In der aktuellen Episode steht der European Health Data Space (EHDS) im Fokus. Die EU-Verordnung zum einem gemeinsamen Gesundheitsdatenraum ist am 26. März in Kraft getreten und wird ab März 2027 schrittweise wirksam. Ziel des ambitionierten Projekts ist es, elektronische Gesundheitsdaten in ganz Europa einfacher zugänglich zu machen – sowohl für Patienten als auch für Ärzte, Forschung und Wirtschaft. Doch was bedeutet das konkret für den Schutz von sensiblen Patientendaten? Holger und Joerg haben dazu Rechtsanwältin Dr. Christina Schreiber eingeladen. Sie ist Spezialistin im Datenschutzrecht mit Schwerpunkt im Gesundheitswesen und erläutert die Hintergründe und Auswirkungen des EHDS. Laut Kristina bekommen Patienten künftig leichter Zugriff auf ihre medizinischen Daten und können diese digital auch für Ärzte im EU-Ausland zur Verfügung stellen. Einen zentralen Speicherort gibt es dabei nicht; die Daten bleiben dezentral in Arztpraxen und Kliniken gespeichert und werden nur bei Bedarf digital zusammengeführt. Ein wesentlicher Teil der Verordnung regelt die sogenannte Sekundärnutzung. So sollen Forscher, Behörden und auch Unternehmen Zugriff auf anonymisierte oder pseudonymisierte Gesundheitsdaten erhalten, um die medizinische Versorgung zu verbessern, neue Therapien zu entwickeln und Gesundheitssysteme effizienter zu gestalten. Eine unabhängige Behörde in jedem Mitgliedsstaat soll künftig prüfen, wer wann welche Daten zu welchen Zwecken verwenden darf – stets unter Berücksichtigung der DSGVO. Angesichts der ambitionierten Ziele sieht Kristina große Herausforderungen. Vor allem die technische Umsetzung sei komplex, und es brauche ausreichend Ressourcen, um die geplanten hohen Datenschutz- und Sicherheitsstandards in der Praxis zu erreichen. Hinzu kommen unterschiedliche nationale Regelungen: In Skandinavien etwa ist die Datenfreigabe für Gesundheitszwecke nahezu selbstverständlich, während Deutschland stärker auf individuelle Zustimmung setzt. Die Diskutanten sind sich einig: Die Idee hinter dem EHDS ist gut und wichtig, aber die Umsetzung bleibt eine Mammutaufgabe. Deutschland hinke bei der Digitalisierung im Gesundheitswesen ohnehin bereits weit hinterher. Die Hoffnung ist, dass der Druck aus Brüssel nun auch hierzulande endlich Bewegung in die Sache bringt.

Joerg und Patrick diskutieren das Spannungsfeld zwischen Vertriebsversprechen und deren Umsetzung. Sie erörtern, wie Unternehmen oft übertreiben, um Kunden zu gewinnen, und welche Auswirkungen dies auf Kundenzufriedenheit und Vertrauen hat. Sie thematisieren den Einfluss starker Marken auf Kaufentscheidungen und die Herausforderungen kleinerer Unternehmen im Wettbewerb. Abschliessend reflektieren sie über moralische Dilemmata im Vertrieb sowie die Bedeutung der Nutzerfreundlichkeit von Technologien im Bauwesen und den Einfluss von Zufriedenheit in der Bildung auf den beruflichen Erfolg.

Diesmal werfen Holger und Joerg gemeinsam mit c't-Redakteur Sylvester Tremmel einen kritischen Blick auf ein umstrittenes Urteil des Oberlandesgerichts (OLG) Schleswig. Dieses Urteil verunsichert derzeit Unternehmen, die Rechnungen per E-Mail versenden. Konkret ging es um eine Rechnung über knapp 15.000 Euro, die ein Handwerker an seinen Kunden per unverschlüsselter E-Mail geschickt hatte. Angeblich unbemerkt wurde diese Rechnung manipuliert, sodass eine falsche Kontonummer zu sehen war. Der Kunde überwies deshalb die Rechnungssumme an Betrüger, und das Geld war weg. Das Gericht gab überraschend dem Kunden recht und entschied, dass der Handwerker die Rechnung hätte Ende-zu-Ende verschlüsseln müssen. So aber hafte er gemäß Art. 82 DSGVO für den entstandenen Schaden und habe keinen Anspruch Zahlung der Rechnung. Im Podcast zeigen sich die Experten fassungslos und üben deutliche Kritik am Urteil. Sylvester ist sich sicher, dass das Gericht technische Details offenbar nicht richtig verstanden hat: Es verwechsle Verschlüsselung mit Signatur. Während eine Ende-zu-Ende-Verschlüsselung den Inhalt einer E-Mail vor fremdem Zugriff schützt, stellt eine digitale Signatur sicher, dass die Nachricht unterwegs nicht verändert wird. Sylvester stellt klar: Verschlüsselung allein hätte den Betrug nicht zwingend verhindert, eine Signatur dagegen eher. Zudem funktioniert Ende-zu-Ende-Verschlüsselung nur, wenn beide Seiten – Sender und Empfänger – kooperieren und entsprechende Schlüssel austauschen. Auch Joerg hält das Urteil für problematisch. Das Gericht habe die DSGVO falsch angewendet, indem es den wirtschaftlichen Schaden mit der datenschutzrechtlichen Schutzbedürftigkeit personenbezogener Daten vermischte. Die Höhe einer Rechnung könne nicht automatisch bedeuten, dass personenbezogene Daten besonders schützenswert seien und deshalb zwingend Ende-zu-Ende verschlüsselt werden müssten. Im Podcast weisen die Experten darauf hin, dass andere Gerichte in vergleichbaren Fällen zu gegenteiligen Ergebnissen kommen. So entschied etwa das Landgericht Rostock, dass Unternehmen nicht automatisch für Manipulationen haften, wenn beide Seiten sich auf E-Mail als Kommunikationsweg geeinigt haben. Auch das Oberverwaltungsgericht Münster betonte kürzlich, dass eine einfache Transportverschlüsselung im Normalfall ausreichend sei. Am Ende gibt Sylvester praktische Empfehlungen: Unternehmen sollten zumindest Transportverschlüsselung nutzen und idealerweise digitale Signaturen einsetzen, um Manipulationen von E-Mails zu verhindern. Komplette Ende-zu-Ende-Verschlüsselung sei wünschenswert, aber in der Praxis oft schwierig umzusetzen. Vor allem aber solle man stets aufmerksam bleiben und bei überraschend geänderten Kontodaten lieber einmal zu viel als zu wenig nachfragen.

Spend any time in the southern Appalachian Mountains and you are bound to cross paths with Galax urceolata. This wonderful little evergreen herb seems to be at home in a variety of habitats from forest streams to granite outcrops and everywhere in between. Managing invasive species can be very challenging, but that doesn't intimidate people like Dr. Mike Schuster. What is a species? On the surface, this seems like an easy question to answer. Get a bunch of biologists in the room together and you will quickly see it can be a bit of a loaded question. Bees run the gamut from generalists to specialists. Whereas the generalists visit a variety of plants for the resources they need, many specialists exist on a single species. Such is the case for at least 20 different bees living in Southwestern North America who specialize on the pollen of the creosote bush (Larrea tridentata). In geologic terms, creosote is a relative newcomer to the Southwest and trying to understand how so many bee species have come to specialize on its pollen and how differences in flowering phenology across its range affect their lifecycle has been a mainstay of Dr. Bob Minckley's career. So many of us have been challenged and shaped by the witness and work of Gustavo Gutiérrez, the Father of Liberation Theology. Few theologians have shaped theology in the 20th century and beyond as much as Gutiérrez, so I asked my friend Dr. Joerg Rieger to join me in reflecting on his life. Joerg is not just a fellow scholar of liberation but was blessed to work and interact with Gustavo personally. His work addresses the relation of theology and public life, reflecting on the misuse of power in religion, politics, and economics. His main interest is in developments and movements that bring about change and in the positive contributions of religion and theology. His constructive work in theology draws on a wide range of historical and contemporary traditions, with a concern for manifestations of the divine in the pressures of everyday life. Counting the rings of a tree can be so much fun. In the temperate zone, each ring marks a year in that tree's life. However, if you know what to look for, tree rings can tell you so much more. Dr. Valerie Trouet has made a career out of counting and measuring tree rings. Tree rings offer a surprisingly detailed window back in time and allows scientists like Dr. Trouet to understand everything from fire regimes to climate conditions. Even beyond that, tree rings can provide valuable insights into human history. Pinesap (Monotropa hypopitys) produces no leaves nor any chlorophyl. It “eats” fungi and can be found growing in many areas around the globe. It flowers in spring, fall, and summer and noby really knows if it is a single species or many. The Adirondack Mountains are home to a remarkable diversity of plant species. Situated in northern New York, these mountains are harsh enough that they foster a thriving alpine community. Despite their ability to handle some of the worst weather conditions, alpine plants can be quite sensitive to human traffic. With more and more people flocking to these mountains every year, concern was growing that the alpine ecosystem was going to be trampled right off the mountain tops. Luckily the Summit Steward Program was put into place to protect and hopefully restore some of what has been lost. Variegation among leaves is a fascinating phenomenon. Though plant breeders have accentuated this trait in a variety of cultivated plants, variegation does occur naturally as well.
