Zucker School of Medicine at Hofstra/Northwell. Dr. Peter Papadakos is Professor of Anesthesiology, Surgery, Neurology and Neurosurgery at the University of Rochester, and a Professor of Internal Medicine at Mercer University School of Medicine. Drs. Papadakos and Glatter dissect the harsh realities of suffering and injustice surrounding the execution of Kenneth Smith in Alabama, the first person executed using nitrogen gas. They explore what nitrogen is and its physiological effects and reflect on the inhumane nature of nitrogen hypoxia. The conversation also touches upon the broader issues of botched executions, delayed executions as psychological torture, the absence of definitive DNA evidence in some death row cases. They highlight the point that both the American Medical Association and the American Society of Anesthesiologists as well as many nursing associations state that participating in executions is not the practice of medicine and is prohibited by their members. This means that executions are conducted by non-medical personnel. They also point out that delaying executions, sometimes for decades, falls under the definition of torture under the Geneva conventions. The last week saw two contrasting examples of how societies treat killers. Valdo Calocane, who killed three people in Nottingham and tried to kill three more, avoided jail and was instead sent to a secure hospital for life because of his mental illness. One of the victim's relatives protested that he “got away with murder”. Meanwhile in America, convicted murderer Kenneth Smith became the first person in the US to be executed using nitrogen gas.Calocane's charge was reduced to manslaughter on the grounds of diminished responsibility because of his paranoid schizophrenia. The mother of one of his victims objected and complained that the families were not consulted. The Attorney General will be reviewing the sentence. It's raised questions about what punishment is for: Is it for criminals – to provide the suffering they deserve, or reform them or deter future offenders? Or is it for victims – providing retribution and a sense of fairness to them? Victims are uniquely placed to appreciate the true impact of crime, so shouldn't their perspective have a greater weight in the judicial process? Would a bigger role for victims improve or hinder justice? The Supreme Court has declined to halt the execution of an inmate who is set to die by nitrogen gas. Kenneth Smith of Alabama will be the first person to be executed by this entirely new method. Lawmakers in Ohio have overridden a veto from Gov. Mike DeWine over a transgender bill. From now on, cross-sex drugs and procedures will be banned for minors in the state, and girls and women's sports will be limited to biological women. A Russian military plane has crashed near the Ukrainian border. Russia said that all 74 people on board were killed, including a number of Ukrainian prisoners of war. The United Automobile Workers Union has endorsed President Joe Biden after he won a write-in campaign in the New Hampshire primary. Alabama has already tried to execute Kenneth Smith once. On the night of November 17, 2022, he was scheduled to be put to death by lethal injection, but workers couldn't find a vein to place an IV. They tried for an hour, during which, he was jabbed with needles in his arms, hands and collar bones. Smith, one of only two living people in the U.S. to have survived an execution attempt, faces death again. On Thursday, the state of Alabama plans to execute him using a method it calls nitrogen hypoxia.
