As attorney general, he rose to national fame through his fight against the unconstitutionality of the Healthcare Reform's individual mandate, and was called “ObamaCare's most formidable foe” at the time. But will it fall apart due to an unforeseen procedural snag? We’ll see! Meanwhile, a whistleblower alleges that a top Trump administration official entered into a sketchy, secret agreement with Immigration and Customs Enforcement’s union leaders that could cripple Biden’s attempts to change Trump’s barbaric immigration policies. THESE ARE THE STORIES YOU NEED TO KNOW: Yesterday, we talked about the big worry of the next few weeks: that Democrats would capitulate to the Republican minority and weaken their own stimulus bill. Well, today we’ve got good news and bad news. The good news is the Democrats don’t appear to be doing that. On Monday evening, Nancy Pelosi and Chuck Schumer introduced a budget bill that included a $1.9 trillion stimulus package, indicating that they appear to want to use a process known as “reconciliation” to get an aid package through without Republican support. This is good, and represents the best shot we’ve got right now of getting an even halfway decent stimulus bill out to the American people quickly. But here’s the bad news. NBC news reports that the reconciliation process could have an unintended side-effect: automatically triggering a cut to medicare. The how and why of this is also a massive own-goal. The cuts would be triggered by the PAYGO act of 2010, which Democrats introduced and pushed for. PAYGO, in short, means that any time you pass a bill raising the national debt, you have to automatically cut federal funds elsewhere -- so bye bye to Medicare, farm subsidies, that sort of thing. The kicker is that avoiding the automatic cuts requires 60 votes in the Senate, which basically puts the Democrats right where they started. And the other fear, of course, is that Biden will still succumb to his Republican-loving side. The Republicans who we mentioned yesterday met with Biden today to plead for a smaller bill, and said the discussion was excellent, according to the New York Times. But the official word from the Biden administration is still that they plan to push the $1.9 trillion bill, so we just have to keep hoping they stick to their guns. REPORT: Trump Using ICE to Sabotage Biden The Trump administration is done, but we’re only now discovering the amount of damage they did on the way out. BuzzFeed News reported on a government whistleblower who alleges that former DHS second-in-command Ken Cuccinelli signed a set of agreements with the union that represents ICE. These guys endorsed Trump in 2016, so don’t be fooled into thinking they’re a nonpartisan force. The Government Accountability Office is representing the whistleblower, and said in a letter: “The agreements grant [the union] extraordinary power and benefits — far more than what DHS agreed upon with its other employee unions which did not endorse President Trump. The agreements confer on the union the ability to indefinitely delay changes to immigration enforcement policies and practices as well.” What this means in practice is that ICE’s union, which is apparently still loyal to Trump, can stonewall the Biden administration’s attempts to roll back the former president’s barbaric policies against immigrants, and stop him from enacting things like a deportation moratorium. According to the GAO, the whistleblower, “possesses information concerning significant acts of misconduct committed” by Cuccinelli. Cuccinelli denies abusing his power, of course -- we’d expect no less from a former Trump stooge. Cuomo's Public Health Execs Keep Quitting There’s a lot to say about New York Governor Andrew Cuomo’s handling of the pandemic, which hit his state harder than most others. Cuomo has racked up accolades and book deals for his appearance of leadership during the crisis, but continued reporting suggests that he may have done more harm than good. According to the New York Times, nine of Cuomo’s top public health officials have resigned during the pandemic, citing Cuomo’s unrestrained war with his own scientific experts. Look at what they’ve had to deal with: Cuomo has micro-managed and over-controlled nearly every step of the process. Take the vaccine rollout for instance: The Times reports that Cuomo threw out his own Department of Health’s carefully constructed plan that worked with local health authorities in favor of one that relied far more on big hospitals. New York’s rollout has, of course, been a huge mess, and officials said that Cuomo often changes health policy abruptly at his emmy-winning press conferences, without asking or notifying them first. And Cuomo’s not even hiding the fact that he thinks he knows better than every doctor in the State. At a news conference last Friday, he said, “When I say ‘experts’ in air quotes, it sounds like I’m saying I don’t really trust the experts. Because I don’t. Because I don’t.” AND NOW FOR SOME QUICKER QUICKIES: In a livestream about the Capitol attacks, Rep. Alexandria Ocasio Cortez revealed that she was a survivor of sexual assault. She compared the GOP’s relentless insistence that she just get over the attempted insurrection during which her life was threatened to the similar language that abusers often use toward their victims. The leadership of Myanmar was deposed by a military coup on Monday, as the country’s armed forces detained its elected president Aung San Suu Kyi and set up blockades throughout the nation’s capitol city. The New York Daily News reports that the warden at NYC’s Rikers Island jail who presided over a dramatic drop in assaults, fights, and officer use of force incidents has been removed from his post after clashing with a powerful cop union over a mentorship program he set up for young inmates. One step forward, two steps back, always. And finally, the Biden Administration plans to quickly release $1.3 billion in federal funding meant for Hurricane Maria relief to Puerto Rico, and remove restrictions on another $4.9 billion. Monday brought disappointing news for Harvard University sophomore Noah Furlonge-Walker. Due to the coronavirus, all of the university's undergraduate classes will be held online this fall, and fewer than half of students will be allowed on campus. The same day, US Immigration and Customs Enforcement announced that international students like Furlonge-Walker would be stripped of their student visas if their coursework is entirely online. Under the new rules, international students must leave the country — or would not be allowed in — if they cannot take classes in person. “I was pretty upset about it because it couldn't have come at a worse time,” said Furlonge-Walker, who returned to his home country, Trinidad and Tobago, after Harvard closed its campus in response to the pandemic in March. “It was a lot of news to take in on one day, and it just felt like the US was making it particularly hard on international students.”ICE's announcement left many international students wondering whether they would be able to complete their degrees or return to their lives in the US. It also left universities scrambling to rethink some of the pandemic contingency plans they've made for fall — and to find ways to keep their students in the country. Some experts say it's the Trump administration's way of forcing universities to reopen before it's safe to do so.Universities and advocates for international students were quick to slam the new rules. Harvard, along with the Massachusetts Institute of Technology, sued the federal government Wednesday, saying the guidelines “threw all of higher education into chaos.” The suit seeks to temporarily block the government from enforcing the policy, saying it was not implemented properly. Dozens of universities signed on to an amicus brief in support of the Harvard and MIT. And many released statements saying they are studying the guidelines and looking for ways to support international students. California also filed a similar lawsuit Thursday.ICE's guidance “imposes a blunt, one-size-fits-all approach to a complex problem.”Lawrence S. Most of them are on F-1 student visas. The federal government provided special exemptions that allowed them to study remotely during the coronavirus outbreak in March. Usually, those on student visas may attend a maximum of one class online; the rest must be in person.Related: Visa restrictions on Chinese students will disadvantage US, says Queens College presidentBut the pandemic is far from over in the US, and many universities have opted to continue offering remote instruction in the upcoming school year. According to the Chronicle for Higher Education, which is tracking more than 1,000 universities around the country, 9% will have remote instruction and 24% will implement a hybrid model, which offers a mix of in-person and online classes. Under ICE's guidelines, students will be allowed to take more than one class online if they're enrolled in colleges and universities offering hybrid classes. But students and their universities have to go through a certification process. In an interview with CNN, Ken Cuccinelli, acting deputy secretary of the Department of Homeland Security, said the guidelines give more flexibility for international students because typically their visas only permit them to take one class online. “If a university … don't reopen this semester, there isn't a reason for a person holding a student visa to be in the country.”Ken Cuccinelli, acting deputy secretary, Department of Homeland Security“If a university … don't reopen this semester, there isn't a reason for a person holding a student visa to be in the country,” Cuccinelli said. “They should go home, and then they can return when the school opens.”Rachel Banks, senior director for public policy and legislative strategy with NAFSA: Association of International Educators, called ICE's new rules “frustrating and disappointing.” “[International students] have to make a decision — if they're here they have to leave and take courses from abroad, or they need to transfer to another US institution that is offering in-person and hybrid classes,” she said. Banks said these options are not practical. She cited one survey from the Institute of International Education that found the majority of international students remained in the US after the coronavirus pandemic hit — as many as 92% remained at more than 400 institutions that responded to the survey. Those students may have also signed leases and made arrangements to stay close to their campuses for the upcoming academic year. And transferring universities is not an easy feat with schools planning to restart classes as soon as next month. Related: Coronavirus closures leave international students in limboEven if students decide to take the remote classes in their home countries, there are issues around timing and the need for proper technology, said Katsuo Nishikawa Chávez, director of International Engagement at Trinity University, a small private college in San Antonio, Texas, where 10% of the student population is international. For example, students in Asia would be taking classes in the middle of the night. Students might not have proper internet connection or face censorship issues in their home countries.“It's impractical — so, that student might quit and go study in Australia,” Chávez said.For universities, it makes the already intricate calculations of what to do in the fall even more difficult. “It's a very complex calculus at this stage,” Banks said. “It is so late in the process, many schools are making the decision whether to be in-person, hybrid, based on the current situation for the virus and what is most safe for students and faculty members ... That's what needs to drive these decisions.”Related: These DACA recipients hit a ceiling in the US. So they left.Even institutions that offer hybrid classes could shut down again depending on fluctuating circumstances around COVID-19. The ICE guidelines state that students would have to leave even if they started the year with in-person instruction, but later have to switch to online instruction. “Imagine a second wave hits, students would have to go home,” Chávez said. “And now, all of a sudden, in the most dangerous time to travel, we're packing up thousands of people into airplanes and sending them abroad. It's irresponsible.”Furlonge-Walker is not sure if his own visa will be valid if he remains at home for the whole academic year, though some immigration experts believe that international student status can be maintained while taking remote classes abroad. At this point, Furlonge-Walker says, there are still a lot of unknowns for the coming school year. Aaron Reichlin-Melnick, policy counsel with the American Immigration Council, said ICE'S new policy is in line with the Trump administration's broader effort to curb immigration overall during the pandemic. “We're the only country in the world to ban immigrants, supposedly for economic competition reasons as a result of the coronavirus.”Aaron Reichlin-Melnick, policy counsel, American Immigration Council“We're the only country in the world to ban immigrants, supposedly for economic competition reasons as a result of the coronavirus,” he said. But creating more hurdles for international students is counterproductive to the goal of restarting the economy, according to Banks.“International students are innovators and entrepreneurs," she said. "We wouldn't have Silicon Valley if we didn't have international students.”Universities announced that they will continue to study the guidelines and will provide support to international students. The University of Arizona said in a statement that it's trying to find ways to ensure international students can have "quality in-person educational experience" in the fall. At Northwestern University, which planned to offer a mix of in-person and online classes, adminsitrators said they will help make sure international students can remain eligbile to study on campus according to the new guidelines.

Symone Sanders is getting ready for a fundraiser. In front of her bathroom mirror, she draws a bold, black line across her eyelid. Her nails are studded with rhinestones, courtesy of press-on nails she picked up from a drugstore across the street from her Washington D.C. apartment. “I’m finishing my fundraiser makeup, so we can chat while I do that,” Sanders tells me. Her phone slips off the bathroom counter several times, a hazard of near-constant video chatting during self-quarantine, but the 30-year-old doesn’t miss a beat. With the candid tenor of a best-friend catch-up, she tells me she sometimes starts off Vice President Joe Biden’s day with pop-culture headlines. “I’ll be like, ‘You want to know what the streets are saying?’” she says. “I try to find him something he’s not regularly hearing or seeing.” The Omaha, Nebraska, native currently serves as a senior adviser on Biden’s presidential campaign, following a 2016 role as Sen. Bernie Sanders’ press secretary, a job she started at age 25, just two years after graduating from Creighton University. Heading into the 2020 primaries, she was courted by Sens. Elizabeth Warren, Kirsten Gillibrand, Kamala Harris, and Cory Booker. Being an unapologetically young black woman pursuing a career in politics seems revolutionary for a country that’s been historically led by older white men. She wants to change that. Sanders documents her rise to influence in her new memoir, No, You Shut Up: Speaking Truth to Power and Reclaiming America (out May 19). It’s all about balance, she says over Zoom. “When I got to D.C., I was like, ‘I know I’m not supposed to be dressing like this,’” she says, gesturing to her colorful outfits and bedazzled nails. “But I’ve always been in environments where there aren’t lots of people like me doing the work I want to do. Nobody gave me pointers.” Her job focuses on crafting Biden’s campaign messaging and acting as his on-camera surrogate, among other things. “If you want the system to change, you need to be strategic,” she says. “You need to infiltrate the apparatus.” This is an idea the communications strategist returns to often. When I ask if running for office is part of her plan to change the system from within, she demurs: “Everybody thinks I’d make a good candidate, [but] I’m just the people that help get people elected.” Much like her book, our conversation is primarily limited to quotable soundbites. In both, she balances autobiographical storytelling with advice. (“Clear space for your goals,” she writes, and “know your own boundary lines.”) The juxtaposition gives a taste of how Sanders imagines her brand: a mashup of campaign formality and Instagram-era motivational prose. “I wanted to give people a little real talk,” she says when I ask about it. “If people get the audiobook, I change my voice when I’m reading the advice sections, like, ‘Come here, let me tell you.’” The title of Sanders’ memoir pulls from real-life experience. During a CNN interview in 2017, while working as a political commentator on the network, she got into a heated exchange with former Virginia Attorney General Ken Cuccinelli about President Donald Trump’s response to the violence at the white supremacist Unite the Right rally in Charlottesville, Virginia. “Can I finish, Symone? Will you just shut up for a minute and let me finish?” Cuccinelli snapped on live TV. “Pardon me, sir,” she responded. “You don’t get to tell me to ‘shut up’ on national television.” The conversation erupted, and anchor Chris Cuomo stepped in. Returning to a presidential campaign with a different, more centrist candidate — particularly one facing a sexual assault allegation — hasn’t happened without scrutiny. Biden’s platform shares none of the hallmarks of Bernie Sanders’, such as support for single-payer health care or canceling student debt. “I didn’t 110% agree with Bernie on every issue while I was working for him,” she writes in No, You Shut Up. “I don’t agree with Biden on every issue, in every instance. But I think in order to make change we have to make strategic decisions.” She started getting biting voicemails from critics about the switch, in addition to vitriolic emails. “I’m used to harassing emails. That doesn’t make it OK, but I’m used to it,” she says. “You have to give it a shrug and move on, but sometimes it affects me. I’m human.” At this time in a typical election cycle, Sanders would be on the road between campaign stops. Instead, Biden is holding “virtual events” from his basement in Wilmington, Delaware. His senior adviser, who would normally be by his side, lives more than 100 miles away. “Rallies show the best of America,” she says, of the in-person variety. “People stand in line for hours to get a glimpse of a person. That means [they] still have hope. And while there are true inequities in this country — I mean, a young black man was murdered jogging in his neighborhood; you shouldn’t have to go viral to underscore your humanity — being on the campaign trail gives me hope.” When our conversation moves to the allegation against Biden from his former Senate staffer Tara Reade, Sanders puts down her makeup brush and moves to the living room. “‘Believe women’ doesn't take a different definition because now the allegation is about my boss,” she says from her couch. “Truth and justice don’t have asterisks next to them. It's not easy for anyone to be accused of something, especially something they’ve said did not happen. But what’s most important is that in this [political] space, women have the ability to come forward. At the end of the day, what matters is the truth. And in the case with Vice President Biden, the truth is that it didn’t happen.” Later, I ask her about a line from her book that surprised me: “Change takes time, but change also can’t wait.” It reads like a convenient disclaimer, I tell her. She lets out a knowing chuckle, and harks back to the fight for civil rights, to Martin Luther King Jr., and then to her dad, whom she says fought against structural injustices. “My dad was 64 years old when he died unexpectedly,” she says. “He grew up in the segregated South. He knew what overt racism looked like. The fruits of his labor, the things he committed his life to, he never got to see,” she says of the chemist for the Army Corps of Engineers. “But his work made a difference.” Sanders thinks young people today are too impatient. She says our generation has been “tarnished” by a desire for instant gratification. When Sanders writes about “the apparatus” — which she does more than 70 times — she’s often referring to the people who have access to power rather than a broken system in itself. “We can’t simply critique the machine that makes the Democratic Party or the Republican Party run; we have to conceptualize ways to change it,” she writes. Does she have an agenda for once the apparatus has been democratized? Unfortunately, our Zoom time has run out. Her makeup is done. Sanders needs to put on a “real shirt” for the fundraiser, she says. She leaves me with a smile, and with a line that inevitably becomes the thesis of our call. “We want a microwave, we want everything right now,” she says of her peers. “I want real, lasting structural change. And structural change you cannot get in a microwave.”

Earlier this week, the Trump administration announced that it intended to deny green cards to aliens entering the United States if they make an attempt to obtain public assistance in the form of Medicaid, food stamps, and housing vouchers. The alleged chlorine attack took place weeks ago against a group allied with al-Qaeda. These accusations take place, however, just a few days after a report by Organization for the Prohibition of Chemical Weapons experts was leaked which casts doubt on the United States’ version of events with regards to a previous alleged chemical attack. The United States is preparing sanctions and criminal charges against Venezuelan officials whom they accuse of using food aid program to launder money for the Maduro government, as well as companies involved in supplying goods to the program. Millions of Venezuelan families rely on the program for food and other basic necessities because of hyperinflation caused in part by existing US sanctions on the country. Lucas Koerner, an activist and writer for VenezuelAnalysis.com, joins the show. The latest Brexit proposal from British Prime Minister Theresa May is causing major controversy and dissension within her own party. May’s final effort to pas a deal comes ahead of elections for the European Parliament, which begin tomorrow. The new hard-right Brexit Party will likely finish first, if the latest polls are correct, with 35 percent of the vote. It shows the Liberal Democrats in second place with 16 percent, followed by Labour at 15 percent, and the environmentalist Green Party at 10 percent. The ruling Conservative Party is projected to finish fifth, with only nine percent of the vote. And the anti-Brexit Change Party, made up of former Conservative and Labour parliamentarians, is polling only five percent. Brian and John speak with Steve Hedley, the senior assistant general secretary of the the UK’s Rail, Maritime, and Transport Workers Union.
