Fez esta semana um ano que Odair Moniz, cidadão luso cabo-verdiano de 43 anos foi morto a tiro por um agente da Polícia de Segurança Pública na noite de 21 de Outubro de 2024 na Cova da Moura, na Amadora, nas imediações da capital portuguesa. Este acontecimento provocou na altura, vários dias de incidentes na zona de Lisboa, com os habitantes dos subúrbios a expressarem o seu descontentamento com o tratamento que lhes era reservado pelas autoridades. Um ano depois, são várias as organizações da sociedade civil que acusam o governo de nada ter feito para restabelecer a confiança entre os habitantes das periferias e as forças da ordem. A crispação é tanto mais palpável que o país tem estado a debater nestes últimos meses uma série de restrições a serem introduzidas tanto na lei de imigração como na lei de nacionalidade. É neste contexto particular que começou na quarta-feira o julgamento dos agentes policiais envolvidos na morte de Odair Moniz, um processo que cristaliza expectativas mas também questionamentos, com o réu principal a invocar que a vitima tinha na sua posse uma lâmina e que ele se sentiu ameaçado. Um dado que até agora não tinha vindo ao de cima e que na óptica de Rui Pena Pires, investigador ligado ao Observatório da Imigração em Portugal, é o prenúncio de que nunca se saberá ao certo o que aconteceu. RFI: O que se pode esperar do julgamento do caso Odair Moniz? Rui Pena Pires: Eu espero que o julgamento esclareça o que se passou. Prefiro sempre pronunciar-me sobre os resultados do julgamento e não a priori, e não fazer um incidente de suspeição antes do julgamento começar. Espero que esclareça bem o que se passou e que explique porque é que foi necessário recorrer a uma arma de fogo para resolver um problema que aparentemente não exigia nenhuma intervenção desse tipo. O Estado, nas sociedades democráticas, é a única entidade que tem poder de vida ou de morte, mas tem que usar com muita, muita parcimónia. Quando algum agente está envolvido na morte de alguém, essa morte tem que ser muito, muito bem explicada. Nós somos um país em que todas as polícias andam armadas com armas de fogo. Nem em todo o lado é assim. E essa é mais uma razão para que se exijam responsabilidades pelo uso das armas que são usadas no exercício das funções policiais. RFI: Durante o primeiro dia de julgamento, surgiu um dado novo: um dos réus afirmou que Odair Moniz tinha consigo uma lâmina e que ele considerou que ele representava uma ameaça à segurança dos agentes presentes. Rui Pena Pires: As versões que têm vindo a público sobre o que aconteceu têm mudado muito. E isso, por si só, não é uma boa notícia. Significa que nunca saberemos bem qual é o valor dessas declarações. Mas para isso existe o julgamento. Agora, há várias coisas que o julgamento não poderá fazer. Não faz parte do âmbito do julgamento. Não será no julgamento que se irá avaliar o treino e a formação que são dados aos agentes policiais para saberem reagir em situações em que haja alguma tensão, mesmo que resulte mais de percepções do que de perigos reais. Como sabemos, não será no julgamento que será discutido o uso sistemático de armas de fogo em todos os contextos, pelas forças de segurança e por aí adiante. E esses assuntos mereciam uma discussão, para além de se saber o que é que aconteceu naquele caso. Importava evitar que aqueles casos se repetissem. E para isso, se envolve outro tipo de discussões sobre o modelo de policiamento, sobre a formação dos agentes policiais, etc. etc. RFI: Na altura deste acontecimento houve uma série de manifestações e movimentos, inclusivamente, de revolta, nas imediações de Lisboa. Perante esta situação, o Governo prometeu ter mais atenção à situação dos habitantes dos subúrbios das grandes cidades, nomeadamente de Lisboa. Um ano depois, qual é o balanço que se pode fazer? Rui Pena Pires: Infelizmente, um ano depois, continuamos na mesma. Ou seja, houve um conjunto de revoltas que evidenciaram uma coisa, evidenciaram que as populações não têm confiança na actuação das forças policiais. E para ganhar essa confiança, eu não vi nenhuma iniciativa. Pelo contrário, o que se viram foram muitas vezes intervenções com transmissão em directo para as televisões e acções muito musculadas das forças policiais em contextos que não o justificavam e que estão a criar uma percepção de insegurança não só sobre a vida na cidade, mas sobretudo sobre a vida nos subúrbios, que não corresponde à realidade e que, no contexto de um aumento do discurso de ódio que caracteriza a ascensão da extrema-direita em Portugal, como noutros países da Europa, só irá agravar o mal-estar que existe na relação com a polícia. RFI: Um ano depois, Portugal está em pleno debate sobre a Lei de Imigração, a Lei de nacionalidade e há poucos dias ainda, foi adoptada na generalidade uma lei proibindo o uso da burca em locais públicos. O que é que se pode dizer sobre esta crescente crispação a nível político? Rui Pena Pires: Esta foi uma crispação que foi introduzida pelo crescimento da extrema-direita em Portugal. A extrema-direita em Portugal, como noutros sítios da Europa, encontrou na emigração bodes expiatórios para os problemas de mal-estar social que existem em qualquer sociedade mais ou menos desenvolvida. É um pouco irrelevante e tem vindo a produzir sobre a emigração um discurso de responsabilização dos emigrantes por tudo o que de mal acontece na sociedade portuguesa. As revisões das leis a que estamos a assistir são sobretudo o reflexo da adesão que este discurso de extrema-direita tem conseguido suscitar em importantes sectores do eleitorado. Primeiro, uma pequena minoria do eleitorado, mas hoje já numa fatia bastante maior do eleitorado nacional. Infelizmente, o centro-direita tem vindo a adoptar parcialmente como suas estas formas de actuação da extrema-direita. Um bom exemplo é o que aconteceu com a Lei da burca, aprovada na generalidade. O problema da burca não tem em Portugal qualquer dimensão social que justifique sequer que seja tratado. Já nem estou a falar sobre a forma como foi tratado. Não justifica pura e simplesmente ser tratado. Se o Estado intervém e produz leis, quando há, sobretudo todo e qualquer tipo de processo social microscópico, como é o caso burca em Portugal, rapidamente teríamos um Estado completamente totalitário no país. Portanto, esta utilização do discurso sobre a imigração para criar bodes expiatórios, para criar distracções, nós não estamos a discutir problemas complicados que existem em Portugal, como por exemplo, o problema do alojamento, que é um dos problemas mais importantes. Andamos entretidos com a agenda da extrema-direita que tem marcado a agenda política. Não havia nada que justificasse a alteração da lei da nacionalidade. A lei da nacionalidade pode ser mais perfeita, menos perfeita. Mas não há nada que vá melhorar com as mudanças que se estão a fazer ou discutir sobre a lei da Nacionalidade. Não é por as pessoas terem nacionalidade mais um ano depois ou um ano antes, que vai mudar qualquer coisa na integração dos imigrantes. Quer dizer, quando muito, aquelas mudanças que estão a fazer à lei da nacionalidade, o que evidencia é uma má vontade do Estado em relação à imigração e aos imigrantes, que terá consequências nos processos de integração dos imigrantes, que se sentirão mais afectados em relação à coesão nacional quando enfrentam este tipo de discurso negativo sobre si próprios. A lei da imigração precisaria de pequenos ajustes cirúrgicos, mas não de grandes alterações. E as alterações estão a ser feitas todas num clima emocional crispado, que era completamente desnecessário para resolver os problemas que existem na imigração, porque no caso, a imigração, a maior parte dos problemas têm pouco a ver até com a lei. Têm muito mais a ver com as políticas públicas de imigração. Há uma grande imigração irregular em Portugal. Porquê? Basicamente porque o sistema de vistos em Portugal nunca funcionou. Porque a regulação do mercado de trabalho em Portugal é fraca. E nenhum desses problemas encontra resposta nas alterações feitas à lei da nacionalidade. Aliás, não se resolve através da lei. Resolve-se através dos modos de funcionamento da administração pública. São leis que entraram no debate por esta capacidade que extrema-direita tem demonstrado em Portugal, infelizmente, de comandar a construção de uma agenda política. RFI: E lá está, o facto de a direita conservadora ter vindo a colar-se cada vez mais à agenda da extrema-direita é uma questão de convicção ou é um cálculo político? Rui Pena Pires: Às vezes não sei. Eu penso que, nalguns casos, nalguns agentes da direita conservadora, é uma questão de cálculo. Mas às vezes, não sei se noutros casos, para alguns outros dirigentes da direita clássica, não é mesmo uma mudança de convicções. E isso é algo que, apesar de tudo, me assusta mais do que a primeira alternativa. Acho que a primeira alternativa é um erro de cálculo. Acho que a segunda é mais grave, porque significa que começam a ser mais generalizadas as ideias que ainda há pouco tempo eram de uma minoria, mesmo muito pequena, dos actores políticos. RFI: Qual é o papel que têm desempenhado os contrapoderes, nomeadamente não só as associações, como também, e sobretudo, os órgãos de comunicação social em Portugal? Rui Pena Pires: O movimento associativo em Portugal é fraco e, portanto, tem procurado responder, mas não tem tido grande poder para construir uma resposta mais robusta. O papel dos órgãos de comunicação social é muito variado. Agora, aquilo que são alguns dos órgãos de comunicação social com maiores audiências, quer ao nível de imprensa, quer ao nível televisivo, para falar apenas dos media tradicionais, tem facilitado o desenvolvimento da extrema-direita e a extrema-direita procura sempre criar situações de grande tensão emocional que dão um bom espectáculo e muitos órgãos de comunicação social têm andado atrás desse espectáculo. E isso de uma forma completamente desequilibrada. Há uma jornalista no Público que faz o levantamento de vários modos de operação de outros jornais e de outros órgãos de comunicação social e que está farta de chamar a atenção para o peso completamente desproporcionado, por exemplo, que tem a exposição mediática do André Ventura, líder do Chega, quando comparada com a intervenção dos outros líderes partidários, mesmo quando esses líderes partidários lideram movimentos mais fortes que aqueles que são liderados pelo André Ventura. E, portanto, eu espero que os media no futuro não sejam apontados ou pelo menos uma parte dos média, para ser rigoroso, não venha a ser apontada como tendo contribuído para a erosão da democracia que é provocada por este crescimento da extrema-direita.

Waar hij nog een zware schuiver had in de vierde etappe, kwam hij er zonder al teveel kleerscheuren vanaf en reed hij uiteindelijk naar een 74ste plaats in het eindklassement. These women did not view the legal system as an enemy, but as an instrument for challenging misdeeds and addressing community needs. Dr. Admiral draws attention to the historical practice and implementation of the Maliki school of Islamic law in an area that remained outside of Ottoman control. She highlights women's engagement with Islamic law as deeply embedded in support systems encompassing families, communities, and legal structures, and makes visible women's agency and power. Tassos Lycurgo é Professor Titular do Departamento de Artes da Universidade Federal do Rio Grande do Norte (UFRN), no Brasil, e Pesquisador Visitante do Reasons to Believe, na Califórnia, Estados Unidos. Ele também atuou nas faculdades de várias universidades, incluindo a Oral Roberts University (ORU), em Tulsa, Oklahoma, como professor visitante. Além de suas atividades acadêmicas, o Dr. Lycurgo é advogado (OAB/RN) e fundador e presidente do Ministério Defesa da Fé, onde atua como pastor.Lycurgo ocupou vários cargos ao longo de sua carreira, incluindo diretor nacional do Departamento de Patrimônio Imaterial e diretor nacional do Departamento de Cooperação e Fomento no Instituto do Patrimônio Histórico e Artístico Nacional (Iphan), no Brasil.
