Daily Halacha Podcast - Daily Halacha By Rabbi Eli J. Mansour
The Gemara in Masechet Ta'anit (29b) states that if a Jew has a court case against a gentile, he should try to avoid scheduling the case for the month of Ab, which is a time when our nation's "Mazal" ("luck") is compromised. He should instead try to schedule the hearing for the joyous month of Adar, which is a time of good "Mazal" for the Jewish Nation. A number of commentators raised the question of how to reconcile this teaching with the rule famously established by the Gemara elsewhere, in Masechet Shabbat (156a), "En Mazal Le'Yisrael" – the Jewish Nation is not governed by the forces of "Mazal" that affect the rest of the world. If, indeed, three is no such thing as "Mazal" as far as Am Yisrael is concerned, then why are we told that we have good "Mazal" during Adar and poor "Mazal" during Ab? The Ritba (Rav Yom Tob of Seville, Spain, 1250-1330) answers that Adar and Ab are exceptions to the rule. Although the Jewish Nation is generally not subject to the forces of "Mazal," Hashem decreed that these influences indeed affect us during these two months. Alternatively, the Ritba suggests, the Jewish People are indeed not influenced at all by "Mazal" at any time, and the Gemara in Ta'anit borrows the term "Mazal" to refer to Hashem's governance of His nation during the months of Adar and Ab. During Adar, He deals with us more graciously and compassionately, whereas in Ab, He deals with us more strictly and exactingly, and this is the Gemara's intent when it speaks of the "Mazal" during these months. A different answer was offered in light of Tosafot's comments to the Gemara's teaching "En Mazal Le'Yisrael." Tosafot explain that indeed, we, like all people on earth, are subject to the powers of "Mazal," but we have the ability to negate these forces through the merits of our Misvot. Accordingly, the Gemara in Maseches Ta'anit might be understood to mean that we require additional merits to overcome the harsh "Mazal" of the month of Ab. We are never helplessly at the mercy of "Mazal," as we always have the ability to earn Hashem's favor through out merits irrespective of our "Mazal," but during the month of Ab this is somewhat more difficult. In conclusion, it is worth noting the Gemara's startling comment in Masechet Mo'ed Katan (28a) that a person's lifespan, his ability to beget children, and his livelihood depend not on his merits, but rather on "Mazal." This seems to explicitly contradict the aforementioned rule of "En Mazal Le'Yisrael." In truth, however, Rav Menahem Meiri (Provence, 1249-1315) comments that the Gemara's statement in Mo'ed Katan reflects a minority view among the Sages, and has been resoundingly rejected. Therefore, the Meiri writes, one should never cease praying for everything he needs and wants, because our merits and G-d's mercy can overcome any "Mazal." Hacham Ovadia Yosef noted that the Rambam similarly followed this view, firmly stating that we are not affected at all by the forces of astrology. This is the position taken by many other Rabbis, as well. Until when specifically should a person delay his court hearing? The Magen Abraham (Rav Abraham Gombiner, Poland, 1635-1682) writes (551:1) in the name of Rabbenu Yeruham (Provence, 1290-1350) that one should delay the hearing until the onset of the month of Elul. According to this view, the inauspicious quality of the month of Ab extends throughout the entire month. By contrast, Rav Levi Yitzhak of Berditchev (1740-1809), in his work Kedushat Levi (Parashat Va'et'hanan) writes that the Gemara refers only to the first half of the month. Starting from the 15 th of Ab – Tu B'Av, which is a festive day – the remainder of the month is not considered inauspicious. Accordingly, some have ruled that already from Tu B'Ab there is no concern going to court. An allusion to this concept is the configuration of the divine Name associated with this month. The Kabbalists teach that the four letters that comprise the Name of "Havaya" (spelled Yod, Heh, Vav and Heh) can be arranged in twelve different sequences, and each sequence is associated with a different month. The month of Tammuz is associated with the reverse spelling – Heh, Vav, Heh and Yod – and this month is thus a month of calamity. The month of Ab is associated with the spelling Heh, Vav, Yod and Heh – with the first two letters reversed, and the second two letters in proper sequence. This alludes to the fact that the first half of the month of Ab is one of misfortune and tragedy, but the second half – starting from Tu B'Ab – is joyous. Hacham Ovadia Yosef, in Hazon Ovadia (p. 166), follows a third view, based on a passage in the Zohar (Yitro, 78b) stating that Esav took control of the month of Tammuz and the first nine days of the month of Ab. According to the Zohar, it seems, it is only through Tisha B'Ab that one should avoid a court hearing against a gentile, but already from the 10 th of Ab there is no concern. This is, indeed, the view of the Ben Ish Hai (Rav Yosef Haim of Baghdad, 1833-1909), in Parashat Debarim, 1). Summary: The Gemara teaches that a person who has a court case against a gentile should try to avoid scheduling the hearing for the month of Ab, which is a time of bad "Mazal." The commentators clarified that this does not mean we are helplessly subject to the forces of astrology and the like. We are always able to earn G-d's favor and compassion through prayer and good deeds, but in the month of Ab He deals with us somewhat more harshly, making it more difficult to earn His kindness. Different views exist as to when specifically one should avoid going to court. Hacham Ovadia Yosef rules that the concern is only through Tisha B'Ab; starting already on the 10 th of the Ab, one may go to court without any worry.

After a quick review and some elaboration on Saadia Gaon, I shared my interpretation, which we examined through three sources: (1) Meiri's commentary on Mishlei 10:3, (2) the chapter of Moreh ha'Nevuchim that Rambam considered most important to pay attention to, and (3) the commentary of R' Sheishes ben Yitzchak Gerondi on our pasuk. As usual, we covered some fundamental methodological points along the way and (I hope) walked away with a few eminently practical ideas.-----מקורות:משלי טז:ארמב"ם - משנה תורה: ספר המדע, הלכות דעות ב:דמאירי - משלי י:גרמב"ם - מורה הנבוכים ב:מחר' ששת בן יצחק גרונדיאבות ב:ד-----With gratitude to Hashem, I'm pleased to announce that I am officially listed as a teacher on YUTorah!

The Gemara tells us, one of the areas we constantly need chizuk in is tefila . No matter how good a person's tefilot are, over time they tend to become more habitual and therefore could definitely use chizuk . The Meiri writes that a person should always feel confident in the power of a good tefila to break a decree and if someone is going through a tough time, or has a family member that is ill, he should go to a chacham and ask him for advice on how to have a good tefila . What is a good tefila ? Obviously one with emotion and tears and obviously one with kavana . But there is another very important factor that could make the tefila truly great. When Rachel Imenu saw that she was barren for many years, she told Yaakov to do something to ensure that she will have a child. The Ramban explains, Rachel was asking Yaakov to pray, thinking that the tefilot of a tzaddik like Yaakov would for sure be answered, especially if he puts all of his efforts into it. But Yaakov replied, there is no guarantee that his tefilot would ensure that she'll have a child. Then, says the Ramban, when the tzadeket Rachel saw that she couldn't even rely on the tefilot of Yaakov who was the Gadol HaDor , that's when she prayed with all of her heart and soul, realizing she had to go straight to Hashem because He was the only One who could help her. Then, וישמע אליה אלוקים – that is when Hashem answered her tefila and that is when she finally had a child. The best prayer is one in which the person realizes Who he is standing in front of and what His capabilities are. This is one of the reasons why we start the Amida with praise, so we realize who Hashem is, and only then do we make our requests. We all know that only Hashem could help us, but from time to time, we need to be reminded of it so that it is at the forefront of our minds. I read a story about a couple from Israel who did not have children for many years. They went to a lot of doctors and none were able to help. One day, the man was telling his friend he didn't know what else he could possibly do to be helped. His friend said to him, he heard there's a top doctor in America who has helped many couples with cases that seemed hopeless. People fly from all over the world to see him. He suggested trying to get an appointment with that doctor. They took his advice and traveled to America and consulted with that doctor, who raised his hands helplessly saying he didn't know what to do to help them. There was one more highly recommended doctor there, but his fees were exorbitant. The couple decided they had to try and they waited there for weeks to finally see him. That doctor analyzed their case for a very long time. He did his own testing and finally concluded by saying, "I don't see any problems at all with you. I can't explain why you are not having children, but I do see that you are religious Jews. Pray to your G-d. Only He could help you." When they heard those words from the top doctor in the field, they took on new meaning to them. From then on, they spent every tefila crying buckets of tears, understanding who they were actually talking to and, within a year, they were blessed with a baby boy. There is nothing that can take the place of a good tefila .

Have any questions, insights, or feedback? Send me a text!Length: 14 minutes 15 secondsSynopsis: Well, THIS episode took an unexpected turn! I intended to just review one point we covered yesterday and read ten words from the Meiri on how to "make" God have mercy on you, but that little addition turned into a whole episode which touched upon the fundamental mechanisms of how tefilah works. We'll return to the halacha in the Mishneh Torah tomorrow.-----מקורות:רמב"ם - משנה תורה: ספר אהבה, הלכות תפלה וברכת כהנים א:במאירי - אבות ב:יגfake Thoreau quotationרמב"ם - מורה הנבוכים א:נגרלב"ג - שמות לג:יט-----The first month of the newly relaunched Rambam Bekius Podcast has been sponsored anonymously. On the surface, this sounds paradoxical: How can a person desecrate Hashem's name if there is no one to witness them? After reviewing the halachos of chilul ha'shem, we delve into the nuanced approach developed by the Rambam and the Meiri. On the night of Rosh Hashanah, a person is supposed to come home from shul and sit at his table and begin the meal by eating certain foods as a good omen for the new year. It is important to follow this procedure and say the accompanying tefilot when eating each food, but it is even more important for a person to act and think the right way on this day. Even one thought of a person feeling that he wants to become better and improve in his observance of Torah and mitzvot is more powerful than all the foods and Yehi ratzons combined. The Meiri writes that one of the purposes of eating those foods and saying the Yehi ratzons is to arouse a person to want to become better. Every thought that we have on this holy day makes a very big impact on the entire upcoming year. A person should be filled with hope and emunah. A person should look at things from the right perspective. We should remove all worry and stress and focus on Hashem's rulership over the world and our lives individually. Every mitzvah we do on this day goes a long way. The Chochmat Shelomo writes in his derushim to parashat Ki Tavo that, on Rosh Hashanah, a person should be happy and say the words “Whatever Hashem does is good,” with real emunah. Those words have the power to change a harsh decree into revealed good. Everything we do on Rosh Hashanah has a major impact. A man sent the following question to Rav Yitzchak Zilberstein a few years back. He said that, for whatever reason, his wife is not happy with him and many times she does things just to get him upset. One of the things that she does is on Rosh Hashanah instead of serving him the head of a sheep, she serves him a tail. Normally, we are supposed to eat from the head as a sign that we should be at the head and not at the tail. He said that makes him so nervous because he doesn't want it to be a bad omen for him. The Rabbi told him, to be at the head means we want our true desire of doing good to lead us on the proper path, rather than getting pulled like a tail by our evil inclination. If a person is able to overcome his inclination of getting upset or yelling at his wife and rather accept what she does with love, he will not need any omens to have his good inclination lead him, because he is already practicing it. He will have already proven that he is a head and not a tail. And that is more powerful than any food or any sign. The main thing is that we shouldn't get upset or speak negatively to anybody. A person's attitude can change everything for the better. On one occasion on Rosh Hashanah, a young avrech came to the Slonimer Rebbe looking very scared. He cried to the Rebbe saying he couldn't afford to buy a head. He only had enough to buy a fish tail. Now he was worried that would be a negative omen for him for a bad year. The Rabbi told him, everything goes after a person's attitude and his tefilot . He told him to pick up the tail and say “This should be the tail-end of all of our troubles and suffering and, going forward, we should only have peace and tranquility.” Nothing should bother us on this great and awesome day. We should utilize every moment we can for Torah, for mitzvot and for ma'asim tovim . And we should be happy and calm, trusting in the great mercy of Hashem
