En este episodio de Parte Médico, el Dr. Julio Castro nos explica todo lo que debemos saber sobre la Escherichia coli (E. coli), una de las bacterias más comunes del intestino, pero que en ciertas circunstancias puede transformarse en una amenaza real para nuestra salud.

A contratação de médicos por meio de pessoas jurídicas gera automaticamente vínculo de emprego e cobrança de contribuições previdenciárias? Para o CARF, a resposta, no caso analisado, foi não. Por 4 votos a 2, a 2ª Turma da 3ª Câmara da 2ª Seção do CARF cancelou cobranças de contribuições previdenciárias, contribuições destinadas a terceiros e multa contra o Hospital Anchieta S.A., relacionadas à contratação de médicos e outros profissionais de saúde por meio de pessoas jurídicas. A discussão é extremamente relevante. A fiscalização sustentava a existência de fraude na contratação dos profissionais. Mas prevaleceu no CARF o entendimento de que a autuação estava fundamentada, essencialmente, na antiga ideia de que seria ilícita a terceirização da atividade-fim. E esse cenário mudou. O STF, no Tema 725 da repercussão geral e na ADPF 324, reconheceu a licitude da terceirização e de outras formas de divisão do trabalho entre pessoas jurídicas, independentemente da atividade exercida. A relatora também destacou que não havia comprovação de que os profissionais tivessem sido coagidos a constituir pessoas jurídicas para prestar os serviços. Mas atenção: a decisão não significa que toda contratação de médico por PJ esteja automaticamente protegida. Se houver simulação ou se, no caso concreto, estiverem efetivamente presentes elementos próprios de uma relação de emprego, a discussão permanece possível. O ponto central é outro: a mera contratação de médicos por pessoas jurídicas — inclusive para exercer a atividade principal do hospital — não pode, isoladamente, ser tratada como fraude. Esse julgamento é especialmente importante para hospitais, clínicas, laboratórios e outras empresas do setor de saúde que trabalham com estruturas de contratação de profissionais médicos. Existem três formas de sabotar a venda do próprio plano de acompanhamento, e nenhuma delas parece sabotagem. Criar o plano e nunca oferecer. Oferecer com culpa. Desistir no primeiro não. Neste episódio, Dr. Lorenzo Tomé mostra por que esses três comportamentos são sintomas, e não causa. O médico tenta resolver comprando mais ferramenta, mais técnica de venda, mais estudo. E o negócio segue parado, porque script resolve o que falar, mas não resolve o que o médico sente quando fala. A tese central é direta: antes da estrutura, vem a identidade. Anos operando como peça de uma engrenagem podem ter sufocado a memória do porquê aquela pessoa escolheu a medicina. A competência segue intacta. O que arrefeceu foi o propósito. E não há técnica de marketing ou de vendas que resolva isso no lugar do médico. O episódio também trata da diferença estrutural entre os dois modelos. A consulta avulsa resolve e acaba. O plano de acompanhamento pede afirmação de valor semana a semana, expõe a autoimagem e alimenta o medo de virar vendedor. Só que é exatamente essa entrega contínua que diferencia, justifica o preço e afasta o médico da condição de commodity. A frase que resume o episódio: não é o paciente que resiste ao plano de acompanhamento. Na esmagadora maioria das vezes, é o médico. Hoje a excelência técnica coloca o médico no jogo, mas não faz ele vencer o jogo.
