Last Thursday morning saw the return of dawn raids on eight major insurance companies conducted by the Competition Commission. In one of the most hotly debatable recommendations in recent memory the Competition Commission last week opened the Pandora's box of public interest assessment conditions, which were inserted into the law via the Competition Amendment Act of 2018, when it ruled that the proposed takeover of Burger King by a US private equity fund be prohibited due to the lack of BEE in the new ownership structure. While the Commission found that the proposed transaction was unlikely to impact Competition in the country, it found that ”...the merger would lead to a significant reduction in the shareholding of historically disadvantaged persons in the target firm...”. If upheld at the Tribunal, this ruling could have significant implications for foreign direct investment/foreign investors looking to make acquisitions of SA entities, existing black shareholders, employment, and small to medium sized firms as suppliers. The case also raises questions about whether competition law is the right tool to advance the country's transformation agenda. On 1 April, the department of communications & digital technologies quietly published a draft national data and cloud policy that has potentially far-reaching implications for the private sector, state-owned enterprises and the public sector broadly. Among other objectives, the draft policy document - which could lead to legislative amendments or even a new act of parliament - seeks to promote South Africa's data sovereignty and security as well as enhance investment opportunities, create jobs and enhance skills development. But it also raises concerns, among them that the policy-making process will eventually create additional regulatory burdens for the private sector while concentrating government cloud business in the public sector to the detriment of private cloud and data service providers. The draft policy document also raises a number of questions around black economic empowerment. Bowmans partners Heather Irvine (who specialists in competition law) and Livia Dyer (ICT policy) join the TechCentral podcast to unpack the importance of the draft policy document, where their concerns with it lie, and what it means for South African companies. Questions that Irvine and Dyer answer include: * Do we really need additional legislation, or even amended legislation, to cater for data centres and cloud services? * Does the Cybercrimes Bill not already deal with some of the issues raised by the department of communications? * If the policy is implemented as it stands, will it reduce competition and harm or exclude private sector players? * Will the draft policy create additional red tape for companies and will it actually help with investment in this space? Jean Madrone is an herbalist, somatic experiencing trauma therapy practitioner, and mama living on Squaxin and Nisqually territory in Olympia, WA. Jean loves matchmaking plants and people. She loves the magic and the sacred in the everyday and the way that the work that she is honored to do can weave the two together. Jean’s work is grounded in clinical herbalism, nutrition, elemental constitution and magic, and harm reduction, and is informed by living with disability, by complex trauma and recovery. Jean was raised in the South and part of their heart will always be there. They really, really love the mountains and the waters in both places. About Jean’s clinical program: The Community Herbalist Clinical Skills Apprenticeship is a 180 hour program in Olympia, WA that will meet one full weekend a month for ten months. It is designed for students who have completed programs in materia medica and medicine making and want to go deeper into herbal medicine and clinical work. The focus will be on matchmaking plants and people, providing person-centered care, and treating the whole person- physical, emotional, and spiritual levels. There will be a particular emphasis on working with the nervous system, mental health, and trauma resolution. Adaptogens and nootropics have been claimed to do amazing things, but do you ever feel the claims made of herbs such as Ginseng and Rhodiola seem vague, too numerous and too good to be true? There is a reason for that. By definition, adaptogens have broad positive effects -- such as helping us withstand stress -- and are somewhat versatile in use. In this class we will go over some of the commonalities of adaptogens, including how they work, as well as differentiate many specific ones in terms of strengths, applications and energetics. From this you will be better able to articulate what an adaptogen is and what systems adaptogens work on. Tulsi, our Herbstalk plant-of-the-year, is an adaptogen, and we will touch on how it is different than many of the others.
