This recording from August 10, 2024. Signum University presents Thesis Theater with Robert Black on Saturday, August 10, 2024 at 4pm ET. This paper proposes to compare once again the heroes Beowulf and Böðvarr Bjarki, using linguistics and critiques of the heroes to build on the traditional approaches of comparison through folktale, etymological, and literary analysis to examine the degree to which Beowulf may be considered a hero or the praised object of censure. After summarizing their mode of Germanic Heroism and lightly comparing the heroes' stories and reviewing the current state of scholarship on the Bear's Son Tale as applied to these analogues and the role of the Dragon in Beowulf, attention is given to the use and significance of the term aglæca in Beowulf, including its application to the eponymous hero. Further consideration is given to Beowulf's fate as a Christianised Germanic Hero, and it is argued that the poet subtly critiques Beowulf for the shortcomings endemic to his particular idiom of heroism, in contrast with absence of critique of Böðvarr. This evidence and reasoning provide additional support for the argument that Beowulf was composed in an Anglo-Latin and thus Christianised England, and allow for fresh examination of the implications thereof. We commemorate the anniversary of the passing of Robert Black on Relevant Tones. Robert Black was an absolute force in the Double Bass repertoire and new music. Through interviews with his previous students and cohorts, Christie Echols, Sean Rubin, Caroline Doane, and Evan Runyon, we find out he was so much more than a bass player. Robert was first and foremost a creative, and surrounded himself with other creative individuals. Robert was enthusiastic about artistic projects and would use every resource and effort to make sure projects were done to the best of his ability. Robert thought of himself as a grain in the sand amongst so many other grains, never allowing his ego or status to dictate what or who he worked with. The "safety valve" provision of the federal sentencing statute requires a district court to ignore any statutory mandatory minimum and instead follow the Sentencing Guidelines if a defendant was convicted of certain nonviolent drug crimes and can meet five sets of criteria. See 18 U.S.C. § 3553(f)(1)-(5). Congress amended the first set of criteria, in§ 3553(f)(1), in the First Step Act of 2018, Pub. L. No. 115-391, § 402, 132 Stat. 5194, 5221, broad criminal justice and sentencing reform legislation designed to provide a second chance for nonviolent offenders. A defendant satisfies § 3553(f)(1), as amended, if he "does not have-(A) more than 4 criminal history points, excluding any criminal history points resulting from a 1-point offense, as determined under the sentencing guidelines; (B) a prior 3-point offense, as determined under the sentencing guidelines; and (C) a prior 2-point violent offense, as determined under the sentencing guidelines." 18 U.S.C. § 3553(f)(1) (emphasis added). The question presented is whether the "and" in 18 U.S.C. § 3553(f)(1) means "and," so that a defendant satisfies the provision so long as he does not have (A) more than 4 criminal history points, (B) a 3-point offense, and (C) a 2-point offense (as the Ninth Circuit holds), or whether the "and" means "or," so that a defendant satisfies the provision so long as he does not have (A) more than 4 criminal history points, (B) a 3- point offense, or (C) a 2-point violent offense (as the Seventh and Eighth Circuits hold).
