Contemplating the scope of conflict around the globe, let alone within a home, can be discouraging. Since 1948 there have been 72 U.N. peacekeeping missions. The Geneva Academy of International Humanitarian Law is presently monitoring 110 armed ethnic conflicts around the globe. UCLA's Anderson Review published September 2023 observed: polarization by cultural values, not by ethnicity, is related to human desire to associate with like-minded folks (homophily), and tends toward maximum antagonism towards those on the other side of the cultural divide. Political parties have become closely aligned with entrenched polarized values leading to the perception of greater polarization. In the midst of this cultural moment of conflict and polarization how did we get here, and is there meaningful hope of unity?

Send us a textAs part of the 75th anniversary series on the Gevena Conventions, Lauren Sanders speaks to André Smit - the ICRC Regional Legal Adviser on Maritime Matters (Asia-Pacific) when he visited Australia in September 2024. They discuss the applicability of Geneva Convention II (GC II) on the Amerlioraton to the region and challenges for states in applying their obligations under GC II in the event of a maritime conflict in the region. André supports the work of the International Committee of the Red Cross (ICRC) in Asia and the Pacific region from the ICRC Regional Resources Network (RRN) in Thailand. The role focusses on advancing the regional understanding of international humanitarian law applicable to armed conflict at sea, strengthening the application of other legal protection regimes at sea, supporting the work of other ICRC métiers and ICRC Delegations on related files, and supporting the ICRC institutional thinking on its future positioning in Asia and the Pacific. His work experience includes practising law; serving as officer in the South African National Defence Force; and service in the South African Foreign Ministry as counsel to Government on International Law. In the military, he served at unit-, training-, Joint Operations-, and Defence Headquarters-levels retiring as a senior officer supporting policy and international law. He provided operational legal support to operations and supported the force preparation of naval infantry, maritime air operations squadrons (helicopter and fixed wing), the submarine service. The culmination of his time as an instructor was serving as Director of the Departmental Course on International Humanitarian Law. After military service, as State Law Adviser (International Law) in the foreign Ministry, he fulfilled legal and diplomatic functions (at the level of counsellor), represented the Government in various bilateral and multilateral diplomatic forums, and co-drafted South Africa's submissions to the International Court of Justice. He was a long-standing member of the South African National Committee on International Humanitarian Law. He lectured at various universities and other training institutions on topics including air and space law, law of the sea, the interfaces of human rights and international humanitarian law in military operations, and at different diplomatic academies with minor publications on related topics of maritime operations.

Despite the universal ratification of the Geneva Conventions, the erosion of respect for these fundamental rules of war endangers lives, infrastructure, and the fragile prospects for peace. In this post, ICRC President Mirjana Spoljaric outlines the pressing need for states to join the Global Initiative on international humanitarian law. By reaffirming their commitment to this much-needed body of law, states can ensure the protection of civilians, restore dignity to those affected by conflict, and build a pathway toward sustainable peace. Send us a textIn this episode, Simon speaks to Professor Helen Kinsella and Associate Professor Giovanni Mantilla, two leading experts on the history and formation of the Geneva Conventions and IHL more generally. They discuss the negotiations leading up the Geneva Conventions and Additional Protocol, exploring some of the political tensions that sits behind the provisions of these key legal texts. This includes how the law treats non-state actors and non-international armed conflict, as well who gets the right to wage war. Helen Kinsella is a Professor of Political Science and Law at the University of Minnesota. Her research focuses on the theorization of gender and armed conflict and she is currently working on a book on sleep in war and another on the histories of the laws of war through the United States' wars against Native peoples.  She is the author of The Image before the Weapon (Cornell University Press, 2011), which won the 2012 Sussex International Theory Prize. Helen has a PhD in Political Science and an MA in Public Policy from the University of Minnesota, Twin Cities, and a BA in Political Science and Gender Studies from Bryn Mawr College.Giovanni Mantilla is an Associate Professor in the Department of Politics and International Studies at Cambridge University, Fellow of Christ's College, and Fellow of the Lauterpacht Centre for International Law. Linking this war to its colonial precedents, Molavi explains who she, as a researcher for the Forensic Architecture project, combines technologies like satellite imaging with on-the-ground stories from Palestinian farmers to produce a powerful form witnessing, and testimony to Israel's war.  She connects the trauma felt by the environment and the trauma felt by the people. She also tells of the new and powerful forms of resistance and resilience that take place at the nexus of nature, landscape, and the Palestinian people.Shourideh Molavi is the lead Israel/Palestine researcher for Forensic Architecture, linking their investigations to the work and research of civil society, grassroots groups and human rights defenders in the country. She is a scholar in political science and human rights and trained with a background in International Humanitarian Law. Gender can still be a confusing and contested subject for international humanitarian law (IHL) and military practitioners. But just as practitioners keep abreast of astonishing technological advancement, and states continue to dedicate significant – and, in numerous contexts, increasing – national spending on defence and security, it is high time that the equal protection of civilians is invested in, too. Gender inequality remains ingrained across today's conflict-affected contexts, and gender-specific harms shape some of the horrors inflicted on civilians. To encourage parties to armed conflict to take more and better measures to reduce this harm, in 2024 the ICRC, the Swedish Red Cross, and the Nordic Centre for Military Operations published a new report – International Humanitarian Law and a Gender Perspective in the Planning and Conduct of Military Operations – based on an expert meeting with state and military practitioners. In this post, the report's co-authors set out ten legal, policy and operational recommendations to equip armed forces to reduce the gendered risks faced by diverse women, men, girls and boys in armed conflict, and identify good practices from modern militaries. It's time for these to be part-and-parcel of how militaries comply with IHL and related civilian harm reduction measures.

Since 2003, the ICRC has submitted a report on ‘International Humanitarian Law and the Challenges of Contemporary Armed Conflict' to the International Conference of the Red Cross and Red Crescent, where the High Contracting Parties to the Geneva Conventions come together with the International Red Cross and Red Crescent Movement to discuss key matters of humanitarian concern and to make joint commitments. In this post and drawing from the 2024 Challenges Report, ICRC Chief Legal Officer Cordula Droege presents the ICRC's analysis of some of the salient legal issues of today's conflicts, animated, first and foremost, by its desire to achieve greater protection of victims of war from the effects of armed conflicts, and informed by its observation of key humanitarian issues on the ground and its dialogue with parties to conflicts in all parts of the world.

The Ancient Art of Modern Warfare

What is the common theme to mercenaries, natural resources, hypersonic missiles, Gaza, and exploding pagers? I can think of several, but in a recent conversation with a colleague of mine, that common thread was challenges to the Law of War, or International Humanitarian Law. Can the notion of the law of war even survive in modern manifestations of armed conflict? I think it can, and it is just as important, if not more so, than in the mythical era of conventional war. In the debate on how artificial intelligence (AI) will impact military strategy and decision-making, a key question is who makes better decisions — humans or machines? Advocates for a better leveraging of artificial intelligence point to heuristics and human error, arguing that new technologies can reduce civilian suffering through more precise targeting and greater legal compliance. The counter argument is that AI-enabled decision-making can be as bad, if not worse, than that done by humans, and that the scope for mistakes creates disproportionate risks. What these debates overlook is that it may not be possible for machines to replicate all dimensions of human decision-making. Moreover, we may not want them to. In this post, Erica Harper, Head of Research and Policy at the Geneva Academy of International Humanitarian Law and Human Rights, sets out the possible implications of AI-enabled military decision-making as this relates to the initiation of war, the waging of conflict, and peacebuilding. She highlights that while such use of AI may create positive externalities — including in terms of prevention and harm mitigation — the risks are profound. These include the potential for a new era of opportunistic warfare, a mainstreaming of violence desensitization and missed opportunities for peace. Such potential needs to be assessed in terms of the current state of multilateral fragility, and factored into AI policy-making at the regional and international levels.

The desire to develop technological solutions to help militaries in their decision-making processes is not new. However, more recently, we have witnessed militaries incorporating increasingly complex forms of artificial intelligence-based decision support systems (AI DSS) in their decision-making process, including decisions on the use of force. The novelty of this development is that the process by which these AI DSS function challenges the human's ability to exercise judgement in military decision-making processes. This potential erosion of human judgement raises several legal, humanitarian and ethical challenges and risks, especially in relation to military decisions that have a significant impact on people's lives, their dignity, and their communities. It is in light of this development that we must urgently and in earnest discuss how these systems are used and their impact on people affected by armed conflict. With this post, Wen Zhou, Legal Adviser with the International Committee of the Red Cross (ICRC), and Anna Rosalie Greipl, Researcher at the Geneva Academy of International Humanitarian Law and Human Rights, launch a new series on artificial intelligence (AI) in military decision-making. To start the discussion, they outline some of the challenges and risks, as well as the potential, that pertain to the use of AI DSS in preserving human judgement in legal determinations on the use of force. They also propose some measures and constraints regarding the design and use of AI DSS in these decision-making processes that can inform current and future debates on military AI governance, in order to ensure compliance with international humanitarian law (IHL) and support mitigating the risk of harm to people affected by those decisions.

Around two thirds of ICRC operations are in Muslim countries where armed conflicts are in progress. Our ability to understand the connections and differences between international humanitarian law (IHL) and Islamic law can make a crucial difference in our operational work and in our ability to build trust and respect with local communities. But how can we do this in the most effective way? As part of commemorating the 75th anniversary of the Geneva Conventions this year, ICRC's legal adviser for Islamic law and jurisprudence, Ahmed Al-Dawoody, looks at some of the parallels between IHL and Islamic law, and considers the critical importance of engagement between the two in today's world.

It examines the intriguing accounts of people who have undergone a near-death experience (NDE) and what was revealed to them while outside their physical bodies. What those people vividly described went well beyond what can be found in religious scripture. The NDE accounts contain descriptions of Heaven and the higher spiritual realms, what interconnectedness/oneness means, the eternal nature and liberation of the soul consciousness, the gift of free will and its purpose, the nature of soul agreements, the universal laws of attraction, reincarnation, and cause and effect (karma), the nature of positive and negative energy, the significance of the death of our physical body as well as our spiritual rebirth and life review. The study and collation of more than 500 NDE accounts, and the identification of common observations and insights drawn therefrom, culminated in the writing of this book. This panel was an opportunity for students to hear about different pathways into Middle East related fields. Meet the speakers: Marwa Baabbad is Director of the Yemen Policy Centre. She is a researcher and development consultant with over ten years of experience working in the fields of community engagement, gender, peace and security, and youth political inclusion. Marwa was Director of the Oxford Research Group (ORG) Strategic Peacebuilding Programme between 2018-2020. There, she led the delivery of a Track-II project that fed into the United Nations-led Yemen peace process. Arda Bilgen is a Research Officer at the LSE Middle East Centre. His work mainly focuses on water politics, transboundary water resources management, and hydraulic infrastructure development. Arda holds a PhD in Development Studies from the University of Bonn, an MA in International Affairs/International Security Studies from the George Washington University, and a BA in International Relations from Bilkent University. Before joining LSE, he worked as a Teaching Fellow at the University of Warwick, an Honorary Research Fellow at the University of Sussex, and as a Lecturer at Clark University. Jack Sproson is a Member of Guernica 37 Chambers. He specialises in Public/Private International Law, International Human Rights Law, International Humanitarian Law, and International Criminal Law. Jack has extensive expertise in humanitarian and legal issues pertaining to conflict- and climate-related insecurity and displacement in Africa and the Middle East, most recently as lead counsel for a major project advocating for the continuation of UN cross-border humanitarian access in Syria. Michael Mason is Director of the Middle East Centre. At LSE, he is also Professor of Environmental Geography in the Department of Geography and Environment and an Associate of the Grantham Research Institute for Climate Change and the Environment. He is interested in ecological politics and governance as applied to questions of accountability, security and sovereignty. This research addresses both global environmental politics and regional environmental change in Western Asia/the Middle East.

I think that to answer this question, we must revisit the laws and customs of war, sometimes called International Humanitarian Law. This includes understanding that not every act of violence in war is a war crime. Effective ROE is a control to manage the risk that the violence inherent to war does not become an excuse for war crimes. Big Data is one of the most important resources in the world, yet the rules for its protection are just beginning to develop. The danger comes into focus by the possibility of a nation-state cyber operation attacking Big Data and having a major detrimental impact on the functioning of another nation-state. Consider, for example, a cyber attack corrupting, stealing, or destroying the records of important financial institutions, causing widespread confusion and panic. Would such an attack warrant a kinetic, lethal response, with bullets and bombs? This issue implicates the UN Charter, the Law of War, International Humanitarian Law, jus in bello and jus ad bellum, attempts to formulate rules in the Tallinn Manual, conflicting priorities among nations, and pure geopolitics. Professor Paul Stephan of the University of Virginia Law School and John Eisenberg, Former Deputy Counsel to the President and NSC Legal Advisor, joined us to explore the issue. Mike Lewis was a naval aviator, and then a renowned law professor, widely admired by other scholars and practitioners. He was a great friend of the Federalist Society, appearing at dozens of lawyer and student chapter events, as well as the 2014 National Convention. He was also a member of the Executive Committee of the Society's International & National Security Law Practice Group. Each year, the Practice Group holds a Teleforum in his honor.
