Today, 38 states have some variation of a Stand Your Ground law, which typically permits an individual to protect themselves with reasonable force — including deadly force — to prevent death or great bodily harm. Increasingly, however, many states' Stand Your Ground laws allow an individual to use deadly force without a duty to retreat.While proponents of these policies claim they're vital to the public's protection, states lacking a duty to retreat have seen a rise in homicides of 10% or more — leading critics to claim that unfettered Stand Your Ground laws should really be called "shoot first" laws. To discuss how these laws developed, how they have been used to embolden individuals to use unnecessary and disproportionate force (especially against marginalized communities), and the many impacts of an over-armed society, hosts Kelly and JJ are joined by Kami N. Stand your ground laws provide for a defense in criminal cases where people have legal allowances to use force, including deadly actions, as a way to defend one's safety. This defense is possible when people encounter an immediate threat against their life. Some laws allow for this interaction to legally occur when there are perceived threats present as well. The grandson of Andrew Lester, the man who shot 16-year-old Ralph Yarl appeared on CNN Thursday morning. He described his grandfather as a conspiracy theory-believing, avid consumer of right-wing media who was acting upon racism. Mary Clayton, 81, was married to Andrew Lester, 84, for 14 years and the pair had three children together. Clayton said that, during their marriage, he would frequently become violently angry. He would fly into a rage, and smash objects in their house. The father of Kaylin Gillis, a young Upstate New York woman allegedly shot to death after turning into the wrong driveway on Saturday, said he hopes the suspect "dies in jail." 38 states in the US now have "Stand Your Ground Laws," statutes that allow anyone who believes their life to be in danger to use lethal force in an act of self-defense, removing the duty to retreat in a public space. For example, since 2005, in 57% of Florida Stand Your Ground cases there was “clear evidence that the person who claimed that Stand-Your Ground could have safely retreated to avoid the confrontation," but didn't.Yet those who get to use that Stand Your Ground defense in the US judicial system is very different from who the law is used against, a lethal disparity that is built on our nation's history of racism, the country's weak gun laws, and the rhetoric of gun lobby groups. Caroline Light is a Senior Lecturer and the Director of Undergraduate Studies in WGS. Her research explores histories of citizenship and belonging, and the ways in which white supremacy, (hetero)sexism, and classism shape collective (mis)memory and archival silence. Light's first book, That Pride of Race and Character: the Roots of Jewish Benevolence in the Jim Crow South (NYU Press, 2014) illuminates the experience of southern Jewish assimilation through the lens of benevolent uplift. She illuminates the gendered and racialized performances of elite, white cultural capital as a critical mode of survival for a racially liminal community of southerners. Stand Your Ground: A History of America's Love Affair with Lethal Self-Defense (Beacon Press, 2017) provides a critical genealogy of our nation's ideals of armed citizenship. Beginning with the centuries-old adage “a man's home is his castle,” she tracks the history of our nation's relationship to lethal self-defense, from the duty to retreat to the “shoot first, ask questions later” ethos that prevails in many jurisdictions today. An update on Florida's Stand Your Ground law as the trial of Curtis Reeves starts on February 7. Reeves attempted to use the law as a defense after a 2014 shooting in a Pasco County movie theater left a man dead. But a judge ruled against his request for immunity.
