He is also the founder and CEO of four startup companies in Mountain Green Engineering, which helps startups and small businesses develop prototypes and products. And also others are called Custom LDS and OVOD, Snapple Solutions and SmartWolf, something to do with dogs, I suppose. Your introduction makes me sound a lot cooler than I probably am, but I'll certainly take it, so thanks for having me. I'm just piling the pressure on so that you know that the expectation is now very high and you have to perform here. That's right. So how do you – I mean, you're still young, quite young, right? You're not yet 40, and you have a budget. No, last week I turned 37, so married for 13 years have four kids and turned 37 Yeah, so you're really not wasting your time and so many degrees so many companies. I mean, how do you keep up with that? You know? Probably, the best answer is you know my always like to joke when people ask me what my what my hobby is I always say startups and there's probably a lot of truth to that in the sense that Most of the you know other people like to watch sports or other people like to read books. I still like to read books and I'll watch TV, but more often than not, when I have free time or I'm out for a jog or anything, my mind tends to wander towards business and learning and other things. So, it gets naturally geared that way. I don't know if there's any better reason. So. what do you like about startups? What is it so exciting about startups? I guess, what do I not like about it? I mean, startups are fun in the sense that it's fun to take an idea from a conception stage where you just think, wouldn't this be cool? Wouldn't it be nice if, and then start to actually work out the solutions and work out how to figure that out. And for me, it's that early stage fun to figure it out, get it up and going, actually implement it. It's the way that it really makes a fun job to have and a fun way to do it. So that's where a lot of times, you know, I have a few different interests and I've got a few different ways with the different businesses, but it's kind of that, hey, this would be a fun idea, a fun thing to do, and then I can figure out, is there a business case around it and how do I bring it to market? I understand that you probably made these companies through your IP attorney work, so maybe that's connected. So why did you become, did you become an IP attorney because you went to work with startups or that's totally unconnected? How did you find that niche? I mean, you've done a lot of things, so it's not like you didn't dabble in many things, many different things. Really, I'd probably say it goes back to when I was kind of wrapping up my undergraduate and you mentioned I did Chinese and electrical engineering and I came out of engineering saying, I enjoy engineering but I don't want to be an engineer, in the sense that I don't want to be stuck on one project for months or years on end. Devin's an entrepreneur who is also a patent and trademark attorney.  He's obtained several degrees including a Law degree (JD) and a Masters in Business Administration. He even have degrees in Electrical Engineering and Mandarin Chinese. While working for a large law firm helping Fortune 100 clients like Amazon.com, Intel, Redhat, and Ford with their intellectual property, he quickly realized that there weren't many good intellectual property legal resources out there for start-ups and small businesses. As an entrepreneur himself, Devin wanted to help other small business owners learn about patents, trademarks, and copyrights so they can build value into their businesses and protect their assets. In addition to founding and running his own patent and trademark law firm, Miller IP Law, Devin is the co-founder of several startups including a multi-million dollar startup for wearable glucose monitoring. Don't Wait too Long to Apply for your Patent– Devin Miller – Ep78   Devin is a patent attorney and the founder of Miller IP Law that focuses on startups and small businesses. He found a gap in the startup/small business area for a need in intellectual property (IP). When you work with Devin, he generally has 2 scenario's his customer is in: Scenario 1: have an invention before you get to investors Scenario 2: more of a lifestyle product; branding is more important than patent Some other areas we discuss: What the Patent office looks at: Novelty - Obviousness - take 2 or more things and combine in an obvious way   Software patents Example: 2+2=4 If all you did was putting this on a computer, it is not patentable What to do If you get a rejection PTAB and what they do   Devin's number one tip: Decide how does your IP fit into the business? Maybe it is better to focus on branding over IP.
