Neste episódio, conversamos com Susana Henriques da Costa, promotora de Justiça do MPSP e professora de Direito da USP, sobre o acesso à justiça e as eventuais exorbitâncias relacionadas à litigância excessiva no Brasil. A Base Nacional de Dados do Poder Judiciário, mantida pelo Conselho Nacional de Justiça, contabilizou mais de 77 milhões de processos em tramitação nos tribunais e varas do Brasil até o dia 28 de fevereiro de 2023. Em 2022, foram protocolados mais de 30 milhões de casos novos e foram julgados mais de 28 milhões de processos. É preciso refletir sobre as medidas de gestão utilizadas para a realidade do Judiciário brasileiro. O que representam estas cifras de processos na casa dos milhões? Uma excessiva litigância acarretada pela facilidade de acesso à justiça ou uma ineficiência do sistema Judiciário no atendimento das demandas? Entrevista com a Profa. Ana Cláudia Rossaneis Resumo: A inteligência artificial é tratada como uma realidade a ser enfrentada pela sociedade, em sua integralidade, e em seus vários aspectos. A atividade jurisdicional, já há algum tempo, vem sofrendo diversas críticas, em relação a sua suposta inefetividade e morosidade, razão pela qual se questiona se o uso da inteligência artificial poderia culminar em uma melhoria significativa para a cenário analisado. Ocorre que a atividade jurisdicional, entre tantos outros escopos, deve sempre tem por primazia a efetivação do direito de acesso à justiça, seja em seu aspecto formal, seja em seu aspecto material, razão pela qual a modificação de qualquer aspecto operacional, em sua atividade, deve ser estudada e analisada com cautela, de forma que os princípios constitucionais, não sejam tão somente não violados, mas sejam, também, efetivados. Sendo assim, busca-se analisar se a utilização da inteligência artificial no âmbito da atividade jurisdicional se trata de situação adequada, em caso afirmativo, em que medida a mesma deve acontecer e se mostra como instrumento capaz de efetivar ou de colocar em risco o direito de acesso à justiça.

O episódio trata do Tema repetitivo 948, segundo o qual “em ação civil pública proposta por associação, na condição de substituta processual de consumidores, possuem legitimidade para a liquidação e execução da sentença todos os beneficiados pela procedência do pedido, independentemente de serem filiados à Associação promovente.” Na conversa com os jornalistas Fátima Uchôa e Thiago Gomide, Renato Castro detalha os principais aspectos discutidos pela Segunda Seção do STJ até a definição da tese repetitiva. “A questão principal foi exatamente a necessidade ou não de a associação, ao ingressar em defesa de consumidores, ter que apresentar o rol dos associados, ter que apresentar a autorização expressa dos associados. E o que se definiu nesse Tema 948 foi exatamente a desnecessidade de autorização expressa, porque o próprio Código de defesa do Consumidor, no artigo 82, já confere legitimidade a associações e não exige autorização expressa”, enfatizou. O magistrado também fez questão de ressaltar a essencialidade da aplicação dos precedentes qualificados para a segurança jurídica no país e esclareceu situações excepcionais de não aplicação das teses firmadas. “Primeira situação: quando aquele caso concreto que está sendo julgado tiver alguma peculiaridade, tiver alguma circunstância que justifique a não aplicação do precedente, ou seja, os casos que redundaram na criação do precedente são um pouco diferentes daquele caso que está sendo julgado. Aí é que se faz a distinção, o distinguishing. E a outra situação que permite ao órgão julgador deixar de aplicar um precedente, é quando ele estiver superado. É o famoso overruling”, explicou. This chapter was rich with information around the indigenous healers in the Panay Highlands of Western Visayas. Written by trained ethnomusicologist, Maria Christine Muyco, they bring us into a story collected by participant-observation learnings of these Panay Bukidnon (mountain people of Panay). Maria spent 2 years in 2003-2004 in the Panay Highlands specifically inquiring the process of this community's types of healing rituals, always incorporating the Binanog, a dance practice that draws its inspiration from the local hawk-eagle called banog. The ideological aspects in Panay healing always aimed to achieve SIBOD - a mastery of structures and synchronizations that produces effectiveness, connectedness, and even transcendence. Through the Binanog dance, Maria first encountered the linkage between healing, movement, and spiritual interplay, and drew her attention to the synchronizations between healing and dancing and how each can realize a healer's intention of bringing harmony to the body-spirit universe, otherwise known as kalibutan. Through her work, Maria meets and speaks with several traditional healers, serruano, dalungdungan, the maarams, the babaylan. They included learning about how young healer Menchie Diaz-Caspillo stepped into her calling, Noning Lopez of Barangay Cabatangan in Lambunao (Iloilo), Violeta Damas from Barangay Taganhin, and an interview with Alfred Castor who knew a family with 7 adult babaylans. These interactions allowed Maria to discuss what defines a serruano , as they do not choose to be so at will, because powerful spirits or forces select them. Maria provides us with several vocabulary words utilized by the Panay Bukidnon to give insight of their perspectives of life from the origin of creation, to the understandings of various spirit beings that exist and can be seeing during times of the night, how the babaylan moved while she sat in ritual, why and how supplication of the spirits was essential, and overall prosing the theme of indigenous ways for bridging body-and-spiritual constituents that bring about healing for those who are in need. --------------------- 1. Agency can not be seen as a matter of anthropocentric, human centred approaches. It is not just left to us to save the day, we need a broader understanding of what constitutes reality. When we try to solve climate-change, we are still trying to solve it within a instrumentalist, hierarchical, patriarchal paradigm. As if we can in one phallic move fix the issues. This is extremely human framed. Another move, is to notice, that we are climate-change - all of us, the whole world. There is nothing that is old, that is not new, and there is nothing that is new that is not old. It is not that all was fine and dandy in the past… Is it even possible to correlate agency and power with skill? It is interesting to behold, that the virus that is now upsetting the human world so greatly, that the sum of those covid-viruses that have inflicted havoc on us, would fit into a tea-spoon. The invitation is to stay with the trouble and with the smallness, maybe that is all we need It is not about not doing anything, it is about disturbing the assumptions in which we frame actions and solutions. It seems that when we apply grand solutions to our problems, they mostly seem to create new problems. Maybe we need to slow down, we need to dismantle our known ways, and let new ways come to us. There is a lot more happening than we are able to detect. There is the molar and the molecular. The molecular is hardly perceivable, but it is happening, it is small but not insignificant in any way. In these difficult times, It is a matter of shape shifting, and that doesn't mean moving towards a harmonious, utopia. Its about opening ourselves to new problems, new critiques, all the different kinds of shadows as well as new ways of potentially being in the world. They first try to identify the total amount of value in a potential agreement, before thinking about the division of value. Divergent thinking is a source of value. In his book, Sanders refers to Creative Conflict as a positive, to be embraced. There's no predetermined solution, and no absolutely perfect price. There are many possible solutions, and good negotiators are able and willing to continue exploring the ambiguity, and welcoming contending ideas. They are open to uncertainty. It may lead to a solution that neither party might have seen on its own. Value potential can be mapped in preparation for negotiation. Sanders introduces the concept of value mapping. Economists are somewhat familiar with this approach at the market level, but perhaps not at the level of individual exchange. Value mapping in contract negotiation is the mental connection of one side's assets to the other side's needs. The value map would include a list of concessions desired from the other side (with a subjective estimate of their importance) and a list of what can be given up by your side to generate more value for the other party. In some cases, the values can be quantified. When presented, these lists become a value proposition for the shared outcome of the negotiation. Sanders provides a value mapping checklist as a tool to help negotiators think about all the assets they might have to bring to the negotiation, and all the areas where concessions might be sought in return. Value mapping points to the productive end of the negotiation continuum. Bill Sanders presents types of negotiations on a continuum (see Mises.org/E4B_121_PDF2). On the left-hand end is bargaining, the traditional zero-sum exercise to capture value, a purely distributive process. At the midpoint is creative dealmaking, where value mapping is applied (see Mises.org/E4B_121_PDF1) to surface extra value so that both sides feel they gain more than they relinquish. On the right-hand end is relationship building, where the two parties enter into a partnership in which each works hard for the other party to succeed. The spectrum is one of ascending creativity from left to right. Austrian economics has a big role to play. Many of the techniques Sanders proffers in Creative Conflict are firmly based in Austrian economics, as he himself emphasizes. Some of the relevant concepts are: Subjective Value: Each party experiences value in their own mind, and anticipates future value in the form of expectations, based on their own evaluative criteria. While subjective value can't be quantified, the concept of an expanding pool of value can be considered by both sides, each from their own unique perspective. Empathy: The tool for understanding the other party's mental model for evaluation is empathy, the exercise of which we often stress as the entrepreneur's primary value facilitation skill. This is as true in contract negotiation as in any other exchange. Trust: Negotiation takes time and requires the declaration of parties' wants and needs, preferences, capabilities and capacities, and the full functioning of the goods and services being traded. Trust is the required underpinning for these declarations. Distributed knowledge: There are always things that the seller knows that the buyer doesn't, and vice-versa. This is the normal (non-equilibrium) position, to be recognized and welcomed. Uncertainty: Uncertainty is the quintessential condition of entrepreneurship. The future is unknowable. Sanders recommends the full recognition of uncertainty and indeterminism in contract negotiations. Explore possibilities rather than imposing mandatory conditions. Heterogeneity: Negotiators are different, firms are different and have different priorities, every deal is different. There is no standard way of business negotiations. Sanders does not try to lay down “rules”. Real time: Time is the context in which change takes place. Every advance in time brings new knowledge and more change. Since negotiation takes time, it must be flexible enough to accommodate change and avoid rigidity. Processual perspective: The market is a process, value is a process and negotiation is a process. Austrian economics recognizes the role and influence of time — time as the context of change — at a high level of impact. Contract negotiators take the same perspective, using the time taken for the process to unfold as a means of facilitating greater value whenever possible.
